Isn't happy with the way the rosds are because her private drive is
continually washing out. Her driveway slopes down hill to the east
from Wescott Hills Drive. This part of Wescott Hilis Drive is draining
from the north and the south. There also is a secondary driveway
further south. This is more suitable because it is a little higher
than the City road and not as easily washed out. The owner states this
road is not usahle in the winter because they can't get to the garage
area.
Last year when this problem was brought to our attention we cut the
east side ditch south of Orvilla Home to let the drainage water of£
the road. Previously this water was going down Mrs. Thorpe's drive.
Pte also cut another drainage area north of Mrs. Thorpe's mailbox to
drain water aaay from her drive area. We know this water eventually
goes into her drive further down but we are trying to keep it away
from the drive entrance where the largesi wash area was. We also
hauled several truck loads of ag-lime to huild up the area where her
drive meets the City street in an effort to build up and siow down
the drainage.
The problems of a down grade driveway in a road with drainage from
both directions is great. The City, as in the past, will continue
to watch and maintain this road.
We will haul in ag-lime for the top of the drive at the City street.
We will also see that the water will drain to the east, where possible.

CYNTHIA WEBBER THOItPE, husband and wife, (heremafter referred to as °Landowners")
and the Ciry of Eagan, a municipal corporation, organized under the laws of the State of
Minnesota (hereinafter referred to as the °City").
WITNESSETH:
That the Landowners, in consideration of the sum of One Dollar ($1.00) and other good
and valuable consideration, the receipt and sufficiency of which is hereby acknowledged, do
hereby grant and convey unto the City, its successors and assigns, a permanent conservation
easement for the purpose of preserving and protecting the natural chazacter of the easement azea,
over and across the following described premises, situated within Dakota County, Minnesota, to-
wit:
Lot 2, Block 1, 'i HORPE WOODLAND GARDENS, according to the recorded
plat thereof on fite in the office of the Registrar of Titles, Dakota County,
Minnesota, which lies easterly and northeasterly of the following described line:
Commencing at the southeast corner of said Lot 2; thence cai an
assumed bearing of North 89 degrees 12 minutes 50 se.:onds
West, along the south line of said Lot 2, a disiance oi 65.U0 ieer;

they shall not themselves perform nor shall they give permission to any third party to perform
any of the following activities within the easement area, without the prior written consent of the

The Landowners, for themselves and their heirs and assigns, further covenant and agree
that the general topography of [he easement area shall be continued in its present condition and
no excavation or change in the tupography shall be allowed, save and ez cept as may be required
by any federal, state or 1oca1 government agency, other than the Lsndowners, which have
jurisdiction over the easement prem.ises or as authorized by the City, in writing, as the City shall,
in its sole discretion decide is apprcpriate; that no cutting or harvesting of any live tree or other
live vegetative cover shall be permitted except as may be required by any federal, state or local
government agency, other than Landuwners, which have jurisdiction over the easement premises
or as authorized by the City, in writing, as the City shall, in its sole discretion, decide is
appropriate.
The easement granted herein does not entitle the Ciry to use or occupy the surface of the
easement except as specifically provided herein. This easement shall be effective upon
Landowners' execution and shall continue in force in perpetuity.
Landowners reserve the right to occupy and use the property and easement for all
purposes not inconsistent or mterfering with the restrictions set forth herein. The easement
granted hereunder and the covenants contained herein shall run with the la.ad and shall be binding
onto the parties hereto and their heirs, successors and assigns.
And the Landowners, their heirs and assigns, do covenant with the City, its successors
and assigns, ±hat they are the Landowners of the premises afozesaid and have good right to grant
and convey the easement herein to tha City.
