Federal Savings and Loan in an amount equal to the first half payment of the special
assessments associated with data processing numbers 566-570 and 562. This check is
being sent to your attention as it is the City's understanding that 'twin City Fed-
eral has already made payment for the first half of these special assessments. If
this is the case, Dakota County should sign off this check so that you may receive
reimbursement. Please be advised that the second half special assessment payment check
will be issued by the City of Eagan directly to Dakota County Treasurer upon verifi-

and the City of Eagan allowing deferment of the existing special assessments levied

the installation of streets and utilities adjacent to your property. Upon full ex-
ecution, the City will file this agreement as an official document along with your
title to the above-referenced property to be referenced as a "deferred" assessrent.

other individuals other than yourself, please obtain their signatures below yours

On October 20, 1981, a letter was sent to your attention indicating that the second
half of the 1981 payment for special assessments levied in association with the above-
referenced project nurber based on your submitting verification of the continuation of
the hardship that was evident at the time the City Council agreed to defer your special
assessments. We had requested this information to be received by November 15 so that
the city could process ilhis second half payment within the proper time frame. Although
no response was received by the requested date, the City processed the second half pay-
ment of your special assessments in good faith that it would be forthcoming.
However, before continued deferment of these assessments can be provided for, we must
receive this verification of continued hardship in the form of a letter from the at-
tending physician verifying the continued medical disability of Mr. Pietsch, which was
the basis for granting the original hardship request pertaining to deferment of special
assessments. Please be informed that the special assessments as originally levied still
remains as a matter of record against your parcel, and as such, will continue to show
up on your next tax statement which will be due and payable to the County Auditor by
May, 1982. Therefore, your deferment of special assessments is no longer in effect as
a result of lack of verification of hardship.

As you are aware, your request pertaining to an abatement/deferment of your special
assessments associated with Project 241 against your property located at 4275 Dodd
Road was considered by the Special Assessment committee on march. 31, 1981. After
reviewing the information sutmitted, the Special Assessment committee recommended
that the assessments be postponed for one year with the understanding that the City
would review your situation on an annual basis during November of each year to deter-
mine if the financial hardship still exists. This recommendation was presented to
the City Council at their meeting on April 21, 1981. The City Council upon review-
ing the information and the recommendation of the Special Assessment Committee con-
curred with the postponement of the special-assessments on a year-by-year basis
with the condition that it be reviewed annually by the City to verify that the finan-
cial hardship would still exist. This review will be handled on November 1 of every
year.
It is our understanding that the first year's installment of the special assessment
principal and interest has been levied on the tax statement. The City will make
payment directly to the Dakota County Treasurer for the first year's installment of
principal and interest with the understanding that this amount will be required to
be paid back to the City of Eagan once the financial hardship is no longer in effect.
In order for the City to proceed with this payment, it will necessary for you to sub-
mit to us a copy of your 1981 tax statement so that we can obtain the correct amount
for direct payment to Dakota County. Therefore, if the financial hardship is deter-
mined to exist as of November 1, 1981, we will contact Dakota County directly and in-
sure that the second year's installment will not appear on the 1982 tax statement.
Hopefully, this information will help you during the interim period until your hus-
band can recover from his injuries and handle the special assessments that are the
responsibility of your property. If you have any questions pertaining to the in-
tentions of the City pertaining to your assessments, please feel free to contact me.

FACTS
We have received a request from Mr. Pietsch of 4275 Dodd Road pertaining to
special consideration for deferment of his assessment payments due to a finan-
cial hardship. Mr. Pietsch is presently not of sufficient age to qualify
under Ordinance #66 for deferment of these assessments. A copy of his re-
quest and several support correspondence pertaining to his hardship is attached
for the Ccmmiittee's information. Mr. Pietsch's property was assessed under
Project 241 for streets and utilities under the final assessment role certi-
fied on September 24, 1980. The total amount of the assessment was $8,095.21.
As can be seen with the attached special assessment spread, the first year's
installment would be approximately $100 per month decreasing to the final
year's installment of approximately $36.00 per month. This assessment was
spread over a 20-year period by the city Council's direction to help alleviate
the burden of these assessments associated with this project.
STAFF'S REX;MENDATIONS
Based on the support documentation received from Mr. Pietsch, it is evident
that a financial hardship situation exists. It would be the staff's recontmen-
daticn that this assessment be postponed for one year with reconsideration
being given to future postponements at the end of that time based on addition-
al information indicating a continued hardship situation.

