As you've seen from the correspondence that I sent you in the previous e-mail, Mr. McCarthy
was notified of his likely assessment related to Project 1073, Wescott Road/Glacier Drive. The
street overlay and associated improvements were recently completed, so the assessment
question is a good question for him to ask.
I've attached the assessment roll and a map of the project/assessable area from the feasibility
report for your reference.
All of the properties that are proposed to be assessed as part of this project (including Mr.
McCarthy's) are potentially developable and not within a drainage and utility or conservation
easement. In accordance with the City's Assessment Policy, assessments have been proposed
at the properties highest and best use as guided by the City's Comprehensive Land Use Guide
Plan. All properties, other than Glacier Hills Elementary and All Saints Lutheran Church, are
proposed to be assessed as residential lots (8 total single-family residential lots) having
driveway access on to the streets to be improved. It is not clear on the attached map, but the
1,059 front feet of PIN 10-01500-76-014 (Mr. McCarthy's property) is not being assessed due to
the conservation easement on about 30 acres of this parcel.
The City's Assessment Policy states that 50% of the mill and overlay costs are assessable for
local residential streets, based on a standard 32-foot width. The estimated cost for single-family
lots based on the City's Assessment Policy is $12/front foot for Wescott Road and $16/front foot
for Glacier Drive.
Mr. McCarthy's proposed total assessment per the feasibility report is $26,212.
Perhaps this is where he is getting the referenced $25,000 amount in a letter. On that note, I
would be happy to help him try to determine the source of the letter if I could see a copy.

Councilmember Bakken stopped this morning and asked whether the City sent Pat McCarthy a letter regarding a
$25,000 damage clause for the work performed on his property or within the easement for the Fish Lake pond
improvements. Do you remember or have any recall of such a letter? Pat called Paul this morning with the question.
Also Pat contacted me this afternoon and asked why he was being assed for the overlay project on Wescott. Can you
shed some light on that.

Dear Mr. McCarthy:
I am responding to the concerns that you have raised regarding the location ofthe City ofEagan
storm sewer lift station near Hurley Lake, adjacent to your property. You had contacted Wayne
Schwanz, Utilities Superintendent, on Apri12Q 1999, and stated that you thought the lift station
may be outside of the public drainage easement that had been acquired from you in 1989.
I have tried to contact you by telephone, but was not able to reach anyone at your number. The
engineering staff has reviewed your concern and has verified that the lift station is clearly within
the easement. The structure is several feet within the limits of the easement and all pipe
connected to the lift station is likewise within public easement.
I have enclosed copies ofthe condemnation certificate and easement agreement for the
referenced public easements for your information. If you are not in agreemeot with this letter
you may want to pursue the assistance of a registered land surveyor in verifying the field
locations ofthe easements.

BACKGROUND INFORMATION
At the September 17, 1985, final assessment hearing held by
the City Council for the above-referenced project, Mr. Arnold Kempe,
attorney for Mr. Patric? McCarthy, submitted a written objection
enclosed on page(s) 1441K pertaining to the assessments associated
with the trun;c storm sewer installation through his property
under that project. Enclosed on page(s) y?l'SV are maps showing
the location of Mr. McCarthy's property in relationship to the
proposed improvement. Also enclosed on page(s) vrZ? is the
final assessment roll identifying the proposed assessments and
their related calculations. The acquisition of the permanent
and ter.iporary construction easements for the installation of
this facility was negotiated as a part of the resolution of
a special assessment appeal for a previous trunk storm sewer
project on another parcel owned by P:r. McCarthy. As a part
of these negotiations, considerable care and detail were given
to insuring that the pond located on Mr. McCarthy's property
would be provided with a storm sewer outlet into the storm sewer
system at a location and elevation acceptable to him.
STAFF RECOMMENDATION
Due to the fact that the area proposed to be assessed under
this project drains into the storm sewer system and that this
property is not entitled to any additional reductions, credits
or deferments that have not already been applied, it is the
staff's recommendation that the assessments be reaffirmed as
proposed.

FINDINGS
1 Prolect f{361 was properly noticed, heard, and approved by the City
Council on October 5, 1982.
2. The contract for Pro;ect 1J361, i.e „ 82-2, was properly noticed, bid,
ar.d awerded by t;e City Gounci;.
3. Tne tota: cost o: Pro ect {F361, including construction of
5383,310.00, and adminisiration, legal, engineering, bond interest and
niscellaneous costs of about 27? plus easement cost of $70,000 was about
$556,879.90.
4. The total assessments for Pro;;ect 11361 are proposed to be $517,407.02.
5. That the assessments in this matter were properly noticed and heard on
Septe;iber 18, 1984, at or by which time Patrick McCarthy filed written
ob;,ections to the proposed assessments, and the hearing was continued as to
his property.
6. The hearing herein was properly noticed and heard at a continued
hearing on February 19, 1985. At that time the Patrick McCarthy uas given the
opportunity to be heard, and at which time all information and appraisals
submitted by the owners were reviewed by the City Council. The City Council
also considered comments by City staff and consultants and appraisals prepared
by Daniel Dwyer.
7. The appraisal by Daniel Dwyer determined that the improvements in
Pro;,ect !/361 increased the market value of the involved property as follows:
Parick McCarthy, et al, parcel (E10-02200-011-04. Value of land
before improvements - $630,000, after improvements - $770,000,
special benefit - $140,000.
8. The proposed assessment of $97,077.35 is based upon uniform raLes
established in 1984 in aecordance with the City`s Special Assessment Policy.
CONCLUSIONS
1. The property described above has been benefited by Pro;;ect 11361.
2. The proposed assessments are uniform across the same class of
property.

