Traffic shall be allowed to pass and to be protected at all times. If it is not possible to allow traffic to pass, a suitable detour must be provided and plans submitted to the Director of Public Works 72 hours in advance. 2. Barricades shall be erected in a manner which will provide suitable visibility in all directions. All barricades shall be in good condition, and all signs shall be of such size and legibility to provide adequate warning to oncoming traffic. At least two 7" flashing amber lights shall be mounted on each end barricade with one on an advance warning sign. 3. Excavations must be shored or sheeted when necessary to prevent undez-mining of roadway, trailways, utilities, or for safety reasons. 4. Guys or stays shall not be attached to trees on right-of-way or ptivate property without written permission. 5. Flagmen shall be furnished by the party or organization performing the work whenever the work being done creates a hazard either to the traffic using said road or the personnel engaged in the construction, or when directed to do so by the City. OPERATIONS 1. Permit on Job--Permits or copies shall be kept on the site of the work while it is in progress in the custody of the individual in charge, and shall be exhibited upon request made by any City official. 2. Provisions and Specifications--These general provisions, specifications and Std. Plate P-1 shall be considered as forming an integral part of each and every permit issued for operations mithin Eagan. The work authorized by this permit shall be done at such time and in such manner as shall be consistent with the safety of the public and shall conform to all requirements and standards of the City. If at any time it shall be found by the City that the work is not being or has not been properly performed, the permittee, upon being notified by the City, shall immediately take the necessary steps, at his own expense, to place the work in condition to conform to said requirements or standards. 3. Execution--The permittee shall use diligence in the execution of the work authorized under this permit in order not to endanger or unnecessarily obstruct travel along any road or trailway. Operations shall be so conducted at all times as to permit safe and reasonable free travel over the roads and trailways within the limits of the work herein prescribed. All safety measures for the free movement of traffic shall be provided by the permittee at his own cost. 4. Conformity to I.aws--The installation shall be made in conformity with all applicable laws, regulations and codes covering said installations. All installations shall be made in conformity with regulations of governmental agencies for the protection of the public. a. The applicant shall furnish a bond or financial guarantee in the amount to be determined by the City which is required to ensure adequate & timely completion of repair. This bond or financial guarantee shall remain in effect for 2 yeazs subsequent to completion of street repair to protect the City from defects in material, workmanship or non-compliance with City Standards or specifications. The applicant shall furnish evidence of public liability insurance of not less than $100,000/300,000 and property damage of not less than $25,000 issued by an insurance company authorized to do business in the State of Minnesota on which the City is named as an additional insured party. c. Except for the negligent acts of the City, its agents and its employees, the permittee shall assume all liability for, and save the City, its agents and its employees, harmless and defend same at its sole cost and expense from any and all claims for damages, actions or causes of action arising out of the work to be done herein and the continuing uses by the permittee, including but not limited to the placing, constructing, and reconstructing, maintaining, protecting and use of said facility under this application and permit for construction. 5. Existing Facilities--The utility facility and installations shall not interfere with any existing utility facility on the City's right-of-way or easements. It is the responsibility of the applicant to call for necessary locations of existing utilities. (Gopher One 454-0002) 6. Private Property--The work permit or permit for construction as issued does not in any way imply an easement on private property. 7. Quality of Work--Finished surface, base and sub-base of road or trailway upon completion of work shall be at least equal to or better than specifications of originally provided road or trailway in accordance with City Standard Specifications. Surface shall be finished within 48 hours upon comvletion of backfill 8. Cutting Trees--The permission herein granted does not confer upon the permittee tha right to cut, remove or destroy trees or shrubbery within the legal limits of the right-of-way, easements that are not specifically identified on the plan attached to this permit or relieve permittee from obtaining any consent otherwise required from the owner of the property adjacent thereto. 9. Drainage--All waterways and lines of drainage shall remain operative. 10. Pole Anchors--Pole anchors, anchors, braces or other construction will be permitted within right-of-way or easements and will be approved on a case by case basis. 11. Driving Limitations. a. Dxiving or parking on City trails or sidewalks shall only be permitted for those operations requiring direct access to the boulevard area. b. Vehicles operating or parked within the right-of-way area shall utilize their warning flashers at all times. c. Vehicles driving on trails or sidewalks shall not operate in excess of 5 miles per hour. Vehicles shall operate at slower speeds when weather conditions, trail conditions, poor visibility, obstructed sightlines or other conditions require special precautions to ensure the safety of trail users and the general public. d. Driving shall not be permitted within those boulevard areas where damage to turf trailways or other infrastructure may occur. e. The Diffley Road reconstruction proJect, which affects the area of Countryside Drive and Country View Drive directly adjacent to your property, was approved on March 17, 1992. I realize that this date is prior to the July 23, 1993, date on which you said you purchased your property at 4172 Country View Drive. You stated in your correspondence that you found it was odd that after contacting the builder, Brian Thorson, and both real estate agents involved in the sale of your home, that none of them were aware of any of the proposed changes which Mr. Stan Lexvold had identified to you at your home on April 6, 1994. State Law requires that all properties that will have a potential assessment must be notified of the proposed improvements. In reviewing our files, we find that your property was not notified because no assessment is proposed for your property. WRh respect to item #1 in your correspondence, the area directly westerly to your property is public street right-of-way. During the initial development of the Country Hollow 2nd Addition, it was anticipated that Country View Drive would be extended southerly and connect to Diffley Road with future development. This