ASSESSMENT AGREEMENT
This Assessment Agreement "'Agreement") is made this 25t?' dav of September, 2003, by
and between DAVID A. KOLHOFF and HEIDE J. KOLHOFF, husband and wife, (hereinafter
"Landowner"), and the CITY OF E.1GAN, a Minnesota municipal corporation (hereinafter
"City") (hereinafter collectively referrei to as the "Parties").
WHEREAS, Landowner is the tee owner of property located in the Cit}? of Eagan,
County of Dakota, State of Minnesota and legally described as:
Lot Two (2) and Lot Three (3) except that part thereof described as follows: Begimring at
the Northwest corner ef said Lot Four (4) in Block Three (3), thence West 100 feet to the
West line of said Lot Three (3) in Block TYiree (3), thence Southerly a:ong said West line
100 :eet to the Southwest corner of said Lot Three (3) in Bloek Thrae (3), thence East on
the South line of said Lot Three (3) in Block Three (3) 100 feet to the southeast comer
thexcof, thence Northerly o,1 the East line of said Lot Three (3) in Block Three (3), 100
feet to the point ofbeginning and there terminating, all in Block'[l?ee (3) Dodd View
Addition, Dakota Counry, M;nnesota.
(hereinafter the "Property").
WHEiLEAS, as part of Public Iriprovement Pro,iect No. 751R (hereinafter the "Project"),
the City assessed the !'roperty for .:treet improvement costs associated ,.vith the street
reconstruction of Dodd Road in the aniou it of $8,000.00 per lot equivalent; and
WHEREAS, the assessment for the Property is equal to two (2) lot equivalents multiplied
by the assessment rate of $8,000.00 per lot equivalent, fox a total of $16,000.00; and
WHEREAS, the Landowner has raquested that the City defer assessment of part of the
street improvemenC costs until sabdivision, platting or development of the Property; and

WHEkEAS, the City is wl!ling to defer collection of the street improvement costs for all
but one lot equivalent upon the ternis and conditions contained herein.
NOVJ, THEREFORE, in consideration of the mutual promises contained herein and other
good and valuable consideration, the receipt and sufficiency of which arz hereUy acknowledged,
the Parties do hereby agree as follovfs:
L Immediate Assessment. Contemporaneously with Lhe execution of this
Agreement, the Lando Nner shall make an immediate payment in the amount of
$8,000.00 for the stree improvement costs for one lot equivalent. The CiYy
hereby waives any accrued interest.
2. Defexced Assessment. The City hereby defers payment far the remaining one (1)
lot equivalent in the amount of $8,000.00 until the Property is subdivided, platted
or developed, at which time the deferred assessment shall be immediately due anda ?

payable. For purposes of thia Agreement, developrngp't o?e}P,r??Q ?[y shall mean
the issuance o1 a buiiding permit for the construction oAR;_ng e-family home.
The deferred asssssment shall bear interest at the rate of five :jnd one-half percent ?
(5.5%) per annum beginning October 1, 2003. Notwithstwding anything in this ?
Agreement to 1he contrary, if the Property is not subdivided ar platted befoxe
Decembex 16, 2032, then the Landowner shall have no obligation to pay the
Ueferred Assessmenf.
3. Waives. The Landowner hereby accepts immediate anc deferred assessments for
sneet improvement costs in connection with the Pxoject in the total amount of
$16,000-00. The Landowner hereby waives the riglit to object or appeal the
assessments pursuant to MINN. STAT. § 429.081 and further waives notice of
heazing o» this Agreement.
4. BindinQ Efiect This Agreement shall be binding upon and inme to the benefit of
the Parties' heirs, successars and assigns and shall run with the ]and.

the South line of said Lot Three (3) in Block Three (3) 100 feet to the southeast corner
thereof, thence Northerly on the East line of said Lot Three (3) in Block Three (3), 100
feet to the point of beginning and there terminating, all in Block Three (3) Dodd View
Addition, Dakuta County, Minnesota.
(hereinafrer the "Property").
WHEREAS, as part of Public Imgrovement Project No. 751R (hereinafter the "Project"),
the City assessed the Property for street improvement costs associated with the sh-eet
reconstruction of Dodd Road in the amount of $8,000.00 per lot equivalent; and
WHEREAS, the assessment for the Property is equa] to two (2) lot equivalents multiplied
by the assessment rate of $8,000.00 per lot equivalent, for a total of $16,000.00; and
WHEREAS, the Landowner has requested that the City defer assessment of part of the
street improvement costs until subdivision, platting or development of the Property; and
WHEREAS, the City is willing to defer collection of the street improvement costs for all
but one lot equivalent upon the terms and conditions contained herein.
NOW, THEREFORE, in consideration of the mutual promises contained herein and other
good and valuable consideration, the receipt and sufficiency of which are hereby acknowledged,
the Parties do hereby agree as follows:
Immediate Assessment. Contemporaneously with the execution of this
Agreement, the Landowner shall make an immediate payment in the amount of
$8,000.00 for the street improvement costs for one lot equivalent. The City
hereby waives any accraed interest.
2. Deferred Assessment. The City hereby defers payment for the remaining one (1)
lot equivalent in the amount of $8,000.00 until the Property is subdivided, platted
or developed, at which time the deferred assessment shal] be immediately due and
payable. For purposes of this Agreement, developqm?nt $ro? rty shall mean ?"
the issuance of a building permit for the construchon°' o(?s?ngl? family home.
The deferred assessment shall bear interest at the rate of five and one-half percent
(5.5%) per annum beginning October 1, 2003. Notwithstanding anything in this /
Agreement to the contrazy, if the Property is not subdivided or platted before
December 16, 2032, then the Landowner shall have no obligation to pay the
Deferred Assessment.
Waiver. The Landowner hereby accepts immediate and deferred assessments for
street improvement costs in connection with the Project in the total amount of
$16,000.00. The Laudowner hereby waives the right to object or appeal the
assessments pursuant to Mnvrr. S'raT. § 429.081 and further waives notice of
hearing on this Agreement.
4. Bindin Eg ffect. This Agn:ement shall be binding upon and inure to the benefit of
the Parties' heirs, successois and assigns and sha11 run with the land.

Enclosed please find three original Assessment Agreements for the Kolhoff matter. Please place
this matter on the next City Council agenda for approval by the City Council. We have also
received a check in the amount of $8,000.00 from Mr. and Mrs. Kolhoff, which is being sent to
Tom Pepper.
Under the Agreement, the Kolhoffs will pay the one lot equivalent ($8,000.00) in full and the
City agrees to waive any accrued interest. The other lot equivalent will be deferred with interest
commencing October 1, 2003. Assuming that the City Council approves the Agreement, please
have the Mayor and Clerk sign and initial on page 2 of the Agreement.
Note to Tom Pepper, please do not cash the $8,000.00 check until the City Council has approved
the Assessment Agreement. Sliould you have any questions conceming this matter, please feel
