1954 i.NERGY CODE REQUIREMENTS
On or about March 1, 1989, the following energy code requirements
' should be calculated and included with a building permit application.
1. Roof - ceiling assemblies - R-38 U= 0.025 Average
2. Exterior walls & rim joists - R-20 U= 0.11 Average
3. Floors over unheated spaces - R-20 U= 0.05 Average
4. Exterior overhangs will be considered as exterior wall.
5. Foundations (all exterior walls) - Minimum of R-5 insulation.
6. All insulated areas must be separated from the heated space
by a well-lapped or sealed vapor barrier with a minimum perm
rating of 0.1. A 4 mil. polyethlene sheet or equivalent meets
this requirement.
A Kraft face R-19 type insulation will be accepted in the rim joist
areas. Air chute baffles are to be placed in every rafter space.

The application of Sally Beauchemin for rezoning from R-1 to Agricul-
tural of a parcel in the Wilderness Retreat area on Cliff Road was next
considered. Ms. Beauchemin xas present and indicated she preferred to rezone
to Agricultural rather than to aequire a specidl use permit as recommended by

the Advisory Planning Commission. She indicated she had contacted all neigh-
boring property owners and there were no objections to the use of horses on
her property and to the rezoning. She had concerns about whether a special
use permit could be revoked in the future. There was also discussion concern-
ing the possibility of future special assessments in the area because trunk
lines are already located quite close. Mr. Beauchemin stated that she under-
stood that assessments aill be levied in the area in the near future. Egan
moved, Parranto seconded the motion to grant a special use permit to the
applicant with the understanding that the Couneil retains the right to review
the permit if there are alleged violations without any specific time limit on
the special use permit and that upon determination that a nuisance does exist
the Council could automatically revoke the permit; further, that th time;
more than three horses and one goat allowed on the property at any g'ven
further, that if there are any anoyances of smell from the deposit of the
animals the applicant shall remove the refuse from the property. All voted in

This type of construction also requires large amounts o£ labor. With labor costs
rising, this construction becomes expensive. It is now used principally for small
barns in suburban areas where a few animals will be housed.
Gothic roofs replaced gambrel roofs and could be fabricated in a plant and de-
livered to the site. This type of roo£, combined with prefabricated wall panels, is
uaed to build a prefabricated insulated barnl which is recommended for a stanchion
dairy barn.

gothic roofs can be made of 1" x 4" boards bent into a form and nailed as shown in

SUBJECT: POND ON PROPERTY AT 955 CLIFF ROAD
The following is an update regazding flooding on Dave Peters' property a655 _ Cliff Road.
It seems he is calling the City Council, the County Attorney, ow Engineering Division, as
well as other County offices in an attempt to pressure someone into ta3ang responsibility.
The City has looked into the matter but is not anxious to become involved in what appears
to be a County problem. The County has taken some action and Steve Sullivan
(representing County Parks) was in yesterday to talk with Mike Foertsch.
Because of the lazge amount of rain we have been experiencing, the lakes in Dakota
County's Lebanon Hills Park aze overflowing into smaller ponds. Unfortunately, the smaller
ponds are also overtlowing and, in the case of this property, the overtlow is draining under
Cliff Road and then into a culvert under Lakewood Hills Drive. The runoff eventually
drains overland to a pond on the north end of Mr. Peters' property. The pond is well
beyond its normal boundaries and the County has now closed the Lakewood Hills Drive
culvert in order to prevent further water from backing up into this property. It is unknown
how long the culvert can remain closed, however, before it begins to flow over L,akewood
Hills Drive and affect other properties.
It is our Engineering Division's position that the problems with the overtlow and the drain
system are the County's. Mr. Peters has agreed there is nothing the City can do but as the
water recedes his major concern remains who will clean up the dead and dying fish that
accompanied the runoff. Lane Wagener, one of our Engineering Techs, was out in the field
this morning and spoke with Mr. Peters and Mr. Peters indicates the County is looldng into
a clean up.
I trust this will conclude our participation in this matter but we will keep you apprised of
any changes.

SUBJECT: POND ON PROPERTY AT 955 CLIFF ROAD
A call was received in our office this morning from Dave Peters who owns the property at
955 Cliff Road here in Eagan. Mr. Peters stated that a pond on his property is being
flooded by runoff from Lebanon Hills Park. It apparendy is obvious where the water is
coming from and he wants it stopped in order to avoid damage to his property.
Mr. Peters said the problem began yesterday at approximately 11:00 a.m. and the ponding
level rose six feet in a matter of hours. He has had representatives of the City and the
County out to view the situation and there appeazs to be some disagreement as to what
entity is responsible. There are no easemenu permitting overIIow to this pond and Mr.
Peters is not concerned as to who will take responsibility only that someone does. He said
the problem could be alleviated via a culvert adjacent to Lakewood Hills Drive.
Mr. Peters asked that you be notified and a record made of tris complaint. I have not
checked any of the information with Public Works.

lines are already located quite close. Mr. Seauchemin stated that she under-
stood that assessaznts will be levied in the area in the near future. Egan
moved, Parranto seconded the motion to grant a special use perait to the
applicant with the understanding that the Council retains the ri3ht to review
the permit if there are alleged violat3ons without any specific time limit on
the special use permit and that upon determination that a nuisance does exist
