ITEM B- Staff had received a letter from Mr. Richard Heuer in regard
to Levi Heuer for a 1-acre variance from the waiver of plat procedure
of a S-acre lot size requirement in an unsewered area located in part
of Lot 8, Auditor's Subdivision No. 42 in the N, of the NE?of,Sectiorr
25:
After reviewing the circumstances in regard to this particular appli-
cation, staff worked with the City Administrator to help Mr. Heuer re-
garding the hardship he has incurred in being displaced from his home
by right-of-way acquisition for I-35E alonq Deerwood Drive_ Due to
the time frame Mr. Heuer has, he was unable to meet the deadlines for
the Planning Commission and requested that he get approval as soon as
possible. Therefore, staff could not follow the normal procedures in
processing this particular application. On July 19, 1983, the City
Council reviewed the request submitted by Mr. Heuer and his relocation
in the City of Eagan. The City Council recognizes that Mr. Heuer has
lived in the City for 75 years, and due to the circumstances regard-
ing condemnation for I-35E, the Council did review and approve the ap-
_plication Mr. Aeuer submitted. The City Council stated, however, that
they would like this application forwarded to the Advisory Planning
Commission and an explanation of why procedures were not followed re-
garding this particular issue. Therefore, staff has submitted the
information that the City Council received and also is requesting that
the Advisory Planning Commission review the City Council's action, and
if there are any circumstances that pertain that the City Council did
not consider, these considerations could then be forwarded to the City
Council. However, if is staff's understanding that formal review and
approval are not necessary due to the City Council's review and appro-
val at the July 19, 1983 meeting.
ITEM D- John Charles Gruidl for a conditional use permit for a billi-
ard/video game room and more than 3 amusement devices located on Lot
1, Block l, Eagan Metro Center Addition.
On July 19, 1983, the City received notice from Mr: Gruidl that the
partner he was going into business with has backed out of this parti-
cular application. It is staff's understanding that the applicant
now is looking at a different portion of the shopping center for his
business. Since staf£ had advertised this particular conditional use
for Unit #116 of Silver Bell Center and the proposed application will
be moved, staff felt that a renotification would have to be made in
regard to this application in order to have the exact legal descrip-
tion for the conditional use permit. Therefore, in talking with the
applicant, staff is suggesting that this item be continued until the
August meeting in order that the readvertisement of this facility can
be made.

AUDITOR'S SUBDIVISION NO. 42 LOCATED IN THE N?, OF THE
The City has received a request £or a hardship by Mr. Richard
Heuer who is the son Levi Heuer who presently resides at 1585
Deerwood Drive. Mr. Levi Heuer has lived in the City for 75
years and is now in the process o£ being displaced by Interstate
I-35E. It is the City's understanding that the State is condemn-
ing the present property where Mr. Heuer is located, and Mr. Heuer
would like to relocate in the City of Eagan. He has found some
property located south of County Road 30 between Dodd Road and
T.H. 3 in a portion of Auditor's Subdivision No. 42, Lot 8. The
property Mr. Heuer would like to purchase is approximately 165'
in width by 633' in depth for a total of 3.93 acres. In review-
ing this proposed location with Mr. Heuer, it is staff's under-
standing that the acquisition of his existing residence was not
enough in value in order for Mr. Heuer to purchase an entire 5
acres. Therefore, the aoplicant would like to relocate to the
portion of Lot 8, Auditor's Subdivision No. 42 containing 3.93
acres.
In review oP this parcel, there would not be City sewer or water
available to this parcel at this time, and a minimum lot size for
sewer and water would be five acres. Therefore, a variance would
have to be considered to allow this new homestead on the 3.93
acre tract. As indicated in Mr. Heuer's letter, he would like
the option to relocate his present home or build a new home plus
move an existing trailer from the site of Deerwood Drive to the
new location. The letter states that Mrs. Meister is residing
in this trailer, and Mr. Heuer would also like her to be relocat-
ed on this parcel. Attached to this application is a survey sub-
mitted by Mr. Del Schwanz showing the particular size of the par-
cel and also a sketch as to how the home and trailer would be lo-
cated on the parcel. Staff has suggested that the applicant also
do an overlay and sketch how the property could be split up in
the future when sewer and water becomes available and locate the
structures in accordance with the lots on the overlay plat. Mr.
Richard Heuer will be submitting an overlay sketch to be attach-
ed with this application. Hopefully, Mr. Heuer will have the
sketch completed to be attached to this packet of information,
but if not, he will have it available for the City Council meet-
ing af July 19.
As you can see, this is a unique circumstance where the City has
a resident of 75 years and is being relocated by the State of
Minnesota, and there are circumstances that warrant a special re-
view of this particular application. Therefore, with these

considerations, if the Council approves the variance to the waiver
of plat to create this new homestead on the 3.93 acres, it should
be subject to the £ollowing conditions:
1) The property cannot be further subdivided until sewer and
water are available to the site.
2) The applicant locate the house and trailer and proposed gar-
age in accordance with the overlay for future plan, in or-
der that when utilities are available, the applicant can max-
imize the land use of the site.
3) The area be included with the platting of the property either
to the east or the west when this area is further subdivided.

