NEW BUSINESS - Final Assessment Appeals SAC 10/9/84 B. PROJECT 383, SCHWANZ LAKE TRUNK STORM SEWER 1. Heide Schiela (10-02500-010-52) BACKGROUND INFORMATION Project 383 provided for the installation of a trunk storm sewer lift station and outlet from Schwanz Lake to the large wetland located south of Wilderness Run Road. Schwanz Lake receives the drainage from those districts referenced on the map enclosed on page. On August 7th, the final assessment hearing was held for the trunk area storm sewer assessments to be levied against all property located within those drainage districts. In response to the notice sent out for this final assessment hearing, Ms. Schiela submitted a letter dated July 27 noting her objections which are enclosed on page An explanatory letter of response to Ms. Schiela by the Public 'Works Dirgctor is enclosed on pages e3 and ?. Also enclosed on page- is a topographic layout of the parcel referencing the pond and the NSP easement along the northside of the property. Enclosed on pages V-41 and qj_ is a follow-up letter from Ms. Schiela dated August 5 continuing her objections of being included within this assessment role and the inclusion of the 4.6 acres of land within the NSP easement. Although the property is homesteaded, its size (9.95 acres) precludes it from receiving any "large lot" credit considerations beyond the standard 20% for right of way dedication for potential future development. However, the 2.2 acres for the existing pond over the eastern portion of her property was also deducted. This entire parcel lies within the drainage district serviced by the Schwanz Lake trunk storm sewer improvements. The pond on the eastern portion of the property has an overflow outlet to the storm sewer system which directs the drainage to Schwanz Lake via Hay Lake. The low depression on the front portion of the property also has a storm sewer outlet providing direct run-off into a storm sewer system discharging directly into Schwanz Lake. STAFF RECOMMENDATION Although special credits and consideration were given in reducing the assessments associated with lateral sanitary sewer, water and streets under Project 241 in 1980, the staff feels that these same criteria are not applicable to trunk area storm sewer which deals with surface run-off. Subsequently, all the property presently owned by Ms. Schiela contributes run-off into the storm sewer district which is serviced by the Schwanz Lake trunk storm sewer lift station outlet. I would like to inform you as to how the area was arrived at in determining your assessable amount. Your lot area of 9.95 acres was reduced by 2.17 acres for the existing pond located on the east portion of your property. The resulting 7.78 acres was further reduced by 20% (1.56 acres) to arrive at a net assessable acreage of 6.22 acres (271,000 sq. ft.) which was assessed at 4.310 per sq. ft. equaling $11,680.00. Under Project 241, the negotiated settlement for the assessable area for trunk area sanitary sewer and trunk area water was 4.55 acres. This was arrived at by taking the size of the parcel (10.56 acres before additional right-of-way dedication) and subtracting the 4.01 acres (200 ft. N.S.P. easement) and the 2.1 acres of ponding on the east portion of your property. This resulted in the 4.55 acres' that was assessed. The 4.01 acres of the N.S.P. easement was deleted from trunk area assessments due to the fact that it was determined to be unbuildable and subsequently there would be no benefit from the sanitary sewer or water main installed along Dodd Road. However, Project 383 provides for trunk area storm sewer improvements to the subdrainage districts referenced on the attached map (L-26,25127 and 28). Since storm sewer relates to water runoff from parcels and not dependent upon their development, the credit for the pond was still applied but the credit for the area within the N.S.P. easement was not deducted. The City Council approved the assessments in the amount of $5,511.41 subject to execution of an agreement to provide for an increased assessment if the property changes in use, with the property owner to waive the right to appeal the future assessments if they are made at the assessments rates existing at the time of the future assessment. Our office drafted a proposed agreement and forwarded it to the Attorney for Ms. Schiela, Bernie Dusich. Mr. Dusich revised the agreement to provide that upon a change in use of the property the City may levy supplemental assessments according to the then existing rates, providing however that the assessments may not exceed the special benefit to the land. Ms. Schiela specifically reserves the right to object to or appeal from the assessments. Mr. Dusich has made it clear that if Ms. Schiela does not retain the right to appeal future assessments