Dear Mr. Merchak:
This letter is in regards to our new store presently
under construction at 1815 Diffley Road, in Eagan.
It has been brought to our attention that the City
requires installation of Walk-in Coolers and Freezers
that are "U.L. Approved". Tom Thumb would appreciate
consideration to be allowed to install a non-approved
cooler and freezer. To compensate for deficiencies in
fire retardency, we would install a fire sprinkler system
on the interiors and fire wall the exteriors.
We believe that this would satisfy the intention of the
State codes.

messages I left you on February 11, 1993 and February 19, 1993. As you are aware, the
Eagan City Council denied conditional use pemut applications for outside storage/display
on Lot 1, Block 1, Bicentennial lst Addition and Lots 4 and S Block 1, Blackhawk Plaza
Addition at their regular meeting December 1, 1992 (see attached letter). Field inspections
made as recently as February 26, 1993 have revealed continued outside storage/display at
the above-referenced locations, as well as the Tom Thumb Store located on Lot 1, Block 2,
Cedar Cliff Commercia] Park. This outside storage/display is in violation of the City Code.
Further City involvement on this matter will require ]ega] action. This illegal use needs to
be stopped within two weeks from the date of this ]etter.

IN'fROllUCTION:
'I'his report concerns the compactiori testing we performed for the Tom Thumb Store project in Eagan,
nlinnesota. Willie Bauer oF W.J. Bauer Construction authorized this work on June 25, 1991.
SCOPG OF WORK:
The scope of our work consisted of the following activities:
1. Yerformance of two soil compaction tests on an intermittent basis as requested by Willie Bauer.
2. Determination of the moistu;e-density relationships for each type of soil encountered in our
compaction tests.
TGST METHODS AND RESUL7'S:
Dctails of our recent testing are included on the attached data sheets. The compaction tests and moisture-
density determinations were performed in general accordance with the ASTM procedures indicated on the
data sheets.
RGMARKS:
The samples from the individual compaction tests have been discarded. A representative sample of each
of ttie soils on which moisture-density relationships were determined will be retained at our laboratory until
completion of the project.

On November 19, 1991 the City of Eagan approved an ordinance regarding outdoor storage
in commercia]/industrial zoning districts. In an effort to allow e3dsting businesses time to
comply with this requirement, the City Council allowed six months, or until May 28, before
enforcement would begin. Your application does not meet the submission requirements and
as a result, it will not be scheduled For the June Advisory Planning Commission meeting.
Attached is a copy of the ordinance.
Once revised plans are prepared meeting submission requirements, the item will then be

posted as NO SMOKING ALLOWED. Signs ahall be placed at public entrances.
13. Provide a product stem-type thermometer for checking the internal temperaturea of
potentially hazardous foods.
14. The internal temperature of potentially hazardous food muet be maintained at
40°F or below, or 160°F or above, except during preparation. Exception: Poultry,
poultry stuffings, stuffed meats must be cooked to a minimum of 165°F.
Thermometers muat be provided in all coolers, freezers, and hot holding units
where potentially hazardoue food is stored, and must be located in an area that ie
representative of the true air temperature.
15. Provide and routinely use a chemical test kit to determine the atrength of the

THIS DECLARATION, made this 7-2 day of 1986, by BLACKHAWK

PLAZA, INC., a Minnesota Corporation and BEURE'-C0, a Minnesota Limited
Partnership, (hereinafter referred to as "Declarants");
HITNESSETH THAT:
WHEREAS, Declarants are the fee owners of certain real property located in
the City of Eagan, County of Dakota, State of Minnesota, legally described as
follows:
Lots 1, 2, 3, 4, 5, 6, and 7, Blackhawk Plaza, according to the plat
thereof on file and on record in the office of the County Recorder in and
for Dakota County, Minnesota,
(hereinafter referred to as the "Subject Property"); and
WHEREAS, Declarants desire to subject a portion of the Subject Property to
permanent easements for the purposes of ingress to and egress from the Suhject
Property, and further desires to provide for the maintenance, repair an3
reconatruction of said easements by the ownera of the Subject Yroperty.
NOW, THEREFORE, Declarants hereby declare as follows:
1. Permanent, private, non-exclusive easements and rights of way for the
purposes of access to and from the Subject Property are hereby created and
imposed upon those portions of the Suhject Property described as follows:
See Exhibit A attached.

