In, a letter dated September 27, 1990, Mr. Dale Wegleitner, the Eagan,
Minnesota Fire Marshal informed you that the townhouse located at
4424 Cinnamon Ridge Trail, Eagan, Minnesota had been 'deemed unsafe;
and asked GMAC to board up the home. The City subsequently secured
the house.
Dale Wegleitner has informed us that he received a report from the'
Eagan 'Police Department approximately one month ago that the 4424
building is unsecured and trespassers are entering the building. We,
understand that GMAC foreclosed on its mortgages.and purchased this .,
townhouse plus the adjacent one at j"4422 Cinnamon Ridge from the
Dakota County Sheriff at the foreclosure°saTe held on July 8, 1991.
The owners' period of redemption expires December 12, 1991. HaVing
purchased the townhouses at the Sheriff's sale and paid the first
half of the 1990 real estate taxes on both units, it is clear'that
GMAC' is protecting its interest in the property. Therefore,,it is,
GMAC witki whom the City must discuss its concerns.
The City of Eagan's primary concern is with vandals trespassing onto
the property and'.into the abandoned townhouses. The inside of
townhouse number 4424 has suffered major damaqe due to trespassers.
Townhouse 4424 has and is repeatedly checked'by City officials 'and
Police to ensure it remains boaYded up. Townhouse 4422 is not
currently boarded up but has a few broken panes of glass. Eagan's
Fire Marshal and Police Department think that,Townhouse 4422 will
also suffer damages if it is not better secured.
We ask your assistance in keeping vandals off the property and out of
both townhouses on Cinnamon Ridge Trail. If you are not already
aware, you may want to proceed to secure the townhouse under
Minnesota Statute Section 582.031, a copy which is attached, which
reads in part:
If premises described in a mortgage or sheriff's
certificate are vacant or unoccupied, the holder of
the mortqage or sheriff's certificate or the holder's
agents and contractors may, but is under no
obligation to, enter upon the premises to protect the
premises from waste, until the holder of the mortgage
or sheriff's certiEicate receives notice that the
premises are occupied. The holder of the mortgage or
sheriff's c2rtificate does not become a mortgagee in
possession by taking actions authorized under this
section.
Minn. Stat. 582.031, Subd. 2 provides that:
The holder of the mortgage or sheriff's certificate
may take the following actions to protect the
premises from waste: install or change locks on doors
and windows, board windows, and otherwise prevent or
minimize damage to the premises from the elements,
vandalism, trespass, or other illegal activities.

[ am wnting about an article in a recert Exoerience Eaera?n. from Winter 2002. It is on the back page in the article
"City Crets qean Sweep for Spring." It states that - The sweeping process has already begun and in the month of
April, crews will work eactended hours to meet the tugeted completion date of May 15th.
[ have lived at my same address of 4422 Cinnamon Ridge Trail for 10 years now. A sweeper did not come on our
street this year or on any of the previous 9 years Are we excluded for some reason?
Mother question. I live in a twinhome that is a mandatory member of °Cinnamon Ridge Twinhome Association "
They collect $50 00 a month for waste removal, snow removal, lawn care, house structural insurance and street
repairs. They even charge a $15.00 late fee. I was originally told 10 years agq thet we were required to be an
association because our streets aze too narrow and that the City of Eagan would not do any repair work as the streets
deteriorate, there£ore it was required to have a pool of money for street repair. There is azound $150,000.00 in the
fund now, which was broke when I bought my house. There are three streets within the association. [ want to know
if this is true and that the City is not response for our streets? And iF the City is response for the streets, why would
we have to be in an association?
One last question. For several months a district 196 school bus has been dropping of a child at 4428 Cinnamon Ridge
Trail. If the City of Eagan is not responsible for cleaning or maintaining our street, then why would a district 196
school bus be using and ruining a private dnve maintained by civilians?