on the basis of lack of special benefit, she would prefer to have the matter tried before the District Court at this time. The hearing is presently scheduled for July 12. Our office agreed to bring the proposal before the City Council at the earliest possible meeting to give the City Council the opportunity to review it and determine whether the revision is acceptable. It should be noted that in a previous assessment agreement with Ms. Schiela relating to sanitary sewer water and street assessments, similar language was included allowing the City to levy a supplemental assessment providing that the existing rates at the time of the supplemental assessment do not result in an assessment exceeding the special benefit to the land. ??Z Thomas Hedges June 11, 1985 Page 2 Ms. Schiela is insisting that similar language be included in the storm sewer assessment agreement at issue here. This would put her in the same position as other persons assessed under the large lot policy, who are not prevented from contesting any increased assessments in the future. On the one hand the City's acceptance of the revised agreement would resolve the matter at this time. On the other hand, it leaves open the possibility of an appeal in the future if the land use changes. The City's appraiser has determined that the property has been specially benefited in the amount of $11,700.00, which exceeds the original proposed assessment of $11,680.00. Our office believes that the change is reasonable and would recommend its approval, given the City Council's decision to reduce the assessment until the land use changes, and given the previous agreement with Ms. Schiela. Because this property is owned by Green Acres, no spread of this assessment has been levied against the property. However, they are concerned regarding their additional liability for this 6-8 months which is listed in the records at the County under their Green Acres deferral. Therefore, they are requesting that this date of final certification accurately reflect the date that the Council approved the negotiated settlement to their special assessment appeal and not the date of the original public hearing from which this original special assessment was subsequently continued. Sale of'any portion of the property, except that if after such sale the property continues to be used only for one single family dwelling as it is currently used, the remaining assessments shall not be levied at such time of sale. Upon any sale the City shall review the,,intended,use,, and if the intended use does not change the current use, the remaining assessments shall not be levied at that time. B. The property is split or platted. C. The property is rezoned for a use other than for one single family use. D.. The property is developed with more than one single family residence. 7. Upon the occurrence of any of the conditions specified in paragraph 6, the City may levy supplemental special assessments against the land described in the attached Exhibit A covering said storm improvements according to the then existing rates being levied by respondent; provided, however, that said rates do not exceed the then "special benefits" to said land. 2 8. The owner Heide U. Schiela hereby waives the right to appeal the assessment in the amount of $5,511.41,-and if said owner does appeal such assessments, this agreement shall be null and-void. . -9. As was related to you by phone call on November 5, 1987, the City's legal counsel is of the opinion that you are not allowed the option of paying off the individual installments; ie the 1983 installment in one year, then the 1984 installment in a later year, and another installment in another year for the five existing assessments on your property. The City's legal counsel believes you could pay off the five installments that have been deferred and the remaining principal from a particular levy. This would probably achieve the same result as paying off one year's installment from a financial standpoint. I have prepared a schedule that shows the payment amount for each levy and its related installments. These amounts are good through November 15, 1987. If you cannot make payment by that date, you should wait until November 15, 1988 to make the payment as the amount would remain constant. The payoff of an individual levy will reduce the total payments made, as interest will stop accruing on that particular balance. If you have further questions, please feel free to contact me. Hauge Page Two October 6, 1981 As I related to you in our recent telephone conversation, the Auditor's Office has indicated that they must be notified prior to October 15th by the City of Eagan of the cancellation of the current assessments and the amount of the new assessments, together with the payment schedule of the new