I received your letter and photographs concerning the business that is
operated on the property owned by Al Harp. The letter and pictures will
be kept on file as official records.
I was able to review this issue with our City Planner, Mr. Dale Runkle,
and he informed me that Mr. Harp has obtained a building permit in Hal-
ley's Addition to construct a new facility where he will locate his business.
The building permit has been obtained by Mr. Harp. Mr. Harp has also
submitted an application to the City for a conditional use permit to allow
that business operation and this item is to be heard at the Advisory Plan-
ning Commission meeting on May 26, 1981.
This conditional use permit is for outside storage that would enable Mr.
Harp to store all the equipment and chemicals at the new site which are
presently used in his operation which are presently stored west of his home
and adjacent to your lot.
Since Mr. Harp is attempting to move his business and if it is agreeable
to you, I will not process any complaints or continue any further with
this investigation until after the Planning Commission and City Council
review of this conditional use permit. Assuming the conditional use permit
is approved by the City, it is to be expected that Mr. Harp's business
will be moved and the noise problems will be mitigated as a result of the
business relocation.

Thank you for the excellent and direct manner in which you addressed
and summarized the "Action Courts, Inc." situation March 18 to the
Mayor and City Council members plus those people of our neighborhood
in attendance.
Your fine efforts as City Administrator are appreciated and noted by
us! I personally am also impressed with the positive approach to
matters by Mayor Blomquist and Council members Smith and Hauge.
We would appreciate being kept advised of the "pole barn" request which
we assume Mr. Harp will present. As noted at the March 12 meeting,
location and sound proofing are important considerations. We personally
could not tolerate this structure along our property line which is where
the business plus storage is and has been located. We suggest either
the Southwestern or South Central portion of Mr. Harps' 5 acre parcel
(providing the City approves a permit).

As discussed, I've enclosed current photographs of the
business presently located at 4785 Dodd Road known as
Action Courts, Inc. These photos were taken on recent
Saturday & Sundays and do depict some employee activity.
These should become a part of Mr. Hedges file.
The relocation of this business to Halley's Addition is
acceptable to us. Naturally we expect that this would
mean the total elimination of the use of their 2 Bobcats
(noise nuisance) on this 5 acre property adjacent to us.
Also an early moval of all equipment and other materials
depicted in the photos to the new work site.
On behalf, of my wife and I you can expect me to attend the
May 26 meeting so as to hear the outcome of the conditional
work permit.

In review of the letter and the dates for violations to Al Harp's facility,
City staff cannot question these violations. However, staff would like to
inform Mr. DuBois that Mr. Al Harp has obtained a building permit in Halley's
Addition to construct a new facility where he will locate his business. This
building permit has been already obtained by Mr. Harp. Mr. Harp has also sub-
mitted an application to the City for a conditional use permit which will be
scheduled for the may 26, 1981 Advisory Planning Carmission Meeting. This
conditional use permit is for outside storage in order that Mr. Harp would be
able to store all of the equipment and chemicals which are presently used in
his operation at his present location. In lieu of the violations which have
already been comdtted, if Mr. DuBois could withstand the noise and the opera-
tion for just a short time more, it is the staff's understanding that Mr. Harp
will be relocating his entire business to this location in Halley's Addition,
which is some distance away from the present location. If you have any
questions regarding the applications or permits which Mr. Harp is seeking,
please feel free to contact me for further information.

This confirms our telephone discussion April 27 relative to
the activity at 4785 Dodd Road.
As I write this letter it is 5:10 P.M. on April 27 and at least
4 employees (non-related to Mr. Harp) are busy (and have been all
day) on the premises mentioned above. Also the "Bobcat" is in use
as it has been all day.
Tom, you know I travel for 3M consequently I'm unable to witness
the activity every day. However when deviations from your 3/20/80
letter occur and I'm home, I note this on my calendar.
Here are some specifics:
Nov. 18, 1980
3 employees using the Bobcat from 8:30 A.M. on to load/unload trucks.
Dec. 1, 1980
Bobcat being used during mid-afternoon for 2 hours.
Feb. 17, 1981
Mr. Harp phones my wife while I'm in Des Moines on business saying
we're both crazy and that we couldn't prove trash came from his
property. Earlier in the day she had phoned him to reason about all
the papers and garbage blown/thrown into our yard. (he hunj up).

Because of the constant harassment, received by us over a period
of time and especially since last May, we are prepared to take
any action necessary to totally remove this business from 4785
Dodd Road. I believe we have rights as individuals and that the
business is contrary to City Ordnance.
