Proposed Use Enclosed is an application for my client, T-Mobile USA, respectfully requesring approval of the above-reFerenced permits for construction of a wireless communication facility at the address referenced above. The proposed facility will consist of a 75-foot painted monopole tower and equipment pad located within in a 12-foot by 20-foot lease area on properry currently owned by Mary, Mother of the Church. T-Mobile USA will attach transmit and receive antennae to the self-support tower; antennae will be mounted at the azimuths of 0°, 120° and 240° respectively. The antennas located at the top of this structure will be low-profile in nature, and will be painted to match the tower color. No tower lighting will be attached to the tower unless FAA safety requirements require so. No advertisement will be attached to the site. Access to the facility is provided by an existing paved driveway and parking lot, and will run to the compound. Please refer to the enclosed plans (6xhibit B) for reference to the design of this site. Purpose of Proposed Use T-Mobile USA provides a state-of-the-art digital wireless telecommunications service called Personal Communications Services (PCS) throughout the greater metropolitan area of Minneapolis and St. Paul, as well as throughout the United States. Development of T-Mobile USA's infrastructure began in 1996, and has continued to grow over the past several years. This proposed communication site represents improvement of both coverage and capacity of the T- Mobile USA network into the Burnsville area. Site Selection Methodoloev Once T-Mobile USA's engineers determine the general area in need of a new communication site, we begin our search for possible locations by reviewing the local zoning code requirements and searching for suitable existing structures for collocation. In the northeastern portion of Burnsville, no existing structures existed near the proposed location that provided any significant height for an antenna installation. As illustrated in Exhibit C of this application, T-Mobile is already collocating communication antennas on the nearby water towers to the south and nor[heast. T-Mobile is also collocated on a transmission pole to the east, and a gas station sign to the noRh. The neiehborhood surrounding our proposed location is made up by a mix of commercial properties to the east, and along Cliff Road, along with single and multi-family residential 346COUN"fRYROAD ! Surveying the azea, and researching Burnsville's current wning and land use, we navt determined what we believe to be the best possible location for the proposed development. O£net locations considered in our search include the Red Oak Park to the southwest. This nark iocaiio*- was ruled out in our search due to its low ground elevation (roughly 25 Feet lower than our proposed location). There are no tall buildings, existing towers or water towers within one-half mile of this location. The current use of the property is Mary, Mother of the Church. In addition to the church facility, it is improved with a large paved parking lot. This is primarily a rectangular-shaped parcel containing 22.23 acres, and is owned by the Church. Development in the immediate vicinity of the property consists of a number of commercial properties to the east, multi-family buildings to the west and northwest, and single-family homes to the north and south. County Rd 42 Introduction T-Mobile USA is requesting a Conditional Use Permit in order to develoo a wireless telecommunications monopole tower ("Communication Site") at 3333 Cliff Road. the proposed communication tower will replace a planned parking lot light pole at this location to increase its ability to blend in with the surrounding development. Mary, Mother of the Church has just recently completed a new parking lot with new lighting, and has postponed the building of a light pole at this location, with the understanding T-Mobile will build the multi-purpose pole in the near future. The associated equipment necessary for the operation of the antennas will be located adjacent to this tower/light pole, and will be placed on a concrete pad. The equipment location will be secured with decorative wrought iron fencing, and will be screened by additional landscaping. Please refer to the attached site plan and drawings for details (Exhibit B). The Conditional Use Permit is being requested per the following sections of the Burnsville Zoning Code: 5ection Towers and Antennas Subject Chapter 29 "Towers and Antennas" 10-29-3: HEIGHT RESTRICTIONS: Height Determination. The height of towers shall be determined by measuring the vertical distance from the tower's point of contact with the ground or rooftop to the highest point of the tower, including all antennas or other attachments. When towers are mounted upon other structures, the combined height of the structure at the tower's point of attachment and tower must meet the height restrictions of this Section. Except as provided in Paragraph C of this Section, maximum