assessments commencing in 1982. Concerning.the damages ghat Ms. Schiela is entitled to as a result of the additional land taken by the City of Eagan for street improve- ments, the City is willing to pay Ms. Schiela $1,000.00 for that addi- tional right-of-way taken. Concerning the damages that Ms. Schiela has sustained as a result of the improvements in question, the City of Eagan will pay Ms. Schiela the sum of $2,981.25 (3/4ths X $3,975.00 - bid of Eagan Excavating Company) for such damages. I would appreciate it if you or another.representative of the City will contact me prior to October 15th, 1981 and confirm that the current assessments have been cancelled and that the new assessment figure has been certified to the Auditor's Office with the first in- stallment commencing in 1982. Lastly, it is my understanding that the assessment figure that has been agreed upon does not pertain to land that currently is under the pond, or land that is beneath the power line going through the Shiela property. Concerning that land, if there is further development on it by way of construction of buildings or purposes of density deter- minations, then that land shall be subject to special assessments according to the then existing rates levied by the City. In essence, the proposed terms of stipulation that were previously forwarded to you, a copy of which I currently enclose for your reference, is agreed to with some modificiation, as mentioned above, and with the deletion of No. 7. I shall attempt to use a map that we have in our file which is a simplified topographical map of the property in question and color that appropriately as Exhibit A, with the payment schedule of Exhibit B being completed on a 20 year schedule at 8% interest, as was the previous assessment figure. As you can see, it is Mr. Metzen's opinion that the property of Ms. Shiela has been benefited in the amount of $13,705.49 which is significantly lower than the $24,991.71 assessment levied against Ms. Shiela's property. I believe that the benefit arrived at by Mr. Metzen is reasonable and fair in light of the amountof property that has not been benefited as a result of the assessments by the City of Eagan. At the pre-trial I had also discussed with you several other matters, concerning the value of the right-of=way that was obtained from Ms. Shiela together with the damages that her property has sustained as a result of having Dodd Road's elevation increased. In addition, she has indicated that when the.right-of-way was obtained the iron fence was taken down and that she has lost an Austrian pine tree which would cost approximately $700.00 to replace based upon the estimate she has obtained. I enclose at this time for your reference copies of estimates from this spring from Fischer Construction and Eagan Excavating Company regarding the filling in of her property to alleviate drainage and runoff problems that have resulted from the elevation increase in Dodd Road. Judge Kluck indicated that the right-of-way question would not be able to be consolidated with the assessments issue at the trial of this matter and on that basis I feel that the other matters that I have mentioned above are all matters which should be considered in determining the value of the right-of-way obtained and the damages sustained by Ms. Shiela as a result of the taking of the property by the City of Eagan.following a resolution of the assessment issue. I would appreciate it if you would forward Mr. Metzen's opinion to the appropriate city officials for their consideration and review. APPROACHES TO VALUE: There are three recognized approaches to value; The Income Approach, the Sales Comparison Approach and the Cost Approach. The first approach is the Income Approach to Value. In this approach the emphasis is placed on the invest- ment potential for the subject property taking into con- sideration the property's past, present and future pot- ential. The second approach is the Sales Comparison Approach or Market Data Approach. Heide (Lauer) Schiela - Project 241 (Dodd Road) Deferment and Reduction Request (Parcel 10 02500 010 52) FACTS The above-referenced parcel is located at 4420 Dodd Road. on September 24, 1980, the City Council officially adopted the final assessment role for Project 241 which provided for the installation of sanitary sewer, watenTain, storm sewer and streets along Dodd Road adjacent to the above-referenced parcel. I am for- warding to you a copy of a letter I received from Mrs. Heide Schiela formerly Mrs. Heide Lauer pertaining to her concerns over her levied assessments. Also attached is a boundary survey representation of her lot overlaid on a topographic map. In addition, we have prepared a spread sheet of the special assessments showing the annual payments resulting from assessments for