In reviewing these assessments with you, we found that the following adjustments were justified due to errors in calculation pertaining to trunk area storm sewer. 9/15/81 FMAL ASSESSMENT CRIDIT REVISED ASSESEMENT Lot 2 $553.56 $ 58.56 $495.00 Lot 3 693.27 198.27 495,00 Lot 4 699.75 204.75 495.00 $461.58 The amount of these credits will be processed through the Dakota County Auditor's office and a revised tax statement will be sent out showing the revised first year's installment for your trunk storm sewer as a result of this correction. You further expressed concern regarding the levied assessments pertaining to benefit received from sanitary sewer laterals, water main laterals, storm sewer laterals and related services. Enclosed with this letter are copies of two different agreerrsnts that you entered into with the City which specifically states that these assessments would be paid as a part of the final plat. However, I recall through our omversa- tions that it was your intention that these assessments be levied at the time that the property is either sold by you or a building permit is requested. The rates that were used to determine the levied assessment were based on 1980 lateral bene- fit rates. Therefore, the City will be willing to "defer" these lateral benefit rates for sani- tary sewer, water, services and storm sewer for lots 3 and 4 until such time as you sell the property or request a building permit. These "deferred" assessmmts will then be re-levied at the rates in effect at the time of sale or building permit ap- plication. Future annual increases cannot be predicted at this time. Therefore, if you sign the attached waiver of Hearing and resubmit it to our atten- tion, we will delete these referenced assessments for Lots 3 and 4 and defer it un- til either sale or building permit application as discussed previously. In any event, the reduction to the trunk storm sewer assessments will be processed as pre- viously discussed. The remaining costs would remain as a pending assessment against this property which would be required to be paid in full at the time of final platting and/or building permit application but they are the best estimates that can be made at this time. I hope that we have been able to resolve all the issues that have care up during our past discussions so that we may proceed with the repair work of the sanitary sewer.