Dear Dr. Dawson:
Mr. Fred Pietsch came back to the Mayo Clinic on the 30th.ahd 31st
of October, 1980 when he was evaluated by myself, Dr. B. Sandok from
the Division of Neurology, and also in the Electromyography Section.
Though at this stage he still requires approximately 4 D9tvocet N
100 tablets a day for a painful arm and hand, Mr. Pietsch has made
some progress in the sense that the pain may be somewhat less than
six months ago and he is now able to move his fingers and utilize the
hand more purposefully. He still however has considerable weakness
from the damage to his left ulnar and median nervetand it will be
quite a few months yet before we reach the maximum recovery.
It would be of the utmost importance that he continues with regular,
physiotheapy in order to keep the muscles as strong as possible until
reinnervation continues and I would be grateful for you for persisting
with an intense physiotherapy program in 'this gentleman.
The left shoulder x-rays that were taken were essentially normal and
the electromyographic study showed that there was improvement with evidence
of reinnervation of muscle supplied by the median, ulnar and axillary nerves.
I talked to Mr. Pietsch generally about his condition and suggested to
him that it will lie at least. another six mnnths before we can begin to
talk seriously about the amount of residual damage. I doubt whether he can
work at this stage and sn-gested to him that he return back her on April 14,
1981 for further assessment. I would like to thank you for your help in the
management of this patient.

Connection Fees
At the City Council meeting of April 5, 1983, the City Council
formally considered your request to defer the connection fees
associated with your sanitary sewer and/or water connection
permits. After considerable discussion and taking into account
the information that you provided pertaining to the estimated
cost to repair your existing well, the City Council denied your
request for deferment.
Please be informed that present City policy requires that con-
nection be made to the City sewer or water system prior to any
repair being performed on existing private wells or septic sys-
tems. Therefore, please be informed that before you will be al-
lowed to repair your existing well, you will be required to con-
nect to City water.
Although connection of the sanitary sewer at the same time is
not specifically required, it is strongly encouraged that you
perform both connections at the same time for cost savings of
installations.
I regret that the City Council is not able to grant approval
to your request. The City also does not have any recommendations
where financial assistance could be obtained to help with the
costs associated with the connection fees and the cost to phy-
sically connect to the system. We suggest that you contact
Dakota County agencies and/or the financial institution that
presently holds the mortgage to your property to try and obtain
some type of financial assistance in maintaining and improving
the value of your house through connection to the City sewer
and/or water systems.

Re: Sewer and Water Connection Fee - Request for Deferment
On March 15, 1983, the City Council formally reviewed your re-
quest to defer the permit fees associated with the connection
of sewer and/or water to your residence at the above-referenced
address. Due to the fact that a portion of the permit fee must
be processed to the Metropolitan Waste Water Control Commission
(MWCC), the City Council cannot waive the Sewer Availability
Charge (SAC) on the sewer connection permit.
As you are aware, the City Council continued consideration of
your deferment request for the connection fees and encouraged
you to solicit estimates for the repair of your private well on
a temporary basis.
Once you have obtained the estimate to repair the well, the
City Council will again consider your financial hardship re-
quest at a future date when this information can be provided.
Therefore, please submit the information to my attention when
it is available so that I can forward it on to the City Council
for formal review in a timely manner.

