RE: RBA for Release from Restricted Access.
Ms. Schouweiler,
We own the lot one, block one, Acorn Pond. It is currently unimproved, but we are planning to
build our dream home here in Dakota County. We are writing to petition the Dakota County
Board to grant us access to our land through the south lot line, and access which is currently re-
stricted. We hope the boazd will consider granting this request for the following reasons:
? Probe Engineering, a professional surveying company, and the professional excavator for
our home, both recommend a south access as the preferred method for accessing the lot.
? A south access would result in a less steep grade in our driveway than the only alternate ac-
cess through the west lot boundazy. A westem access might force the driveway close to the
10% maximum grade permitted by the City of Eagan and would increase the difficulty of
accessing the lot. A forced topography change would negatively impact more azea and trees.
? A south access would be less damaging to the environment than a west access, specifically
regazding the number of significant trees which would have to be removed.
? A south access would be consistent with the driveways of our neighbors immediately to the
east and west of our lot.
? Probe Engineering and the professional excavator estimate the cost of constructing a drive-
way through the south boundary to be several thousand dollars less than one through the
west boundazy.
We would like to emphasize that we are not requesting that our driveway be permitted to pierce
Cliff Road directly. We understand that our driveway must join the neighbor's existing drive-
way, and we plan to have it do so well north of Cliff Road. We have met with some members
ofthe Plat Commission to discuss these issues, but the meeting was not fruitful. We feel that
this resuh may have occurred in part because the representatives from the County Highway De-
partment, an office which has indicated a positive disposition towazd our request, was not repre-
sented ai the meeting. We therefore wish to petition the full Dakota County Boazd to hear ow
request.

www.co.dakota.mn.us release of restricted access of Lot 1, Block 1, Acom Pond Addition. Said plat is adjacent to
CSAH 32, and is [herefore, subjec[ to the Dakota County Contiguous Plat Ordinance.
We received your letter asldng the Plat Commission To further consider the request for release of
restricted access. The Plat Commission had previously reviewed this request on December 18,
2000 and did not recommend release of restricted access. Subsequently, the County Board sent a
letter to the owners of the lot dated Januazy 31, 2001 in response to their letter petitioning the
Counry Board for the celease. The County Board letter stated that the Plat Commission is w act
on variance only when requested by the Cities to insure consistent application of the guidelines.
In 7996 and 1997, the Plat Commission reviewed the plat of ACORN POND ADDITION with
the plat being filed for record in March 1997.
The Plat Commission discussed the approval process of the plat and that the issue of access to Lot
1 was discussed in geeat length with the developei at the time of the plat approval. At Chat time
the pxoperty had one driveway that served the existing lot and this driveway need to the serve the
two proposed additional lots with no new access to CSAH 32. The driveway did not meet the
County's Access Spacing Guidelines for a proposed 4-lane divided highway with more than
15,000 ADT, which calls for no private driveways. However, this tract had no other access to a
public road and therefore, must access CSAH 32. The County required restricted access to be
dedicated on the final plat except for the one existing driveway opening.
The County has estabiisned the following Variance Conditions: A variance may be recorrunended
provided that:
• The conditions causing the hazdship are unique to the prapeity.
• The variance is proved necessary in order to secure for the property a right or rights enjoyed
by other properties in the same area or district under similar standards and conditions.
• Granting of the variance will not be contrary to public interest or damaging to the rights of
othex properties in the same area or districC. • The granung of the vaziance will not be contcazy to the poliey and intent of the Ordinanee or
detrimen[al Yo the public health, safery, and welfare.
• No vaziance shall be granted simply because theie are no objections.
• No variance shall be recommended solely for economic reasons.

The Plat Commission does not feel that any of these factors apply to the subject property and do
not recommend release of Ihe restricted access.
No work shall commence in the County right of way until a permit is obtained from the County
Highway Department and no permit will be issued until the plat has been filed with the County
Recorder's Office. The Plat Commission does not review or approve actual engineering design
of proposed accesses or other improvements to be made in the right of way. The Plat
Commission highly recommends euly contact with the Highway Department to discuss design
features of any construction in pub?ic right of way. The County Highway Deputment permit
process reviews the design and may require construction of highway improvements, including,
but not limited to, mm lanes, drainage features, limitations on intersecting street widths,
allowance and size of inedians, etc.

As required by the Dakota County Plat Commission, this letter is to request further
consideration by the Commission of the request for release of restricted access for the
above-referenced parcel in the City of Eagan. The Plat Commission has previously acted
on this item at the request of the property owners, David Bailey and Jennifer Simonds.
City staff has visited the site and are aware of the relatively substantial grading and tree
impacts associated with constructing a driveway for the lot (with reasonable grades) to
intersect with the existing driveway easement to the west. Staff also understands the
County's Access Spacing Guidelines for CliFf Road, which calls for no increase in private
driveways onto this classification of roadway. Hopefitlly, some resolution agreeable to the
property owner and Dakota County can be reached on this matter.
City staff is available to discuss this issue with you or the Plat Commission. Please contact

Mr. Gorder,
Thank you far meeting with our agent and touring our lot on Cliff Road.
At the direction of a Dakota CounTy employee, as part of our effort towazd an access vaziance, we
had sent a letter to each County Board Commissioner {copy enclosed}. Because our approach
was with the guidance of someone with Dakota County, the response was surprising. The en-
closed reply from Nancy Schouweiler of the County Board tells that protocol would have us seek
the efforts of the City of Eagan to assist us in this appeal.
We ask that you help shape the City of Eagan's involvement in this matter because of your pro-
fessional engineering credentials, and because yodve seen our lot with its topographical chal-
lenges. You, perhaps better than anyone can underscore the safety concerns that wme with a
steep grade that would resuk if the Dakota County were to fail to grant this variance.
Mr. Greg Hove, Eagan's City Forester might also have some contribution to our cause, although
we aze awaze from your conversation with our agent Tun Goggin that the County seldom consid-
ers tree preservation in its decisions. Also, we were thinking that Eagan's Ylanning Department
that had approved this lot sub-division might also have a favorable stance.
We own the lot one, block one Acorn Pond, it is currently unimproved, and we hope to build our
dream home here in Eagan. We purchased this land last year, and continued to save and plan our
dream with a new baby on the way. We have always been aware that our driveway would not
connect directly to Cliff Road, and we aze not seeking to change this fact. You understand that for
us to avoid a 10% &uade, we really need access through the south lot line. We seek your kind as-
sistance, and thank you for your attention.

This letter is to verify the status of significant trees located on Lot i, Block 1, Acom Pond Addition.
During a site visit on October 16, 2002, all significant trees were tagged and identified by Pioneer
Engineering, P.A.. It is noted that significant tree removal exceeds the 20% allowable (see graphic for
location, size and type of tree to be planted as mitigation). Several lazge oaks to be saved that are
located along the grading limits will be treated with Merit (systemic insecticide) and paclobutrazol
(growth hormone) due to the unpacts to their critiacal root zones.
The house has been staked. Tree protection fencing should be placed outside of the dtipline of all trees
to be saved. Future grading and construction should not have a negative effect on these trees.
