During a site inspection in your neighborhood, I noticed a deck had been recently constructed on your
properry. Enclosed is a page 'From the 1997 Uniform Building Code entitled SECTION 106 - PERMITS,
which explains the requirements for building permits.
I discussed with you the need for a building permit so our deparhnent can inspect your deck and assure
that it is safely constructed for use. Your friend, Dave, called and said he would bring in a plan and apply
for a permit on September 24th. As of today's date, we have not received a plan. We are now asking
that you submit a plan for approval and obtain the necessary 6uilding permit from our department
within 14 days of the date of this letter so further action by the City will not become necessary. Our
office is open Monday through Friday between the hours of 7:00 a.m. and 4:30 p.m. so homeowners, such
as you, have an opportunity to meet with us.
Your anticipated cooperation is greatly appreciated. If you have any questions, do not hesitate to call me

I041.6 Liability. The building official charged with the en-
furcement uf [his cude, acting in good faith and without malice in
the discharge of the duties required by this code or other pertinent
law or ordinance shall not thereby be rendered personally liable
for damages tha[ may accrue to persons or property as a result of an
acc or by reasun of an act or omission in the discharge of such du-

cause of such act or umission performtd by the building official or
employee in the enforcement of any pmvision of sucfi codes or

sponsibility of any person owning, operating or controlling any
building or structure for any damages ro persons or property
caused by defects, nor shall the code enforcement agency or its
parent jurisdiction be held as assuming any such liability by rea-
son of the inspections authorized by this code or any permits or
cer[ificates issued under this code.
104?J ModiPcations. When there are practical difficulties in-
volved in caming out the provisions of this code, the building of-
ficial may gtant modifications for individual cases. The building
official shall first find Ihat a special individual reason makes the
strict letrer of this code impractical and that Ihe modification is in
conformance with the intent and purpose of this code and that such
modiFication does nat lessen any fire-protection requirements or
any degree of strucmral integriry. The details of any action grant-
ing modi[ications shall 6e remrded and entered in [he 6les of Ihe
code enforcemznt agency.
I041.8 Altemate materials, alternate desigo and methods of
construction. The provisions of this code are nat intended to pre-
vent the use of zny material, alternate desien or method of
constmetion not specifically prescribed by this wde, provided
any alremate has been approved and its use authorized by the
buifding official.
The building nfficial may approve any such aitemate, provided
the building official tinds that !he proposed design is satisfactory
and complies wieh the provisions of this code and that the material,
method or work offered is, For the purpose intended, at least the
eyuivalent of Ihai prescribed in this codc in suitability, strength,
effectiveness, fire resistance, durability, safety and sanitation.

104.2.l0 Coopera[ion of olher officials and otFcers. The
building official may requc,t, and s-hall recnive, the assistance and
cooperation of other officials of this jurisdiction sa far as is re-
quired in the discharge of tht duties required by [his code or other
pertinent law or ordinance.
SECTION 105 - BOARD OF APPEALS
105.1 General. In order tu hear and decide appeals of orders, de-
cisions ot dzterzninations made by the building official relative ro
:he apptication and ia!erprztatiorz of thk code, there shal! be and is
hereby created a board of aPpeals consisting of ine:nbers who aze
qualified by experience and training to pass on matters pertaining
to building construction and who are not employees of the juris-
diction. The building oKcial shall be an ex officio member of and
shall act as secretary to said board but shall have no vote on any
matter before Che board. The 6oard of appeals shall be appointed
by the goveming body and shall hold office at its pleasure. T'he
board shall adopt rules of procedure for conducting i[s business,
and shall rendec a4t decisions and findings in writing to the appel-
lant with a duplicate copy to the building official.
105.2 Limitations of A¢thority. The board of appeals shall
have no authority rela[ive to interpretation of the administra[ive
provisions of this code nor shall [he board be empowered to waive
requirements of Ihis code.
SECTION 106 - PERMITS
106.1 Permits Required. Excapt as specified in Section 106.2,
no buildin- or structure regulated by this code shall 6e erecced,
constructed, enlarged, altered, repaired, moved, improved, re-
moved, conver(ed or demolished unless a separate permit for each
building or stmcture has first been obtained from the 6uilding offi-
cial.
106.2 Work Exempt from Permit. A building peanit shall not
be reGuiced [ot the followine:
1. One-srory detached accessory buildings used as tool and
storage sheds, playhouses, and similar uses, provided the floor
area does not exceed LO square feet (il.li m-'). ?
2 Fences not over 6 feet (1829 mm) high.
3. Oil derricks.
4. Movable cases, counters and partitions not over 5 feet
9 inches (1753 mm) high.
5. Retaining Walls that are not over 4 feet (1219 mm) in height
measured from the bottom of the footing to Ihe tap of the wall, un-
less supporting a surchacge or impounding Class I, ![ or l[I-A liq-
uids.
6. Wamr tanks supported directly upon grade if the capacity
does not exceeJ S,INNI gallons (18 927 L) and the ratio of height to
diameter or widih does not exceed 2: t.
7. Platforms, walks and driveways not more than 30 inches ?
(762 mm) abuve grade and not over any basement or story balaw.
8. Pain[ing, papering and similar finish work.
