Building Issues 1. Yes. The builder is required to supply a railing, or cover, over egress window wells that are within 4' of a walkway. Stipulation for these devices can be found in the 1997 Uniform Building Code (UBC), Section 310.4 - see attachment. 2. The builder is required to seal all exterior penetrations occurring in the foundation - 1997 UBC. 3. All egress window wells within a vertical depth of more than 44" shall be equipped with a permanently affixed ladder -1997 UBC, Section 310.4 - see attachment. 4. All furnaces and water heaters must be vented. 5. The exterior walls should be fully insulated to an'R' value of 19 - see attachment. 6. All exterior penetrations shall be sealed. 7. Horizontal seams in sheetrock should fit tightly together; however, if they do not, a City Building Inspector may require that they be taped. 8. State Electrical Inspector, Mark Anderson, will be happy to assist you with your concerns regarding electrical installation. Please provide more detailed information to him, i.e. what units have exposed wiring or are improperly wired'? Mark can be reached at 952-445-2840 Monday through Friday between the hours of 7:00 - 8:30 a.m. 10. Water pipes that start with 1/4" and branch out to %z" to the fixture with the 3/8" O.D. speedy connector making the final water connection comply with the Minnesota State Plumbing Code. Water pressure to a fixture could be reduced by any of the following: 1) the faucet aerator screens are plugged with debris; 2) the fixture angle shut-off valve could have debris in the angled area; or 3) a valve may not be turned fully open. Grounds/Exterior Issues 1. Lang should be responsible for structural damage, if any, to the roads caused by their operations. City Engineering staff did not find any structural street damage during a recent visit to the development. Some superficial damage was found. 2. City Engineering staff saw one driveway (3406 Eagan Oaks Court) where a small portion of the driveway surface slopes slightly back toward the garage. Once the garage and the curbing are in place, it would be very difficult to replace. If it is causing damage to a building structure, perhaps a drainage system (drain tile) should be installed to direct runoff away from the garage. 3. The Uniform Building Code does not call for installation of gutters. 4. Lang has addressed the area of concern behind the 803-807 building mentioned in the City's correspondence to Lang Builders (9/15/99). They placed functioning drain tile behind the unit that drains water to the storm sewer system. The other areas of concern at the 813-815 building and the 3422 building have not yet been resolved. They have been put on notice that these items must be addressed satisfactorily. If not, their letter of credit for the development will not be released to them. 5. Yes. 6. Yes, reference City Code, Sec. 2.78. Building numbers. (attached) 7. Unleveled air conditioner slabs do not affect performance of a unit. It is the heating contractor's responsibility to level a unit. 8. Private utility companies install their lines within public easement and right-of -way under City utility permits. If the unburied lines are on private property, the individual utility companies should be contacted and informed that, if the lines are not taken care of, the association will perhaps look elsewhere for private utility service. 9. There are three large stumps existing just off the bike path along Yankee Doodle Road that lie within the Association's property and are its responsibility. Yankee Doodle Road is a County road, therefore, the City would not take responsibility for cutting trees in this area. For the most part, Lang Builders did abide by the City's Tree Preservation Plan. This plan called for saving only nine trees along the woodlands next to Yankee Doodle Road, and more than nine trees were saved. Spot checks on other parts of the development also confirmed that the plan was followed. There was no evidence of trees removed where they should not have been removed (with the exception noted below behind Units 810-814). Tree #112 (or #103?) received damage as noted below. There was what appeared to be wind damage to some of the trees in the wooded area above the retaining wall along Eagan Oaks Lane (behind Units 810-814). Trees #31, #80-84, #86, and #87 behind Units 810-814 (but in front of the retaining wall) were to be preserved, but appear to have been removed. Perhaps these trees were the ones your letter refers to as being "damaged" or "knocked down" and "still lying there." The contractor may have since removed them during his recent visit. On our site visit, a resident stated that many trees were planted only last week. As a result, the contractor may have already addressed some of the written complaints/inquiries in your letter regarding downed trees and whether the landscape plan was followed. In general, the number of trees planted follows the plan. The following trees were stressed or damaged and require replacement: 2 dead oaks; 3 stressed oaks; 2 dead Arborvitae; one large dead existing tree. Other trees had branches