The subject property, parcel 010-78 located southeast of the Wescott
and Dodd Road intersection in Section 13, is zoned LI (Light
Industrial) by the City of Eagan. The existing home is a permitted

Service
There are a total of eight (8) parcels that abut Dodd road or may need servicing from Dodd Road
that will be discussed.

Existing Conditions - Sanitary Sewer
This parcel currently exists without sanitary or water services. A sanitary sewer manhole is
currently installed outside of Dodd Road that can be connected to at the time a connection
request is made. The sanitary sewer manhole located adjacent to this parcel is serviced by an 8"
line.
Existing Conditions -Water
Currently, no water is available to this parcel. An 8" water main exists on the opposite side
(West) of Dodd Road as shown in Figure No. 38.
Proposed Improvement - Sanitary Sewer
It is felt that at the time of change in land use of this parcel, the necessary connections to the
sanitary sewer line available to the parcel can take place. Therefore, no sanitary sewer service
improvements will be proposed at this time.
Proposed Service - Water
An 8" by 6" tee should be cut into the 8" main line. An additional 105' of 6" DIP water
main should be installed. The 6" DIP line could service this parcels future needs as well as
Parcel 012-02. This improvement is shown on Figure No. 39.

Councilmember Egan questioned whether the surrounding property owners had standing
to object to the zoning at the present time. Councilmember Smith also indicated
that there appeared to be extensive documentary evidence indicating that the property
was intended for commercial use including all of the history showing the intent for
that purpose. The issue has now been raised before the Council at three different
regular meetings and the Council had heard arguments from both sides'in detail. Mayor
Blomquist indicated that a mistake had been made by the owners and there is not
adequate reason shown by the owners and developers that the property was not intended
to be excluded from the Blackhawk Park Planned Development and PUD Agreement.
Councilmember Egan gave the same statement and indicated that the affidavit by Mr.
Ed Dunn did not negate the exclusion of the commercial center in the PUD Agreement.
The APC had recommended approval of the plat and site plan subject to certain condi-
tions. Smith moved, Parranto seconded the motion, to authorize the City Council to
enter into an amendment to the PUD Agreement to revise the description recognizing
the history and also the agreement, the documents submitted, and the applications
submitted provided that commercial uses were intended for that location. Those in
favor were Smith and Parranto, those against were Blomquist, Wachter, and Egan.
Smith then moved, Parranto seconded the motion, to deny the application for pre-
liminary plat approval and for site plan approval for the reasons cited above includ-
ing the objections made to the application and the fact that the property had not
been properly zoned for commercial purposes, including the fact that the developer had
specifically excluded the subject commercial property from the PUD-legal description,
but that the applicant, including the owner and developer, could submit a request to
Cra the City Council to clarify the zoning due to the complexity of the legal and factual
issues involved. All members voted in favor.

The application for rezoning from Agricultural to I-1, Limited Industrial, and
conditional use permit to allow outside storage submitted by Central Fence and Supply
Company was next considered. Mr. James Sander, attorney, appeared on behalf of the
applicant as did Mr. Loenard Hersten. There were no objections to the application.
There was concern by certain Councilmembers concerning the land use designation by
the City of Eagan reflecting an R-2 use for the subject property. Also, there was
concern about the zoning on the Inver Grove Heights side to the south of property
currently owned by Central Fence and it was noted that it is currently zoned
industrial or will be zoned industrial. Mr. Sander indicated it is a wholesale and
not a retail business and that there would be no storage above the height of the
fence. The basic change was to provide for five year conversion of use for the
residential property consisting of Lot 2 rather than conversion for office or busi-
ness purposes at the present time. Egan moved, Wachter seconded the motion, to
approve the applications for conditional use permit and for rezoning providing for
five year phasing for the change in use and further subject to the following recom-
mendations of the Advisory Planning Commission:
1. A more detailed site plan in the area of the existing home/proposed office
shall be submitted and approved by the City prior to final approval of the conditional
use permit.

