Presently, the parcel 10-02600-010-56 is located in part of
the SE; of the SW; of Section 26. The parcel is approximately
10 acres in size and zoned Agricultural. According to Chapter
11 of the Eagan City Code, an Agricultural zoning does allow
one family detached dwellings as a permitted use within an
Agricultural District. Therefore, the proposed parcel and lot
are consistent with the Eagan City Code Chapter 11 and allows
one family detached dwelling as a permitted use within this
district. Once utilities become available to the site, the
owner of the property may subdivide the property for a more
intense use. However, this will not be allowed until the
availability of utilities.
Enclosed is the section of the City Code specifying what the
permitted uses are within the Agricultural District.

districts are hereby established as shown on that certain
map entitled "2oning Map of the City of Eagan, Minnesota",
which map is properly approved and filed in the office of the
City Clerk, hereinafter referred to as the "ZOning Map".
Said map and all of the notations, references and other
information shown thereon shall have the same Eorce and
effect as if fully set down therein and are hereby made a
part of this Chapter by reference and incorporated herein as
fully as if set forth herein at length. It shall be the
responsibility of the City Clerk to maintain the Zoning Map
and make same available to the publ,ic. Where a dispute
arises over the City Clerk's determination of the exact
Location of a diatrict boundary, said dispute shall be heard

A. Permitted Uses. Within any Agricultural

6. A special permit pursuant to Subdi-
vision 7 of Section 11.40 shall be required for day care
facilities providing secvices to at least seven (7), but not
more than ten (10) children at one time. Payment of a
$25.00 permit fee and Council approval are required. The
applicant shall submit, for approval by the Council, a
petition upon which the applicant has acquired signatures of
all property owners or residents within 150 feet of the
applicant's property, or in the event the signatures are not
acquired, evidence of notice to such persons delivered ten
(10) or moce days prior to the hearing on the permit ahall
be submitted. The permit shall also be conditioned upon
licensing of the facility hy the appropriate State and
County agencies.

CITY OF EAGAN, (called City), and PAUL L. JOHNSON and MILLICENT JOHNSON,
husband and wife (called Owners) of 975 Cliff Road, Eagan, Minnesota 55123;
WNEREAS, the City proposes to asaess the following deacribed premiaea in
Dakota County, Minnesota, owned by Ownera:
The East 330.00 feet of the Southeast Quarter of the Southwest Quarter of
Section 26, Township 27, Range 23.
for the following improvements pursuant to City Project 444R:
Trunk Storm Sewer including lift station
Wt1EREAS, such assessments would normally be based upon the present trunk
area storm sewer assessment rate of $.OS per square foot for 331,610
approximate square feet that is, $16,581.00; and
NOW THEREFORE, upon consideration of the mutual covenants herein, the
parties agree as followa:
1. The City agrees to asseas said property for the Project and purpoaes
described above based upon a Large lot credit resulting in an assessable area
of 165,000 square feet, that is, $8,250.00.
2. The Owneie agree for themselves, their heits, executors,
administrators, successors, and assigns, that in the event that the actual uae
of the property is changed in the future, resulting in a aubstantial increase
in storm water runoff or in the event of subdivision of the property, then in
that event the City may reassess or levy a supplemental assesement at such
time limiting such reassesament or levy of a supplemental assesament to the
difference between the asseasment prior to the large lot credit and the
assessment with the large lot credit at the assessment rates, according to
City policy, in effect at such future time.
3. The Owners, for themselves, their heire, executors, administrators,
succesaors and assigne, further waive notice of any and all hearings necessary
and waive any and all objections to the present or future assessments agreed
to herein or to the proceedings related thereto and waive the right to appeal
auch assessments.
4. The undersigned hereby agree that this agreement may be recorded with
the Dakota County Recorder and that the owners shall execute any and all
documenta necessary to implement the recording of this agreement including the
delivery of the Owner's Duplicate Certificate of Title to the affected lands
if necessary.
5. The underaigned agrees that this agreement ahall run with the affected
land and binds the heirs, successora and asaigns of euch land.
6. The undersigned, heirs, successors and asaigns of such land, include
all of the person, firms or corporation that hold an interest in the assessed
land described above, including the fee title owners, contract for deed
vendees or vendora or holders of any other interest under contract for deed,
option or otherwise.
7. The undersigned hereby agree to grant an easement to the City of Eagan
as described in Exhibit A attached hereto, in coneideration of payment of
$180.00 for eaid easement.
