I have received your letter of August 26, 1994. First, please accept my apologies for the
difficulties that you have encountered with the City of Eagan. I have reviewed the situation
with your sod and can understand your frustration. While it is of little consolation to you,
the City from time to time has dif5culty with particular developers and that is what
happened in your case. For the most part new developments go quite smoothly overall,
however, that does not preclude individual problems such as you have experienced. It is not
always possible to get immediate cooperation from the developers and/or builders which
leads to frusuation on everyone's part.
Regarding the watering preservation program, the generic nodce you received was generated
as a result of a telephone complaint received by the City. The notice is intended to remind
and clazify and not to offend. Perhaps in our desire to be ef£cient in mailing/delivering
these notices, we have sacrificed too much of the personal approach and they haue become
too generic and can be offensive. To the extent that the notice offended you, I apologize
for that as well.
Concerning the speed limit on the street in front of your house, I have passed your remarks
along to Police Chief Pat Geagan and asked him to review the situation.
Again, I apologize for the difficulties expressed in your letter. It is my understanding that
the sod probiem created by the new development has now been rectified and hopefully you
can now enjoy your yard. Please contact me directly if you have additional concerns.

It's amazing how fast you noticed that our yard was heing watered
on a"variety of days" at "many hours", in violation of your
watering ban, yet your City of Eagan trucks passing by daily in
front of our house never noticed that the developer/city owed us
sod that was ripped out in October of 1993 and was finally replaced
sometime around August 25, 1994. We called your planning office
over and over and over again, and even the mayor, to complain about
noncompliance of our developer and, you, the City of Eagan.
I think your City cffice- and people who vae*_-k in them are o_n_e hiq
joke. I can tell you about noncompliance. Just come and live in
my house for a day and you'll see what noncompliance is. One of
them is not replacing our yard properly and in a timely manner.
It's ridiculous to wait from the initial ripping up of our yard in
October 1993, then the street and yard directly in front of us on
May 19, 1994, to the final laying of street in June, at which time
all of our neighbors got new sod across the street twice, provided
by the developer/City. Our yard is filled with weeds and it
looked horrible for months.
Guess what3 We got the sod replaced, we've been watering what
little sod was put in (not enough) in hopes to get our yard back to
a decent looking yard, and you send us an immediate noncompliance
notice. Noncompliance to me is that we didn't get our full yard's
sod replaced. We have at least a foot and a half yet on the side
yard that's not sodded. I know it will never be replaced. We
still have a five foot square of dead grass courtesy People's
Natural Gas Company by the mail box not yet replaced. I doubt now
that will ever be replaced either.
I suggest that you notify my neighbors yourself of your watering

I don't. accept the notice to disregard if we have new sod in the
letter sent to us as any way to discredit the rude, vague tone of
your letter. I feel your office personally owes my family an
apology for the lack of compliance with us on our development
problems and the inconvenience and suffering caused to us by the
City and the developer.
Another noncompliance in front of our house is the speeding going
on. I think you should track the speeders going by my home. I
assume they think the speed limit is 40 to 45 since it is off Dodd,
which the speed limit is 40, and Diffley and Cliff, which the speed
limit is 45. I wish we had a cop here on rush hours and a speed
limit sign with the proper speed limit posted.
