Sanitary Sewer and Water Service
Listed below is some background information.
April 27, 1987
Project #491A - Eagan Hilis Farms trunk utilities was approved which included the
construction of the sanitary sewer lift station in Country Hollow and a force main
from the Country Hollow plat to the intersection of Dodd and Diffley Road.
July 21, 1987
Project #505 - Country Hollow trunk utilities was approved which included the
construction of a trunk watermain from the intersection of Dodd and Diffley Roads
to the east up to the northwest corner of Lot 4, Block 1, Eveland Addition and
across Diffley Road and loops into Country Hollow and connects to the watermain
in Autumn Oaks Court.
The construction as-built plans for Project #505 indicates that a water lateral and a water
service was constructed to serve the Eveland property along Diffley Road. Further
research indicates that the water senrice was never installed and the proposed cost of
said service was not assessed. Lateral benefit from trunk water was assessed at a cost
of $2,241.00. The Development Agreements for Country Hoilow and the Eveland Addition
were both approved October 6, 1987.
I have reviewed the Eveland Addition plat file and everything that was approved by the
City indicates that a sanitary sewer and water service should have been constructed from
Dodd Road to service the existing single family home on Lot 4, Block 1 except the
Development Agreement in paragraph 5(page 2) indicates that the Developer was to
install sanitary sewer and water services for Lots 2 and 3 only. The Eveland Addition plat
also indicates an additional 10 feet of drainage and utility easements for the utiliry service
to serve said Lot 4.

The only reason I can think of why the Development Agreement omitted Lot 4, Block 1,
from being served from Dodd Road is that Bert Eveland did not want it and the
Development Agreement was prepared to accommodate his request.
If the sewer senrice was installed from Dodd Road, it would serve the first floor only by
gravity fiow. The basement would need some type of ejector pump.
I have talked to Ann Tubbs a couple times today and I have started to work with the
Tubbs' on finding what they want to do based upon their cost estimates.
Several things we have agreed to are that the City would prepare a Waiver of Hearing for
the costs of the service water line in Diffley Road from the main to the driveway and some
of the connection costs. Ann Tubbs indicated that she will have a couple estimates in a
couple days from several plumbing contractors and I have talked to Bruce Allen to get
a cost estimate from Imperial.
As soon as we determine the costs and I can prepare the Waiver of Hearing, I would
expect that the City and/or a private plumber can start as early as next week.

On June 22, 1993, you applied for the above-referenced grading permit as the applicant
(contractor) and property owner to provide for the filling of the ravine primarily located on
Lot 8, Block 1, Hawthorne Woods West as shown by the permit and plan enclosed
herewith. On July 23, City Engineering personnef performed an inspection/verification
survey of the construction area and found that the work pertormed to date has
significantly exceeded the boundaries/limfts identified on the grading pian. Several
concerns have been identified associated with this and they are listed as follows:
The excavation/grading activity has extended approximately 50' further
south than indicated on the plan submitted with the permit. This has
resulted in the removai of an unknown quantity of additional trees in this
previously heavily wooded ravine area. It appears that this grading activity
has gone beyond the limits of Lot 8 and encroached into Lot 7 to the south.
2. It has been brought to our attention that Peggy and Mike DeMuse, R.A. Kott
Homes, Inc. and Lyman Lumber Company have been involved with various
stages of ownership of Lot 7. We have been contacted by Mr. and Mrs.
DeMuse who have expressed strong objection to the encroachment on their
property and the loss of the natural woodland buffer along the southern 50'
of Lot B. (See enclosed "History of Filling Ravine").

3. On the permit, you had indicated a completion of the grading by July 23rd
with vegetation restoration completed by August ist. It appears this
schedule is not likely to be met.
4. During the grading and filling of the ravine, it appears that the north
(downstream) outlet to a 12" CMP driveway culvert draining Lot 7 has been
disturbed along with its structural embankment boulder retaining wall.
5. There have been statements made that a berm larger than the plan
attached to the permit would be provided. The Ciry has not received any
revised plans indicating this.
I would appreciate ft'rf you could provide a response addressing these concerns and
indicating whether a revised plan is forthcoming or how you intend to comply with the
permit plan.

