Dear Mr. Raarup:
This letter is in response to your request to the City Council at their December 5 listening session
to reconsider the special assessment levied to your property for fhe sVeet improvements under the
above-referenced project. Your objections to the assessment were also stated in your letter to the
Clfy.
As was explained to you by our City Administrator, Tom Hedges, at the iistening session, the City
met all applicable statutes in notifying and conducting public hearings for assessed property
owners, and that your opportunity for objection to the assessment expired after the public hearing
October 18, 2005. Mr. Hedges also explained the unfavorable precedent that reconsideration of
levied assessments would present to the City.
In our conversation afrer t6e Council tistening session, you requested that in lieu of Smmediate
reconsideration of the assessment, the City provide documentation that the assessment levied
under City Project 912 ($421) may be considered by the future City Council as a credit to possible
future streei upgrade improvement assessments, in the event an improvement and associated
assessment were to take place within the existing City Deerwood Drive right-of-way adjacent to
your property. In addition to your assessment notice sent to you in October, please consider this
lefter as such documentation. tVhile allosving such a credit on future assessments will be eniirely
at the discreYion of the City Council at the time of the assessment, City staff believes it is
reasonable that such a credit be considered.
For your information, the City is also sending letters to your neighbors (1244 Deerwood and 1250
Deerwood) who are in a similar situation to yourself along the unimproved portion of Deerwood
Drive, informing them of this same possible future situation.
A copy of this letter will be kept in the City's parcel files for future reference. Thanks for your

Dear Mr. Gorder and Eagan City Council Members:
My name is Thor Raarup. I live at 1240 Deerwood Drive, Eagan. I am writing in
regards to special assessment #103598 associated with project 912 -
WindcresUBirch Park/ Deerwood/ Denmark Street Improvements. I do understand
that a public hearing on this matter was already held in October. However, I am
requesting that you consider my appeal of the special assessment based on what I
believe are unique circumstances.
1. My properly at 1240 Deerwood Drive does not adjoin any of the improved
portions of Deerwood Drive, Denmark Avenue, etc.
2. Residents living on Hosford Hills were not assessed for any of fhe
improvements of Deerwood Drive or Denmark Avenue. And would not have
been even if Hosford Hills had not been improved.
3. Residents living on Deerwood Drive whose properties do not adjoin the non-
improved portion of Deerwood Drive (currently a dirt road) would not be
assessed if, hypothetically, there were a residential assessment for
improvements on this portion of Deerwood Drive in the future.
To me, the assessment logic is not consistenf. My property should be looked at
similarly to Hosford Hills properties. The improvements to Deerwood Drive and
Denmark Avenue affected them in the same way it did mine. I.e., both are dead-
ends that feed onto the improved roads. And, if there was a determination that no
assessment would be made to the Hosford Hills properties, the same logic should
apply to my property. Alternatively, if I am assessed for these improvements,
despite not having any adjoining property, any future improvement on the portion of
Deerwood Drive adjoining my property should also be assessable to the other
residents of Deerwood Drive. Please see the attached maps for supplementary
comments and detaii.

STREET OVERLAY IMPROVEMENTS
FINAL ASSESSMENT HEARING
ACTION TO BE CONSIDERED: Approve the Final Assessment Roll for Project 912
(Denmark Avenue/ Deerwood Drive/ Windcrest - Street Overlay Improvements) and
authorize its certification to Dakota County for collection.
FACTS:
• Project 912 provided for the bituminous overlay of the streets within the VVindaresU
Birch Pazk Additions/ Deerwood Drive/ Denmark Avenue neighborhood, south of
Wescott Road, east of Pilot Knob Road.
• The Fina1 Assessment Roll was presented to the City Council on September 20, 2005,
with a public hearing scheduled for October 18 to formally present the final costs
associated with this public improvement to the affected benefiting properties.
• The final assessment cost is about 20% less than the estimated benefit amounts that
were presented at the original Public Heazing December 6, 2004.
• All notices have been published in the legal papers and sent to all affected property
owners informing them of this public hearing. No written objections have been
received to date An informational meeting was held on October 11 to address a11
property owners' questions or concerns and provide any additional information of
interest. Of the 204 parcels (126 single-£amily, 76 townhomes, and 2 public facility
pmperties) being assessed, no one attended the meeting.

Dear Mr. Bergin:
As you requested in our telephone conversation of May 8th, I am
forwarding to your attention a copy of the Feasibility Report for
Project 361 which shows the assessment/benefited area associated
with the installation of this trunk sanitary sewer. In addition,
I am also forwardinq to you a copy of our 1982 Comprehensive Sewer
Map which designates the drainage boundary to be serviced by this
trunk sanitary sewer. As can be seen from this information, even
though your surface topography may show drainage to the south, its
sanitary sewer would be serviced by a deep sewer line draining to
the north into this trunk sanitary sewer, as there is no trunk
sanitary sewer to the south to service your property.
This is the reason for including your property in this project for
trunk area sewer assessments.
Although your property is approximately 5 acres in size, the City
has deducted the dedicated right-of-way for Deerwood Drive plus
an additional 20% of the resulting figure to arrive at a net assess-
able area of 3.64 acres to assessed at $995.00 per acre which
amounts to $3,621.80. This assessment is proposed to be spread
over 15 years at a rate of interest as determined by the Bond sale
that will finance the construction of this project. The interest
rate of the most recent Bond sale in December of 1983, was 10.5%.

The septic system at your home was inspected by myself on
April 4th. 'Lhe well was also sampled for water quality.
The inspection of the septic system shows a 1000
gallon concrete septi.c tank and a drainfield.
This system is IN COMPLIANCE. The tank will need to be
pumped and flushed on a 3 year basis to maintain i.ts
efficiency. See MPCA attachments.
Minimum septic tank size for a 3-4 bedroom home is 1500
gallons.

The water sample was sent to a state certified laboratory for
analysis. Tests performed were for Nitrates and Bacteria.
The Nitrate level is < 1 ppm. The limit is 10. The Ievel for
Racteria is acceptable..

Dear David:
As you requested, this letter is to explain what I witnessed regazding a septic drainfield
on property located at 1244 Deerwood Drive at the time of soils excavation for your new
home.
In October 2003, River City Builders Millwork, General Contractor, requested that I

come out to the site where I discovered that the drainfield for 1,240_Deerwuod Drive
encroached onto the property at 1244 Deerwood Drive as a result of a subdivision of
property at 1240 Deerwood Drive.
The property owner at 1240 Deerwood Drive was notified of this and he chose to
reconstruct his system to meet today's setback and size. Per discussions with your
contractor and excavator, the contaminated soils were to be removed. Upon returning to
the site, the removal was complete and soils are no longer an issue.
