DRAINAGE AND UTILITY EASEMENT
THIS EASEMENT is made this 201h day of July, 2004 between PETER D. LiJND and
DEBORAH KLEIN, husband and wife, (hereinafter referred to as "Landowners"), and the CIT'Y
OF EAGAN, a municipal corporation, organized under the laws of the State of Minnesota,
(hereinafter referred to as the "City").
WITNESSETH:
That the Landowners, in considerafion of the sum of One Dollar ($1.00) and other good
and valuable consideration, the receipt and sufficiency of which is hereby acknowledged, do
hereby gxant and convey unto the City, its successors and assigns, a 20.00 foot wide permanent
drainage and utility easement, over, across and under the following described premises, situated
within Dakota County, Minnesota, to-wit:
Lot 1, Block 1, BORCHERT - INGERSOLL INC. 1ST ADDITION, according to
? the recorded plat thereof, Dakota County, Minnesota. The centerline of said
'- ? easement is described as commencing at the most northerly comer of said Lot 1;
thence on an assumed bearing of South 50 degrees 45 minutes 02 seconds East,
along ine northeasterly line of said Lot 1, a distance of 134.83 feet to the point of
beginning ofthe centerline to be described;thence South 47 degrees 40 minutes
41 seconds West, a distance of 100.56 feet to a northerly line of the drainage and
? utility easement dedicated in said plat of BORCHERT - INGERSOLL INC. 1sT
? ADDITION, and said centerline there terminating.
The sidelines of said easement are to be prolonged or shortened to terminate at
said northeasterly line of Lot 1 and at said northerly drainage and utility easement
line.

The grant of the foregoing permanent easement for drainage and utility purposes includes
the right of the City, its contractors, agents and servants to enter upon the Easement Area at all
reasonable times to construct, reconstruct, inspect, repair and maintain pipes, conduits and mains;
and the fuitlier right to remove trees, brush, undergrowth and other obstructions within the
Easement Area. After completion of such construction, maintenance, repair or removal, the City
shall restore the Easement Area to the condition in which it was found prior to the
commencement of such actions, save only for the necessary removal of trees, brush, undergrowth
and other obstructions.
And Peter D. Lund, his heirs and assigns, does covenant with the City, its successors and
assigns, that he is the owner of the Easement Area and has good right to grant and convey the
easement herein to the City.

Dear Mr. Borchert:
The Minnesota Pollution Control Agency (MPCA) staff has determined that the
cleanup performed in response to the petroleum tank release at the site
referenced above has adequately addressed the petroleum contamination, and
therefore the file regarding this release will be closed.
On January 18, 1993, a petroleum tank release was reported to the MPCA. Since
then, the following corrective actions have been taken in response to the
release:
1. The following underground storage tanks were removed from the Site:
- 640 gallon capacity previously containing new hydraulic oil
- 640 gallon capacity previously containing new SAE lOW motor oil
- 640 gallon capacity previously containing new SAE 40W motor oil
- 640 gallon capacity previously containing new SAE10-14W motor oil
2. Approximately 1.25 cubic yards of petroleum contaminated soil were
excavated and thinspread on site.
3. Field hydrocarbon readings taken with a flame ionization detector (FID)
from the excavation basin and sidewalls indicated two of the highest levels
of petroleum contaminated soil at 970 and 1000+ parts per million (ppm)
remaining along the north side of the tank(s) excavation adjacent to the
building. Chemistry analyses of soil samples taken fro;n the excavation
basin and sidewalls detected between 970 and 2,500 ppm diesel ranged
organics from the same general area.
4. One test boring was advanced to the a depth of 21 feet through the former
location of the underground storage tank. Field hydrocarbon readings were
not detected in soil samples collected throughout the boring using a FID.
One soil sample, collected from 19 to 21 foot interval, was analyzed for
diesel ranged organics, benzene, ethyl benzene, toluene, and xylenes. None
of the tested analytes were detected above method detection limits. The
subsurface sediments consists of fine to coarse sand fill and sand with
silt to the terminal depths of the soil borings. Ground water was not
detected in this soil boring.