(hereinafter referred to as the "Easement Property"). These access easements
shall be for the non-exclusive use and benefit of the owners of the Subject
Property, their respective tenants, licensees, invitees, successors and
assigns.
2. The Easement Property shall be blacktopped and used for access from
public streets and roads to the Subject Property. Declarants hereby impose
upon the present and all future owners of the Subject Property the obligation
of maintaining, repairing and reconstructing such blacktop. The cost and
expense of such maintenance, repair and reconstruction shall be borne by the
owners of the Subject Property and shall be allocated amongst them, ao that
each owner shall be obligated to pay a percentage of such cost and expense
equal to the percentage of the total square footage of the Easement Property
which is located upon the portion of the Subject Property owned by such owner.
In the event any owner of a portion of the Subject Property shall fail or
refuse to pay when due all or any portion of its share of the cost 3nd expense
of such maintenance, repair or reconstruction, then the other owners, or any
of them, may make such payment on behalf of such delinquent owner, and the
owner or owners making such payment shall be entitled to repayment from such
delinquent owner for all sums so psid, together with interest at the maximun
rate permitted by law. .
3. The easement rights and the obligations created herein and imposed
hereby shall be permanent in their duration, shall run with the land, and
shall be binding upon and inure to the benefit of the succeasors and assigns
of Declarants.

shall be in conformance with Article 79, Flammable and Combustible Liquids, contained in Minnesota
Uniform Fire Code (1988 edition as amended).
Final approval will be given following an inspection of the facility by either your area local fire authority
or Deputy State Fire Marshall.

The Watts 007 Series Doubie Check Valve Assembly is
designed to provide protection of ths potable water supp-
ly in acCOrdance with national plumbing codes and water
utility authority requirements. This series can be applied
to a variety of installations where the degree of hazard is