broken off at their upper limbs, as if by high or straight-line winds. Tree #112 (or #103?) sustained a large scar from machinery or during development. There was no evidence of trees sustaining root damage along the retaining wall in the woods behind Units 810-814. There is an approximately 10'-15' swath of cleared ground between the retaining wall and the edge of the woods. This area is devoid of any trees and vegetation at this time and presumably turf will be put in according to the plan. Trees beyond this area are 10'-15' behind the retaining wall, do not appear to be stressed, and presumably are far enough from the construction area to not have sustained any root damage. Wood mulch needs to be moved away from bases of pines and all trees. Twine was not cut from around burlap on pines we sampled. 10. The property line/ right-of-way line is approximately 10 feet south the trail along Yankee Doodle Road. The developer is responsible for restoration of all disturbed areas due to their activities with the development. 11. The pipes extending above the ground are water service valve boxes that are adjustable and can be lowered by striking them with a rubber hammer. This is the responsibility of the developer, but possibly a maintenance person with your association would wish to lower them for ease of landscape maintenance. 12. Please call Craig Novaczyk, Building Inspector, at 681-4683 to set up an appointment to view this area. And some final general concerns 13. For your information, we are including a handout from the State of Minnesota entitled Housing; Statutory Warranties, Chapter 327A, that addresses a builder's warranty obligations. 14. Yes. See attached "punch list" to Lang Builders dated 9/30/99. 15. The escrow is actually a letter of credit in favor of the City. It helps to ensure site- development related items in the development contract such as grading, landscaping, public utilities (sanitary sewer, water main, storm sewer), street work and street lighting are done according to approved plans and specifications. The City will not release this letter of credit until work associated with these areas is satisfactorily completed. The City is currently holding a letter of credit in the amount of $32,006. The development contract is between the City and the developer (Citywide/ Lang), and therefore, any issues relating to the contract are generally between those two parties. The association has the right to ask for a "hold" on the security relating to those items in the development contract listed above. Hopefully this letter will provide the answers to your concerns. Since we met, we surveyed owners of Eagan Oaks Townhome Association to gather other unresolved issues with Lang Builders. We would appreciate your assistance or recommendations to resolve these issues. We have two major areas of concern: 1) Building issues on items that may or may not be covered by City Building Codes. We would like to know whether the City can require the Builder to address these issues, despite the fact that the homeowner's original warranty may have expired. 2) Exterior issues, such as trees, landscaping, asphalt, etc. We would like to know what the City requires of the builder before leaving the site, and if you can help the Association in addressing these issues with the builder. Listed below are questions we felt we need answers to and/or items of concern from the survey. Building Issues 1. • Many of the units have egress window installed on the side of the unit next to the sidewalk. Is the builder required to provide a railing or a cover over these window wells? This is a real safety issue, as well as an insurance issue for the Association, if someone slipped and fell in. Lang has recently covered some of the window wells with a make-shift cover made of 2x4's. They are fairly heavy, and would be difficult to move if a person needed to exit the window well. They also block the light which defeats the purpose of having a window installed. What does the City require, if anything, per the building code? 2. • When Lang backfilled some of the window well culverts he damaged them, which in turn pulled them away from the block, causing the block mortor seams to crack. Bolts that secure culverts are being pulled out of block due to this damage. Also, there are still some window wells where holes in the foundation are still evident, although some are hidden by rocks in the wells. We understood that this was in violation of code. What is the builder's liability? Is this limited to the homeowner's warranty, or will the City require that the builder re-address areas that are damaged, and holes in the foundation? 3. Some egress window still do not have ladders installed. 4. Some owners reported inadequate or non-existent venting of mechanicals. 5- Some owners reported missing insulation. Our home was missing insulation at the fireplace. We wouldn't have known this unless the marble on the fire place hadn't cracked. At the time of replacement it was discovered by the installer that the insulation was missing. 