This letter is acknowledgement of your inquiry regarding the landscaping of public property
adjacent to your property. The trees on the public property were heavily damaged by the storms
that passed through Eagan this past summer. I have enclosed three copies of a covenant for you
to sign for the City Council to approve.
The covenant will allow you to complete landscaping on the public propeRy and maintain said
landscaping. It requires the City staff's approval of the landscaping plan prior to any
landscaping improvements. It also protects the City of Eagan's rights to maintain the City's
propeRy as necessary.
I believe this covenant satisfactorily addresses your request that we discussed in our meeting at
your residence. Please contact me with any questions. If some of your neighbors have the same
interest, please have them contact me also. Thank you for your interest in the beautification of
your neighborhood and for giving me the opportunity to respond to your request. I will
anticipate your return of the three signed copies of the covenant.

THIS COVENANT, is made this ciay oi' . 1998, by and between
Joseph Huebner and Mary 13uebner, htisband and wife (hcreinafter "Coveriantor") and the CiTY
OF EAGAN, a Minnesota municipal corporation (hereinaiter "Covenantee")(hereinaftcr
collectively referred to as the "Parties").
WFiEREAS, Covenantor is the fee owner of certain real property located in the City of
Eagan, County of Dal:ota, State of Minnesota, and legaily described as:
Lot 5, Block 1, Northview Mcadows 2id Addition
(hereinafter "Covenantor's Propertd')
WHEREAS, Covenantee is the fee owner of or has easement ovcr certain reat property
located in the City of Eagan, Coimt of Dakota, State of Minnesota, legally described on Exhibit
"A" attached hereto and made a part hereof (hereinafter "City Property"); and
WFIEREAS, Covenuitor has requested, in connection with the improvement of their
property, to constnict and install certain landscaping within City Property that abuts their
property; to provide for the installation, maintenance and repair of the landscaping located on
City Property and to insure payment by Covenantor and all subsequent owner of Covenantor's
Propcrty of all maintenance and cepair aosts incun•ed in connection with the landscaping
undertaken by Covenantor upon City Property; and
WHEREAS, the Covenantec is willing to grant access to City Property upon the ternis
and conditions contained ,herein.
NOW, THEREFORE, in consideration of the mutuai promises contained herein and other
good and valuable considcration, the receipt and sufficiency of which are hereby acknowledgcd,
the Parties do hereby agree as follows:
l. Definitions
a. ('ovenantee. The City of Eagan, a municipal corporation, in County of
Dakota, State of Minnesota.
b. itKAssessments. Cost incurred by the Covcnantee in curing any default
oP Covenantor in the performance of any oblinations to maintain and
repair the landscaping as set forth in this Covenant.

c. I.,andscapina. Any and all landscaping materials located on CiYy Property
or including, but not lirnited to, trecs, shrubs, grass or other ground cover,
stone, rock, and all waicr/irrigation systems and heads, piping, controls
and wiring rclatcd thercto,
d. Covenantor's Property. Ccrtain real estafe located adjacent to the Property
and (egally described as L,ot 5, Block 1, Northview Meadows 2nd
Addition.
Covenantor's Property shall also mean any suhdivision parcel resulting
from the future platting or replatting of the LoC or a portion thereof.
e. Covenantor. Record owner or contract purchaser of the fee simple title to
Covenantor's Property, but excluding the contractor sellers, moctgages or
others having sucli interest merely as security for the pertormance of an
obligation.
f. City Propertv. Certain real estate owned by the Covenantee or upon which
is public easement within the City of Eaoan, Dakota Cotmty, Minnesota.
2. Construction and Insta3lation of Landscapinp.
As and when City Property is landscaped by Cocenantor, Covenantor shali obtain
a C,ity Boulevard Landscape Permit for and cause the initial construction and
installation oFthe landscaping in accordance with the landscaping plans approved
by the City.
3. Maintenance and Renair.
Covenantor shall maintain the Landscaping in accordance with generally accepted
landscapc maintenance practices. All maintenance shall be at no cost to the
Covenantee. Branches of all trees planted in City Property shall overhang no
lower than 13.5 feet abovc paved street surface of 3.0 feet above a paved trailway.
For such purpose, the Covenantor shall have a license to enter upon City Property,
at reasonaUle times to conduct said mainfenance or repair.
4. ep fault.
If the Covenantor shall fail to perfonn airy required maintenance or repairs of the
Landscaping the Covenantee shall have the right, after the expiration of thirty (30)
days after written notice has been given by the Covenantee to the Covenantor of
such failurc, to perfonn any rcquired maintenance or repairs. While the
Covenantce may have the right ro maintain and repair the Landscaping the
Covcnantce has no obligation Co do so. [f tho Covenantor fails to aclequately

5. City Assessments.
The Covenantee may charge the Covenantor for the Covenatnee's actual costs for
labor and materials expended and used in connection with the maintenance, repair
or removal of tlie Landscaping after default by tlie Covenantor, plus reasonaUle
adcninistrative fees not to exceed 20% thereof. Within Tliirty (30) days after
presentation of a detailed invoice therefore, the Covenantor sha11 reimUurse the
Covenantee for any such charges. Such charges sliall bacome par of the City
assessments. If the Covenantor fails to perfomi as hereinabove provided, the
Covenantee shall include such assessments as part of their real estate talces due
and payable with respect to the Lot. Covenantor, on behalf of itself and all
subsequent Owner(s) of Covenantor's Property waives any rights to hearings or
notice oPhearing rclating to the Ievying of any City asscssments.
This Covenant shall be binding upon and imire to the benefit of the Parties' heirs,
successors and assigns and shall run with the Covenantor's Property.