ment at the service line entrance, and where approved for

APPLICATION SUMMARY: An application has been submitted by Tom
Thumb requesting a Conditiottal Ose Permit to allow motor fuel sales
in a neighborhood business district on Lots 4& 5, Block 1,
Blackhawk Plaza, and a pylott siqn for Lot 4, Block 1, Blackhawk
Plaza.
BACRGROIIND: The Blackhawk Plaza final plat was approved in
November 1986 approximately. With plat approval, the project also
received approval for a Conditional Use Permit for Lot 5, Block 1,
to allow motor fuel sales. Tom Thumb currently located on the west
end of the strip center is proposing to relocate on Lots 4 and 5
located along Diffley Road.
COMMENTB: The site plan illustrates a building coverage of 11%.
Twenty percent is allowed in the NB zoning district. Circulation
on the site appears to be good, however there is potential for
vehicle movement conflicts with entrance to the site on the
northwest and on the west side. The potential hazard results from
the proximity of parking spaces to the drive entrances.
The City Code requires one off-street parking space for each 150
sq. ft. of gross floor area for retail uses. Based on the building
size, this proposal requires 26 spaces. The plan submitted shows
28 spaces, however four of these would be lost anytime the
underground storage tanks were being filled.
The site plan shows an inside trash enclosure on the south side of
the store. Staff has suggested moving the enclosure to the east
side of the building which would allow trash removal to take place
outside of any drive isles, as well as provide two additional
parking spaces on the south side of the building.
The applicant has not submitted an elevation plan illustrating the
appearance of the store and car wash buildings or the proposed
signage band for the canopy, store and car wash building. The
applicant has agreed to provide a brick surface to all sides of
both buildings that will match the brick exterior on the existinq
Blackhawk Plaza center. Staff has suggested to the developer that
the signage and color scheme of the canopy, store and car wash
fascia should be uniform. The developer has not made a final
decision as to the fascia, but will have renderings at the public
hearing.
Due to the car wash exit being on the north side of the structure,
staff has recommended that the car wash be equipped with a blower
and a catch basin. Details of the car wash have not been submitted
at this point.
The applicant has submitted a landscape plan that meets the overall
landscape plan approved in November of 1986. Installation of a 3-
foot berm in combination with the proposed landscaping along the
south property line may be appropriate. The overall plan addressed
only the southern property line of the two lots under
consideration. The applicant has, for the most part, continued the
intensity of landscaping on the southern boundaries along the east
boundary. The north and west boundaries are lacking significant
landscaping. Because site lines are important on the north and
south, it appears some overstory trees would be appropriate in
these areas. A detailed landscape plan will need to be submitted
on an approved grading plan.
The developer has not finalized the design and appearance of the
proposed pylon sign, however the sign will meet the Ordinance
required maximum height of 27' and maximum size area of 125 sq. ft
As shown, the proposed pylon does not meet the required 10'
setback.
aRADING. DRAINAGE 6 EROSION CONTROL: Although no grading, drainage
and erosion control plan was submitted with this application, the
development will be required to submit a detailed site erosion
control plan at the time of the building permit issuance. The
existing drainage over the proposed development is generally in a
northerly direction. The site was rough graded with the initial
development of Blackhawk Plaza.
The storm sewer and ponding system on the Blackhawk Plaza
development was designed to have Lot 4 drain to the pond to the
east on Lot 3, and Lot 5 drain to the west to the pond on Lot 1.
The pond on Lot 3 is drained via a 12" storm sewer system to the
pond on Lot 1. An outlet has been provided for the pond on Lot 1
through the storm sewer system on Blackhawk Road which drains
southerly to Pond AP-7. Pond AP-7 is a designated ponding area in
the City's Comprehensive Drainage Plan.
OTILITIES: An existing 8" sanitary sewer is in place along the
north edge of Lots 4 and 5 and heads northerly and then westerly
to Blackhawk Road. The sanitary sewer system is of sufficient
size, capacity and depth to serve this proposed development. The
need for a sanitary sewer manhole on the sewer service line and
provisions for a sand trap that serves the car wash will he
? evaluated at the time of building permit review and issuance.
Water main of sufficient size and capacity is available to serve
this development from the existing 6" line along the north side of
Lots 4 and 5.
STREETS/ACCESS/CIRCULATION: The preliminary site plan submitted
with this application proposes to obtain access to Lot 5 from the
private entrance road on the west and the private street to the
north. Lot 4 is proposed to have access from the private road to
the north. The access to Lot 5 to the north shall match the
centerline of the existing driveway to the north. City staff
recommends that a concrete valley gutter shall be constructed
across the private streets at all three intersections of the new
driveways.
Internal streets within the Blackhawk Plaza development are
privately owned and maintained. The private street along the
north side of Lots 4 and 5 shall be extended along the north
property line to the east edqe of Lot 4. Staff recommends that
a minimum of a 36' wide roadway be provided along the north
property line of Lots 4 and 5 to provide adequate access for this
and future development to the north.
A right-in, right-out access to the Blackhawk Pla2a development was
provided from Diffley Road. The preliminary site plan is not
proposing any new access off of Diffley Road.
EASEMENTS/RIGHT-OF-AAY/PERMITS: The building permit approval will
require dedication of the City's standard 10' utility and drainage
easements around the lots. This development shall be responsible
for ensuring that all regulatory agency permits are acquired prior
to building permit approval.
FINANCIAL OBLIGATION - 20-CU-1-3-90:
Based upon the study of the financial obligations collected in the
past and the uses proposed for the property, the following charges
are proposed. The charges are computed using the City's existing
fee schedule and connections proposed to be made to the City's
utility system based on the submitted plans.

property lines.
9. The pylon sign shall meet Ordinance requirements and be
subject to the one-time sign fee of $2.50 per sq. ft.
10. The buildings shall be constructed on all sides with brick
similar in color to the existing strip center.
11. All canopy and building fascia will be uniform in design.

conditions encountered; to raview and evaluate these conditions with
resgect to the proposed construction; and to present our fdundation
recommendations for the oonvenience store.

