Dear Rosemary Tarnowski:
This is in response to your request to extend your existing deck.
You have authorization of the BriarHill Homeowners' Association
(BHA)Board of Directors to extend your deck as follows:
The deck cannot extend further then the corner of the house and not
further out from the house then the existing deck and must be
cosmetically identical to the current structure. The deck must be built
using 2"x lo" treated joists, and 4"x6" treated support posts, with deck
flooring 5/4 treated or cedar lumber which must be attached with screws
not nails to the joists. The screws must be stainless steel or galvanized
decking screws and must be properly countersunk into the joists, using
two screws per board per joist. The support posts must be placed or
seated on at least a 48" frost footing or as per City of Eagan codes.
Also, the deck ledger boards must be lag screwed to the existing
structure, as well as properly "Z "flashed to prevent premature rotting
of ledger board and existing siding.
Additionally, you must purchase landscaping film and Bryan red rock, to
place under the extension to a depth of three (3) as grass will no longer
grow there. The BHA, requires, you use a clear or colored deck stain,
specifically designed for wood, and apply it to the flooring every year
or two as needed to protect the flooring and to maintain it, as it will
prevent harm caused by the elements. The floor will not be painted, as
paint does not hold up on a horizontal surface exposed to the elements.
Last of all, the tree located at the corner of the house, by the chimney
will not be removed or replaced at the associations expense should it die
as a result of the work being done.

The Northwesterly ten (10) feet of Lot 21, Block 1, as measured at
right angles from the northwesterly line of Lot 21, Block 1, Briar
Hills 3rd Addition, Dakota County, Minnesota.
NOW THEREFORE, the said Grantor, in consideration of One ($1.00) Dollar
and other good and valuable consideration to it paid by Grantee, receipt
whereof is hereby acknowledged, hereby conveys, warrants and dedicates to said
Grantee, its heirs and assigns, for trail puroses, together with the
