Dear Mr. and Mrs. Pintozzi:
This office serves as legal counsel for the City of Eagan. We have been provided with copies of
coaespondence sent by the City's Water Resource Coordinator, Eric Macbeth, to yoix dated July
26, 2007 and September 11, 2007 (copies enclosed). The City has provided us wiih a copy of the
conservation easement dated May 3, 1988 and requested us to determine whether the placement
of the stairs and patio azea (see enclosed pictures) within the conservation easement azea is a
violation of the restricuons contained within the conservation easement.
Puisuant to paragraph l(A), you ace prohibited from constructing, installing, storing or
maintaining anything made by man, includang but nat limited to buiidings, structuses, fences,
walkways, clothes line poles, and playground equipment, except that temporuy seasonal docks
shall be permitted.
Accordingly, the city is requesting that you remove the stairs and patio area no later than May 1,
2008. Please note that because the removal of the stairs and patao area will significantly disturb
the easemeni area, we would request that you make contact with the City's Water Resources
Coordinator, Eric Macbeth, at (651) 675-5306 to develop a plan for the removal of the stairs and
patio area and appropsiate restoration of the conservation easement area.
A representative o£ the City will conduct an inspection in May, 2008 to make certain that the
stairs and patio area have 6een cemoved and that you are in compliance wiih the conservation
easement. Please be advised that if you fail to remove the stairs and patio area, we will request
that the City Council direct our office to seek all available legal remedies to make certain fhat the

Harvey's Heritage Addition obtain utility permits you can invoice
the energy cost to the homeowners for said Lots 2, 3, 4 and 5,
Block 1 also. (See attached map.)
A streetlight was installed by Dakota Electric to serve this plat
when Braun Court was constructed under City of Eagan Public
Improvement Project 487R and Dakota Electric is currently billing
the City for the energy cost.

I am a property owner in the Drexel Heights Addition currently being
completed near the City Hall on Fish Lake. It has come to my attention
that one of the existing property owners bordering Drexel Court on the
West side of the street is keeping heavy industrial equipment and trash
on his property. This is obviously a serious eyesore since several
potential buyers of my lot have not made offers "because of the garbage
and heavy equipment in the area."
Please have the City Council take whatever measures that are necessary -
to enforce the zoning ordinances in that area.

the boulevard width is not the standard due to the fact that
the center line of the street was shifted to the east during
construction due to the topography. Therefore, lot corners,
construction as-built surveys, etc., will have to be evaluated
to determine if a violation exists.
It would be appreciated if this information could be made available
by July 12 so that it can be forwarded to the Council with our
next packet.

During the several neighborhood meetings regarding the proposed
improvement of Braun Court, there was considerable discUSSion
regarding the allocation of costs associated with this street in
relationship to the proposed future development (Harvey's
Heritage Addition) of the unplatted parcel (010-52) to the north
of the Braun Sunrise Addition.
The feasibility report for Project 487R which was approved by
Council at the July 7, 1987 public hearinq, proposed to allocate
the assessments for street improvements equally on a per lot
basis, assuming three lot equivalents for the proposed Harvey's
Heritage Addition and three lot equivalents between Lots 1 and 2
of the Braun Sunrise Addition (six lot equivalents total).
As a clarification, the file should reflect that the proposed
Harvey's Aeritaqe Addition should be assessed for 50% of the cost
of the street to be spread over however many ultimate lots have
frontage on the proposed Braun Court.
The remaining 50% of the street improvement cost would then be
divided equally by the three lot equivalents (L.E.) to Lot 1(2
L.E.) and Lot 2(1 L.E.). If Lot 1 were to subdivide more than
the proposed two lot equivalents, each lot that would take direct
access to Braun Court would share equally in the 50$ cost of the
Braun Court street cqnstruction.
All other assessment allocations for other types of improvements
remain as discussed in that feasibility report for Project 487R.

This letter is in response to questions and complaints that have arisen re-
garding the manner in which Mr. Braun is using his property. Mr. Braun, who
is in the contracting business, owns several aeres immediately south of Fish
Lake and stores equipment and materials on that property. We understand Mr.
Braun has been living in this area since the 1950s. Property owners in the
Drexel Heights Addition, which is immediately east of the Braun property, and
others have objected to the manner in which Mr. Braun is keeping his property.
These ad,jacent areas have been developed within the past 10 years.
COUNCIL HISTORY
This matter has been before the Couneil on previous occasions. At the April
17, 1984, Couneil meeting, Mr. Braun gave assurances that during the month of
May the property would be improved to the neighbors' satisfaction. This
matter was also before the Council on June 19, 1984, as the promised clean up
did not take place. As a result of that meeting, a list of 13 improvements to
be made to the Braun property was developed. Those listed improvements were
to be substantially completed by August 31, 1984. It is our understanding
that the listed improvements have not all been completed. Once again the
neighbors have raised complaints.
USE
A.noneonforming use is defined by Seetion 11.03, Subdivision 52 of the City
Code as a use of land, building or struetures which does not comply with all
the regulations of the City Code governing the zoning district in which sueh
use is located, adopted subsequent to the initiation of said use. It is
essential to the right of a nonconforming use that the use began before the
restriction was imposed upon it, and that it existed when the restrietion
became effective. This determination is often a question of fact. Noncon-
forming uses which begin after a zoning regulation or restriction is imposed
are not entitled to protection from compliance with its provisions.