heights for towers are as fol lows; 1. In all protected residential property, the maximum height of any tower, including all antennas and other attachments, shall be thirty (30) feet, except that no tower shall be in excess of a height equal to the distance from the base of the antenna and tower to the nearest overhead electrical power line which serves more than one dwelling or place of business, less five (5) feet. 2. In residential zoned property other than protected residential property, the maximum height of any tower, including all antennas and other attachments, shall not exceed one (1) foot for each two (2) feet the tower is setback from protected residential property up to a maximum height of seventy-five (75) feet for towers and antennas located on property developed for apartment buildings and one hundred fifty (150) feet in all other cases, except that no tower shall be in excess of a height equal to the distance from the base of the antenna and tower to the nearest overhead electrical power line which serves more than one dwelling or place of business, less five (5) feet. In all non-residential zoning districts, the maximum height of any tower, including all antennas and other attachments, shall not exceed one (1) foot for each two (2) feet the tower is setback from protected residential property, up to a maximum height of one T-Mo6ile Communication Tower pmposal Page Z of9 1301 E. The City Council may allow towers up to two hundred (200) feet high if the applicant can demonstrate that based upon the topography of the site and surrounding area, siting of the antenna, antenna design, surrounding tree cover and structures and/or through the use of screening, that off-site views of the tower will be minimized. Exceptions. The following are exceptions to the maximum height restrictions for towers: 1. Multi-User Towers. Multi-user towers may exceed the height limitations of this Section by up to twenty (20) feet, provided that if only the antennas of a single personal wireless service provider will be attached to the tower at the time of application, the additional twenty (20) feet will not be used but will remain vacant for use by a second personal wireless service provider. 2. Amateur Radio Antenna. In accordance with the preemption ruling PRBl of the Federal Communications Commission, towers supporting amateur radio antennas that comply with all other requirements of this Section are exempted from the height limitations of this Section up to a total height of seventy (70) feet, provided that such height is technically necessary to receive and broadcast amateur radio signals. 3. Towers and other antenna devices which are attached to a structure and not freestanding may be located in residential zoned districts under the following conditions: a. the towers and antennas are located upon existing or proposed structures allowed as principal or conditional uses in the underlying zoning district and/or upon public structures; and b. the towers and antennas are limited to a height of fifteen (15) feet projecting above the structure. The City Council may permit antenna heights of up to twenty-five (25) feet above the structure if the applicant can demonstrate that, by a combination of antenna design, positioning of the structure and/or by screening erected or already in place on the structure, off-site views of the antenna are minimized to accepted levels. 4. Public utility structures, including but not limited to water towers, antennas, lights and signals, power and telephone poles, and poles supporting emergency warning devices. 10-29-4: SETBACKS: Towers shall conform with each of the minimum setback requirements: Towers shall meet the principal structure sethacks of the underlying zoning district except that towers may be located five (5) feet from the rear property line, provided that the rear property line abuts industrially zoned property and the tower does not encroach upon any easements. Required setbacks for pri»cipal structures in the R-1 District are: Front Yard: 20 feet, Side Yard: 10 feet, Side Yard (Street): 20 feet, Rear Yard; 30 feet. The proposed tower meets all setbacks of this zoning district, being /ocated at /east 150 feet from any property line. For protected residential property, the required setback for an antenna and tower not rigidiy attached to a building, shall be equal to the height of the antenna and tower. Those antennas and towers rigidly attached to a building, and whose base is on the ground, may exceed this required setback by the amount equal to the distance from the point of attachment to the ground. Towers shall be set back from all public rights of way and roadway easements by a minimum distance equal to one half (1/2) of the height of the tower including all antennas and attachments. The proposed tower is located approximately 300 feet from the nearest pub/ic right-of-way meeting the above stated set back from aU public right-of-way. T-Mobile Communica[ion Tower proposal Page 3 of 9 1301 E. CounN Rd 42 Towers shall not be located between a principal structure and a public street, with the following exceptions: 1. In industrial zoning districts, towers may be placed within a side yard abutting an internal industrial street. 