DRAINAGE AND UTILITY EASEMENT
THIS INDENTURE, made and entered into this Z?? day of
q P, 1987 by and between CLIFF ROAD PROPERTIES, a
Minnesota General Partnership fee owner, and ADVANCE
DEVELOPERS, INC. contract vendee, collectively Grantors, and
the CITY OF EAGAN, Dakota County, Minnesota, as Grantee,
WITNESSETH WHEREAS, said Grantors, are the owners of the
tracts of land in the City of Eaqan, Dakota County, Minnesota,
legally described as follows:
See Exhibit "A" attached hereto and made a part hereof.
and Grantors desire to declare an easement for drainage and
storm sewer purposes over the real property described on
Exhibit "B" attached hereto and made a part hereof.
NOW, THEREFORE, the said Grantors, in consideration of One
Dollar ($1.00) and other good and valuable consideration, to it
paid by Grantee, receipt of which is hereby acxaowledged,
hereby grant an easement over the property described on Exhibit
"B", to said Grantee, its successors and assigns, for permanent
drainage and storm sewer purposes and for utility line
purposes.
The Grantee shall have the right to what is reasonably
necessary for the enjoyment of the rights herein granted,
including the right of clearing the easement area to allow for
the use thereof as stated herein, and for ingress and egress to
and from said easement area and over and across said easement
area only for the purpose of laying, maintaining, operating and
repairing said utility lines.
And the said Grantors, for themselves, their heirs,
executors, administrators and assigns do hereby release the
