We'd like to respond to your letter dated January 12, 2005 regarding three items, here are our thoughts regarding each of these items. Item 1- Access to primary function areas - It is our belief that the lower half of the main level is the "primary function area". It contains the largest gathering space, as well as the accessible toilet. The existing building layout does not readily accommodate a ramp that would be upwards of 50' long to accommodate the slope and the required landings. A more reasonable solution would be to incorporate a lift that would have a small impact on the floor area and still provide access to the upper portion of the main level. Item 2 - Occupant Load and Occupancy Separation Level S.F. Item 3 - Required Toilet Fixtures Taking the 148 occupants from the table above, and dividing it by 50 (business occupancy - most restrictive) would require 3 toilets. There currently exists two toilets in the upper level that would remain -and our proposal is to remodel the toilet on the first floor for a total of 3 unisex toilets. MN Rules, Chapter 1311 - Section 501.4.1, item 5 states that "At least one accessible unisex or male & female toilet room for every 3 levels of the building" is required. We feel we are meeting the intent of this code by providing the accessible unisex toilet on the primary function level of the building.
