The Parties agree the street improvement costs for the remaining one lot equivalent in the amount of $8,000.00 shall be deferred until the Property is sold, transferred, subdivided or platted, whichever occurs first, at which time the deferred assessment shall be immediately due and payable. The deferred assessment shall bear interest at the rate of five and one-half percent (5.5'%) per annum beginning June 30, 2003. The Parties agree that, notwithstanding anything in this Agreement to the contrary, the deferred assessment and all interest thereon must be paid in full no later than December 31, 2032. 3. Waiver. The Landowner hereby accepts immediate and deferred assessments for street improvement costs in connection with the Project in the total amount of $16,000.00. The Landowner hereby waives the right to object or appeal the assessments pursuant to Minn. Stat. § 429.081 and further waives notice of hearing on this Agreement. 4. Binding Effect.