3. The special benefit to the properties described above from Pro?ect
#361 as measured by the increase in market value, is $140,000 for the McCarthy
property.
4. The proposed assessments meet all criteria of special assessment lav
and procedure under M.S.A. Chapter 429.
LEVY OF ASSESSMENTS _
The City Council hereby approves and orders the levy of the assessments
against the properties described to be spread over 15 years at 10.5% percent
per annum in the amount of $97,077.35.

assessment roll adopted as stated above.

Dear Mr. McCarthy:
As you are aware, on January 15, 1985, the City Council held
the final assessment hearing pertaining to trunk area storm
sewer assessment over the northern 25+/- acres of the above-
referenced parcel. You had submitted a written objection pertaining
to the assessment proposed to be levied under this project at
that final assessment hearing. Based upon the written objection
that you submitted, the Public Works Department conducted a
further detailed review of the improvements installed in relation-
ship to the benefit received from your property under this parti-
cular project and subsequently recommended that your property
be deleted from this particular assessment roll. This recommenda-
tion was accepted by the City Council in the formal adoption
of the final assessment roll.
Therefore, there will be no trunk area storm sewer assessment
levied against the above-referenced parcel under this project
due to its deletion. However, this action does not relieve
this property of its ultimate obligation of trunk area storm
sewer assessments. They will become due and payable under an
assessment for some other benefitting project or when this property
develops as a condition of final plat approval.

On November 13, 1984, the City of Eagan completed the settlement
for the acquisition of the trunk area storm sewer easement with
the McCarthy family which includes the necessary easements to
provide for the trunk storm sewer outlet under Project 411 which
provides future benefit to Outlots D, E and F of the Windcrest
2nd Addition, which is proposed to be replatted into the Birch
Park Addition.
In accordance with a letter from our City Attorney to your attention
dated June 29, the City has prepared a Waiver of Hearing form
to be executed, notarized and returned to my attention which
will allow the City of Eagan to proceed with the certification
of this supplemental assessment for the acquisition of the related
easements for the trunk storm sewer outlet. A copy of this
letter is included for your information.
I would appreciate it if you would have the appropriate officers
of the company execute this form and return it to my attention
by December 31, 1984. If you have any questions pertaining

On November 13, a negotiated settlement was reached for the
acquisition of a variety of ponding and utility easements associated
with the above-referenced projects from the property owned by
the McCarthy family. The total negotiated settlement was
$230,680.27, which includes interest calculated from September
1, 1981, on a principal of $165,000.
Due to the fact that this settlement incorporated the vacation
of certain existing ponding areas, the acquisition of new ponding
areas and all permanent/construction easements necessary for
the completion of the above-referenced projects, the total cost
has to arbitrarily be allocated to the individual projects as
it was not done so as a part of the negotiated settlement.
This breakdown is as follows:

Although the major ponding area for Hurley Lake was acquired
under Projct 305, it should be noted that there were no related
trunk area storm sewer assessments associated with this project
which provided for the construction of Wescott Road. However,
the cost associated with the acquisition of the ponding area
should be the responsibility of the trunk storm sewer fund.
Project 382 provided for the installation of the necessary trunk
storm sewer facilities which made essential use of this ponding
area. Therefore, the cost associated with the acquisition of
the ponding area under Project 305 could justifiably be charged
to Project 382 for accounting purposes if necessary.
The cost associated with the acquisition of easements for Project
#361 ($69,903_11) were covered under a special assessment agreement
with Jim Curry which allowed the City to assess a supplemental
assessment of $70,000 to specified properties within the Lexington
South Planned Unit Development Agreement.

The cost allocated for the acquisition of easements for Project
411 ($20,970.94) will be reimbursed in the amount of $10,000
through a supplemental assessment by a previously executed agreement
over Outlots D, E and F(equally on a per lot basis) of the
Windcrest 2nd Addition in the very near future. An additional
$5,000 of reimbursement will be provided through a previous
commitment at the time of final platting the Pilot Pointe Addition
which incorporates parcels 010-27 and 020-27 in the northwest
quarter of Section 22. It is anticipated that this final plat
will be processed during 1985.