Based on the currently available information, we concur with the conclusions of
Dahl & Associates that these actions have adequately addressed the.petroleum
tank release. Therefore, MPCA staff does not intend to require any more
investigation or clean-up work in response to this release. However, the MPCA
reserves the right to reopen this file and require additional work if in the
future more work is determined to be necessary, and Yhis letter does noi
release any party from liability for this contamination.
Because you performed the requested work, the state may reimburse you for a
major portion of your costs. The Petroleum Tank Release Cleanup Act
establishes a fund which in certain circumstances provides partial
reimbursement for petroleum tank release clean-up costs. This fund is
administered by the Petroleum Tank Release Compensation Board (Petro Board).
More specific eligibiliiy rules are available from the Petro Board
(612/297-1119 or 612/297-4203).

calculated by dividing the actual cost of project 381 by the total number of acres being served
and multiplied by the number of acres contained in the parcels listed above. . ?
Example: Actual cost of $245,000 divided by 700 acres equals 350 per acre actual cost multiplied
by 435 acres equals $1522 .
The total adjustment based on actual cost of the project plus the interest on the differential can be
credited to the cost of the lateral and ponding at the time the property is developed.
This request is based on the adjustments received by those property owners who threatened legal
action at the time of the assessment. We realize that there is no legal recourse availab(e to us at
this time and appeal to the city council to treat us in a fair, equitable and ethical manner.
In addition , we would appreciate the city being helpful to the business that may purchase this
property in determining the estimated cost of the lateral sewer line and ponding..

Dear Mr. Anderson:
You had expressed concerns regarding the information contained in
a previous letter from the City of Eagan dated June 7, 1988,
regarding future assessments/connection obligations for various
property owned by Borchert-Ingersoll, Inc. Subsequently, you
arranged the meeting held on June 20 in the City Administrator's
office to discuss these concerns. During that meeting, there was
confusion expressed over the "water trunk main" that was
discussed in Situation 1 of the June 7 letter. Based on my
review of the situation, I have determined that reference to a
"water" trunk main is incorrect and that the letter should have
properly referenced this as a"sanitary sewer" trunk main.
Attached to this letter is a map showing the relationship of the
existing utilities to your property for further clarification.
Correspondingly, the rates quoted under Situation 1 were
incorrect in the June 7 letter. The correct 1988 rates are
$15.85/front foot resulting in a gross obligation of $33,816 for
the 2133.52 front feet. This procedure for determining the
financial obligation will be calculated at the time of actual
connection to the sanitary sewer facility if it should occur.
In addition, Mr. Shawn Moynihan on June 10 submitted a letter to
the City requesting additional information regardinq Situation 2
of our previous June 7 letter. Specific projects that provided
storm sewer availability to this property through the City's
trunk system were constructed under City Projects #302 in 1982-
1983, and Project #381 constructed in 1984. These two projects
combined provide for storm water outlet availability from the
pond located within the Borchert-Ingersoll property down to the
Minnesota River. Lot 1, Block 2, of the Sorchert-Ingersoll
Addition should have been included under one of these two
projects, but was inadvertently omitted in the preparation of
those assessment rolls. '

The storm sewer rates for trunk area storm sewer assessments were
calculated on the basis that every property within the City of
Eagan would share equally (by their proper zoning classification)
of the cost to construct the entire trunk storm sewer system
throughout the community. Therefore, in a continued effort to
try and maintain equity and parity for all property within the
City of Eagan, we try to identify any omissions and work with the
property owners to ensure that they pay their fair share when
most appropriate.
The other question that was raised at the June 20 meeting
pertained to the extension of Borchert Lane through the Gopher
Smelting property with an ultimate connection to Yankee Doodle
Road (County Road 28). The City would be receptive to any road
alignment that is agreeable to both property owners and that
meets City design standards for the commercial/industrial road
with access onto County Road 28 in accordance with County highway
standards.
If any additional information or clarification would be helpful,

confusion created and the error in our letter of June 7 and hope
that this letter of clarification helps to resolve your concerns.