i 2. Accesses to the prop erty from County Road #63 (Dodd Road) shall be approved
by Dakota County.
3. The conditional use permit shall be approved for a period of seven (7)
years provided the developer complies with the conditions under which the conditional
use permit is granted and all other pertinent ordinances of the City.
4.' The applicant shall be required to dust control the outside storage area
at all times.
5. The perimeter fence shall be set back a minimum of 20 feet from the right-
of-way line along Dodd Road and the setback area shall be bermed and landscaped as
approved by the City. The driveways and parking area related to the proposed office
shall be surfaced prior to the development and use of the outside storage area.
6. Materials and equipment storaged in the outside storage area shall relate
directly to the Central Fence and Supply Company's operation and no other outside
storage shall be permitted unless approved by the City Council of Eagan.
7. At such time as any application for building permit is requested of the
City, the property shall be platted.
8. With the rezoning of this property and the approval of a conditional use
permit, the City does not intend to promote the dual use of property wherein the
existing house would be continued to be used as a residence for a long period of
time. The applicant shall submit a proposed schedule for converting the residence
into an office which shall be approved and become a part of this conditional use
permit.
9. Lateral benefit from trunk water main and sanitary sewer shall be assessed
against this property in accordance with existing assessment policy pertaining to
Limited Industrial zoning.
10. A detailed site plan shall be submitted and approved, indicating the
limits of the open storage, parking area, entrance drive, and landscaping ground
cover. This plan must also indicate grading elevations and drainage patterns.
11. The existing residential property (proposed office complex) shall
be connected to existing sanitary sewer system rather than to the on-site disposal
system at the time of conversion to office use.
12. Adequate right-of-way on Dodd Road and Wescott Road shall be dedicated
to the City as required by the staff.

In response to your letter of June 26 to our Special Assessment Clerk,
Ann Goers, we have reviewed the revised certificate of survey for the
two lots in Section 13 and 24 that are being incorporated with the Central
Fence and Supply Company's operation. The revised figures of 147.95 feet
in Section 13 and 148.54 feet in Section 24 will be used for computing the
special assessments for lateral benefit from a trunk utility. The total
of the footage of these two lots remain the same so that your respective
assessment does not change from the previous amount of $7723,57. The
parcel in Section 13 has been revised to$3854.10 and the parcel in Section
24 has been revised to $3869.47. for a total assessment due of $7723.57.
In your letter, you indicated that Central Fence and Supply Company has
a period of thirty (30) days to request a hearing on these assessments.
This letter is to inform you that the hearing for these assessments has
already been held and by action of the Special Assessment Committee, they
were deferred until the rezoning of the property took place. Central
Fence and Supply Company has a period of thirty (30) days from the approval
of the rezoning to make payment in full. . If payment in full is not
desired and you wish these to be spread as a special assessment, we re-
quest that you sign the waiver of hearing allowing us to spread these special
assessments.
As you are aware, we have determined that sanitary and/or water trunk area
assessments have not yet been levied on the one parcel in question. This
letter is to inform you that these trunk area assessments will not become
a liability of the property until connection to the utility system is made
or until a future utility project incorporates these parcels within its
assessment area. Therefore, you will not be required to pay these trunk
area assessments at this time; only the lateral benefit from trunk water-
main and trunk sanitary sewer as previously discussed.

CITY OF EAGAN
WHEREAS, a regular meeting of the City Council of the City of Eagan, Dakota County, Minnesota,
was held on the 4th day of April, 2017, at 6:30 p.m. at the City Hall located at 3830 Pilot Knob Road, Eagan,
Minnesota;and
WHEREAS, pursuant to M.S.A. §412.851, the Mayor convened the public hearing to consider the
proposed vacation of right-of-way lying over and across the following described real property in the City of
Eagan, County of Dakota, State of Minnesota, described as follows:

WHEREAS, the Council at a regular meeting on the 20th day of September, 2016, accepted a
petition to vacate said right-of-way pursuant to a petition and scheduled a public hearing on the vacation
for the 18th day of October, 2016, at 6:30 p.m. at the City Hall,which hearing was closed and continued to
coincide with future City Council consideration of the Tipperary Addition final plat;and
WHEREAS, an Affidavit of Publication of Notice of Hearing in the Sun Thisweek newspaper, dated
September 30 and October 7, 2016, relative to the proposed vacation was submitted; and
WHEREAS, there appearing no objections to said vacation and the Council desiring to vacate said
right-of-way;and
WHEREAS, it having been determined that other than petitioner, there are no other parties,
including public utility companies, having an interest in said public right-of-way, and it appearing that it is
in the public interest to vacate such right-of-way, and there being no objections;
NOW THEREFORE, it was resolved that the public right-of-way lying over and across the following
described property is hereby vacated:
