RIGHT-O&WAY, DRAINAGE AND UTILITY EASEMENT
IN CONNECTION WITH EAGAN CITY PROJECT NO. 751

THIS EASEMENT, made this - f day of AuGusr 2002, between WEIERKE
TRENCHING & EXCAVATING CO., Minnesota corporation ("fee owner"), and PHILIP T.
LARSON AND SHIRLEY R. LARSON, husband and wife, and KENNETH LEE, a single person,
("contract for deed vendees") fee owner and contract for deed vendees are (hereinafter collectively
referred to as "Landowners"); and the City of Eagan, a municipal corporation, organized under the
laws of the State of Minnesota, (hereinafter referred to as the "City").
WITNESSETH:
That the Landowners, in consideration of the sum of One Dollar ($1.00) and other good and
valuable consideration, the receipt and sufficiency of which is hereby acknowledged, do hereby
grant and convey unto the City, its successors and assigns, a permanent right-of-way, drainage and
utility easement, over, across and under the following described premises, situated within Dakota
County, Minnesota, to-wit:
An easement over, under and across that part of the following described property:
That part of the Northwest Quarter (NW 1/4) of Section Thirty-six (36), Township
Twenty-seven (27), Range Twenty-three (23), Dakota County, described as follows:
Commencing at the Northeast comer of said Northwest Quarter;
thence North 89 degrees 41 minutes 50 seconds West (assumed
bearing) along the North line thereof a distance of 805.84 feet to
the point of beginning; thence continuing North 89 degrees 41
minutes 50 seconds West along said North line a distance of
312.68 feet; thence South 00 degrees 15 minutes 00 seconds West
a distance of 450.80 feet; thence East a distance of 234.50 feet;
k thence North a distance of 164.80 feet; thence North 83 degrees 00

Commencing at the northeast corner of said Northwest Quarter;
thence North 89 degrees 41 minutes 50 seconds West (assumed
bearing) along the north line thereof a distance of 1,118.52 feet;
thence South 00 degrees 15 minutes 00 seconds West a distance of
286.00 feet to the point of beginning of tract to be described; thence
continuing South 00 degrees 15 minutes 00 seconds West a distance
of 164.80 feet; thence East a distance of 234,52 feet; thence North a
distance of 164.80 feet thence West a distance of 233.80 feet to the
point of beginning.
which lies northeasterly of a line hereinafter referred to as Line "A" and described
as commencing at the point of beginning of the above described property; thence
on an assumed bearing of North 89 degrees 41 minutes 50 seconds West, along
said north line of the Northwest Quarter of Section 36, a distance of 90.56 feet;
thence deflecting to the left 100 degrees 11 minutes 13 seconds a distance of
50.80 feet to the southerly right of way line of Cliff Road and the point of
beginning of said Line "A"; thence continuing on the last described line, a
distance of 5.36 feet; thence southeasterly a distance of 156.66 feet along a
tangential curve concave to the northeast, having a radius of 237.00 feet and a
central angle of 37 degrees 52 minutes 25 seconds; thence southeasterly, tangent
to said curve, a distance of 28.55 feet; thence deflecting left I degree 51 minutes
19 seconds a distance of 74.14 feet; thence deflecting right 2 degrees 02 minutes
12 seconds a distance of 11.72 feet to the south line of said above described
property and said Line "A" there terminating.
EXCEPT Dodd Road easement on the east and Cliff Road easement on the north.
Together with:
A temporary easement over, under and across that part of the above described
property lying 15.00 feet westerly of and adjoining said Line "A" described
above.
EXCEPT Cliff Road easement on the north.
The sidelines of said temporary easement are to be prolonged or shortened to
terminate on the south line of said above described property.
Said temporary easement to expire July 31, 2003.

The grant of the foregoing permanent easement for right-of-way purposes includes the right of
the City, its contractors, agents and servants to construct, reconstruct, inspect, repair and maintain a
roadway and erect and maintain signs in conjunction with the public's use of said roadway and
appurtenances and any signs erected in conjunction with the use of the roadway and appurtenances.
The grant of the foregoing permanent easement for drainage and utility purposes includes
the right of the City, its contractors, agents and servants to enter upon the premises at all reasonable
times to construct, reconstruct, inspect, repair and maintain pipes, conduits and mains; and the
further right to remove trees, brush, undergrowth and other obstructions. After completion of such
construction, maintenance, repair or removal, the City shall restore the premises to the condition in
which it was found prior to the commencement of such actions, save only for the necessary removal
of trees, brush, undergrowth and other obstructions.
And the Landowners, their heirs, successors and assigns do covenant with the City, its
successors and assigns, that they are the Landowners of the premises aforesaid and have good right
to grant and convey the easement herein to the City.
IN TESTIMONY WHEREOF, the Landowners have caused this easement to be executed as
of the day and year first above written.

Dear Mr. Pahl:
You recently received correspondence from Mary Granley, City of Eagan Code
Enforcement Technician reminding you of requirements of your interim use permit (IUP)
at the above-referenced location.
Another requirement of the IUP is the removal of the access driveway onto Cliff Road
(Dakota County Road No. 32) after completion of the City's reconstruction of Dodd Road.
This work has now been completed and provides for adequate access onto Dodd Road for
the property. Therefore, the access on Cliff Road must be physically removed within 14
days from date of this letter. A follow-up inspection will be conducted at this time.
A permit to work within the Cliff Road right-of-way is required from the Dakota County
Transportation Department (located in the Western Service Center in Apple Valley). This
permit must be acquired before you commence with the removal. The permit will stipulate
restoration requirements for the ditch along Cliff Road.
