ACCESSORY HOUSING PERMIT/MICHAEL KALZENBERG
A. Accessory Housing Permit, 1725 Deerwood Drive for Michael
Ka lzenberg--Michael Kalzenberg who resides at 1725 Deerwood Drive
made application for an accessory housing permit on August 25, 1987.
Since this application is the first formal application received by
the City for consideration of an accessory apartment, the Planning
Department has carefully reviewed the intent of the ordinance and
proposed accessory apartment to determine whether the unit meets the
intent of the city ordinance. It was determined by the City Planner
that the application appears to meet all the requirements of the
Eagan City Code, Chapter 11.20, Subdivision 5.C.7. Therefore, a
letter was sent to all residents within 200 feet of the Kalzenberg
property stating that if any property owner wishes to object to the
proposal, a written letter of appeal must be submitted to the City
within 10 days of the date of that letter. The letter was mailed on

This item appears on the City Council agenda due to an objection
expressed by several neighbors in a petition dated August 26, 1987.
The neighbors have asked that this item be heard by the City Council
and are planning to attend the meeting on Tuesday to object to the
accessory housing permit as requested by Michael Kalzenberg.
Enclosed on pages through is a copy of a brief update
from City Planner Runkle including a petition received from home-
owners in the area.
ACTION TO BE CONSIDERED ON THIS ITEM: To approve or deny the
accessory housing permit as requested by Michael Kalzenberg of 1725
Deerwood Drive and, further, that action is required due to
objections stated by residents within 200 feet of Kalzenberg's
property.

We hereby propose to furnish in accordance with the specifications below, or on attached pages, all materials and labor to
complete the following:
GENERAL CONDITIONS: The project consists of repair of the south masonry foundation wall of
the home. Along with the repair the two existing windows at the east half of the south foundation
wall will be replaced with egress sized windows. The repair will consist of excavating along the
exterior of the south foundation wall to expose the wall. The wall will then be straightened to a
plumb condition, and reinforced with interior pilasters to provide a stable foundation. The egress
windows will be installed, the exterior of the wall waterproofed, and the soil back filled and
compacted. The surface grade along the exterior of the south wall will be changed to provide
proper slope away from the house. The following specifications apply:
PROJECT SPECIFICATIONS
1. Provide all permits.
2. Install braces at interior of south foundation wall.
3. Excavate to elevation of footings along south foundation wall. All soil to stay on site.
4. Install jacks at interior of south foundation wall and straighten foundation as close to plumb as
possible.
5. Remove section of foundation wall to provide access for two egress windows at east half of
south wall. Window openings to match existing window locations.
6. Install wood frames for egress window installation.
7. Install two clad casement egress windows at south wall. Painting staining and trim by others.
8. Install reinforced core fills 32" on center along south foundation wall. Each core fill to have one
1/2" steel rod.
9. Waterproof exterior below grade portion of south foundation wall.
10. Back fill excavation with existing soils. Compact in two foot lifts.
11. Install two galvanized steel area walls, one at each egress window. Provide escape ladder for
each area wall.
12. Haul in additional clay soils and grade to provide positive drainage away from building at
south wall.
13. Remove braces and shoring from interior of house.
14. All interior finish work to be by others.
15. All landscape and sod repair to by others.