The problem which arises in regard to the use of the Braun property is two-
fold. First, a question exists whether or not the land use was initiated
prior to the adoption of the City Code or its predecessors. This has a
bearing on whether or not the property is entitled to nonconforming use
status. If a further examination of the history of the use of the Braun
property indicates that the use did indeed begin after zoning restrictions had
been adopted, the property should not be considered a nonconforming use and
would be in violation of the current zoning restrictions regarding agricul-
turally zoned property. While a long and continued violation of an ordinanee
will not ripen into a preseriptive right, the permissive use over a long
period of tiroe is sometimes evidenee of a policy of interpretation. This
could present a problem in that the property has been used in this fashion for
over 20 years and the City has not attempted to enforee its zoning regulations
before now. Secondly, should the Braun property be considered a nonconforming
use under the current City Code, what impaet does that determination have on
the City's ability to regulate that land use.
Section 11.10, Subd. 3(A) of the Code provides in part that the adoption and
the provisions of this Chapter shall not prohibit a continued use or expansion
or rebuilding of any use or 6uilding existing upon the date of adoption of
this Chapter which would have conformed to the provisions of any prior Code.
What this means is that any land use which was a permitted use under any old
zoning ordinance or zoning provision cannot be prohibited by the adoption of a
new zoning ordinance or provisions. However, subparagraph C of the same
subdivision states that any nonconforming use that is not subject to the
provisions of subparagraph A shall not be altered or expanded unless speci_
fically approved by the Council. This means that a noneonforming land use
whieh was nonconforming or not permitted under any prior zoning ordinance or
provision would continue to be nonconforming or not permitted under the new
Code and any alteration or expansion would need the specific approval of the
City Council. A violation of this Code provision is punishable as a misde-
meanor pursuant to Section 11.99.
OTHER VIOLATIONS
Other provisions may be applicable depending upon the nature of the storage at
the Braun property.
A. Chapter 10, Section 10.21, Maintenance of Private Property, provides in
part, that it is the primary responsibility of a property owner to remove
all public health and safety hazards from his property or the City may
cause such work to be done after seven (7) days notice has been given.

B. Chapter 10, Section 10.51, provides that it is unlawflal to park or store
any unlicensed, unregistered, or inoperable motor vehicle, household
furnishings or appliances, or parts or components thereof on any proper-
ty, unless housed within the lawfully erected building. Any violation of
this section is declared a nuisance and upon seven (7) days notice to the
owner, the City may remove the same and certify the cost as any other
special assessment. The removal of a motor vehiele stems from Minnesota
Statutes Section 168.B which applies to unregistered or inoperable motor
vehieles. Once there is a determination that the vehicle is either not
registered or that it is inoperable, the vehicle may be removed and
disposed of pursuant to City Code Section 2.70 which outlines the proce-
dures for the sale of abandoned motor vehicles. A violation of either
Seetion 10.21 or 10.51 is deemed to be a misdemeanor pursuant to Section
10.99.
C. Chapter 11j Seetion 11.10, Subd. 19• states that the Council may direct
the removal or otherwise limit the parking of any large vehicle upon or
adjacent to any residential use where it is determined that said parking
has a detrimental effect upon residential use. Said large vehicles ahall
include, but not be limited to, buses, motor homes, cruisers, or trucks.
D. Chapter 11, Section 11.10, Subd. 20 requires that every boundary line
fence shall be maintained in a condition of reasonable repair and shall
not be allowed to become a public or private nuisance. A violation of
either of these sections is deemed to be a misdemeanor pursuant to Sec-
tion 11.99 of the City Code.
PUBLIC NUISANCE
Minnesota Statutes 609.74 and 609•745 make it a misdemeanor for a person to
permit property under his control to be used to maintain a public nuisance.
The statute defines a public nuisance as a condition which unreasonably
annoys, injures, or endangers the safety, health, morals, comfort, or repose
of any considerable number of inembers of the public. The general rule is that
a 3unkyard is not a nuisance merely because it is a junkyard. It has also
been held that offending the aesthetic sensibilities of the persons living in
the neighborhood, standing alone, is not enough to constitute a junkyard a
nuisanee. From the limited number of people affected by the Braun property,
it is unlikely that the public nuisanee provisions could be applicable in this
instance. There are, however, private nuisanees which may be abated by
private laWSUits. Minnesota Statutes 561.01 create an aetion for nuisances
which are defined to include "anything which is injurious to health, or inde-
cent or offensive to the senses, or an obstruction to the free use of
property, so as to interfere with the comfortable enjoyment of life and
property" These aetions could be undertaken by people whose property is
in3ured or whose personal enjoyment is lessened by the nuisance.