HISTORY OF FILLING THE RAVINE.
Early June:
Imperial Development contacted R.A.Kot who told them to contact us, the DeMuse's, and geve them
Mike's work number.
Shedins contected us, the DeMuse's, Glen mdiceted he wanted to Sll in the raven for safety reasons
bvt would not do it unless everybody agreed to it.
• We then had some preliminary conversafions with Shedins,'ISibEs and Imperial. We expressed our
concem on the project, and speci5cally on not wanCng to see Diffley Road. Roy &om Impeiial said
that won't be a problem just a few trees out of the bottom will be taken out and those don't come up
` high enovgh to block our view. 7he remairung trees in the ravine proyided the blockage of Diflley.
Imperial also stated that we could have any type of drainage we desired to prevent furiue erosion in
the ravine.
In summary before any work was done we were told that the trees that blocked our view of Diffley
would remain in tact and in addition there would be a birm to hetp reduce the noise
• At that point we said he needed to see a drawing of exactly what was going to be done before any
decision would be made. We were not going to sign enytliing without seeing a drawing. VVe were
told no work could be done until and unless all the neighboring land owners agreed [o it.
• In late lune the'Ihbbs were asked to sign the waiver of objection. Ann requested a drawing of what
was to be done and was told there wesn't one.
• 71ubbs and the Shedins were asked to mark trees they wanted preserved. Ann expressed concem
over the fact thaf Shedins only marked trees up high. Roy told Ann he would go streight across &om
the trees the Tubbs hed mazked. T7-IEY DID NOT. ln addition, Impenal removed trees that were
speci5cally identified as to remain.
• ]iily 1. Went to the house and saw Itnpenel had gutted the ravine removing the blockage of ow v1ew
of Diffley Road without getting our permission. Imperial, imowing we were objectuig to Uie project,
went to Steve Ryan ( of Lyman Development) and had him sign the papers. Steve Ryan had sold the
lot to our developer in April. Imperial lnew Steve Ryan was not the owner of tlie property any more
and still had him sign for the project purposely bypassing us in the process to get persnission from the
Ciry to start the project.
July 2. Kenny from Imperial cazne out to the property to discuss the problems with the Tubbs and
ourselves. Kenny stated that Imperial would place bums in the area to our insWchons. These bums
were to reduce noise and line of site to DiHIey. The birms would be es high as we wanted. 7he only
restnction was the slope of the bum adjacent to Diffley had to meet City requirements.
'ILbbs and DeMuses indicated that the birms were unsufficirnt Trees and proper drainage were also
required. Kenny then indicated it was up to the land ovmers to supply proper drainage. This is
contrary to thc promises given to the Tubbs and ourselves eazly on in die projzct.
Imperial trespassed on our property Wdng down at least 2trees, one tree approxirnately 6" in
diameter and one approximately 18" - 20" in diameter. They aLso removed a retaining wall of
boulders speciScally placed to prevent erosion. Since the removal of the retaining wall, the edge of
the properiy hes started to erode threatening three trees, two of which aze white oaks.
. Addilionally, a spring runs t}uough the back of our property and drains into the ravine, et this time no
additional dreinage hes been supplied to ensure the spnng will keep flowing freely - lmperial has
covered with diri the area were the spring drains. tUthough the spring has found a way through the
fill at some point it could beckup onto ow property and 8ood the back of our lot.
• THE FOLIAWING 17'EMS ARE REQUIRED TO RESTORE THE PROPERTY:

to 5nd where it drains.

SUBJECT: GROUNDWATER TESTING
During the grading and construction work on the Diffiey Road project, the Contractor
under a private agreement filled a large ravine located just east of the Michael Tubbs
residence whose address is 608 Diffley Road. When filling this area, we found it to be wet
and assumed it was a spring draining from the south. In checking closer we also found
that this drainage had a sewage odor so testing was done. We had three samples taken
and a chemical analysis was determined.
Test #1 was taken just north of the existing driveway that heads east of the Tubbs
residence. This test tested at 200 CFU/100 ML. The 2nd test was taken south of the old
driveway just east of the Tubbs septic drainfield and it tested at 250 CFU/100 ML. The
3rd test was taken approximately 100 feet south of test #2 and found to be at 100
CFU/100 ML. See attached map for test locations. It appears that some of this drainage
is underground drainage from Pond JP-68 but is also being contaminated by a septic
system drainfield. This drainage flows north to Diffley Road then enters into the City's
storm sewer system, then flows north to Pond JP-26 located in Country Hollow Addition.
Sanitary sewer is now available in this area which was constructed under our Diffley Road
contract.