6. Homeowners have discovered some openings between the foundation and floor trusses. If you remove the the insulation in these areas you can see daylight. This allows mice and other rodents to enter the house. Is the builder required to correct this problem? What about the owners that have already had their basements finished?. Is there something that can be done from the outside? One of our homeowners had a red squirrel in her house all winter. Is the builder's liability limited to a warranty period, or is this a code issue? 7. • Is there a requirement that the interior of an attached garage must be taped? Some of the garages have'/." to 6" holes in them. When this was brought up to Lang Builders, they said some inspectors require it and some don't. What is the code? 8- • One unit has the furnace installed on the sewer clean out. Is this a code violation? 9. • Some owners have exposed wiring or feel some of the wiring is improperly installed. What steps, if any, can they take to have the City re-inspect this? 10. • Some units are having problems with water pressure and unable to get adequate water pressure to the upstairs of their unit. Does this have something to do with the water pipes that start with'/. inch and branch out to 1/2 inch? Is this code? GroundsfExterior Issues Many of the roads have been damaged by Lana's equipment during construction. It appears the final coat of ashphalt was installed, because it is even with the concrete ridge on the curb. As you know, all the roads in Eagan Oaks are private except Trails End. We think it would be an unfair financial burden on the Association members to have to pay for these road twice in such a short time (once in the cost of the home and again because of Lang's negligence). Is the builder required to repair the damage before leaving the site? 2. • We have reports of several driveways with improper slopes. Water runs into the garages. Another example of poor grading. Is the Builder required to correct this? 3. • Is the Builder required to install gutters when the design of the unit produces unsafe icy conditions in the winter? One owner commented that ice built up so badly this winter that it caused water to leak into the wall between the garage and the kitchen. Lang's recommendation for this was installing heating coils, but I do not believe it was at his expense. Water also runs down into those areas that have holes in the foundation. This then makes the sump pump turn on to pump out water. 4. • As far as we know the drainage issues you documented in you letter of 9/15/99 to Lang Builders have not been resolved. This also accounts for some of the dead grass as noted below. We received new reports of improper drainage from owners of 3410 Eagan Oaks Ct and 819 Eagan Oaks Lane 5. • There are problems with the irrigation system where the sprinkler heads are too close to the houses, so water saturates foundations, window wells and windows. Is this something the Builder must address? 6. • Addresses on many of the building are very hard to read. Is there a requirement or standard established by the City in regard to visibility/readabilty for the purposes of emergency vehicles? Some are white, some are black, all being on same background. Which do we use? 7. • Some owners have unlevel air conditioner slabs, does this affect the air conditioner's overall performance or life? Is is acceptable by code? • There are still unburied cables, phone lines and water pipes which need to be addressed. Cable company was notified and they say they have up to a year to cover this. Is this true? They gave us a date of May 26. Is the Builder or Association responsible for driving this issue? What impact can your office provide? We have major concerns regarding the landscaping. There were some trees removed last fall along Yankee Doodle. Did the City do this, or was it done by Lang?. If done by Lang, were these accounted for in the tree preservation plan? There also are big stumps remaining; shouldn't these have been removed when the trees were removed? We would also appreciate a review of the orginal plan compared to the current status. Lang has had trees removed and billed to the association that we don't think were appropriate charges. Additionally, there was damage to trees when putting in a retaining wall along Eagan Oaks Lane 810-814. Heavy equipment damaged or knocked down trees which are still lying there. The remaining trees behind these units have also had the roots severely distrubed. Several knowledgeable people, including a horticulturist, have told us that these trees will die in the next few years. If so, shouldn't these be addressed as a Builder's development cost before leaving the site? How can this be determined? 10. • At what point along Yankee Doodle does Eagan Oaks take responsbility for maintenance of the grounds? In the wooded area just south of Yankee Doodle there is considerable bare ground, due to removal of trees and undergrowth. What is the responsibility of the Builder to recover this ground? 