sewer and water laterals, streets and sewer and water trunk area assessments. The total assessment was derived from the following breakdown: Size of Parcel: 10.56 acres - 20% future easement dedication = 8.45 acres assessable Sanitary Sewer Area Trunk at $590.00 per acre = $4,985.50 Water Area Trunk at $590.00 per acre = $4,985.50 Sanitary Sewer Lateral 417.59 feet at $10.75 per foot = $4,489.09 Water Laterals 417.59 feet at $9.00 per foot = $3,758.31 Dodd Road Street Assessment: 417.59 at $16.22 = $6,773.31 TOTAL STREET AND UTILITY ASSESSMENT: $24,991.71 A ponding area over the eastern portion of this parcel comprises approximately 2.6 acres to the 918.0 high water elevation. This ponding area has not been dedicated as a ponding easement to the City of Eagan. There is a 200' wide power line easement dedicated to NSP along the northern boundary of this parcel encompassing approximately 3.96 acres. However, this incorporates approximately 0.55 acres of the previously discussed ponding easement. Discounting this over- lapping ponding area/NSP easement, the net NSP easement area that will be dis- cussed amounts to 3.41 acres. During the construction of streets and utilities for Dodd Road, additional right-of-way was not dedicated over and above pre- viously-existing 33' half right-of-way. All calculations were based on infor- mation obtained from the Dakota County Surveyor's office. Because the ponding area had not been dedicated to the City, the 2.6 acres were not deducated from the area calculations. In addition, no credit was given for the 200' NSP Power line easement based on past policy pertaining to the availability of this area to be used for required open space and density calculations upon future development of large parcels (5+ acres). Correspondingly, no credit was given for frontage along Dodd Road for this NSP easement for similar reasons. During the easement acquisition process, the City Attorney's office estimated to the best of their knowledge available at that tame what the anticipated assess- ments would be resulting from this project. If the Committee and Council determine that credit should be given, the assessments could be adjusted accordingly. NOW, THEREFORE, in consideration of the mutual promises contained herein and other good and valuable consideration, the receipt and sufficiency of which are hereby acknowledged, the Parties do hereby agree as follows: 1. The Landowner agrees to reassessment of the assessments for the Projects by the City 2. Landowner warrants that she is the sole owner of the Property and that she has full power and authority to make this Agreement. 3. The Landowner may defer payment of the balance of the assessments, together with interest accruing thereon, which balance as of this date equals $47,203.04. The assessment and accrued interest shall be payable in a lump sum payment upon the sale, transfer, subdivision of the Property or any part thereof, whichever occurs first; or the Landowner no longer qualifies for senior citizen's deferral; or the Landowner no longer resides on the Property; or the death of the Landowner; or if the Property should for any reason lose its homestead status; or if for any reason the City Council determines that there would be no hardship to require immediate or partial payment. 4. Upon the occurrence of an event described above, the deferred assessment shall be immediately due and payable. The deferred assessment shall bear interest at the rate of eight percent (8%) per annum, beginning January 1, 2008. 5. Waiver. The Landowner hereby accepts deferred assessments for the improvements in the total amount of $47,203.04. The Landowner hereby waives the right to object or appeal the assessments pursuant to Minn. Stat. § 429.081 and further waives notices and hearings on this Agreement. 6. Binding Effect. APPROVE ASSESSMENT AGREEMENT - 4420 DODD ROAD ACTION TO BE CONSIDERED: To approve an assessment agreement with the property owner (Heide Schiela) for 4420 Dodd Road. FACTS: • State "Green Acres" law permits deferral of property taxes and special assessments for certain agricultural or specialized use property (such as a nursery or a greenhouse). The result of "Green Acres" property tax status is that the property is classified as agricultural and taxed accordingly. Special assessments are deferred with interest until the property is reclassified. When assessments are deferred in this manner, the City assumes the obligation to make bond debt service payments from other taxpayers and/or other revenues. • Dakota County is the governmental agency responsible for determining eligibility for Green Acres status and the City has not taken an active role in eligibility determinations other then to occasionally inquire about a particular parcel and its status. • The property