Ms. Beauchemin xas present and indicated she preferred to rezone to Agricultural rather than to aequire a specidl use permit as recommended by 6 , •. „ Council Minutes April 21, 1981 the Advisory Planning Commission. She indicated she had contacted all neigh- boring property owners and there were no objections to the use of horses on her property and to the rezoning. It seems he is calling the City Council, the County Attorney, ow Engineering Division, as well as other County offices in an attempt to pressure someone into ta3ang responsibility. The City has looked into the matter but is not anxious to become involved in what appears to be a County problem. The County has taken some action and Steve Sullivan (representing County Parks) was in yesterday to talk with Mike Foertsch. Because of the lazge amount of rain we have been experiencing, the lakes in Dakota County's Lebanon Hills Park aze overflowing into smaller ponds. Unfortunately, the smaller ponds are also overtlowing and, in the case of this property, the overtlow is draining under Cliff Road and then into a culvert under Lakewood Hills Drive. The runoff eventually drains overland to a pond on the north end of Mr. Peters' property. The pond is well beyond its normal boundaries and the County has now closed the Lakewood Hills Drive culvert in order to prevent further water from backing up into this property. It is unknown how long the culvert can remain closed, however, before it begins to flow over L,akewood Hills Drive and affect other properties. It is our Engineering Division's position that the problems with the overtlow and the drain system are the County's. Mr. Peters has agreed there is nothing the City can do but as the water recedes his major concern remains who will clean up the dead and dying fish that accompanied the runoff. Lane Wagener, one of our Engineering Techs, was out in the field this morning and spoke with Mr. Peters and Mr. Peters indicates the County is looldng into a clean up. Mr. Peters stated that a pond on his property is being flooded by runoff from Lebanon Hills Park. It apparendy is obvious where the water is coming from and he wants it stopped in order to avoid damage to his property. Mr. Peters said the problem began yesterday at approximately 11:00 a.m. and the ponding level rose six feet in a matter of hours. He has had representatives of the City and the County out to view the situation and there appeazs to be some disagreement as to what entity is responsible. There are no easemenu permitting overIIow to this pond and Mr. Peters is not concerned as to who will take responsibility only that someone does.
