In response to the letter fran Ed Mci4enomy dated Navenber 2nd, I am for-
warding to your attmticn a oopy of the street oonstruction plans for the
tpgrading of Dodd Road which shvws the new "asbuilt" searface caidth of Dodd
Road (shaded in yellow) as rrF,mared to the original gravel road wi.dth pr.ior
to oonstruction (red line).
As you can see, the centerline of the new roadway aligrxnent is app*nx;mate-
ly 16' east of the oenterlire of the right-of-way adjacent to Mr. and Mrs.
Rahn's pmperty at the above-referenced address. Haaever, the newly con-
structed roadway is within the existing 33' half right-of-way adjacent to
Mr. & Mrs. Rahn's praperty. Therefore, the additiarial 7' right-of-way is
not necessary at this time, but will be neoessary if, and when, we ever
up4rade and widen Dodd Road the additicnal 5' on each side as originally
planned.
The reason for tle shift to the east of dedicated right-of-way centerlire
was to preserve the roa of mature oak trees along the westerly side of the
right-of-way in front o£ Mr. Fd Schwanz's pmperty (4395 Dodd Road).

to Yu.s request in his letter dated November 2nd. If any additional irr-

I have reviewed your letter of July 8 with Tom Colbert, the Eagan Public Works
Director, and his reaction is as follows: -
1. That the square footage demand £or 2,520 square feet covering a 7-foot strip
at about $2.50 per square foot is excessive. He suggested that the payment be
made on a more realistic basis of about $10,000 per acre whicfi would reduce the
payment to abovt $600. He stated that he would recoffinend this swn to the City
Council.
2. He also stated that the improved surface is 24 feet with the water contained
within the bituminous surfacing with the maximum right-of-way eventually to be
44 feet or 22-foot half right-of-way. It would therefore be contained within
the 33-foot half right-of-way and the 7-foot additional right-of-way is not a
necessary part of the pexmanent easement.

Arvid Rahn concerning the easement that was requested in 1979 for the Dodd Road
expansion project. Obviously, Rahn's attorney did not get back to the City and
make a request specifically for payment, but are now doing so. I have asked
that you review this letter and we should look at it in light of some of the
other payments that were made to owners who granted easements in the general
area on Dodd Road.

Dear Mr. Hauge:
We represented Arvid and Bernice P.ahn back in 1979 when the City
of Eagan sought to acquire an additional 7 feet of right-of-way fror,,
the Rahns for purposes of making public impzovements. An easement
caas never obtained from the Rahns and they granted the City permission
to construct the improvements by virtue of a waiver of entry as indicat-
ed in [he enclosed copy of letter dated October lst, 1979.
According to our calculations, the Rahns own 36v feet of frontage
on Dodd Road and [he City of Eagan has tal:en an additional 7 foot strip
of their property, for a[otal taking of 2,520 square feet. The Rahns
have indicated that at this time they are willing to execute the pro-
posed Highway Easement need, provided that the City of Eagan is willing
to pay them just compensation for their property that the City has
acquired. The Rahns have an at[ractive homesite on Dodd Road and,
by virtue of the [aking of their property, traffic flow and traffic
speed have increased and have been brought closer to their home, result-
ing in an increased noise'level to their property. We have reviewed
various cases of other individuals who we have represented with regard
[o right-of-way acquisition by the City and, based upon these cases,
the Rahns are entitled to damages in the amount of $6,000.00 and will
sign the proposed Highway Easement Deed conditioned upon payment of
that sum to them by the City of Eagan.
Please contact us within 60 days of the date of this letter with
regard to [he City of Eagan's posi[ion in this matter. If we do no[
hear Erom you within 60 days of the date of [his letter, we shall have
no alternative but to commence an ac[ion for inverse condemnation on
behalf of the Rahns against the City of Eagan.