In conclusion, the following options are available to the City:
l. Continued monitoring of progress on the listed improvements which were
agreed upon last June and a gentle prodding of Mr. Braun to complete
those improvements;
2. Further research into the history of the use on the Braun property with
particular focus on the date with which Mr. Braun began his use of the
property in relation to the particular zoning provisions which were in
effect at the tiroe. This would facilitate a final determination of
whether the Braun property is entitled to a nonconforming use status;
3. Inspection of the property to determine whether any public health or
safety hazards exist, or if any of the property covered by Seetion 10.51
of the Code, such as inoperable motor vehicles or household furishings,
are being stored, as well as to aseertain the condition of the fences on
Mr. Braun's property.
If theae conditions exist, the City may order Mr. Braun to conduct the appro-
priate cleanup operations, issue citations, or after appropriate notice the
City may have the work done on their behalf.

On September 26, 1984, I did a personal inspection of the proposed
storage site. In this review, my personal comments are that a sub-
stantial amount of work has been done to rectify [his storage area.
Much of the scrap wood, cans, etc., have been removed completeLy
and [he storage on the site is stacked up neatly versus the original
condition. Also, berms have been installed on two to three sides
of the property and it is Staff's understanding that a fence will
be constructed in this area. The fence has not been constructed
to date,hopever,it will be one item that will be continued to be
worked on and, hopefully, once this fence is erected the issue will
be resolved for screening.
I have also contacted Mr. Sob Braun and informed him that we are
still receiving complaints about this storage area and that he is
still working at completing this project as soon as possibLe. Mr.
Sraun has indicated to the City that he will contact Mr.
Walz regardi-ng timing and working a compromise as to when this
area will be cleaned up and hopefully this will resolve the issue
between Mr. Braun and Leonard Walz. At this time I have not sent
a letter Co Mr. Braun or Mr. Walz. I have con[acted Mr. Braun with
his intentions of contacting Mr. Walz regarding this issue.
I will follow up on this item to see where it stands prior to the
October 16, 1984 City Council meeting.

up the subject parcel that this item be complied with first prior
to getting into the rest of the overall cleanup. Hopefully, you
will take this concern and immediately remove the dead trees from
the property to show good faith with the neighbors. It was
pointed out at the July 2, 1984, Council meeting that this was the
pi'iority item and should be remedied first prior to the other 12
items listed in the agreement. Hopefully, you will take this
inadvisement and start with the removal of the dead trees in the
clean-up project on Drexel Court.

In accordance with the council wishes of June 19, I arranged a meet -?
ing with Mr. Walz and Mr. Klein to discuss their concerns regarding the
construction yard owned by Harvey Braun. On June 23, Mr. Walz, Mr. Klein
and myself inspected the yard. I noted their concerns and sug9estions
abeut the constructicn ywrd, ar,d discussed these issues wich Fir. Braun -
the same day. The following is a list of improvements which are mutually
agreeable.
1. General clean-up of scrap material.
2. Reduction in the size of the yard to the extent possible.
3. Relocation or removal of two sheets of corrugated steel roofing.
4. Removal of dead battery and loose motor oil cans.
5. Removal of L.P. tanks.
6. Removal of dead trees and trim one live oak ajoining the property of Mr
7. Removal of white fence on east side of yard.
8. Build a 2' - 3' high earthen berm on east and southeast corner of yard.
9. Construct a 4' wood fence on top of berm.
10. Line the south side of yard with fast growing deciduous trees.
11. Lower the height of material racks.
12. Improve the fence on the north side of the yard.
13. Relocate telephone pole.
It is also agreed that such listed improvements will be substantially
completed by August 31, 1984.

