WHEREAS, the Lutheran Church Missouri Synod has acquired a parcel of
property located at the southwest intersection of Diffley Road (County Road
1130) and Dodd Road in the City of Eagan, legally described on Exhibit "A", a
copy of which is attached hereto and made a part hereof; and
WHEREAS, Missouri intends to develop the parcel for the construction of a
church and related facilities; and
WHEREAS, the Eagan City Council did, on April 3, 1984, approve an _
application of Lexington South Associates for preliminary approval of Sunset
5th Addition consisting of two single family lots lying adjacent to and
southerly of the parcel owned by Missouri; and
WHEREAS, one of the conditions for the approval of the preliminary plat
of Sunset 5th Addition was that a written committment be acquired from the
Lutheran Church Missouri Synod that it will dedicate for street right-of-way
purposes, 60 feet along the southerly line of the land described in Exhibit
"A" at such time as the City requests that such dedication be placed for
purposes of improvement of the road right-of-way consisting of a proposed
extension of Yorktown Place, easterly to Dodd Road; and
WHEREAS, the parties desire to enter into an agreement whereby Missouri
will commit itself to the dedication of such right-of-way at such time as is
requested by the City of Eagan for the improvement of such right-of-way for
street purposes;

NOW THEREFORE, for and in consideration of the mutual covenants herein
contained, the parties agree as follows:
1. Missouri hereby agrees that it will dedicate for permanent street
purposes, the southerly 60 feet of the parcel described in Exhibit "All
attached hereto at such time as Eagan submits a written request to do so.
2. At such time as Missouri grants the dedication of the requested
right-of-way to Eagan in a form acceptable to Eagan, Eagan will then release
and quit claim all interests that it has in this Agreement.
3• Special assessments for the street improvements will be levied by
Eagan against the property described in Exhibit "Ail based upon benefits
received.

CONFIRMATION HIGHWAY EASEMENT DEED
THIS CONFIRMATION DEED, made on this day of ?? Gcin d c ,
1983, by and between LEXINGTON SOUTH ASSOCIATES, a Minnesota general partner-
ship, as Grantor and the CITY OF EAGAN, Dakota County, State of Minnesota, as
Grantee.
(1) Grantor conveyed to grantee by easement deed dated November 8, 1982
and recorded November 19, 1982 as Document Number 611792, in the office of the
LLrr Recorder of Deeds of Dakota County, Minnesota, a copy of which is annexed
N t thereto and incorporated by referencetherein;
(2) In the Deed incorporated herein, by mistake, the words "A perpetual
easement for utility purposes over, under and across 50 feet of the North one-
half of the North one-half of the Northwest Quarter..." were set forth instead
of the words "A perpetual easement for utility purposes over, under and across
the North 50 feet of the North one-half of the North one-half of the Northwest
Quarter..." which were in fact intended by the parties and which would
adequately express the agreement between them;
(3) To prevent difficulties hereafter, and to permit recordation of a
deed which reflects the true agreement of the parties in every respect, the
parties desire to correct these errors;
THEREFORE, this instrument witnesseth that Grantor in consideration of
One ($1.00) Dollar and other good and valuable consideration, receipt of which
does hereby convey, warrant and dedicate to said Grantee, its successors and
assigns, for highway purposes, together with the unrestricted right to improve
the same, the below described tract of land, together with the right to lay,
maintain, operate and repair utility lines over and through said tract
described below, free and clear of all encumbrances, except for restrictions,
reservations and easements of record, if any, of the tract of land in the City
of Eagan, Dakota County, Minnesota, legally described as follows:
A perpetual easement for utility purposes over, under and across the
North 50.00 feet of the North one-half of the North one-half of the
Northwest Quarter of Section 25, Township 27, Range 23, Dakota
County, Minnesota, lying westerly of Dodd Road, except the West
225.00 feet of said North one-half of the North one-half of the
Northwest Quarter.
And said Grantor, for itself, its heirs, executors, administrators and
assigns does covenant never to cut, damage, destroy or remove any tree or
shrub or other natural growth upon the hereinbefore described premises for the
continuance of this easement and does hereby grant and convey to the said City
of Eagan all grasses, shrubs, trees and natural growth now existing on said
lands or that may be hereafter planted or grown thereon.
And the said Grantor, for itself, its heirs, executors, administrators
and assigns does hereby release the said City of Eagan, its successors and
assigns, from all claims for any and all damages resulting to the premsies
hereby conveyed by reason of the location, grading, construction, maintenance,
and use of a public highway over and upon, the removal of materials from the
premises hereby conveyed and from the uses incident thereto; it being under-
stood said release shall not apply to any damage to any property abutting the
premises: conveyed hereunder arising because of the use of the premises con-
veyed hereunder by the Grantee; and said City of Eagan shall have the right to
use and remove all earth and other materials lying within the parcel of land
hereby conveyed and the right to construct and maintain, upon the lands
adjoining the parcel hereby conveyed, such portable snow fences during such
months as weather conditions make necessary; provided that such snow fences
shall not interfere with any access roads now or in the future leading from
the property abutting the premises conveyed hereunder.
And the said Grantor, for itself, its heirs, executors, administrators
and assigns does hereby waive the right to any and all notice for the removal
of trees or hedges within the limits of the above described highway under the
provisions of Section 160.22 Minnesota Statutes Annotated or otherwise and
hereby expressly waives any claim for damages on account thereof.