As you requested, I am forwarding to your attention detailed
in£ormation pertaining to the final assessment that is proposed
for the above-referenced parcel under Project 361. The total
amount of $98,055.10 for,this assessment is broken down as follows:
Lateral Benefit from Trunk Sanitarv Sewer:

Trunk Area Sanitarv Sewer:
54.1 Acres @ $995/Acre = $53,829.50

The footage of the lateral benefit from trunk sanitary sewer
was determined to be that portion of the trunk sanitary sewer
that would have had to have been constructed in the future through
the proposed development of the property in accordance with
the attached plan if the trunk sanitary sewer would not have
been constructed by the City under Project 361.
The area calculation provided a credit of 3.3 acres for the
pond and then applied a 20% credit (13.52 acres) to the resulting
figure for future public right of way dedication to arrive at
the assessable area of 54.10 acres.
This assessment is proposed to be spread over 15 years at a
10.5% rate of interest on any unpaid balance. This assessment

As you are aware, on July Sth, the City Council approved the final
assessment roll for Project 305 which provided for the installation
of trunk water main along Wescott Road with resulting trunk area
water assessments along with lateral benefit from trunk water main
assessments to the benefited properties. we received a written ob-
jection from the attorney for the McCarthy family for Parcels 10-
01500-010-76 and 10-022.00-011-04.% Subsequently, the Council con-
tinued the public hearing,until some future date to allow the City
to proceed with the proper property appraisal to justify tfie amount
of the final assessments.
Therefore, would you please initiate the.proper action to have this
property appraised and inform me as to the following course of ac-
tion to be taken to insure that this final assessment hearing can
be rescheduled and the final assessment roll adopted for certifica-
tion? I would like to have this process completed by September 15
if at all possible to insure that this assessment is certified to
the County by October 15th for collection on the 1984 property tax
statement.

Pursuant to the receipt of the sketch and description of the Blackhawk Lake
storm sewer project, our office prepared a rough estimate of the acreage
over which the City of Eagan requested utility easement on the property
owned by Patrick McCarthy and family. Our original figures were based on
payment for the widening of the permanent easement already taken for sani-
tary sewer by 10 feet in width and payment for a 170 foot temporary ease-
ment computed by subtracting the 30 foot wide permanent easement from the
requested 200 foot temporary easement. Based on these calculations, we
suggested payment for an estimated .447 acres of permanent easement and
7.188 of temporary easement. Assuming payment of $2,000 per acre for per-
petual easements and $1,000 per acre for temporary easement, the total pay-
ment to the McCarthys was suggested as $8,082.00. This was rejected.
Mr. McCarthy's attorney responded requesting payment for the full 200 foot
temporary easement saying that the pexpetual easement was for the perman-
ent taking of the property and that the temporary easement was for the
temporary nuisance caused by construction (i.e. placing of dirt, excava-
tion and movement of construction vehicles), concluding that the City
should pay for a temporary easement even where it overlaps a permanent
easement. The permanent easement was increased slightly and the tempor-
ary easement was actually reduced because of a mathematical error.
McCarthy has, however, stated that the City's normal payment schedule is
grossly inadequate and has requested payment of $12,000 per acre of per-
manent easement and $1,700 per acre of temporary easement. Based on these
figures and [heir acreage computations, they requested payment of $18,853.
We have since discussed the manner of computing the acreage with their
attorney and he tentatively agreed with our original computation of the
permanent easement acreage, but has continued to demand payment for the
full 200 foot temporary easement. Properly computed, this should be
9.222 acres of temporary easement.
Assuming $12,000 an acre for permanent and $1,700 an acre for temporary,
the amount demanded would be $21,053.40. At $2,000 per acre of perman-
ent and $1,000 per acre of temporary, the amount offered would be $10,118.
For your additional reference, an example of a possible middle ground
would be $5,000 an acre for permanent, $1,500 an acre for temporary, re-
quiring payment of $16,073.

We seem to be fairly close to agreement with Mr. McCarthy as to the amount
of land involved. The more difficult problem,faced by our office is the
negotiation of the amount to be naid per acre of easement. Mr. McCarthy
is arguing that a permanent easement is a complete taking of the land and
should be compensated for by payment of the full market value. The City,
of course, has contended that this is only a restriction of future use,
which, hopefully, has been planned in such a way as to place minimum re-
striction on future development of the property.

By authority of Minnesota Statutes, Chapter 117, I hereby certify
that the lands herein described have been taken by the county of
Dakota in eminent domain procee3ings for county hiqhway purposes in
. conformity with the requirements of Chapter 117 of said statutes as
amended; that commissioners were duly appointed by the court to
ascertain and report the amount of damages sustained by the several
owners on account of such taking; that said commissioners qualified,
and made and filed their report of such damaqes; that the time for
appeal fron the awards in said report has expired with no appeals
having been filad; that all damages, as determined by award, and by
agreement of the par=ies, have been paid by the County of nakota; that
the proceedings for the taking of certain rights in said lands are now
complete; and that said County now owns permanent and/or temporary
easements over said lands for the purpose of maintaining the same for
County highway purposqs.