2. On sites adjacent to public streets on all sides, towers may be placed within a side yard abutting a local street. A tower's setback may be reduced or its location in relation to a public street varied through a conditional use permit, at the sole discretion of the City Council, to allow the integration of a tower into an existing or proposed structure such as a church steeple, light pole, power line support device, or similar structure. The term "integration" may include replacement of an existing structure to include a personal wireless service provider, but does not include replication of a structure. A tower's setback may be reduced or its location in relation to a public street varied through a conditional use permit, at the sole discretion of the City Council and upon demonstretion that integration with an existing strudure is infeasible, to allow replication of an existing structure such as a church steeple, light pole, power line support device, or similar structure. T-Mobile is submitting a Conditiona/ Use Permit Application for review by the City Council for the integration of the tower as replication of a planned parking /ot /ight pole. The proposed tower is located within the existing parking /ot, and is located in the side/rear yard of the property. 10-29-5: TOWERS IN RESIDENTIAL ZONING DISTRICTS: Towers in the residential zoning districts are subject to the following restrictions: Towers supporting amateur radio antennas and conforming to all applicable provisions of this Code shall be allowed only in the rear yard of residentially zoned parcels. Towers supporting personal wireless service antennas and conforming to all appiicable provisions of this Code shall be allowed only in the following residentially zoned locations with a conditional use permit: Church sites; The proposed site for the T-Mobf/e tower is the Mary, Mother of the Church. T- Mobile is submitting a Conditiona! Use Permit application to meet this requirement. Park sites, when compatible with the nature of the park; 3. Sites guided under the City's Comprehensive Plan as Commercial Recreational Business Sites; Apartment complex or development; and Government, school, utility, and institutional sites. Only one tower shall exist at any one (1) time on any one (1) residential parcel, unless additional towers or antennas could be incorporated into existing structures such as a church steeple, light pole, power line support device, or similar structure. The proposed communication tower is the on/y such structure on or proposed within the subject property. 10-29-6: LIGHTING: Towers shall not be illuminated by artificial means and shail not display strobe lights unless such lighting is specifically required by the Federal Aviation Administration or other federal or state authority for a particular tower. When incorporated into the approved design of the tower for camouflage purposes, light fixtures used to illuminate ball fields, parking lots, or similar areas may be attached to the tower. The proposed tower is camouflaged as a parking lot light pole. For this reason, a replication of the former parking /ot lighting from the existing (planned) pole I'-Mobile Communication Tower proposal Page 4 of 9 1301 E. CounN Rd 42 wil! be mounted at approximate/y 20 feet, 10-29-7: SIGNS AND ADVERTISING: No signage, advertising, or identification of any kind intended to be visible from the ground or other structures is permitted, except appl,icable warning and equipment information signage required by the manufacturer or by Federal, State, or local authorities. T-Mobile wiU comp/y with this requirement. 10-29-8: ACCESSORY UTILITY BUILDINGS: All utility buildings and structures accessory to a tower shall be architecturelly designed to blend in with the surrounding environment and shall meet the minimum setback requirements for accessory structures of the underiying zoning district. Ground mounted equipment shall be screened from view by suitable vegetation, except where a design of non-vegetative screening better reflects and complements the architectural character of the surrounding neighborhood. T-Mobile's accessory structure consists of painted metal utility cabinets set on a concrete slab near the light pole structure, along the edge of the existing parking lot/driveway of the church. The equipment will be secured inside a/ocked worought iron fence with new landscaping to screen the view. The equipment location is approximate/y 150 feet from the nearest (side yard) property line, exceeding all required setbacks for the RI District. 