2 have performed an assessment study on the parcels of land
currently owned by Borchert-Ingersoll. Based on this study, I
find two situations that I will address. See the attached
indexed map.
Situation 1:
There is an eighteen inch water trunk main that lies
northeasterly of the railroad right-of-way. 'Fhis water main is
readily available to provide water to Lot 1, Block 2, of the
Borchert-Ingersoll Addition and to parcel #10-01200-011-50. Lot
1, Block 2, of Borchert-Ingersoll currently receives water from a
lateral in Borchert Lane. However, if for some reason, it was
decided to connect to this water lateral, the City would require a
payment associated with the benefit received from this connection.
Any extra-ordinary costs incurred in constructing the service
extension from this main would be credited against the financial
obligation of the connection. Parcel 10-01200-011-50 has
approximately 800 feet-of frontage. At the first occurrence of
plattinq or connection to this main, the City would require
fulfillment of this financial obligation which could be handled
through a special assessment against the benefitting parcel(s).
'I'he estimated footage of 2133.52 front feet @$21.60/front foot
results in a gross obligation of $46,084 based on the 1988
equivalent rate for the present zoning.
Situation 2:
Lot 1, Block 2, of the Borchert-Ingersoll Addition has not been
assessed for storm sewer trunk. This omission was discovered
late in 1987 when the City audited all existing parcels to
determine if they were previously assessed for trunk storm sewer.
In an effort to resolve the issue, the City:
1. may impose this obligation as the condition of the
issuance of any future building permit required for
this property; or

2, would accept a request from the affected property owner
to spread the cost as an assessment by signing a Waiver
of Assessment Hearing Eorm which allows the City to
levy the assessment; or
3. the City may initiate the required assessment hearings
to formally levy these outstanding assessment
obligations. Using the 1988 Commerical/Industrial
storm sewer trunk rate of .083 cents pez square foot,
the obligation computes to:
427,074 S.F. @#.083 per square foot =$35,447
Any assessments generated in the future would be computed at the
then existing rates.

In our telephone conversation last week we had discussed Dakota County's use of the Borchert-
Ingersoll site located off of Mike Coliins Drive for the ouiside storage of semi-trailers. The City
of Eagan is aware that Dakota County currently controls the property and is leasing a portion of
the property to Norstar Transit for the pazking of semi-trailers. As you know, the City of Eagan
requires a Conditional Use Permit (CUP) for the outside storage of semi-trailers. Please be
aware that the outside storage of semi-trailers must discontinue on the site until a CUP has been
issued to the property for the use.
Enclosed please find a development application for a CUP. The next submittal date for
development applications will be September 18, 1996. If you have any quesdons regazding this

The Dakota County Environmental Management staff hava
conducted an investiqation of the above referenced matter.
A review of available maps and aerial photographs taken in
1977, 1985 and 1989, has indicated extensive filling
activities on this property.
The Eagan Public Works Department has no record of a permit
beinq issued to Borchert-Ingersoll for filling or grading at
this site prior to 1990; however, we understand you claim
Borchert-Inqersoll had permission from the City of Eagan to
qrade this site.
The pond located on site is currently designated by the
Minnesota Department of Natural Resources (DNR) as a type 5
Protected Wetland. An environmental assessment of this site
conducted by Nova Environmental in 1990 sugqests that the
previous filling activities may have violated DNR
regulations.
During site inspections conducted in 1992, Department staff
observed large quantities of demolition waste and rubble
deposited on the eastern slope of the pond. Erosion
channels in the filled area have revealed concrete curbing
and large slabs of concrete.
The use of these materials is not considered acceptable for
clean fill projects. Dakota County Solid Waste Management
Ordinance No. 110 (Ordinance No. 110) defines Clean Fill as
" Uncontaminated natural earthen materials such as soil,
sand and gravel." However, the Department may allow

