Based on the information provided, the PRP staff has closed the release site file. Closure of the file means that the PRP staff does not require any additional investigation and/or cleanup work at this time or in the foreseeable future. Please be aware that file closure does not necessarily mean that all petroleum contamination has been removed from this site. However, the PRE staff has concluded that any remaining contamination, if present, does not appear to pose a threat to public health or the environment. - The MPCA reserves the right to reopen this file and to require additional investigation and/or cleanup work if new information or changing regulatory requirements make additional work necessary. If you or other parties discover additional contamination (either petroleum or non-petroleum) that was not previously reported to the MPCA, Minnesota law requires that the MPCA be immediately notified. You should understand that this letter does not release any party from liability for the petroleum contamination under Minn. Stat. ch. I 15C (2008) or any other applicable state or federal law. DISCUSSION Service There are a total of eight (8) parcels that abut Dodd road or may need servicing from Dodd Road that will be discussed. Parcel 010-02, PIN # 10-02400.010-01 Figure Numbers 37,38,39 Existing Conditions - Sanitary Sewer This parcel currently exists without sanitary or water services. A sanitary sewer manhole is currently installed outside of Dodd Road that can be connected to at the time a connection request is made. The sanitary sewer manhole located adjacent to this parcel is serviced by an 8" line. Existing Conditions -Water Currently, no water is available to this parcel. An 8" water main exists on the opposite side (West) of Dodd Road as shown in Figure No. 38. Proposed Improvement - Sanitary Sewer It is felt that at the time of change in land use of this parcel, the necessary connections to the sanitary sewer line available to the parcel can take place. Therefore, no sanitary sewer service improvements will be proposed at this time. Proposed Service - Water An 8" by 6" tee should be cut into the 8" main line. An additional 105' of 6" DIP water main should be installed. The 6" DIP line could service this parcels future needs as well as Parcel 012-02. This improvement is shown on Figure No. 39. Parcel 012-02, PIN # 10-02400-012-02 Figure Numbers 38,39,40 Existing Conditions - Sanitary Sewer This parcel currently exists without sanitary or water services. As shown in figure 40, located at the back of this report, a sanitary sewer manhole is currently installed outside of Dodd Road that can be connected to at the time a connection request is made. The sanitary sewer manhole located adjacent to this parcel is serviced by an 8" line. This 8" line is sufficient for most land use requests. Existing Conditions - Water Currently, no water is available to this parcel. An 8" water main exists on the opposite side (West) of Dodd Road as shown in Figure No. 38. Dodd Road Street and Utility improvements 4 Proposed Improvement - Sanitary Sewer It is felt that at the time of change in land use of this parcel, the necessary connections to the sanitary sewer line available to the parcel can take place. This 8" sewer line was extended from the cul-de-sac in Havenhill Road to the west property line of parcel 010-05 as shown in Figure No 41. This location of sewer service will work with the given contours and elevations of the property. Existing Conditions - Water Currently, water main exists along the west side of Dodd Road, adjacent to this property as shown in Figure No 42. A 1" service has also been provided to serve the existing use (one single family) of this parcel. Proposed Improvement- Sanitary Sewer It is felt that at the time of change in the use of land for this parcel, the necessary connections to the sanitary sewer line available to the parcel can take place. Proposed Improvement - Water It is felt that a 6" line should be stubbed to this parcel for future needs. If this parcel was to subdivide, a 6" line would be necessary. By installing a 6" water main at this time, no disruptions to the new road will occur. This proposed improvement is shown on Figure No 43. I had hoped to obtain a legal description from Mr. Cordes but have not received the promised description and revised drawing. I am reluctant to further delay the registration proceeding and would like to go forward. The only matter which would prevent proceeding to close out the registration by default is the informal extension of time to the City of Eagan as we worked out the details surrounding the realignment of Dodd Road and the exchange of vacated right-of-way for easement previously discussed and agreed to by our clients. Jim O'Connell advises me that revising the legal description at this point in the registration would necessitate republication and cause further delay and expense. Rather than vacate the excess right-of-way before registering, I would propose to complete the registration and handle the exchange of the easement for vacated right-of-way after the registration is completed. The vacated street can be added to the legal description by a Directive of Examiner in view of the recent change in the statute and should not require supplementary proceedings. The easement can be placed of record as a memorial following the conclusion of the registration. I would propose at this time to go forward by default with the registration. This letter will further confirm our client's willingness to exchange the easement for the vacated right-of-way at such time as we are able to obtain a description, have it reviewed by the City and complete the vacation proceedings.