30-29-9: DESIGN STANDARDS: Proposed or modified towers and antennas shall meet the following requirements: Towers and antennas (including antenna cables) shall be designed to blend into the surrounding environment to the maximum extent possible as determined by the City through the use of building materials, colors, texture, screening, landscaping, and other camouflaging architecturel treatment, except in instances where the color is dictated by federal or state authorities such as the Federel Aviation Administration; In the spirit of the Burnsville zoning ordinance, the proposed tower is camouflaged as a parking lot light pole. Personal wireless service towers shall be of a monopole design unless the City Council determines that an alternative design would better blend in to the surrounding environment. oposed tower is of a monopole design. 10-29-30: CO-LOCATION REQUIREMENT: All personal wireless service towers erected, constructed, or located within the City shall comply with the following requirements: A proposal for a new personal wireless service tower shall not be approved unless the City Council finds that the telecommunications equipment planned for the proposed tower cannot be accommodated on an existing or approved tower or building, that is greater than 75 feet in height, within a one-quarter (1/4) mile search radius for towers less than one hundred twenty (120) feet in height or a one-half (1/2) mile search radius for towers equal to or greater than one hundred twenty (120) feet in height of the proposed tower due to one or more of the following reasons: 1. The planned equipment would exceed the structural capacity of the existing or approved tower or building as documented by a qualified and licensed professional engineer, and the existing or approved tower cannot be reinforced, modified, or replaced to accommodate planned or equivalent equipment at a reasonable cost. 2. Existing or approved towers and buildings within the search radius cannot accommodate the planned equipment at a height necessary to function reasonably as T-Mobile Communicahon Tower prOposal Page 5 of 9 1301 E. County Rd 42 documented by a qualified radio frequency engineer. 3. Other unforeseen reasons that make it infeasible to locate the planned telecommunications equipment upon an existing or approved tower or 6uilding. T-Mobile conducted a search within ?/z mile of the proposed tower /ocation. There are no existing towers, water towers or other suitab/e buildings or structures that could accommodate T-Mobile's needs in this »eighborhood. T- Mobile already occupies space at the nearest water tower faci/ity to the south in Eagan. The applicant must demonstrate that a good faith effort to co-locate on existing towers and structures was made, but an agreement could not be reached. Any proposed personal wireless service tower shall be designed, structurally, electricaliy, and in all respects, to accommodate both the applicanCs antennas and comparable antennas for at least two (2) additional users if the tower is over one hundred (100) feet in height or for at least one (1) additional user if the tower is over seventy-five (75) feet in height. Towers must be designed to allow for future rearrangement of antennas upon the tower and to accept antennas mounted at varying heights. Since the proposed tower is not more than 75 feet in height, the accommodation of additional users fs not required. 10-29-11: TOWER CONSTRUCTION REQUIREMENTS: All towers erected, constructed, or located within the City, and all wiring therefore, shall comply with the requirements of Chapter 7, Title 4 of the Burnsville City Code. T-Mobile will provide complete, code-compliant engineering specifications for fhe tower and foundation when app/ying for a bui/ding permit for this installarion. 10-29-14: ABANDONED OR UNUSED TOWERS OR PORTIONS OF TOWERS: All abandoned or unused towers and associated facilities shall be removed within twelve (12) months of the cessation of operations at the site unless a time extension is approved by the City. In the event that a tower is not removed within twelve (12) months of the cessation of operations at a site, the tower and associated facilities may be removed by the City and the costs of removal assessed against the property. After the facilities are removed, the site shall be restored to its original or an improved state. 10-29-15: INTERFERENCE WITH PUBLIC SAFETY TELECOMMUNICATIONS: No new or existing telecommunications service shall interfere with public safety telecommunications. The proposed tower wil/ not interfere with pub/ic safety telecommunications. P/ease refer to the RF Engineering memorandum in Exhibit C for more information. 