C A request has been received from Nolan and Nolan to construct an EZ Mini
Storage addition to the property on Highway l113 and Cedar Avenue. One of the
conditions in granting the EZ Mini Storage permit initially was that the
property be platted in conjunetion with the issuance of a building permit.
The platting was not completed and the staff now recommended that any approval
be subject to platting. Upon motion by Wachter, seconded Thomas, it was
resolved that the application be approv=d subject to compliance with a11
necessary ordinances and that the platting of the entire pareel be completed
prior to oceupancy or use of the premises. A1l voted in favo^.
HARVSY BRAi1N PROPBRTY - STORAGE OBJBCTIONS
City Council members had received a citizen's complaint from Leonard Walz
concerning open storage on the Harvey Braun property adjacent to the Walz
property in Drexel Heights. Discussion has taken place between Mr. Braun and
Mr. Walz and several neighboring property owners were present at the Council
meeting as Were Mrs. Mary Braun and Robert Braun, her son. Mr. Braun stated
the property was bought in 1951 and that Harvy Brau? had operated as a con-
traetor frrom the site for many years. Mary Braun indicated that the corpora-
tion has been operating less than 10 years and that the owners would build a
fence if aeceptable to the City. Harvey Braun indicated to the Council at an
earlier time that he would work out the problems with the neighbors and the
Councilmembers expected the property to be cleaned up some months ago. There
was discussion concerning non-conforming uses and whether the property was a
non-conforming use strictly under the City Ordinance. It was noted a number
of changes in use had taken place on the property over the years. No action
was taken and it was suggested the neighbors attempt to resolve the problem.
CONTRACf #83-13 - LS%INGTON AYffiNIIE BOOSTER STATION
The plans and specifications for the Lexington Avenue Hooster Station
were submitted and it was recommended the council approve them, and further,
that the Council authori2e a bid opening for 10:30 a.m. on Friday, July 14,
C 1984 at the Eagan Municipal Center. Wachter moved, Smith seconded the motion
to approve the plans and authorize the advertisement of bids. All voted in
favor. Wachter then moved, Thomas seconded the motion to provide for the sign
on the booster station with quotes to be acquired with future approval by the
City Council. All voted yes.

? HARVSY BRADN PROPERTY COlPLAINTS
Mr. Leonard Walz and other neighbors were present concerning their com-
plaints regarding the debris and other junk on the Harvey Braun property
located on the south side of Fish Lake. A letter had been submitted to the
City by Mr. Braun's son indicating that 12 items will be corrected within 60
days. There were strong ob,jections regarding the dead trees, the machinery
and other equipment that was located on the property. It was recommended that
the dead trees be removed for safety purposes.
LE%INGTON PL9CE DTILITIES CONTRACf #84-14
Formal bids were received on June 29, 1984, covering Contract #84-14,
regarding service to Lexington Place 2nd Addition and Lexington P1ace South
Addition. Certain easements, however, had not been acquired and Mr. Colbert
recommended that the Council continue consideration of the award of the con-
tract until the July 17, 1984, meeting. Thomas moved, Wachter seconded the
C1 motion to approve the recommendation. All voted yes.
SUN CI.IFF ADDITION S'fREETS AND UTILITIES - CONTRACf #84-15
Bids have now been received covering utility and street improvements for
Sun Cliff 2nd Addition and it was recommended that the low bidder, M& M Sewer
and Water Company, in the amount of $355,793•20, be approved. Wachter moved,
Smith seconded a motion to approve the Iow bid of M& M Sewer and Water
Company as recommended. All voted in favor.
1984 SE9L C09TING CONTIiACT - 184-6
The bids have been received for seal coating throughout the City vnder
C Contract 0184-6 and it was recommended that the low bidder, Allied Blacktop,
with a total base bid of $91,027.20 be approved and awarded. Thomas moved,
Wachter seconded the motion to approve the total base bid of $91,027.20 and a
deduct for Alternate No. 1 in the sum of $7,098•00 to Allied Blacktopping
Company. All voted in favor.

Re: Conservation Easement, Harvey's Heritage Addition
The City of Eagan holds about two dozen conservation easements that have been
recorded on various land parcels throughout the City over the past 20 years. Such
easements, which are legal agreements between historical landowners and the City,
prohibit specific activities on the legally described areas and also allow any other
activities as granted by historical landowners. Conservation easements aze permanent and
"run with the properties."
Enclosed for your reference is a copy of the conservation easement docuxnent recorded in
May and June of 1988 for your and your two neighbors' properties alongside Fish Lake,
which are legallyplatted as Lots 1, 3, and 4, Block l, Harvey's Heritage Addition.
Please be advised that within the next two to four weeks City staff intends to access the
easement area of these properties between 8:00 a.m. and 4:00 p.m. Monday through
Priday to inspect its condition relative Yo the terms of the easement. In accordance with
Condition #3 of the document, this letter serves as reasonable notice of the City's
intentions.

conservation easement dated May 3, 1988 and requested us to determine whether the Plucement
of the stairs and patio area (see enclosed pictures) within the conservation easement area is a
violation of the restrictions contained within the conservation easemejit.
