It is felt that at the time of change in the use of land for this parcel, the necessary connections to
the sanitary sewer line in Witham Lane can be made.

Since this parcel already has water service for its current needs met, it is felt that at the time of
land use changes, a connection should be at that time. Water main is available at Witham Lane
and along the entire north property line. Therefore, no additional water improvements for this

Proposed Improvement - Sanitary Sewer
This current owner of this parcel requested individual services for sanitary sewer and water. The
owner did not indicate any want to subdivide in the near future. This lot does have the potential
to subdivide, but would have to be done utilizing a flag lot geometry. This would also likely
require the need to relocate the current house location. Therefore, only the current needs (4"
PVC sewer) for services are proposed to be met as shown in Figure No. 51. At the time of any
lot split request, the necessary connections can be made to a sanitary sewer manhole and water
main available within city right-of-way, outside of the newly constructed street.

Dear Mr. & Mrs. Buehler:
On September 18, 1990, the City Council held a public hearing to
consider the adoption of the final assessment roll for the above-
referenced project as it relates to your property. At that
meeting, you had submitted written information indicating that you
will obtain your water service from the water lateral installed
along your southern property line by the developer of the Hills of
Stonebridge 3rd Addition. Subsequently, you requested special
consideration for postponement of the lateral benefit from trunk
water main assessment under the above project. The City council
agreed to postpone this assessment subject to your execution of the
enclosed agreement prior to October 10, 1990.
Therefore, please have all three copies executed, notarized and
returned to my attention for counter-execution by the City of Eagan
and recording at Dakota County. If this agreement is received by
the referenced date, no assessment will be certified to Dakota
County in accordance with the conditions of that agreement.
However, if the agreement is not returned by that date, the City
will proceed with certification of the amount identified in the
final assessment roll as presented at the public hearing on
September 18.

SPECIAL ASSESSMENT AGREEMENT
PROJECT 581
This Agreement is between Donald L. & Adeline K. Buehler, husband and wife
("Owner"), Owners and occupiers of land in the City of Eagan, Dakota County,
Minnesota ("City") as shown and described as Lot 1, Block 11, Hills of
Stonebridge 1st Addition on Exhibit A ("Premises") and the CITY OF EAGAN
in conjunction with City Project No. 581, Stonebridge 2nd Addition.
The City of Eagan had proposed to assess Premises pursuant to Minnesota
Statutes Section 429 for the lateral benefit from watermain in the amount of
$3,795.00. It has been determined by the City that an alternative watermain
hook-up is available. That being the case, the owner and City have agreed that
the Premises will not be assessed for lateral benefit relating to the watermain
in Dodd Road unless and until the Premises were hooked up to the watermain in
Dodd Road.
NOW, THEREFORE, the City of Eagan and the Owner do hereby agree as follows:
1. That the City will not assess the lateral benefit for watermain as part
of the special assessment levy for Project No. 581, Hills of Stonebridge 2nd
Addition. If and when the Premises are connected to the watermain in Dodd Road
which was installed as part of Project No. 581, the Owner, her heirs, successors,
or assigns, shall pay to the City of Eagan, the then current rate for lateral
benefit for watermain for 276 front feet. Said payment shall be made within 30
days of the hook-up.
2. In the event that the premises are not hooked up to the watermain
installed in Dodd Road as part of City Project No. 581, neither the Owner nor
the Premises shall be obligated nor responsible for any payment for lateral
benefit for watermain from City Project No. 581 as part of the Agreement.

Under terms of our land sale contract (see paragraph 3 of
enclosed copy) the developer has agreed to supply four utility
hookups from the sewer and water mains on Oxford Road at no cost
to us. One of the hookups is for our house and the other three
for possible future development of lots.
Since we derive no lateral benefits from the water trunk on Dodd
Road and the cost of the hookups has effectively been paid to the
developer we contend that no assessment should be due us on this
property.

ADDENDUM TO CONTRACT FOR DEED
BETWEEN
DONALD L. BUEHLER AND ADELINE K. BUEHLER,
HUSBAND AND WIFE (SELLER)
AND
COMMERCIAL EXCAVATING, INC. (BUYER)
The following are additional terms to said Contract for Deed:
1. Seller agrees to sign any and all documents required to obtain
the consent of all regulating and governing bodies for the development of
the property into single family residential lots, at no cost to the Seller.
2. It is agreed and understood that the land being purchased has
been used for farming or cattle grazing in the past, and-that the Purchaser
hereby gives his permission to Seller to continue this activity at Seller's
sole risk and responsibility until the development of the land shall begin,
including storing farm machinery in the steel barn until May 1, 1987, which
barn shall be retained and then removed by Seller.
3. It is agreed and understood between the parties that a parcel
of property wherein the Seller's homestead and well are located was not
sdld pursuant to this Contract for Deed ("Retained Parcel"). Purchaser
agrees that the Retained Parcel shall be designated as a single outlot in
the plat of the property. Seller agrees to join in the plat and to include
the Retained Parcel therein. Subject to approval of the City of Eagan,
Purchaser agrees to extend a roadway from Dodd Road adjacent to the south
boundary of the Retained Parcel and to install sanitary and storm sewer
mains and water mains in the roadway. The parties will cooperate with the
City of Eagan so that no gap exists between the Retained Parcel and the
new roadway. Purchaser further agrees to install, at Purchaser's sole cost,
utility service hookups from the sewer and water mains to the boundary of
the Retained Parcel with the roadway at up to four locations to be designated
by Seller. Seller shall make such designations at the time Purchaser installs
the sewer and water mains.
4. In the event the City of Eagan will not approve a plat permitting
the Purchaser to fulfill the requirement of locating a platted roadway
adjacent to the south boundary line of the Retained Parcel, then the Purchaser
shall be obligated to purchase the most southerly one acre of the Retained
Parcel at an agreed price of $34,715.00, plus provide the Sellers at the
Purchaser's cost with one utility hookup to the property li% of the then
Seller's homestead.