9. Mallard Park 1st Addition 1 Utility Easement Vacation. A petition
had been received for vacation of certain utility easements in Mallard Park
1st Addition, which is being replatted as Tiberon Addition. It was
recommended that the petition be received covering the vacation of common lot
line utility easements and that a public hearing be scheduled before the City
Council on May 3, 1983 at 7:00 p.m. at the City Hall.
10. Brittany 3rd Addition - Street Vacation. A petition had been
received from the developer of Outlot A of Brittany 3rd Addition requesting
vacation of the dedicated right-of-way of Sheffield Circle in anticipation of
replatting Outlot A for a new subdivision layout. It-was recommended that the
Petition be received and that the public hearing be scheduled on the vacation
for May 3, 1983 at the City Hall at 7:00 p.m.
Upon motion by Egan, seconded Wachter, it was resolved that the foregoing
Consent Agenda items as recommended by the City staff be approved and
authorized implemented. All voted yes.
OAK CHASE 1ST ADDITION - UTILITY EASEMENT VACATION
A petition was received from the developer of the Oak Chase 5th Addition
to vacate the side and rear lot line drainage utility easements over Lots 1
and 2, Block 3, Oak Chase 1st Addition, being replatted into Oak Chase 5th
Addition. It was recommended that the petition be received and that a public
hearing before the City Council be scheduled at the City Hall on May 3, 1983
at 7:00 p.m. Upon motion by Wachter, seconded Thomas, it was resolved that
the Petition be received and the public hearing be scheduled as recommended.
All voted yea.
ANN PIETSCH - DODD ROAD CONNECTION FEES
A request had been received from Ann Pietsch,,4275'Dodd -Road, for
deferment of sewer and water connection fees to allow Mrs. Pietsch to connect
to City sewer and water at her rysidence on Dodd Road. The Council had
discussed the matter at two earlier meetings and the Public Works Director
indicated that the approximate cost would be $2,000.00 to connect to city
water. The cost would be $600.00 to replace the screen and $800.00 to replace
pump, for a total $1,400.00, if Mrs. Pietsch were to improve her system
privately. The City policy requires that when repairs are made to a well,
that the owner must then hook to City water if available. Because of the
present problems, the fact that it is expected that the property will be sold
within the near future, and that there are others who are Rrobably equally
needy in the City, Egan moved, Wachter seconded the motion to deny the request
because of no absolute showing of need. All voted yes.
ASSESSMENT HEARINGS
Mr. Hedges stated that the City Coun2il has before it a group of special
assessment hearings covering special assessment projects and that
inadvertantly the notices had been published and mailed scheduling the

WATER TREATMENT PLANT - STATUS REPORT
CONTRACT 183-1
Bob Rosene, the City Consulting Engineer gave the Council a brief update
concerning the plans and specifications for the water treatment plant under
Contract 183-1. He noted that the total cost estimate for the project is
relatively close to that which was originally provided in the June 18, 1982
Summary Report. No action was taken.
JOINT CABLE COMMISSION UPDATE
Mr. Hedges and Councilman Smith gave the Council an update regarding the
Joint Cable Commission meeting of March 3, 1983 when Carl Pilnick of Tele-
communications Management, Inc. was present and reviewed the Group W proposal
that was received in January. Public hearings will be scheduled for April and
a request to draft the ordinances by both Eagan and Burnsville will take place
during May. It was also noted that modifications to the City Hall will be
implemented to more easily accommodate cable televising at the City Hall.
TRUNK HIGHWAY #13 SERVICE DRIVE
A Petition has been received from Rax Roast Beef and Perkins Restaurant
management requesting preparation of a feasibility report to eliminate the
existing service drive for old Trunk Highway #13 between Country Club Market
and Minnesota Federal. Staff has been working with the management of both
restaurants and noted, however, that no progress had been made with Minnesota
Federal or the management of Country Club. The Public Works Director was
requested to do additional planning and to attempt to acquire consensus from
the property owners along the service drive, as far east as the Mr. Donut Shoo
and further to contact the Minnesota Department of Transportation for possible
cost-sharing. Wachter moved, Egan seconded the motion to direct the Public
Works Director to prepare such a report, make the contacts and do some pre-
liminary design work on the road and then return to the City Council with
plans for the drive from Rahn Road to Silver Bell Road. All voted yes.
ANN PIETSCH - CONNECTION FEE DEFERMENT
A request from Ann Pietsch for approval of deCermont of connection fees

before the Council. Mrs. Pietsch was present and indicated that for financial
reasons she would be unable to pay the connection charges required to connect
to water and sewer and that she expected it would be necessary to connect
within a short period of time. After discussion, it was suggested that Mrs.
Pietsch contact a well service company and determine what types of problems
she may be having with her well before making determination as to connection
to the Eagan water system.