concrete less than 18 inches in any dimension to be used as
qualified clean fill as part of a planned beneficial use
project, with Department approval.
Be advised that these conditions are in violation of
Ordinance No. 110 , Section II, Subsection 1, which states
the following:
" No person shall make nor allow his land or property
under his control to be used for intermediate or final
disposal of any solid waste except at a waste facility
for which a license has been granted by the County
Board, unless otherwise provided by this ordinance."
However, this site may be brought into compliance with
Ordinance No. 110 by performing the following site closure
activities :
1. The responsible party must submit a closure plan to this
Department for approval. A complete plan must contain the
following information;
A. Dates of Oberation. The plan must indicate the
dates material was accepted for placement at the site.
B. Notarized Affidavits. The plan must indicate the
type of material accepted by providing notarized
affidavit(s) from persons knowledgeable about the
site. The affidavit(s) should list the types,
eomposition, volume and location of material deposited
on the property. Such affidavits may include
disclosures by the site owner, operator, and/or
employees who have knowledge of the above.
C. Narrative Renort. The plan must provide
narratives of how the site will be physically closed
and describe the following:
1. Thickness and type of cover material to be used to
cover the site.
2. Stabilization of the slope and establishment of
approved vegetation to control erosion.
D. Narrative of End Use The plan must provide a
narrative of the proposed end use of the facility.
This includes proposed zoning, structures, or
additional filling to be conducted at the site.
2. The owner or responsible party must complete the
activities described in the closure plan after obtaining
Department approval.

Department requirements regarding the closure of this site
are dependant on the land use restrictions of other
regulating authorities. If continued filling is allowable
and consistent with the rules and regulations of the City of
Eagan and the DNR, site closure can be incorporated into
this activity.
The site must be surveyed to identify the location of the
demolition material. The property owner must complete a
Closure Record to be filed with the Dakota County Recorder.
The Department will not require removal of the material at
this time but reserves the right to require abatement
activities if warranted by adverse environmental impacts or
public health concerns arise from this site.

Dear Peter,
I was contacted last week and met on site with Tom Deyoung and a Mike, an empioyee
there, regarding the drainage on the semi-irailer parking area on your property. They fQel
the street improvement of Borchert Lane blocked the underground drainage system in place
prior to the roadway work. They stated that this existing system kept the parking lot from
fiooding and getting soft spots which they are now experiencing.
Since the project in 2004, Tom and Mike claim they have 6rought in several loads of
aggregate to try to repair the soft areas, and completely cover one of the inlets with the
gravel to stop the water from entering the system and level off the low spot near the inlet.
According to Tom and Mike, these steps didn't seem to be very effective so they decided
to give us a call.
The City does not have any records showing existing storm sewer in the parking area and
therefore this system would not have been taken into account in the plan preparation for
Borchert Lane back in 2004. I also talked to our Assistant City Engineer John Gorder
about the issue. He said that he had discussed the Borchert Lane project with you before
construction and you did not mention any existing underground storm sewer system in the
gravel parking area. With these things in mind, the City cannot take responsibility for
eliminating/cutting off a private existing drainage system which we had no knowledge of.
This doesn't change the tact that there is a problem which needs to be addressed. Under
the Borchert Lane project, there was storm sewer installed on the easterly side of Borchert
Lane just north of the northerly entrance into your parking area. If you wish to have your
drainage system connected into the City's storm sewer, we would allow the connection and
be willing to waive any "work in the right-of-way" permit fees associated with the
connection. We would only ask that you submit a plan to John for review and keep us
informed as to when the work would occur so we could schedule inspections as needed.
