Strobel 1434 Deerwood Path Eagan, MN 55122 RE: Conditional Use Permit Application by Tim Phillips I am a two-year resident of the Deerwood neighborhood. I've been aware of the conditional use permit application for a beauty salon by Tim Phillips and his wife for some time now. Although I live in a different cul-de-sac within Deerwood and would not be directly affected, I strongly oppose this type of business operating within the neighborhood. I'd be here in person to voice my opposition, but unfortu- nately, I have a previous commitment this evening. As you know, Deerwood is not a typical housing development. It has no outlet, so traffic is always very light. Consequently, children play in the streets and cul-de-sacs more than in any other neighborhood I've ever seen. In addition, the cul-de-sacs have islands in the center covered with hills, trees, shrubs and flowers. Automobiles can not see around the islands. Although residents are aware of this, people unfa- miliar with the neighborhood are not. Safety of the neighborhood children is my main concern with the Phillip's proposal to operate their business in Deerwood. For this reason, I attended the Eagan Planning Commission meeting on Tuesday, November 27, 1990. At that meeting, a vote to recommend the approval of this application was passed. I strongly oppose this decision. It is for this reason that I feel that the Eagan City Council needs to be aware of some additional information that did not come out at the Planning Commission meeting. In approximately March of 1989, before Mittelstadt Brothers Construction began the Phillips' home, I received a phone call from Tim Phillips. He asked for a rec- ommendation on Mittelstadt, since that company also built my home. I answered his questions about the builder, and then he then asked me the following question: "I'd like your honest opinion on one other matter. What would you think if my wife started up a beauty salon in our new house?" I replied - in no uncertain terms - that I thought it was a terrible idea and that I didn't think the Deerwood covenants even allowed such a business to operate. I also Jsaid that one of the reasons I moved to Deerwood was to get away from these types of businesses and that most if not all Deerwood residents would agree with me. I 2 felt this was a valid enough warning to Mr. Phillips that he might have trouble get- ting his wife's business started in Deerwood. Obviously, he thought differently. I urge the City Council to strongly consider the many valid concerns of the residents most directly affected by this issue. Again, even though I live in another corner of Deerwood, my sole motivation in presenting you with this information is the safety of all the children who live and play in Deerwood. My wife and I always notice right away the cars of people who aren't residents. They're the ones speeding around the cul-de-sacs at 30 miles per hour. In a closed outlet neighborhood like Deerwood, the conditional use application before you is not appropriate for the area.
