August 12, 2005 Mr. Patrick Gregg 13554 Coachman Road Eagan, MN 55122 Re: Retaining Wall in City Easement Area Dear Mr. Gregg: With the proposed connection of storm sewer piping for the adjacent new Pearlmont Heights development to the exisring storm sewer, it has come to the Ciry of Eagan's attenrion that a substantial retaining wall has been constructed over the City's storm sewer pipe along the common lot line with your neighbors to the south (3558 Coachman Road). The existence of this retaining wall over a public storm sewer pipe and within public easement violates the intention of the easement, which is to keep the area over the pipe free and clear of obstructions to allow for its proper maintenance and repair. Please see the attached plan sheet showing the pipe and easement. The location of the retaining wall made the conshuction of the new pipe connection from Pearlmont Heights difficult, but it was accomplished without apparent disturbance to the wall today. If there is a future settlement of the wall that you feel was a result of this construction, you will not have a claim as to damages because the walls are within the public easement. Further, if the City needs to excavate the storm sewer for future repair, and the wall needs to be removed to accomplish this repair, the City will not be responsible for the wall's replacement or repair, and the City will not be financially liable for compensarion damages associated with its removal. I hope you understand the City's need to ensure that its easements are clear from obstruction to allow for proper maintenance and repair of its storm sewer system.