THIS AGREEMENT dated this 17th day of June , 1982, between
the CITY OF EAGAN, called CITY, and ANN PIETSCH of 4275 Dodd Road, Eagan, Minnesota
55123;
WHEREAS, a request from Fred J. and Ann Pietsch of 4275 Dodd Road was submitted
to the City of Eagan and was considered by the Eagan Special Assessment Committee
on March 31, 1981, requesting deferment of assessments for improvements associated
with Improvement Project #241, based upon financial hardship; and,
WHEREAS, the Eagan Special Assessment Committee recommended approval of the
deferment although the applicant did not qualify under the ordinance #66 Senior Citizen
provisions, but rather was based upon the fact that Mr. Pietsch had not been gainfully
employed due to a physical disability which was verified by his physician in a written
letter to the City; and,
WHEREAS, the Eagan City Council accepted the recommendation of the Assessment
Committee at its regular meeting of April 7, 1981, and authorized the deferment on
certain conditions; and,
WHEREAS, a letter has now been received from Ann Pietsch at the request of
the City of Eagan requesting extension of the hardship deferment due to financial hard-
ship, which letter was received on December 22, 1981; and,
WHEREAS, the City Council on January 19, 1982, considered such request for
deferment due to reasons of severe financial hardship;
WHEREAS, the Eagan City Council, upon motion by Councilmember Smith, seconded
Councilmember Egan, authorized deferments subject to the execution of an agreement
between the City and Ann Pietsch; and
WHEREAS, the Eagan City Council on May 18, 1982, authorized such deferment upon
the signature of Ann Pietsch alone;
NOW THEREFORE, upon consideration of the mutual covenants, the parties agree
as follows:
1. Ann Pietsch hereby states that she is one of the owners of the following
described property at 4275 Dodd Road:
,Lot-1, Block 2, Saddle Horn Addition, Dakota County,-Minnesota,--Minnesota,
tto-the duly=recorded plat thereof;
and that she can act solely on behalf of the owner. or owners of the property in enter-
ing into this agreement without consent of any other person, or any other person with
an interest in the property consents to this agreement by signature at the end hereof.

In the event that any other owners, their heirs or assigns, contest this agreement or
any assessment deferred pursuant to this agreement, Ann Pietsch, for herself, her
heirs and assigns, hereby agrees to indemnify and hold the City of Fagan harmless from
all resulting claims, liabilities, or losses, including inability to collect any portion
of the agreed assessments and costs, expenses and attorney's fees upon any resulting
legal action.
2. The City hereby agrees to defer the payment of assessments upon said property
associated with Improvement Project #241, based upon financial hardship until June
1, 1983, or until the property is sold or ownership is changed, whichever occurs first
with interest to accrue from the date of levy of the assessments, October 7, 1980.
3. It is agreed that the undersigned owner, her successors or assigns waives any
and all objections to the assessment procedure or amount of assessments provided under
this agreement, the time of ultimate assessment of the property for improvements related
to Improvement Project #241, and waives any right to appeal such assessments.
The undersigned have signed this Agreement on the date above written.

financial status of the owner or the owners of the property as determined by the
City of Eagan, whichever is soonest.
3. It is understood that at such time as the property will be reassessed
for the improvements associated with Improvement Project 11241, at the rate then
in existence for comparable improvements in the City of Eagan
4. It is agreed that the undersigned owner/owners, their successors or
assigns waive any and all objections to the assessment procedure or amount of
assessments provided under this agreement, the time of ultimate assessment of the
property for improvements related to Improvement Project 11241,and waive any right
to appeal such assessments.
