AGREEMENT
This Assessment Agreement ("Agreement") is made this NA day of rC-_r4 ZUA2Y ,
2003, by and between RONALD G. ARMSTRONG, (hereinafter 'Landowner"), and the CITY
OF EAGAN, a Minnesota municipal corporation (hereinafter "City") (hereinafter collectively
referred to as the "Parties").
WHEREAS, Landowner is the fee owner of property located in the City of Eagan,
County of Dakota, State of Minnesota and legally described as:
A? Lot One (1), Block One (1), Dodd View Addition, County of Dakota, State of Minnesota.
(hereinafter the "Property")
WHEREAS, as part of Public Improvement Project No. 751R (hereinafter the 'Project"),
the City assessed the Property for street improvement costs associated with the street
reconstruction of Dodd Road in the amount of $8,000.00 per lot equivalent; and
WHEREAS, the assessment for the Property is equal to one and one-third (1 1/3) lot
equivalents multiplied by the assessment rate of $8,000.00 per lot equivalent, for a total of
$10,666.64; and
WHEREAS, the Landowner has requested that the City defer assessment of part of the
street improvement costs until subdivision or development of the Property; and
WHEREAS, the City is willing to defer collection of the street improvement costs for all
but one lot equivalent upon the terms and conditions contained herein.
NOW, THEREFORE, in consideration of the mutual promises contained herein and other
good and valuable consideration, the receipt and sufficiency of which are hereby acknowledged,
the Parties do hereby agree as follows:
1. Immediate Assessment. The Parties agree the Property shall be immediately
assessed for street improvement costs for one lot equivalent in the amount of
$8,000.00.
2. Deferred Assessment. The Parties agree the street improvement costs for the
remaining one-third (1/3) lot equivalent in the amount of $2,666.64 shall be
deferred until the Property is sold, transferred, subdivided or platted, whichever
occurs first, at which time the deferred assessment shall be immediately due and
payable. The deferred assessment shall bear interest at the rate of five and one-
half percent (5.5%) per annum beginning June 30, 2003. The Parties agree that,
notwithstanding anything in this Agreement to the contrary, the deferred
assessment and all interest thereon must be paid in full no later than December 31,
2032.
3. Waiver. The Landowner hereby accepts immediate and deferred assessments for
street improvement costs in connection with the Project in the total amount of
$10,666.64. The Landowner hereby waives the right to object or appea! the
assessments pursuant to Minn. Stat. § 429.081 and further waives notice of
hearing on this Agreement.
4. Binding Effect. This Agreement shall be binding upon and inure to the benefit of
the Parties' heirs, successors and assigns and shall run with the land.