located at 4420 Dodd Road owned by Heide Schiela has lost its Green Acres status and deferred assessments ($46,71104), are now due. • The agreement provides for deferment of the Green Acres balance ($46,713.04) and the remaining balance on one levy still running ($490.00) for a total deferred principal amount of $47,203.04. • Ms. Schiela is eligible for a Senior Citizen deferment and has agreed to the assessment agreement that provides for future collection of the assessment with additional interest. Should the applicant plead and prove, to the satisfaction of the council, that full repayment of the deferred special assessment would cause the applicant particular undue financial hardship, the council may order that the applicant pay within 60 days a sum equal to the number of installments of deferred special assessments outstanding and unpaid to date, including principal and interest, with the balance thereafter paid according to the terms and conditions of the original special assessment. Subd. 4. The option to defer the payment of special assessments shall terminate and all amounts accumulated plus applicable interest shall become due upon the occurrence of any one of the following- A. The death of the owner when there is no spouse who is eligible for deferment. B. The sale, transfer or subdivision of all or any part of the property. C. Loss of homestead status on the property. D. Determination by the council for any reason that there would be no hardship to require immediate or partial payment. (Code 1983, § 2.75, eff. 1-1-83) State law reference-Senior citizens or retired and disabled persons hardship special assessment deferral, Minn. Stat. § 435.193. Sec. 2.76. Partial prepayment of special assessments. Subd 1. Scope. Partial prepayment of assessments in connection with any assessments adopted by the council and certified to the county auditor for collection may be made at any time. Subd 2. Payment. The owner of any property so assessed may, within 30 days of adoption of the assessment roll by the council, prepay any or all of his assessment to the city. No interest will be charged on any portion of the assessment paid within said 30 days. The remaining unpaid balance of the assessment shall be spread at the same rate of interest and for the same term of years as the original assessment. (Code 1983, § 2.76, eff. 1-1-83) Sec. 2.77. Emergency preparedness plan. The council may, by resolution, adopt, from time to time amend, or repeal an emergency preparedness plan for the city. (Code 1983, § 2.77, eff. 1-1-83) See. 2.7& Building numbers. Subd. 1. Building numbers required The owner or occupant of any building fronting upon any street or avenue shall place and maintain on the front thereof the proper building number assigned by the city. CD2:20 ADMINISTRATION AND GENERAL GOVERNMENT § 2.75 extension thereof such other and further conditions and restrictions as the council may deem proper to protect the city's interests, nor shall anything contained in this section limit any right or power possessed by the city over existing franchises. (Code 1983, § 2.72, eff. 1-1-83) State law reference-Municipal franchises, Minn. Stat. §§ 300.03, 300.04. Sea 2.73. Absentee ballot counting board. The council hereby authorizes an absentee ballot counting board and further authorizes the election judges of such board to receive, examine, and validate absentee ballots. The further duties of such board shall be those provided by statute. (Code 1983, § 2.73, eff. 1-1-83) Sec. 2.74. Special assessment policy. The council may, by resolution, adopt, from time to time amend, or repeal a special assessment policy. (Code 1983, § 2.74, eff. 1-1-83) Sec. 2.76._ Deferment of special assessments. 7 Subd 1. The council may defer the payment of any special assessment on homestead property owned by a person who is 65 years of age or older or who is retired by virtue of permanent and total disability, and the city clerk-treasurer is hereby authorized to record the deferment of special assessments where the following conditions are met: A. The applicant must apply for the deferment not later than 90 days after the assessment is adopted by the council. B. The applicant must be.65 years of age or older or retired by virtue of permanent and a-CDQ total disability. c3 C. The applicant must be the owner of the property. D. The applicant must occupy the property as his principal place of residence. E. The average annual payment for all assessments levied against the subject property exceeds one percent of the adjusted gross income of the applicant as evidenced by the applicant's most recent federal income tax reti&n The average annual payment of an assessment shall be the total cost of the assessment divided by the number of years over which it is spread. Subd 2. The deferment