10-29-16: ADDITIONAL SUBMITTAL REQUIREMENTS: In addition to the information required elsewhere in this Title for an application for a Building Permit for towers and their antennas, applications for conditional use permits for such towers shall include the following supplemental information: 1. A report from a qualified and licensed professional engineer which does the following: a. describes the tower height and design including a cross section and elevation; b. documents the height above grade for all potential mounting positions for co- located antennas and the minimum separation distances between antennas; c. describes the tower's capacity, including the number and type of antennas that it can accommodate; and 2. For all personal wireless service towers, a letter of intent committing the tower T-Mobde Communica[ion Toaer proposal Page 6 of 9 1301 E. County Rd 42 owner and his or her successors to allow the shared use of the tower if an additional user agrees in writing to meet reasonable terms and conditions for shared use, so long as there is no negative structural impact upon the tower and there is no disruption to the service provided. A report and project drawings have been submitted along with the App/ication for the Conditiona/ Use Permit (see Exhibit B). Before the issuance of a building permit, the following supplemental information shall be submitted: 1. Confirmation that the proposed tower complies with the requirements of the Federal Aviation Administration, Federal Communications Commission, and any appropriate state review authority or that the tower is exempt from those regulations; and 2. A report from a qualified and licensed professional engineer which demonstrates the tower's compliance with the applicable structural and electrical, but not radio frequency, standards as required under Section 4-7-2(B) and (E) of the Burnsville City Code. T-Mobi/e will comply with these standards at building permit submittal. 10-29-17: EXEMPTIONS: The following antennas are exempt from the requirements under this Chapter except as otherwise provided in Subsection B of this Sedion: 1. Satellite earth station antennas that are two (2) meters or less in diameter and located or proposed to be located in a Business or Industrial District; 2. Antennas designed to receive signals as follows: a. Antennas that are one (1) meter or less in diameter and that are designed to receive direct broadcast satellite service, including direct-to-home satellite services; b. Antennas that are one (1) meter or less in diameter and that are designed to receive video programming services via multipoint distribution services, including multichannel multipoint distribution services, instructional television fixed services, and local multipoint distribution services; or c. Antennas designed to receive television broadcast signals. T-Mobile Communication Tower proposal Page 7 of9 1301 E. CounTy Rd 42 TITLE 4, BUILDING REGULATIONS: CHAPTER 7, TOWERS AND ANTENNAS; (A)Building Permit: It shall be unlawful for any person, firm, or corporation to erect, construct, place or re-erect, replace, or make structural repairs to any tower without first making application for and securing a building permit as provided in this title, except as provided in subsection (C) of this section. (B)Professional Engineer's Report: The applicant shall provide a report from a qualified and licensed professional engineer which demonstrates the tower's compliance with all applicable structural and electrical standards, including, but not limited to, the Minnesota state building code, and includes the engineer's certification. An application for a buiJding permit for the proposed tower and accessory equipment will be submitted once all zoning approvals have 6een granted. (C)Exceptions: Permits are not required for: 1. Adjustment, repair, or replacement of existing antennas or the elements of an antenna array affixed to a tower or antenna; provided, that adjustment or replacement does not reduce the safety factor. 2. Routine maintenance (e.g., painting) and other nonstructural related repairs of towers. 3. Antennas and/or towers erected temporarily for test purposes, for emergency communication, or for broadcast remote pick up operations, provided that all requirements of subsection (E) of this section are met, with the exception of subsection (E)8 of this section (regarding corrosive material) which is waived. Temporary antennas shall be removed within seventy two (72) hours following installation, unless additional time is approved by the chief building officiaf. Temporary towers erected for emergency purposes may be exempt from setback requirements of this chapter as determined by the chief building official. (D)Fee: The fee to be paid is that prescribed under building permit fees, section 4- 1-3 of this title. **The required bui/ding permit fee wil/ be paid. (E)Construction Requirements: All antennas and towers erected, constructed, or located within the city, including all necessary wiring, shall compiy with the following requirements: 1. All applicable provisions of this code. (Ord. 674, 7-7-1997) 2. Towers and their antennas shall be certified by a qualified and licensed professional engineer to conform with the latest structural standards and wind loading requirements of the 2000 international building code and the Electronics Industry Association and all other applicable reviewing agencies. (Ord. 956, 1- 18-2005) 3. The last signal level displayed is gey which indicates areas where the sigrial is only strong enough for outdoorcoverage.