development will not occur and this street extension is no longer necessary. It would seem that a private driveway would have much less impact on your property versus a public street connection to a County road. Item #2 has been greatly mitigated through the efforts of Stan Lexvold and his conveying your concerns to the City's Parks Department. The City's Parks Department has agreed to plant shrubbery east of the bituminous trailway which will result In a barrier between the trailway and the future driveway of the proposed lot lying south of your residence. If additional landscaping is desired, this would best be worked out cooperatively between you and your future neighbor. In Item #3 of your correspondence, you feel the City is responsible for extending your existing sprinkler system. Privately owned sprinkler systems in City public right-of-way are allowed only by permit by the City. This permit states that the property owner may install a sprinkler system in public right-of-way with the understanding that if the City needs to modify the existing public right-of-way in any form, the property owner is responsible for any modifications to a sprinkler system which the property owner has installed wi[hin City public right-of-way. Prior to doing so we contacted the City of Eagan with our concerns of the dead end street to the south of our home and also the plans for the construction of the Park. Relayed to us was that there would be a wildlife park seiting and a walking path through the middle of the two pond areas. None of these plans included any mention of reconstruction ofi the iwo drives Countryview and Countryside to accommodate the park area, only that the road would remain a dead end. This +roas very appealing to us in the decision of the purchase of the home as it was an important factor that this would be a safe location for our children to play in. On approximately April 6, 1994, Stanley Lexvold, Construction Supervisor for the City of Eagan, came to our home to inform us of the reconstruction plans for the Park area and the two drives, Countryview and Countryside. Stan stated that these road reconstruction plans were entered in to the City ofi Eagan's record books in February 1993, but without rrention of the proposed driveway. We were quite shocked and concerned to say the least of these plans as it was only 9 months after we purchased the home and these plans were not mentioned to us when we contacted the City prior to our purchase. What we found to be odd after contacting the Builder, Brian Thorson and both Real Estate Agents involved in the sale of the home, none were aware of any of the proposed changes. We are protesting the issue because we feel the plans for the reconstruction of the road and the future driveway to the lot to the south of our home will greatly effect the appearance and safety of our fot. Enclosed you will find a sketch which Stanley Lexvold has given to us of the proposed plans for the project which is Page 2 Mayor Tom Egan already underway. Our concern with this sketch is thai there is no specific details or guidelines defining widtii and footage of the driveway as weli as a required turn around on the lot south of our home. Points that <ve would like to make which greatly concern us are the following: 1. The vacant lot next to our home (which is in the process of being platted) will have a driveway which will cross through our front yard. This is a strong objection on our part as it will impose a safety hazard as well as take away the appeal of our home should we choose to sell in the future. 2. The eight foot black top vvalking path which will be finished soon, 2s Yhe pians show it tc be, will be right next to the future driveway. Again, ancther safety hazard in our opinion. Stan Lexvold has mentioned that there will be bushes planted and a incline implemented between the walking path and the future driveway. We fPel because this will affiect our front lawn with people walking and future neighbors driving on the proposed driveway, that tnESe bushes should be added to our property as well. 3. Our sprinkler system, which we installed last fall, will need to be extended to the end cf the property line after completion of the project at hand. We already had to move one head due to the road reconstruction and we don't feel that we should be liable for any costs incurred to the system due to these new plans. 4. Can we be guaranteed that the driveway will in fact be installed as specified on the sketch? 5. In the process of the construction of the walking path the plans are to install sod from our property line up to the walking path, covering the area of the future driveway. This would mean that when a home is buiit, the sod would be ripped up to construct the drivevvay. Wili be guaranteed that the driveway and sod reinstallation will be done to specification as we have been made aware? In the process of the developing o( the Park at Diffley and Highway 3, drainage reconstruction began the middle of April which entailed installation of a drain system behind our home on top of the hill. On April 26, 1994 there was a heavy downpour of rain which caused erosion of the mounds of dirt which the work Fage 3 iv1ayor Tom Egan crews had created in the process of the projeci. Consequently this caused the water to floNi down to our backyard, leaving our sod with large piles of dirt and rock covering it. And also for the first time since the construction of our home there was water seepage into our basement This was confirmed by our builder that the house, which stood vacant for one year, never had incurred a water problem prior to the reconstruction of the drainage system project. We contacted Stanley Lexvold on Aprii 27, 1994 about this incident and he came out and inspected our yard ard insured us that the damages would be completely repaired. Stan stated that he would contact the Contractor af the project and Developer in regards to this issue. On April 27 we aiso contacted the office of Tom Hedges to report this incident, Holly Duf(y responded on April 28 saying thaY they were aware of the problem and that Staniey was handling it but to call her with any future problems. As of today, May 6, 1994, we have not been contacied with a date when repairs will be tended to. Our drainage system was installed by the builder/developer and in working order up to this Spring. It currently is set up to drain to the south of aur home which incidentally runs right through the vacant lot south ofi us. If the vacant lot has to be elevated to buiid a home on, will this cause drainage problems for our lot? We have contacted our insurance Company in regards to claims for water damage which they do not cover, we want to be sure that this seepage problem will not happen again due to the drainage system that is being installed currently. This letter comes to you with great frustration and anger. We feel that our rights as home owners have been violated and that we have strong reason to protest. We sincerely hope that our best interest will be part of the completion of the proJects in the works and that we will be made aware of any further future plans which will invoive our property.