1 l . • Many of the trees have already died or have been improperly planted. If you examine the trees that were planted, many of them are at an angle and not deep enough. Is the Builder required to replace these trees before leaving the site? A lot of the grass has also died and there are areas that have not been sodded, and/or retaining walls that have not been built as the owners had been led to understand. There are areas where grass can not be cut properly due to poor grading. Some trees have been replaced once, and some grass areas have been resodded a second time, and the trees or grass has died a second time. Is the Builder still responsible, or is his liability limited to I replacement? 12- • There are still several pipes extending above ground in various areas. Are all of these supposed to be be made flush with the ground? Is this required of the Builder? And some of our final, general concerns: • If Lang fails to address something he should have, and the City doesn't catch it until sometime later, will the remedy still lie with the Builder, or is the Association responsbile by default? • Do you have a check list of items we could review which may not already been brought to our attention that Lang is required to address before you release his final escrow? • What is the City of Eagan's policy regarding the release of the final escrow to the builder. What do they look for? What can we reasonably expect the builder to do? Do you have any communications with any of the owners or Board members for issues they feel have not been resolved which should have been? Does the Association have a right to ask for a "hold" on escrow monies until the Builder has addressed our concerns? Thank you in advance for your help with the above issues. The minimum net clear openable width dimension shall be 20 inches (508 mm). When windows are provided as a means of escape or rescue, they shall have a finished sill height not more than 44 in- ches (1118 mm) above the floor. Escape and rescue windows with a finished sill height below the adjacent ground elevation shall have a window well. Window wells at escape or rescue windows shall comply with the follow- ing: 1. The clear horizontal dimensions shall allow the window to be fully opened and provide a minimum accessible net clear open- ing of 9 square feet (0.84 m''-), with a minimum dimension of 36 inches (914 mm). 2. Window wells with a vertical depth of more than 44 inches (1118 mm) shall be equipped with an approved permanently af- fixed ladder or stairs that are accessible with the window in the fully open position. The ladder or stairs shall not encroach into the required dimensions of the window well by more than 6 inches (152 mm). Bars, grilles, grates or similar devices may be installed on emergency escape or rescue windows, doors or window wells, provided: 1. The devices are equipped with approved release mecha- nisms that are openable from the inside without the use of a key or special knowledge or effort; and 2. The building is equipped with smoke detectors installed in accordance with Section 310.9. 310.5 Light, Ventilation and Sanitation. Light and ventilation shall be as specified in Chapter 12. The number of plumbing fix- tures shall not be less than specified in Section 2902.6. 310.6 Room Dimensions. 310.6.1 Ceiling heights. Habitable space shall have a ceiling height of not less than 7 feet 6 inches (2286 mm) except as other- wise permitted in this section. Kitchens, halls, bathrooms and toi- let compartments may have a ceiling height of not less than 7 feet (2134 mm) measured to the lowest projection from the ceiling. Where exposed beam ceiling members are spaced at less than 48 inches (1219 mm) on center, ceiling height shall be measured to the bottom of these members. Where exposed beam ceiling members are spaced at 48 inches (1219 mm) or more on center, ceiling height shall be measured to the bottom of the deck sup- ported by these members, provided that the bottom of the mem- bers is not less than 7 feet (2134 mm) above the floor. If any room in a building has a sloping ceiling, the prescribed ceiling height for the room is required in only one half the area thereof. No portion of the room measuring less than 5 feet (1524 mm) from the finished floor to the finished ceiling shall be in- cluded in any computation of the minimum area thereof. 310.4 310.9.1.3 If any room has a furred ceiling, the prescribed ceiling height is required in two thirds the area thereof, but in no case shall the height of the furred ceiling be less than 7 feet (2134 mm). 310.6.2 Floor area. Dwelling units and congregate residences shall have at least one room that shall have not less than 120 square feet (11.2- m''-) of floor area. Other habitable rooms except kitchens shall have an area of not less than 70 square feet (6.5 m-). Efficiency dwelling units shall comply with the requirements of Section 310.7. 310.6.3 Width. Habitable rooms other than a kitchen shall not be less than 7 feet (2134 mm) in any dimension. 310.7 Efficiency Dwelling Units. An efficiency dwelling unit shall conform to the requirements of the code except as herein provided: L The unit shall have a living room of not less than 220 square feet (20.4 m'-) of superficial floor area. An additional 100 square feet (9.3 m'-) of superficial floor area shall be provided for each occupant of such unit in excess of two. 2. The unit shall be provided with a separate closet. 