On July 2, I was contacted by Mr. Mike Tubbs, resident and owner of the above-
referenced parcel, looking for clarification as to who is responsible for the costs
associated with providing sewer and water service to his lot. He was reviewing a copy
of the development agreement for the Eveland Addition and referenced Paragraph 5H
(page 5) which refers to Exhibit "B", Condition #5 in particular. He feeis that these
portions of the development contract obligates the original developer, Burt Eveland, to
pay for the cost of water and sanitary sewer service to his lot.
While reviewing this issue with him on the phone, t quickly referenced Paragraph 5(page
2) which indicated the developer was to install sanitary sewer and water services only for
Lots 2 and 3. Apparently Lot 4 was excluded for some reason not so stated. I also
informed him to review his purchase agreement to see if the obligation had been assigned
to Mr. Tubbs through his purchase in accordance wfth Paragraph 22 (page 14).
In the interim, I assured Mr. Tubbs we wouid research the issue to determine the extent
of obligation and intent of the Eveland Addition development. I would appreciate it if you
would arrange to have all the appropriate files researched to determine how Lot 4 was
being addressed in regards to its need for sanitary sewer and water services in
accordance with City Code requirements. With your response, I wiil then contact Mr.
Tubbs and hopefully resolve his concerns.

As per your request, I have reviewed the sanitary sewer and water servfce costs and how the Ciry arcived
at these costs when the Ciry prepared the Waiver of Hearing No. 425 on June 21, 1993.
The sanitary sewer service costs were taken from the feasibility report and I gave a copy of that information
to you on September 22, 1993.
The water service cost was calculated by using the contract bid unft prices of Diffley Road and 30%
overhead was added to the construction costs. We used a copy of a portion of a plan sheet which we are
enclosing wfth the water service highlighted.

OBLIGATION
On July 2, I was contacted by Mr. Mike Tubbs, resident and owner of the above-
referenced parcel, looking for clarification as to who is responsible for the costs
associated with providing sewer and water service to his lot. He was 'reviewing a copy
of the development agreement for .the Eveland Addition and referenced Paragraph 5H
(page 5) which refers to Exhibit "B", Condition #5.in particular. He feels that these
portions of the development contract obiigates the original developer, Burt Eveland, to
pay for the cost of water and sanftary sewer service to his lat.
While reviewing this issue with him on the phone, I quickly referenced Paragraph 5(page
2) which indicated the developer was to instafl sanftary sewer and water?lservices only for
Lots 2 and 3. Apparently Lot 4 was excluded for some reason not so stated. I also
informed him to review his purchase agreemerit to see 'rf the obligation had been assigned
to Mr. Tubbs through his purchase in accordance wRh Paragraph 22 (?page.l4).
In the interim, I assured Mr. Tubbs we would research the issue to de1
of obligation and intent of the Eveland Addition development. I would E
would arrange to have all the appropriate files researched to determir

most of the people in her neighborhood assumed that the original petition regardiag streetlighta was alao their

Grantor is the owner of the tracts of

Lot 1, B1ock 1, Eveland Addition, Dakota County, MN.
NOW, THEREFORE, the said Grantor in consideration of One Dollar
($1.00) and other good and valuable consideration to it paid by
Grantees, receipt whereof is hereby acknowledged, hereby grants
access over the southecly 20 f=et of Lot 1, Block 1, Eveland
Addition, for access exclusively to Lot 4, 81ock 1, Eveland
Addition. It is understood that the Grantees may improve the access
easement at the sole cost of the Grantees upon submission and
approval by the Grantor of the plan for improvement, which approval
shall not be unreasonably withheld. It is further expressly
understood thhat at such time as the Grantees no longer occupy the

at such time such access shall be abandoned and no longer used arid
the Grantees shall execute any and all documents, including a Quit