shall be granted for as long a period of time as the hardship exists and the conditions as aforementioned have been met. However, it shall be the duty of the applicant to notify the city clerk-treasurer of any change in his status that would affect eligibility for deferment. Subd 3. The entire amount of deferred special assessments shall be due within 60 days after loss of eligibility by the applicant. FIRST JUDICIAL DISTRICT STIPULATION OF SETTLEMENT File No. WHEREAS, the above action is an appeal from certain special assessments levied by the City of Eagan against certain land owned by the appellant in the City of Eagan; and WHEREAS, the parties desire to settle their differences concerning such special assessments upon the terms provided in this agreement; NOW, THEREFORE, in consideration of the mutual covenants herein contained, the parties agree as follows: 1. That Heide U• Schiela is the sole owner of land in Dakota County, Minn- esota, described as follows: All that part of the N1/2 of the SW1/4 and the NW1/4 of the SE1/4 of Section 25, Township 27, Range 23, described as follows: Beginning at the NE corner of said N1/2 of the SW1/4 and running thence North 88° 53' West along the North line thereof 618.68 feet to its inter- section with the centerline of Dodd Road; thence South 04°55'50" West along said centerline 206.59 feet; thence South 12°45'50" West along said centerline 100.00 feet; thence South 20°15' West along said centerline 111.00 feet; thence Squth 79° East 992.7 feet; thence North 01°06'50" East 579.5 feet to the North line of the NW1/4 of the SE1/4 of said section; thence North 88°53' West along said North line 282.45 feet to the point of beginning; which lies within the boundaries of the 80.00 feet strip of land which is described as follows: (SEE EXHIBIT "A" ATTACHED). 2. That the land colored in red on the map attached hereto as Exhibit "B" and incorporated herein by reference has been "specially benefited" by the improve- ments which are the subject of this appeal. 3. That the amount of said special benefits is as shown on Exhibit "C" here- to attached and incorporated herein by reference, which benefits total $13,195.71 and which are to be paid according to the payment schedule shown on said Exhibit "C'. 4. That no special benefits have accrued to the land colored in green on said Exhibit "B", consisting of land under the 200 foot NSP power easement and within the pond thereon, by reason of the improvements which are the subject of this appeal, subject however to the provisions of paragraph 7 of this Stipulation. ? 5. That the assessments which are the subject of this appeal, except as specified in paragraph 2 above, may be and hereby are cancelled, and that the Dakota DISTRICT COURT County Treasurer and the Dakota County Auditor are hereby directed to remove said assessments from their records. 6. That the assessments shown on Exhibit "C" may be and hereby are approved, and the Dakota County Auditor is hereby directed to spread said assessments on appellant's land beginning in the year 1982. 7. That ife the land colored in green on said Exhibit "B" . a. is developed by the acquisition or a building permit for the construction of buildings thereon, or b. is included for the purpose of density determinations the land colored in red on said Exhibit "B", then, and in that event, that portion of the land that is colored in green on said Exhibit "B" that is so used shall be subject to special assessments covering all improvements provided in Exhibit "C", according to the then existing rates being levied by respondent; provided, how- ever, that said rates do not exceed the then "special benefits" to said land. 8. Penalty and interest by reason of nonpayment of the first installment of the special assessments from which this appeal is taken may be and hereby are forgiven. 9. Heide U. Schiela shall hold the City of Eagan harmless from any and all claims relating to the payments made by the City to Schiela under this agreement by any other person who may claim an inter- est or ownership in the lands described in paragraph 1 above. 10. Heide U. Schiela shall be paid $1,000.00 as damages for the permanent and temporary right-of-way required by the City for the o` improvement of Dodd Road adjacent to the above described property, which sum shall be paid and an executed easement conveyed upon execu- tion of this Stipulation. 11. The City shall pay Heide U. Schiela the sum of $2,981.25 as full and final release of any and all claimed or actual damages % C,caused by the City, its contractors or agents, due to the improvement of Dodd Road adjacent to the Schiela property. 12. That the City of Eagan shall replace the survey stakes which were removed from Schiela's property as a result of the improve- ment of Dodd Road. 13.