The following is a summation of the facts of this matter to date:
1. In April of 1987, the City adopts an ordinance creating accessory
apartments. Eagan City Code Section 11.20, Subd. 5(c)7.
2. August 25, 1987. Michael Kalzenberg petitioned City of Eagan for
accessory housing permit.
3. October 20, 1987. Council resolves to deny the application based
upon the strong opposition of the neighboring property owners (Mr.
Yetzer included).
4. October 7, 1988. Complaint received from Mr. Yetzer advising the
City that the basement of the Kalzenberg property is being rented in
contravention of the ordinance and Council's action.
5. January 17, 1989. Council rescinds ordinance creating accessory
apartments. Eagan City Code Section 11.20, Subd. 5(c)7.
6. John Yetzer and other neighbors inform the City that Kalzenberg
had continued to rent his lower level as a separate unit up until the
present. Mr. Yetzer states there seems to be only one renter at
present. City of Eagan has directed us to serve notice and
prosecute, if necessary, Mr. Kalzenberg's violation of the R-1 zoning
ordinance prohibiting maintaining two living units in an R-1 zone.
On February 16, 1989, a certified letter was sent from our office to
Mr. Kalzenberg informing him that he was in violation of Eagan City
Code Section 11.20, Subd 5. We informed Mr. Kalzenberg that if he was
not in compliance with the City zoning ordinance by April 1, 1989, he
would be cited for criminal violation of the City Code, a
misdemeanor. Mr. Kalzenberg responded to our notice with a letter
dated February 23, 1989. In that letter, he stated he was not in
violation of the zoning code. Be stated that after the accessory
housing permit was denied, the couple living in his basement moved
out as required by the City Council. He further stated that he now
has three roommates which share the entire house equally.
The issues are whether the City has sufficient evidence to charge Mr.
Kalzenberg with a violation of the zoning ordinance and secondly, the
City's chances for success in prosecuting Mr. Kalzenberg.
The Eagan City Code allows only one family detached dwellings in R-1
districts (11.20, Subd. 5(a)l). "Family" is defined as an individual
or two or more persons each related by blood, marriage or adoption
living together as a single housekeeping unit; or a group of not more
than five persons not so related maintaining a common household and
using common cooking and kitchen facilities (11.03, Subd. 21).
Therefore, in order to prove that Mr. Kalzenberg is in criminal
violation of the Eagan zoning ordinance, the City must prove beyond a
reasonable doubt that Mr. Kalzenberg has two "families" residing in
his dwelling. Since Mr. Kalzenberg does not claim to be related to
the renters or renter, the City would have to prove that:
1. There are either more than five persons in the home or
2. That the unrelated persons are not maintaining a common household
or are not using common cooking and kitchen facilities.
We feel that there is sufficient evidence to charge Mr. Kalzenberg
with a violation of the Code. That evidence is as follows:
1. Kalzenberg's application for an accessory housing permit showed an
intent to use the home for two families.
2. The home inspection and diagrams made by Dale Runkle and Doug Reid
show that there are complete and independent living facilities
including a separate cooking and kitchen facility in the lower level
of the Kalzenberg home.
3. After the accessory housing permit was denied, Kalzenberg made
statements to the neighbors at the Council meeting that he would
continue to rent the lower level and would merely call the renters
"roommates".
4. Observations by the neighbors that Mr. Kalzenberg did indeed
continue to rent the lower level of his home.
5. Observations of the neighbors that the current renter uses the
lower level entrance to the home while Mr. Kalzenberg uses the upper
level entrance to the home.
While this evidence would give sufficient cause to charge a
violation, the City would still have an uphill battle meeting its
burden of proof. This is proof beyond a reasonable doubt. The City

must establish guilt by legally sufficient evidence, either direct or
circumstantial, so complete as to overcome reasonable theories of
innocence and to the exclusion of every other reasonable hypothesis.
This has been explained to Mr. Yetzer in detail and he is still
anxious for the City to proceed against Mr. Kalzenberg. We have
explained to him that the neighbors' testimony will be a crucial
element of the City's case. Mr. Yetzer has assured us that the
neighbors are ready and willing to testify. The City would also have
to subpoena Mr. Kalzenberg's renter to testify. The case may be won
or lost on whether or not this renter, in all likelihood a hostile
witness, will admit on the stand that he and Mr. Kalzenberg are using
separate cooking and kitchen facilities or are not "maintaining a
common household".

This letter is written as a follow-up to our phone conversation of
may 1, 1989. During that conversation I reviewed with you the
contents of our earlier conversation where we had discussed the
necessity for neighbor testimony should Mr. Kalzenberg be sited for a
zoning violation. You stated during our conversation that one of the
roommates had moved out of the Kalzenberg home recently and he had
also done some tidying up around the property.
I further explained to you that Mr. Kalzenberg had responded to our
letter telling him he was in violation of the zoning ordinance
regarding accessory apartments. I've enclosed a copy of that letter
for your information.
i explained to you that in order to prosecute Mr. Kalzenberg, we
would have to prove in a Court of law beyond a reasonable doubt that

home.
I will speak to Dale Runkle and we will make a determination as to
whether or not we would be able to successfully prosecute Mr.

