In regards to the inquiries made on the property at 861
Diffley Road (PID #10-02300-01076). There is no water service
servicing this property. The City of Eagan postponed the levy of
assessments for lateral benefit from trunk water until connection
is made to the water main (see enclosed agreement).
There is sanitary sewer servicing the property which was
constructed under Contract #87EE. Trunk sanitary sewer assessments
will be levied at the time the connection is made.
The assessments and connection charges at 1990 rates are as

We reached a verbal settlement last night subject to County
Board approval of the full property purchase of the Gangl
property at 861 Diffley Road (sta. 231+39 left). The
Gangl's agreed to accept our appraised value of $75,000 and
the Gangl's do not pay pending, but not levied, specials for
CP 30-06 of $6,755. Gangl's will rent back for one year,

ITEM: Request Authorization to Purchase all Property at 861 Diffley
Road, Eagan on CP 30-06.

Dakota County Board Resolution 92-569, Dated July 21, 1992 included the
approval of Parcel 9 (134),, a partial acquisition for the appraised
value of $28,500. The landowner rejected a partial "taking" insisting
that their property be purchased in its entirety. The proposed
permanent right.of way line is 5 feet from the front of the house and
the temporary easement line is coincident with the front of the house.
The detached double garage is within the new permanent right of way. It
is anticipated that the Court appointed Valuation Commission will view•a
partial taking very negatively. The County's entire property valuation
of this parcel is $75,000 and the landowner accepts that amount as
compensation for an entire taking plus $750 lump sum settlement of
required relocation assistance plus $500 reimbursement of landowner
appraisal fee. It is expected that the lot will be saleable for
approximately $20,000 in the after condition.
Since the appraised value of $28,500 for a partial taking has been
previously approved for Parcel 9 (134) on CP 30-06, a resolution of the
Dakota County Board of Commissioners is necessary to approve the
settlement amount of $75,000 for an entire property taking plus $750 in
lieu of relocation assistance plus $500 as reimbursement of landowners
appraisal fee and to authorize payment not to exceed those amounts as
full and final compensation to the landowners.
The County Engineer and the County Attorney recommend the acceptance of
the full property acquisition settlement amount. The Eagan Public Works
Director concurs in this settlement.
RESOLUTION
WHEREAS, a full property acquisition settlement amount has been reached
for the purchase of all real property of 861 Diffley Road, Eagan; and

WHEREAS, the settlement amount is acceptable to the landowner as full
and complete settlement for the real property at 861 Diffley Road,
Eagan.
NOW, THEREFORE, BE IT RESOLVED, That the Dakota County Board of
Commissioners approves the settlement amount for the purchase of all
real property at 861 Diffley Road, Eagan for right of way acquisition on
CP 30-06 in the amount of $75,000 plus $750 in lieu of relocation
assistance and $500 for landowner appraisal fee reimbursement with
payment from the Road and Bridge Fund.
