After inspection of the area and conversation with a worker on site we verified that blacktop was removed from an area of the property where black dirt was once stored. This blacktop extension running up the hill was to prevent soil from being cut away by bobcat equipment and to separate the soil at the hillside from the storage pile of black dirt. There was no extension of the blacktop or additional blacktop added to the area. A photo is enclosed for your perusal. The condition of the Richfield Blacktop business area seemed quiet and there were no violations of CUP's noted at this time. Premier will use 41 grade red cedar for construction materials which is substantially more durable than green treated wood as well as providing a better appearance. Premier will also use stainless steel fasteners which will not bleed through. The dark running marks on fences are caused by bleeding of the fastening materials. They will also provide a 5 year written warranty as well as a more detailed construction bid, leaving little room for misunderstanding of the construction standards and a quality product. Since we will be responsible for maintenance of the fence, we believe that the additional cost of $100, split between us, is more than justified. We would appreciate a check made out to Premier Fence, Inc. for $1375 (50% of the total cost of the fence) be sent to us as soon as possible so that we can lock in the bid, pay the down payment and set up construction dates. Your check will not be cashed until completion of the project. It is our understanding that construction dates are about 3-4 weeks out at this time. Johnson and Penny Johnson, as individuals, and as doing business as Richfield Blacktop, (the "Johnson"). The issues that are addressed are those which are the subject of various meetings between the Killers and the City Staff for the City of Eagan and they deal with the operation of the business conducted by the Johnsons.and are the subject of four separate Conditional Use Permits that were issued for the following businesses: operation of V-Haul rental trucks operation of auto service and repair outside storage of materials and equipment Installation of a pylon sign. whatever concerns the Millers have had regarding the rental truck business ware basically those of general city business and were not personal to them and the issue of the number of units to be stored is no longer an issue and that matter has been resolved to the extent that the Millers have any concern regardinq the operation of the U-Haul rental truck business. The Johnson were unable to put together the requisite siting or planning for the pylon sign and the Conditional Use Permit expired. The Johnsons had agreed to consult with Northern states power to eliminate whatever interference that their lighting system has with the Millers enjoyment of their property. Mr. Miller has also indicated that one of his clients is in the lighting business and that he is prepared to provide the Johnson with information through his client of the appropriate shading that will eliminate the glare. This issue can be resolved-between the parties or through Northern states Power and that matter shall be left to the parties. The parties have agreed to fence the rear of the Johnson property which also is the rear of the Miller property. The fence Will be 8 feet tall, loo feet in length and the Met Of the fence will be divided 50t by the Millers and 50% by the Johnson . In consideration of the Millers paying for Sot of the cost of the fence, the Johnson grant to the Millers the right to prune the trees that are on the Johnson property to allow for the growth of the younger trees. Currently the outside storage of landscape material is located at the north and of the property and to the rear of the customer and employee parking which is at the north end of the existing building. The Killers have expressed concern for this location and have requested that the Johnsons consider moving it to the soutbweet corner at the property where the V-Haul rental equipment is displayed. Because of the topography and other concerns, the Johnsons do not conceive this as a feasible alternative. The parties have agreed that the operation shall continue as it is presently, with the understanding that the parties shall feel free to consult with each other if there are noise problems that occur an a repeated basis.