3. The unit shall be provided with a kitchen sink, cooking appliance and refrigeration facilities, each having a clear working space of not less than 30 inches (762 mm) in front. Light and ven- tilation conforming to this code shall be provided. 4. The unit shall be provided with a separate bathroom contain- ing a water closet, lavatory and bathtub or shower. 310.8 Shaft and Exit Enclosures. Exits shall be enclosed as specified in Chapter 10. Elevator shafts, vent shafts, dumbwaiter shafts, clothes chutes and other vertical openings shall be enclosed and the enclosure shall be as specified in Section 711. In nonsprinklered Group R, Division 1 Occupancies, corridors serving an occupant load of 10 or more shall be separated from corridors and other areas on adjacent floors by not less than ap- proved fixed wired glass set in steel frames or by 20-minute smoke- and draft-control assemblies, which are automatic clos- ing by smoke detection. 310.9 Smoke Detectors and Sprinkler Systems. 310.9.1 Smoke detectors. 310.9.1.1 General. Dwelling units, congregate residences and hotel or lodging house guest rooms that are used for sleeping par- t poses shall be provided with smoke detectors. Detectors shall be installed in accordance with the approved manufacturer's instruc- tions. 310.9.1.2 Additions, alterations or repairs to Group R Occu- pancies. When the valuation of an addition, alteration or repair to a Group R Occupancy exceeds $1,000 and a permit is required, or when one or more sleeping rooms are added or created in exist- ing Group R Occupancies, smoke detectors shall be installed in accordance with Sections 310.9.1.3, 310.9.1.4 and 310.9.1.5 of this section. EXCEPTION: Repairs to the exterior surfaces of a Group R Occu- pancy are exempt from the requirements of this section. 310.9.13 Power source. In new construction, required smoke detectors shall receive their primary power from the building wir- ing when such wiring is served from a commercial source and shall be equipped with a battery backup. The detector shall emit a signal when the batteries are low. Wiring shall be permanent and without a disconnecting switch other than those required for over- current protection. Smoke detectors may be solely battery oper- ated when installed in existing buildings; or in buildings without 1-27 1997 UNIFORM BUILDING CODE 1401 1403.3 Chapter 14 EXTERIOR WALL COVERINGS SECTION 1401 - GENERAL 1401.1 Applicability. Exterior wall coverings for the building shall provide weather protection for the building at its exterior boundaries. Exterior wall covering shall be in accordance with this chapter and as specified by the applicable provisions elsewhere in this code. Unless otherwise approved by the building official, foundation walls enclosing a basement below finished grade shall be dampproofed outside by approved methods and materials. 1402.5 Window Wells. All window wells shall extend below the I window sill height. All weather-exposed sur- faces shall have a weather-resistive barrier to protect the interior wall covering. Such barrier shall be equal to that provided for in UBC Standard 14-1 for kraft waterproof building paper or asphalt-saturated rag felt. Building paper and felt shall be free from holes and breaks other than those created by fasteners and construction system due to attaching of the building paper, and shall be applied over studs or sheathing of all exterior walls. Such felt or paper shall be applied horizontally, with the upper layer lapped over the lower layer not less than 2 inches (51 mm). Where vertical joints occur, felt or paper shall be lapped not less than 6 inches (152 mm). A weather-resistive barrier may be omitted in the following cases: 1. When exterior covering is of approved weatherproof panels. 2. In back-plastered construction. 3. When there is no human occupancy. 4. Over water-repellent panel sheathing. 5. Under approved paperbacked metal or wire fabric lath 6. Behind lath and portland cement plaster applied to the underside of roof and eave projections. 1402.2 Flashing and Counterflashing. Exterior openings ex- posed to the weather shall be flashed in such a manner as to make them weatherproof. All parapets shall be provided with coping of approved materi- als. All flashing, counterlashing and coping, when of metal, shall have a minimum thickness of 0.019-inch (0.48 mm) (No. 26 gal- vanized sheet metal gage) corrosion-resistant metal. SECTION 1403- VENEER 1403.1 Scope. 1403.1.1 General. All veneer and its application shall conform to the requirements of this code. Wainscots not exceeding 4 feet (1219 mm) in height measured above the adjacent ground eleva- tion for exterior veneer or the finish floor elevation for interior ve- neer may be exempted from the provisions of this chapter if approved by the building official. 