SUBJECT: VARIANCE FROM THE WAIVER OF PLAT FOR PART OF LOT 8,
AUDITOR'S SUBDIVISION Nd. 42 LOCATED IN THE N? OF TAE

The City has received a request for a hardship by Mr. Richard
Heuer who is the son Levi Heuer who presently resides at 1585
Deerwood Drive. Mr. Levi Heuer has lived in the City for 75
years and is now in the process of being displaced_by Interstate
I-35E. It is the City's understanding that the State is condemn-
ing the present property where Mr. Heuer is located, and Mr. Heuer
would like to relocate in the City of Eagan. He has found some
property located south of County Road 30 between Dodd Road and
T.H. 3 in a portion of Auditor's Subdivision No. 42, Lot 8. The
property Mr. Heuer would like to purchase is approximately 165'
in width by 633' in depth for a total of 3.93 acres. In review-
ing this proposed location with Mr. Heuer, it is staff's under-
standing that the acquisition of his existing residence was not
enouqh in value in order for Mr. Heuer to purchase an entire 5
acres. Therefore, the applicant Would like to relocate to the
portion of Lot 8, Auditor's Subdivision No. 42 containing`3.93
acres.
In review of this parcel, there would nQt be City sewer or water
available to this parcel at this time, and a minimum lot size for
sewer and water would be five acres. Therefore, a variance would
have to be considered to allow this new homestead on the 3.93
acre tract. As indicated in Mr. Heuer's letter, he would like
the option to relocate his present home or build a new home plus
move an existing trailer £rom the site of Deerwood Drive to the
new location. The letter states that Mrs. Meister is residing
in this trailer, and Mr. Heuer would also like her to be relocat-
ed on this parcel. Attached to this application is a survey sub-
mitted by Mr. De1 Schwanz showing the particular size of the par-
cel and also a sketch as to how the home and trailer would be lo-
cated on the parcel. Staff has suggested that the applicant also
do an overlay and sketch how the property could be split up in
the future when sewer and water becomes available and locate the
structures in accordance with the lots on the overlay plat. Mr.
Richard Heuer will be submitting an overlay sketch to be attach-
ed with this application. 'HOpefully, Mr. Heuer will have the
sketch completed to be attached to this packet of information,
but if not, he will have it available for the City Council meet-
ing of July 19.
As you can see, this is a unique circumstance where the City has
a resident of 75 years and is being relocated by the State of
Minnesota, and there are circumstances that warrant a special re-
view of this particular application. Therefore, with these

considerations, if the Council approves the variance to the waiver
of plat to create this new homestead on the 3.93 acres, it should
be subject to the following conditions:
1) The property cannot be further subdivided until sewer and
water are available to the site.
2) The applicant locate the house and trailer and;proposed gar-
age in accordance with the overlay for £utur2`--plan, in or-
der that when utilities are available, the applicant can max-
imize the land use of the site.
3) The area be included with the platting of the property either
to the east or the west when this area is further subdivided.

The application of Levi Heuer for waiver of plat for the five acre lot
size requirement in an unsewered area, including a special permit to move a
house and building permit for a pole shed and transfer of a trailer permit was
considered by the Council. Mr. Heuer was present as was his son, Richard
Heuer, who explained that the I-35E ri'ght-of-way is now relocating Mr. Hever
and he wi22 be required to vacate his current home during the coming fall. A
variance from the procedure was requested for the plat waiver and Mr. Heuer
submitted a letter signed by ad,joining owners who indicated they did not
oppose the application. There was discussion concerning the need for the
Planning Commission to review the application and it was requested that the
information be transmitted to the Planning Commission. Wachter moved, Egan
seconded the motion to approve the waiver of plat, including the variance from
the procedural requirements, and the application for the other permits re-
quested by Mr. Heuer were approved, sub,ject to the following requirements:
1. The property shall not be fLrther subdivided until sewer and water
are available to the site.
- 2. The applicant shall locate the house and trailer and proposed garage
in aceordance with the overlay for future plan, in order that when utiZities
are available, the applicant can maximize the land use of the site.
3• The parcel shall be included with the platting of the property
either to the east or the west when this area is further subdivided.
A11 voted yes. A plan for the future subdivision of the property was
also submitted and reviewed by the Council.

Richards Lane. Smith moved, Egan seconded the motion to approve the applica-
tion for final plat, subject to compliance with the necessary City ordinances.
