This Assessment Agreement ?'A cement") is made this 19th

2003, by and between CLARENCE F. REINKE and LORRAINE F. REINKE, husband and
wife, (hereinafter "Landowner"), and the CITY OF EAGAN, a Minnesota municipal corporation
(hereinafter "City") (hereinafter collectively referred to as the "Parties").
WHEREAS, Landowner is the fee owner of property located in the City of Eagan,
County of Dakota, State of Minnesota and legally described as:
All that part of the Northwest Quarter (NW '/4) of Section 36, Township 27,
Range 23 described as follows: Commencing at a point 2125.85 feet East of the
4 n Northwest corner of said section 36 lying on the north line thereof, thence south at
right angles to said North line distance of 2197.0 feet, thence North 6 degrees 35
minutes East 229 feet to the actual point of beginning, thence continuing north 6
degrees 35 minutes East 250 feet, thence at right angles to the right 225 feet,
thence at right angles to the right 250 feet, thence at right angles to the right 225
feet to the point of beginning.
(hereinafter the "Property").
WHEREAS, as part of Public Improvement Project No. 751R (hereinafter the "Project"),
the City assessed the Property for street improvement costs associated with the street
reconstruction of Dodd Road in the amount of $8,000.00 per lot equivalent; and
WHEREAS, the assessment for the Property is equal to two lot equivalents multiplied by
the assessment rate of $8,000.00 per lot equivalent, for a total of $16,000.00; and
WHEREAS, the Landowner has requested that the City defer assessment of part of the
street improvement costs until subdivision or development of the Property; and
WHEREAS, the City is willing to defer collection of the street improvement costs for all
but one lot equivalent upon the terms and conditions contained herein.

NOW, THEREFORE, in consideration of the mutual promises contained herein and other
good and valuable consideration, the receipt and sufficiency of which are hereby acknowledged,
the Parties do hereby agree as follows:
1. Immediate Assessment. The Parties agree the Property shall be immediately
assessed for street improvement costs for one lot equivalent in the amount of
$8,000.00.
2. Deferred Assessment. The Parties agree the street improvement costs for the
remaining one lot equivalent in the amount of $8,000.00 shall be deferred until
the Property is sold, transferred, subdivided or platted, whichever occurs first, at
which time the deferred assessment shall be immediately due and payable. The
deferred assessment shall bear interest at the rate of five and one-half percent
(5.5'%) per annum beginning June 30, 2003. The Parties agree that,
notwithstanding anything in this Agreement to the contrary, the deferred
assessment and all interest thereon must be paid in full no later than December 31,
2032.
3. Waiver. The Landowner hereby accepts immediate and deferred assessments for
street improvement costs in connection with the Project in the total amount of
$16,000.00. The Landowner hereby waives the right to object or appeal the
assessments pursuant to Minn. Stat. § 429.081 and further waives notice of
hearing on this Agreement.
4. Binding Effect. This Agreement shall be binding upon and inure to the benefit of
the Parties' heirs, successors and assigns and shall run with the land.