1403.1.2 Limitations. Exterior veneer shall not be attached to wood-frame construction at a point more than 30 feet (9144 mm) in height above the noncombustible foundation, except the 30-foot (9144 mm) limit may be increased when special construc- tion is designed to provide for' differential movement and when approved by the building official. 1403.2 Definitions. For the purpose of this chapter, certain terms are defined as follows: BACKING as used in this chapter is the surface or assembly to which veneer is attached. VENEER is nonstructural facing of brick, concrete, stone, tile, metal, plastic or other similar approved material attached to a backing for the purpose of ornamentation, protection or insula- tion. Adhered Veneer is veneer secured and supported through ad- hesion to an approved bonding material applied over an approved backing. Anchored Veneer is veneer secured to and supported by ap- proved connectors attached to an approved backing. Exterior Veneer is veneer applied to weather-exposed surfaces as defined in Section 224. Interior Veneer is veneer applied to surfaces other than weather-exposed surfaces as defined in Section 224. 1403.3 Materials. Materials used in the application of veneer shall conform to the applicable requirements for such materials as set forth elsewhere in this code. For masonry units and mortar, see Chapter 21. For precast concrete units, see Chapter 19. For portland cement plaster, see Chapter 25. Anchors, supports and ties shall be noncombustible and corro- sion resistant. W&Leo Subpart 1. Scope. One- and two-family residential buildings that are heated or mechanically cooled must comply with the requirements of subpart 2 or 3. Subp. 2. Prescriptive criteria. A. Minimum thermal resistance of the insulation in ceilings to achieve a Uo factor of 0.026 is as follows: In ceilings with attics insulation must be R-38 with improved or advanced framing, or R-44 without improved or advanced framing. In ceilings without attics insulation must be R-38 between framing plus R-5 sheathing. 000?? B. Minimum thermal resistance of the insulation in rim joists: R-19. C. Rules Chapter 7670 25 June 1994 § 2.75 EAGAN CODE / l date through December 21 of the following year, and the total amount of principal and interest shall be certified to the county auditor for collection with taxes the following year. Partial prepayment of special assessments. Subd. 1. Scope. Partial prepayment of assessments in connection with any assessments adopted by the council and certified to the county auditor for collection may be made at any time. Subd. 2. Payment. The owner of any property so assessed may, within 30 days of adoption of the assessment roll by the council, prepay any or all of his assessment to the city. No interest will be charged on any portion of the assessment paid within said 30 days. Emergency preparedness plan. The council may, by resolution, adopt, from time to time amend, or repeal an emergency preparedness plan for the city. (Code 1983, § 2.77, eff. 1-1-83) Sec. 2.78. Building numbers. Subd 1. Building numbers required. The owner or occupant of any building fronting upon any street or avenue shall place and maintain on the front thereof the proper building number assigned by the city. CD2:20 ADMINISTRATION AND GENERAL GOVERNMENT § 2.80 Subd. 2. Posting. The building number shall be conspicuously posted on the front of the building or on a building accessory so as to be readily identifiable for all purposes. Subd. 3. Specifications. The building number shall be clearly displayed, of a color in contrast with the color of the building to which it is attached, with minimum height of numbers at least three inches for residential structures, and six inches for multiple-dwelling and commercial structures. All surplus moneys in the consolidated debt service bond fund which remain after the costs of each improvement have been fully funded, and which are not transferred to another separate improvement fund. Investment earnings generated by the moneys in the community investment fund. D. Any other moneys appropriated by the council or donated for the purpose of the fund. Subd 2. Purpose of fund. We would appreciate your assistance or recommendations to resolve these issues. We have two major areas of concern: 1) Building issues on items that may or may not be covered by City Building Codes. We would like to know whether the City can require the Builder to address these issues, despite the fact that the homeowner's original warranty may have expired. 