I was saddened to receive your letter. It appears that
you have somehow been mislead. Your notification of a violation
is completely in error.
Some time ago, I applied for an accessory housing permit.
It was denied by the City Council. Shortly thereafter, Mark
and Janet Michael mover] out as required by the City Council.
Subsequently, I found honest hardworking roommates whose
lifesty7.es mesh with my way of life. Presently, I have three
roommates. Other then out respective bedrooms, we ull share
the entire house equally. I am not aware that four unrelated
people sharing a house is a violation.
I have no way of knowing for sure why you have taken time out
of your busy day -to allege that I am a non law abiding citizen.
I suspect that Mr. John Yetzer is continuing his personal
vendetta and has filed some false complaints against me.
If this is the case, I would appriciate if you and the City
would not be a party to this uncalled for harassment.
In summary, I am now and will always be in compliance with the
city zoning ordinance.
I hope this matter has now been satisfactorily cleared up

We write as City Attorneys for the City of Eagan.
You are hereby notified that you are in violation of Eagan City Code,
Section 11.20, Subd. 5.
Your home is located in a district zoned R-1. This means that only
one-family detached dwellings are permitted. By allowing renters,
unrelated by blood, marriage or adoption, to reside in your lower
level and providing them with complete independent living facilities,
you are in violation of the above-referenced zoning ordinance. A
violation of the zoning ordinance is a misdemeanor punishable by a
fine up to $700.00 and/or 90 days in jail.
The City staff has made numerous attempts to work with you on this
matter to no avail. They have now turned the matter over to us for
criminal prosecution. If you are not in compliance with the City
zoning ordinance by April 1, 1989, you will be cited for criminal
violation of the City zoning ordinance.

The Planning Department has been advised of the complaint
regarding the accessory structure or rental unit on Deerwood
Drive. As you recall, the City Council reviewed and denied an
application for accessory housing at this particular location.
The City has been contacted that the owners of the property are
using the basement as rental and the Planning Department is. in
the process of reviewing the circumstances regarding this
complaint.
The City has advised the complainant that they must file a
written complaint to the City in order for us to monitor the
property for the violation. Presently, it is difficult to cite a
violation as the City would have to provide proof this is a
rental unit and without permission from the homeowner to enter
the property, it would be difficult to determine if a violation
is occurring at this property. Upon receipt of a written
complaint, staff will then begin monitoring the property with the
help of the police department to determine if there is a
violation of the zoning code. We are also pursuing this
complaint with the City Attorney's Office to see if we can
prosecute or what information and documentation the City will
need in order to prosecute the violation.
The Planning Department is aware that this complaint has reached
City Council members and this department is working expeditiously
to review and monitor this complaint. Our utmost attention will
be given to resolve the current problem as soon as posible in
accordance with proper ordinance procedure. Staff will give you
an update on the situation once a determination is made regarding
an ordinance violation.

As you are aware, in November of 1987, homeowners appeared before the
City Council meeting and expressed their wishes of having the renting
of the lower-level apartment in a single-dwelling area stopped. The
owner of the property at 1725 Deerwood Drive was told at that meeting
that he must stop renting the lower-level apartment in his home.
The lower-level apartment has continued to be rented without
interruption. Since November 1987 there have been four different
parties renting the lower-level apartment; and the neighbors have not
received any letters regarding permit requests. The last renters moved
in the first of October 1988.

Dear Ms. Willey:
This letter is in response to your request for a written letter
from me stating my concerns expressed in telephone conversations
we had on June 19 and June 25 regarding the property at 1725
Deerwood Drive in Eagan.
My concern is the fact that the lower level of this home is being
rented as an "apartment". We built our home in the area 14 years
ago in a single family area and the fact that many parties moving
in are renting out parts of their homes is a concern to many
homeowners in our immediate area. We have been told by realtors
that this most certainly will bring down the property value.
We have not been notified that the above-mentioned property
wishes to rent out the lower level of their home as an apartment.
I have been told that a permit is needed to do this. We would
appreciated it if this matter could be checked in as soon as
possible. We too pay taxes and feel we have a right as a
homeowner to question the fact that a permit has not been
obtained and perhaps there are some matters that are not legally
up to code. For example, the stairs laid on the ground up the
back hill.
Please feel free to contact me if I may be of assistance. I did
hold up sending this letter thinking that perhaps this party
would move out and the "apartment" would not be rented again, but
this was not the case.
