(A synopsis of the November 27, 1996 meeting was previously forwarded to all in attendance.) Following is a list of items both parties were asked to give consideration to before attending this meeting: Mr. Braun has asked that Mrs. Yard install a timber retaining wall along the property line to reduce the slope so he can mow his property. 2. Mrs. Yard offered to purchase a part of Mr. Braun's property on the west side that is too steep for Mr. Braun's use. 3. As the garage floor was constructed 1'6" higher than indicated on the original site plan, install a retaining wall of the same height to reduce the grade levels between the two lots to be less sloping. Discussion took place as follows: • Mrs. Yard asked Mr. Braun if he had given any thought to Item #2 and Mr. Braun said he did not wish to sell any of his property. • Mr. Braun showed a drawing of an Allen Block retaining system prepared by Greenside, Inc. at an installation cost of approximately $3,000. A railroad timber retaining wall would be considerably cheaper. Mrs. Yard asked Mr. Braun if he had, or would, consider land cover vegetation. Mr. Braun stated that he did not want that. A tentative date of April 3, 1997 at 9:00 a.m. was set to meet at the site to show by using strings, the possible grades, slopes, etc. (alternate date of April 9, 1997 if weather does not permit) to hopefully find a workable solution for both residents. braun.mt2 ?rAwn ?:ury % A4(i++ . 4o f a, E zo?k ( MEMO TO: FILE: PROJECT 487R, BRAUN COURT FROM: THOMAS A COLBERT DATE: AUGUST 20, 1987 SUBJECT: ASSESSMENT ALLOCATION - STREET COSTS During the several neighborhood meetings regarding the proposed improvement of Braun Court, there was considerable discussion regarding the allocation of costs associated with this street in relationship to the proposed future development (Harvey's Heritage Addition) of the unplatted parcel (010-52) to the north of the Braun Sunrise Addition. The feasibility report for Project 487R which was approved by Council at the July 7, 1987 public hearing, proposed to allocate the assessments for street improvements equally on a per lot basis, assuming three lot equivalents for the proposed Harvey's Heritage Addition and three lot equivalents between Lots 1 and 2 of the Braun Sunrise Addition (six lot equivalents total). As a clarification, the file should reflect that the proposed Harvey's Heritage Addition should be assessed for 508 of the cost of the street to be spread over however many ultimate lots have frontage on the proposed Braun Court. The remaining 508 of the street improvement cost would then be divided equally by the three lot equivalents (L.E.) to Lot 1 (2 L.E.) and Lot 2 (1 L.E.). If Lot 1 were to subdivide more than the proposed two lot equivalents, each lot that would take direct access to Braun Court would share equally in the 508 cost of the Braun Court street construction. Since the City received the letter there were some neighbors who appeared at the July 2, 1984, City Council meeting and indicated that nothing had been agreed to. Staff brought forth the letter you had sent indicating what items you would do and when they would be done. Hopefully, this resolved the issue of not cooperating with the surrounding neighbors. The one issue that staff did become aware of,is in regard to the removal of dead trees or trim one live Oak tree adjoining the property of Mr. Walsh. The surrounding property owners requested that in cleaning up the subject parcel that this item be complied with first prior to getting into the rest of the overall cleanup. Hopefully, you will take this concern and immediately remove the dead trees from the property to show good faith with the neighbors. It was pointed out at the July 2, 1984, Council meeting that this was the priority item and should be remedied first prior to the other 12 items listed in the agreement. Hopefully, you will take this inadvisement and start with the removal of the dead trees in the clean-up project on Drexel Court. The following is a list of improvements which are mutually agreeable. 1. General clean-up of scrap material. 2. Reduction in the size of the yard to the extent possible. 3. Relocation or removal of two sheets of corrugated steel roofing. 4. Removal of dead battery and loose motor oil cans. 5. Removal of L.P. tanks. 6. Removal of dead trees and trim one live oak ajoining the property of Mr. Walsh. 7. Removal of white fence on east side of yard. 8.
