APPLICATION SUMMARY: An application has been submitted requesting
a Variance of 10' from the. required 40' front yard setback.
COMMENTS: The applicant is requesting a Variance in order to
construct a new garage off the front of the existing house.
The construction of I-35E resulted in the realignment and regrade
of Deerwood Drive which, in turn, left a drop in elevation of 8'
from the applicant's driveway to the improved street. The
applicant believes it is impossible to access the existing garage
because the driveway slope would be as severe as 45 degrees.
A Variance of 10' was previously granted at this site on December
20, 1984.

As you are aware, your request for a variance to the front yard set-
back requirement to allow the construction and addition of a garage
to your existing dwelling unit was placed on the December 6, 1983
Council agenda. It is my understanding that subject to approval of
this variance request, you are willing to accept the State's finan-
cial offer for acquisition of permanent and temporary construction
easements from your property. Similarly, one of the conditions of
approving the variance is subject to your acceptance of the finan-
cial settlement offered by MnDOT.
Unfortunately, when your item was brought up at the Council meeting,
it was continued until December 20th because there was nobody there
to represent and present the request. I was inadvertently called
out of the Council meeting when this item came up and was not able
to present the circumstances as we had discussed on the phone that
day.
Subsequently, when I explained the situation to individual Council-
members, they concurred with the staff's recommendation of approval
and indicated that they will pass and approve the variance request
at the December 20th meeting as a routine matter.
Therefore, based on the response that I received from the individual
Councilmembers that I personally talked with, I am willing to guar-
antee and assure you that your variance request will be accepted sub-
ject to your acceptance of MnDOT's settlement. The timing of this
issue becomes critical due to the fact that the Attorney General's
office has scheduled a Commissioner's Hearing for December 20th at
Hastings Government Center. Hopefully, you will accept this written
assurance and subsequently conclude your acquisition process with
MnDOT prior to the formal scheduling and initiation of the Commis-
sioner's court hearing on December 20th.
If you have any questions pertaining to the future action to be ta-
ken by the Council on December 20th, please feel free to contact
Thomas L. Hedges, City Administrator.

On May 4th, I forwarded to your attention a letter requesting that
Mr. Gene Danmeier (MnDOT Cc right-of-way acquisition) should not
proceed with any substantial monetary offer pertaining to damages
resulting from the upgrading of Deerwood Drive in association with
I-35E until the City has had an opportunity to review the design
that resulted in the determination of damages. Subsequently, I
have had several meetings with Ron Volker of your Detail Design
Section along with the affected property owner, Mr. Dale Wagnild.
After reviewing the various alternative designs to maintain access
to this property and the estimated construction costs associated
with extensive retaining walls and driveway relocation, it was mutu-
ally determined to be beneficial to all parties concerned to proceed
with a financial offer to allow the property owner to perform the
reconstruction/relocation of the existing garage at a lower eleva-
tion (approximately 9 feet below existing garage floor) which would
result in an acceptable driveway access slope.
However, the City has concerns that whatever money is transferred
to the property owner in consideration of the additional expenses
incurred to perform this reconstruction work, that it be earmarked
for that specific purpose. If there is anyway that when the pay-
ment is made that it could contain a hold harmless agreement or a
similar release for the City of Eagan and the State of Minnesota
should the property owner not proceed with his alternative design
of constructing a new garage at a lower elevation.
In summary, the City no longer has any objections to MnDOT proceed-
ing with the right-of-way acquisition and payment for damages in-
curred subject to proper protections being provided for the City.
Your response to the City's concerns in reviewing the matter has
been greatly appreciated as we now have a better understanding of
the problems involved.

The State of Minnesota has made you an offer to purchase your property
that is involved in this condemnation action. The State's appraisal
of value, as currently completed and approved, is in the amount of
$11,100.00. A description of the property being acquired from you by
the State of Minnesota is described in Exhibit "A" which is enclosed
with this notice.
Because you were not in a position to accept; or, for other reasons
did not accept the State's direct purchase offer, your property will
be acquired through an eminent domain proceedings. This proceedings
will be commenced by a hearing to consider the State's petition. The
hearing will be held in the Government Center at 9:00 A.M., on
Tuesday, December 20, 1983, at Hastings.
It is necessary for the State of Minnesota to secure title and the
right of possession to the property prior to the filing of the award
of the Court-appointed Commissioners in the eminent domain
proceedings. In accordance with Minnesota Statutes, Section 117.042,
you are hereby given notice that the State shall have the right to
take title and possession to the property or property rights, as
described in Exhibit "A", on February 14, 1984.
In the event this parcel involves any person lawfully occupying the
real property who will be required to move from a dwelling or to move
a business or farm, a subsequent "Notice to Vacate" letter will
follow. This letter will be sent at least 30 days prior to the date

that the property must be vacated. In the case of occupied property
the vacation date will occur no earlier than 30 days following the
title and possession date of February 14, 1984. All advertising
devices located within the right of way to be acquired must be removed
by the title and possession date of February 14, 1984.
In order for the State to comply with State law regarding the
acquisition of title and possession to property in advance of the
filing of the award, the amount of the State's appraisal of value must
be either paid to the parties of interest or be deposited with the
District Court on or before February 14, 1984.
If you are the record fee owner or a contract for deed purchaser of
the property, a "Request for Payment" and a self-addressed envelope
have been enclosed. If you want payment to be made to the parties of
interest, rather than have it deposited with the District Court,
please fill out the form and return it in the envelope provided. If
the payment is deposited with the District Court, it will be your
responsibility to contact the court to request release of any money
deposited with the court. Please return the request form prior to the
date noted on the bottom of the enclosed Request for Payment form.
Please be informed, that the payment of the appraised valuation by the
State, does not prevent you as the property owner or contract for deed
purchaser, from asking the Commissioners or a jury for additional
damages you feel have resulted due to this acquisition. If you
request that the money be paid directly to you, you will not, in any
way, have given up any rights you have in this proceedings.