2) Exterior issues, such as trees, landscaping, asphalt, etc. We would like to know what the City requires of the builder before leaving the site, and if you can help the Association in addressing these issues with the builder. Listed below are questions we felt we need answers to and/or items of concern from the survey. Building Issues • Many of the units have egress window installed on the side of the unit next to the sidewalk. Is the builder required to provide a railing or a cover over these window f wells? This is a real safety issue, as well as an insurance issue for the Association, if someone slipped and fell in. Lang has recently covered some of the window wells with a make-shift cover made of 2x4's. They are fairly heavy, and would be difficult to move if a person needed to exit the window well. They also block the light which defeats the purpose of having a window installed. What does the City require, if anything, per the building code? • When Lang backfilled some of the window well culverts he damaged them, which in turn pulled them away from the block, causing the block mortor seams to crack. Bolts that secure culverts are being pulled out of block due to this damage. Also, there are still some window wells where holes in the foundation are still evident, although some are hidden by rocks in the wells. We understood that this was in violation of code. What is the builder's liability? Is this limited to the homeowner's warranty, or will the City require that the builder re-address areas that are damaged, and holes in the foundation? li : • Some egress window still do not have ladders installed. • Some owners reported inadequate or non-existent venting of mechanicals. • Some owners reported missing insulation. Our home was missing insulation at the fireplace. We wouldn't have known this unless the marble on the fire place hadn't cracked. At the time of replacement it was discovered by the installer that the insulation was missing. • Homeowners have discovered some openings between the foundation and floor trusses. If you remove the the insulation in these areas you can see daylight. This allows mice and other rodents to enter the house. Is the builder required to correct this problem? What about the owners that have already had their basements finished?. Is there something that can be done from the outside? One of our homeowners had a red squirrel in her house all winter. Is the builder's liability limited to a warranty period, or is this a code issue? • Is there a requirement that the interior of an attached garage must be taped? Some of the garages have 1/4" to 6" holes in them. When this was brought up to Lang Builders, they said some inspectors require it and some don't. What is the code? ), • One unit has the furnace installed on the sewer clean out. Is this a code violation? • Some owners have exposed wiring or feel some of the wiring is improperly installed. What steps, if any, can they take to have the City re-inspect this? • Some units are having problems with water pressure and unable to get adequate water pressure to the upstairs of their unit. Does this have something to do with the water pipes that start with % inch and branch out to'/, inch? Is this code? Grounds/Exterior Issues • Many of the roads have been damaged by Lang's equipment during construction. It appears the final coat of ashphalt was installed, because it is even with the concrete ridge on the curb. As you know, all the roads in Eagan Oaks are private except Trails End. We think it would be an unfair fttancial burden on the Association members to have to pay for these road twice in such a short time (once in the cost of the home and again because of Lang's negligence). Is the builder required to repair the damage before leaving the site? • We have reports of several driveways with improper slopes. Water runs into the garages. Another example of poor grading. Is the Builder required to correct this? Is the Builder required to install gutters when the design of the unit produces unsafe icy conditions in the winter? One owner commented that ice built up so badly this winter that it caused water to leak into the wall between the garage and the kitchen. Lang's recommendation for this was installing heating coils, but I do not believe it was at his expense. Water also runs down into those areas that have holes in the foundation. This then makes the sump pump turn on to pump out water. • As far as we know the drainage issues you documented in you letter of 9/15/99 to Lang Builders have not been resolved. This also accounts for some of the dead grass as noted r below. We received new reports of improper drainage from owners of 3410 Eagan Oaks Ct and 819 Eagan Oaks Lane • There are problems with the irrigation system where the sprinkler heads are too close to < the houses, so water saturates foundations, window wells and windows. Is this something the Builder must address? • Addresses on many of the building are very hard to read. Is there a requirement or standard established by the City in regard to visibility/readabilty for the purposes of y emergency vehicles? Some are white, some are black, all being on same background. Which do we use? • Some owners have unlevel air conditioner slabs, does this affect the air conditioner's overall performance or life? Is is acceptable by code? • There are still unburied cables, phone lines and water pipes which need to be addressed. Cable company was notified and they say they have up to a year to cover this. Is this true? They gave us a date of May 26. Is the Builder or Association responsible for driving this issue? What impact can your office provide? • We have major concerns regarding the landscaping. There were some trees removed j last fall along Yankee Doodle. Did the City do this, or was it done by Lang?. If