Warmka at 3345 Donald Avenue regarding a business which is apparently operating next
door to his home. Please see me regarding this item and plan on having one of the
Project Planners follow up with this matter. I have promised Mr. Warmka that we will give
him a response as to our alternatives within the next several weeks. Please track this
item so we can forward correspondence to him in that time. We probably will not have
the issue resolved by that time, but I would like to keep them informed due to the nature

My letter is in regard to a company called "Maxi-Vend Inc." I have
attached a copy of their ad from the Yellow Pages.
The address Maxi-Vend lists is 3351 Donald Avenue, which is next
door to me. My wife and I have lived at 3345 Donald Ave. since we
bought the house in late 1989. No one has lived in the house at 3351
Donald Ave. since we have lived there. There may have been a few
nights in the last three and a half years that someone has stayed
there, but no one lives at the house. This, alone, doesn't bother me
too much, they keep the place somewhat tidy, what my complaint is
is having a commercial business next door when it's supposed to be a
single family home. Maxi-Vend is certainly not a "home-based
business." There is an enormous detached garage in the back yard
which is used as a warehouse in addition to the house garage, and
there is at least one employee who comes to work every morning,
loads his truck, runs his route, and returns in the afternoon.
I am asking you, as my city representative, to ensure that this
property does not have continued use as a commercial property. If
this is not within your scope of responsibility, please advise me who
is responsible for such things.

to; discontinue all small business activities at my home.
Mayor Thomas Egan and Council Members:
I need your help. This is my side of the dilemma.
In the Spring of 1988 I was looking for a house to buy that had
a large garage, or land around it that a large garage could be
built near the house. My realator found a house at 3351 Donald
Ave. He showed me the house, and I liked it. On or about April 21 st.
1988 I walked into the Eagan City Hall, and asked the receptionist
who I should talk to about what Eagan allows, concerning building
a garage in a back yard. She said that would be Shannon, and called
her to the front area. Shannon said building a large garage in
the back yard was ok, but Eagan only allows you to have buildings
on 20% of your land. Then I told her that I had a small vending
route, and when the temperature got up into the high 80's and 90's
the chocolate candy bars got soft and melted. Then in winter the
pop would freeze. So I needed the garage to park my vending van
inside, store some pop, personal items, boat, motor, tools, lawn-
mower, and whatever else needed storing. I figured that a garage
36' wide x 46' deep x 12' high with a door 11' high, would be
what I wanted to build. I asked Shannon if it was against city
rules to do what I wanted to do, ie: parking my vending van in
the back yard garage and storing those items, because I did not
want any one complaining about me having a small business at my
home. Shannon said that there would be no problem as long as;
1. There was no sign on the property with the name of the
business.
2. There could be no customers coming or going.
3. Structures on the lot could take up no more than 20% of
I
the square footage of the land.
She told me these things 2 or 3 times and gave me an application
for a building permit to look at. I left the Eagan City Hall
feeling great about Eagan, and the progressive attitude Eagan
had towards the small buisness person who was trying to get a
small buisness off the ground and could not afford both a house
and separate commercial space.
I decided to go ahead and buy the house. My purchase offer
was accepted, and we closed the sale on June 28, 1988.
In April of 1989 I came back to the Eagan City Hall to find
out the procedure for getting a building permit. I was told that
Shannon was the person to talk to. Shannon gave me information
on set-back requirements, height restricttions, lot coverage-20%,
easments, footings, and other construction requirements for
garages @ ( polebuildings). Shannon also gave me another applica-
tion form to fill out for a building permit. At this time I also
reminded Shannon of our discussions a year earlier, about parking
my vending van, and storing some pop in this garage. I asked
if anything had changed as far as rules or ordinances were
concerned, because I did not want to be in trouble if a neighbor
complained. Shannon told me the same thing she said a year earlier;
1. There could be no sign on the property.
2. There could be no customers coming or going.
I said that was great news, because it fit in perfectly with my
vending route. 98% of my work is done away from home. I mainly
just need a place to park the van when it is not in use, so the
candy bars do not melt in summer, and the pop does not freeze
in winter.
I asked Shannon to write out a little memo about it being
OK to park my vending van and store some pop in the new garage.
She thought for a moment and then said, "Don't worry everything
will be perfectly fine as long as ;
1. You have no sign on the property.
2. You have no customers customers coming or going.
So I said OK and left to fill out the application. As I was
leaving, I decided that the memo was not really needed, the
approved building permit for a garage 36'x46'x12' would be plenty
of proof, that it had been discussed by the powers that be and
approved. Shannons title was assistant to the Zoning Commissioner.
So she would be there to explain what I wanted to do with a garage
that size.
My building permit was approved and I paid the $402.50 on
5-10-89. That summer the garage was completed, and I have been
using it ever since.
I try to be a good neighbor- very quiet. No customer has ever
been to my house. No sign anywhere, not even on any car or van.
If a salesman calls and wants to meet with me. I try to set up a
meeting away from home. About the only outward sign of business
activity is when the van leaves the driveway in the morning, or
comes home at night. I have a lot of big trees in my yard, that
make it very hard to even see the garage from the street.
There are a number of money making enterprises all around my
house. The biggest enterprise is across the street and down
block. Bunker Hill Apartments is probably taking in 1'z to 2
million a year. My living room window looks out on a street of
4 plexes, some are rented out. There are guys with lawnmowers on
trailers on each side of me. Snowplows in winter. The big diesel
buses pick up passengers and drive up and down Donald Ave.in
front of my house. I am sure there are many more small businesses
being operated from homes, such as Mary Kay Cosmetics, Avon,
Shackley, and Amway. All night long, you see ads on cable TV for
businesses you can do at home. The information Mike Ridly sent
me, makes it look like nothing is allowed, on my side of the street.
Mike Ridley said that I should write a letter to the Mayor
City Council, explaining what I told him. He also said that the
present ordinance concerning what you can and cannot do in your
home,(business wise) was passed way back in 1983.
I think living and working conditions have changed quite a bit
in recent years. Computers allow people to do more and more work
at home. It is also much more expensive to live now. Since
building the garage in 1989 my property taxes have tripled.
I would like to see the ordinance up graded to allow more
flexability for people to operate a small business out of their
home. I grew up living next door to a man with a painting
business. He would be out in his driveway first thing in the
morning loading paint cans, brushes, rollers, and drop cloths.
It never even occured to us to complain about his small business
to the city. He was not bothering us.
I asked Mike Ridley what specific things I was doing that
bothered someone. Mike said there was nothing specific, in the
complaint, just that I had a small business at home.
I heard a professor, who had written a book, on the radio a
while back. He was saying that 20 years ago one person working
could support a family. Now it takes two incomes to make it, and
in a few years, it will take three incomes to make it. If housing
costs, food, gas, utilies, taxes, etc. keep going up, it will
take three incomes to pay the bills. To me that means, just
about everyone will need a second job or a small business they
can do out of their home.
