TEMPORARY CONSTRUCTION EASEMENT
This easement, made this21day of 6£? , 2007, between Mark T. Parenteau
and Dorothy M. Parenteau, husband and wife, ereinafter referred to as "Landowner"), and the
City of Eagan, a Minnesota municipal corporation, organized under the laws of the State of
Minnesota (hereinafter referred to as the "City").
WITNESSETH:
That the Landowner, in consideration of the sum of One Dollar ($1.00) and other good and
valuable consideration, the receipt and sufficiency of which is hereby acknowledged, does hereby
grant and convey unto the City, its successors and assigns, a temporary construction easement for
drainage and site grading purposes over and across the following described premises, situated
within County, Minnesota, to-wit:
SEE ATTACHED EXHIBIT "A"
The grant of the foregoing temporary construction easement for drainage and site grading
purposes includes the right of the City, its contractors, agents and servants to enter upon the
premises at all reasonable times to construct, reconstruct and inspect drainage improvement and site
grading and the further right to remove trees, brush, undergrowth and other obstructions. After
completion of such construction, maintenance, repair or removal, the City shall restore the premises
to the condition in which it was found prior to the commencement of such actions, save only for the
necessary removal of trees, brush, undergrowth and other obstructions, subject only to permanent
easement alterations. Said easement to expire November 1, 2009.
The Landowner, their heirs and assigns, does covenant with the City, its successors and
assigns, that it is the owner of the premises aforesaid and has good right to grant and convey the
easement herein to the City.
IN TESTIMONY WHEREOF, the Landowner has caused this easement to be executed as
of the day and year first above written.

I told Dale we will not require the property at 4895 Dodd Road to be platted in order to issue a
Building Permit for an open-air deck. The rationale is that the deck addition does not expand
the footprint of the home or add additional impervious surface to the lot.
There could be similar but different scenarios that could result in a different view, I suppose,
but in this case I think the reasons stated support issuance of said permit.

I've done same as Sarah, although we've also said they can replace a deck, because even though it requires a building
permit, it's replacing what's already there. According to the memo, we anticipated the situation where upon
replacement of a deck, someone might want to expand it at that time too, and agreed that was reasonable if the
expansion met setbacks and other standards. The question on this one is constructing a new deck where there wasn't
one before. It is a bit of a gray area, which we also anticipated we would run into, and said those would need to be
decided case by case.

I've always told people a Building Permit is when the requirement kicks in, unless it's for maintenance such as a reroof,
window replacement, etc...

I would say adding a deck is different than expanding an existing and they should have platted. However, it is a
structure, but not a building, does that weigh in at all?
I also don't think it matters as to the size of the lot.
Aaron and I have talked with this guy many times but it's probably been a good year now. He is wanting to subdivide
but I'm unsure of the timeframe.

Is there any exception on the platting policy for larger lots? 4895 Dodd Road is a gross 5 acre lot, net 4 acres, where
they are building a new deck. Inspections already issued the building permit, and upon getting the first inspection lined
up,Terry noticed the property is unplatted. The deck meets all other standards. The policy memo on platting for
building permit says there could be some gray areas to be considered case by case. I'm wondering if this is one of those
cases and if they absolutely have to plat. The policy memo says we can allow replacement and expansion of a deck if it
meets all other standards. Is adding a deck where there was none before that much different than expanding a deck, if
it meets all other standards? It is not a 4-season expansion of the building envelope, and the property is large enough
that it is likely to be subdivided and platted at some point in the future.