The project site is locate8 south of Diffley Road across fram the
Blackhawk Center, west oY Interstate 35 in Eaqan, Minnesota. At the
time of our exploration, the site was a relatively Plat lot. Ground
surfaee elevations at our boring locatians ranged fram +98.4 to +100.8
with reapect to our benchmark. The suX£iaial soils across the site
were soPt at the time of our exploration an8 our drilling equipment
experienced diffiaulty traversing the.site. This was likely due to the
recent rain and qround thawing.

One of our Engineers met you on-site on MarCh 28, 1991, to locate the
borfngs. The borings were located taping from existing structures
using the site plan you providefl to us. Our drill erew determined tha
gxound surface elevations et each boring looation usinq tlie top of the
Eire hydrant 40 feet northwest of our boring 1 as our benchmark. Due
to the absence of a known elevation, vre assiqned this benchmark a
relative elevation of +100.0 Eeet.

The borinqe were flrilled with a CME 35 rig, using hollow stam augers to
advance the bareholes. At the ti.me of our exploraLion, the surficial
soils were soPt and our 8ri11 rig had to be trnaed about the site by a
buildozer.
3oi1 samples wese obtained by the split barrel method in accordance
with AsTM: D 1586. The standarc! Penetration Values (N-values, blows
par foot) recorded in the sampling procedure are shown on the
respective logs. Trie N-values are uaed as an indication of the in-
place density oY cohesionless soils, and to a more appreximate deqree,
the consistency of cohgsive or semi-cohesive soils. Recovered samples
aere preliminarily classified in the fie].d by the drill crew, sealed in

The soil classification program was initiated by a Geotechnical
8ngineer examining each of the samples to determine the major and minor
soil components, while also noting the color, degree of saturation, and
any lenses or seams found in the - samples. The Engineer

plasticity in accordance with the Unified Soil Classification System.
The letter symbols in parenthases Following the written description on
the boring logs is the estimated group symbols based on this system.

The eubsurfaae conditions encountered at each boring Iocation are
described in the logs included in the report Appendix. SVe wish to
point out that subsurface conditions at other times anct lecations on
tha site may diPPer fram those found at aur boring locations. If
differept conditions are encountered during construction, it is
necessary that you contact us so that our recommendations ean ba
reviawed.
The surfiaial soils consisted of about 3 inches oP "topsoil" in boring
1, anc3 about 3 feet of silty sand fill in borinq 2. i7nderlying these
soil.s, we enaountered interbedded strata of inedzum desse to dense sand
and silt, and very ffitiff clay to the boring completion depths.
Numarous cohbles were noted within the sand and silt strata while
drilling. Below the fill and topsail, the SPT N-valuea ranged from 27
to 79.

Fill placed to bring the sita to final qrade shauld be 'granulaz. The
fill should be placed in loose lifts not exceeding 8 to 10 inches.
Each lift should be aompaeted to at least 95$ of the maximum Modified
Proctor dry density (ASTM: D 1557).
We recommend that a representativa of the 6eotechnical Engineer be
present to observe and test the base soils and compaction.

Footinga bearing withfn the medium dense to dense sands having an SPT
N-value oE at least 30 may ba praportioned assuminq a net allowable
bearing pressure not to exeeed 3,500 pounds per squara foot. This
refera to the pressura which may be tsanemitted ta the bearing stratum
in excess of the pressure Erom the gurrounding depth of overburden.
The Pootinga can be placed on the naturally-occurring sand'.or on
compacted granular fill placed as desaribed in th¢ Site 8raparation
section. Oversize for footinqs should be 1:1 (the fill beneath
Poot3nqs should extend outward 1 foot Erom the edge of the Eooting for
each 1 foot oP fill placed beneath tne footings). We recommend that
spread footinqs have a minimum width of at least 30 inches and that
strip Pootings have a minim? width of at least 20 inches, even if the
resultinq contaat presffiure is less than the recommended bearing,value.
We estimate that the maximum settlement of the completed structure be
on the order oE 1 inch with differential sattlement being less than