done by Lang, were these accounted for in the tree preservation plan? There also are big stumps remaining; shouldn't these have been removed when the trees were removed? We would also appreciate a review of the orginal plan compared to the current status. Lang has had trees removed and billed to the association that we don't think were appropriate charges. Additionally, there was damage to trees when putting in a retaining wall along Eagan Oaks Lane 810-814. Heavy equipment damaged or knocked down trees which are still lying there. The remaining trees behind these units have also had the roots severely distrubed. Several knowledgeable people, including a horticulturist, have told us that these trees will die in the next few years. If so, shouldn't these be addressed as a Builder's development cost before leaving the site? How can this be determined? • At what point along Yankee Doodle does Eagan Oaks take responsbility for maintenance of the grounds? In the wooded area just south of Yankee Doodle there is considerable bare ground, due to removal of trees and undergrowth. What is the responsibility of the Builder to recover this ground? Many of the trees have already died or have been improperly planted. If you examine the trees that were planted, many of them are at an angle and not deep enough. Is the Builder required to replace these trees before leaving the site? A lot of the grass has also died and there are areas that have not been sodded, and/or retaining walls that have not been built as the owners had been led to understand. There are areas where grass can not be cut properly due to poor grading. Some trees have been replaced once, and some grass areas have been resodded a second time, and the trees or grass has died a second time. Is the Builder still responsible, or is his liability limited to 1 replacement? • There are still several pipes extending above ground in various areas. Are all of these supposed to be be made flush with the ground? Is this required of the Builder? And some of our final, general concerns: • If Lang fails to address something he should have, and the City doesn't catch it until j sometime later, will the remedy still lie with the Builder, or is the Association responsbile by default? • Do you have a check list of items we could review which may not already been brought r 13 to our attention that Lang is required to address before you release his final escrow? • What is the City of Eagan's policy regarding the release of the final escrow to the builder. What do they look for? What can we reasonably expect the builder to do? Do J you have any communications with any of the owners or Board members for issues they feel have not been resolved which should have been? Does the Association have a right to ask for a "hold" on escrow monies until the Builder has addressed our concerns? Thank you in advance for your help with the above issues. I have observed the site on two occasions and the followings concerns are based on those site visits. Today, I observed the removal and replacement of drain file at the rear of 803 through 807 Eagan Oaks Lane. This was an area that I had noted as being deficient in proper drainage on a previous visit in August. I noticed the use of a laser level by the installers, which should help than install the pipe at the appropriate grade to ply drain this area I am concerned, however, that the design of the `French drain' as I observed it being installed may be subject to high maintenance or replacement in a relatively short period of time, less than three years. The lack of a filter fabric, or me:rnbranne, around the I" minus rock will allow finer material to migrate towards the drain tile, likely restricting the flow of water to the pipe. The shallow bury of the pipe may also make the pipe susceptible to fieezing during the spring thaw. Perhaps regrading the area would have provided adequate drainage without the expense or maintenance concerns of the `French drain'. While I was there today, I reviewed sonic other areas of concern from my previous visit. The area at the rear of 813 and 815 Eagan Oaks Lane is not graded appropriately to allow proper overland drainage of said area. Water is standing in a low area in excess of 50 feet in length. There appears to be an adequate elevation difference between this area and the unsodded area to the west to allow the regrading of a proper slope. Said unsodded area should also have appropriate vegetation established The area at the rear of 3422 Eagan Oaks Court also has insufficient overland drainage. Water is standing in this area and the sod appears to be dying. Either the regrading of this area and the downstream area to the east or the installation of an appropriate `French drain' system are needed. Careful grading will also be needed for the new unit being constructed to the west so that the adjacent area is properly drained and does not adversely affect the downstream area. A hold may be placed on future building permits or inspections if these drainage issues are not properly resolved- I appreciate your oooperal with my drainage concerns.
