Partnership, (hereinafter referred to as "Declarants");
WITNESSETH THAT:
WHEREAS, Declarants are the fee owners of certain real property located in
the City of Eagan, County of Dakota, State of Minnesota, legally described as
follows:
Lots 1, 2, 3, 4, 5, 6, and 7, Blackhawk Plaza, according to the plat
thereof on file and on record in the office of the County Recorder in and
for Dakota County, Minnesota,
(hereinafter referred to as the "Subject Property"); and
WHEREAS, Declarants desire to subject a portion of the Subject Property to
permanent easements for the purposes of ingress to and egress from the Subject
Property, and further desires to provide for the maintenance, repair and
reconstruction of said easements by the owners of the Subject Property.
NOW, THEREFORE, Declarants hereby declare as follows:
1. Permanent, private, non-exclusive easements and rights of way for the
purposes of access to and from the Subject Property are hereby created and
imposed upon those portions of the Subject Property described as follows:

shall be for the non-exclusive use and benefit of the owners of the Subject

2. The Easement Property shall be blacktopped and used for access from
public streets and roads to the Subject Property. Declarants hereby impose
upon the present and all future owners of the Subject Property the obligation
of maintaining, repairing and reconstructing such blacktop. The cost and
expense of such maintenance, repair and reconstruction shall be borne by the
owners of the Subject Property and shall be allocated amongst them, so that
each owner shall be obligated to pay a percentage of such cost and expense
equal to the percentage of the total square footage of the Easement Property
which is located upon the portion of the Subject Property owned by such owner.
In the event any owner of a portion of the Subject Property shall fail or
refuse to pay when due all or any portion of its share of the cost and expense
of such maintenance, repair or reconstruction, then the other owners, or any
of them, may make such payment on behalf of such delinquent owner, and the
owner or owners making such payment shall be entitled to repayment from such
delinquent owner for all sums so paid, together with interest at the maximum
rate permitted by law.
3. The easement rights and the obligations created herein and imposed
hereby shall be permanent in their duration, shall run with the land, and
shall be binding upon and inure to the benefit of the successors and assigns
of Declarants.

In response to your review comments dated April 30, 2003, and phone conversation
of May 1, 2001, the comments are provided:
The Project is being resubmitted under the IBC 2000, Code.
The second floor is the office space for the store operations. It will not
be a waiting area for the retail operations. The waiting area is a minor use
area of the office space with waiting for three persons (one for each
office). The total area for the second floor is 1,830 net square feet
(excluding stair). Per stated code review on sheet G100, the whole
second floor is considered office area with an occupant load of 20. (2,000
(gross) sf /100 sf per occupant - table 1003.222).
2. See response for #1.
3. Per table 1003.2.2.2, the occupant load of the second floor is 20 (see
response #1). Two exists would be required if the occupant load is over
50. Per section 1004.2.1, one exit is required.
4. Toilet rooms have been revised to comply with MSBC 1341.0405. See
attached drawings.
5. Per MSBC - 1341.0403 Item E Subpart #1, only 2 accessible spaces are
required. The third space will be revised to a regular space. Per section
1341.0428 Subpart 3 - two accessible spaces may share a common access
aisle. The access aisle conforms to section 1341.0428 Subpart 6.
6. Drinking fountain shall conform to MSBC. See attached drawings.

We have completed our review of the site plan and landscape documents
submitted in pursuit-of obtaining a building permit for the above referenced
project. It is our goal that this review will help you in complying with the
applicable codes and we are therefore, requesting that the following items be
addressed:
1. A lighting plan must be submitted for approval as addressed in Condition
6 of the Conditional Use Permit conditions.
2. The north elevation plan shall indicate additional building materials and/or
windows as addressed in Condition 8 of the Conditional Use Permit
conditions.
3. A revised landscape plan shall be submitted indicating additional
landscaping to the south of the building as shown on original plans
submitted with the Conditional Use Permit application and additional
landscaping on the south side of the parking lot is required. Eagan's
landscaping ordinance requires 75% of the parking lot shall be screened
from the public.

3. Service bay doors shall be prohibited from being open more than 12 inches during
automobile repair.
4. Automobile or truck rental is prohibited on the site.
5. Outdoor storage of tires or other automobile parts is prohibited.
6. Wall and pole mounted light fixtures shall be cut-off and shielded to control glare.
7. All wall and freestanding sign shall comply with the City Code.
8. An additional building material and/or windows shall be incorporated on the north
elevation of the building.
9. A state-registered landscape architect or state-certified nurseryperson shall prepare the
landscape plan.
10. Tree Protective measures (i.e., orange colored silt fence or 4 foot polyethylene
laminate safety netting) shall be installed at the Drip Line or at the perimeter of the
Critical Root Zone, whichever is greater, of significant trees to be preserved on-site.
11. The applicant shall contact the City Forestry Division and set up a pre-construction
site inspection at least five days prior to the issuance of the grading permit to ensure
compliance with the approved Tree Preservation Plan and placement of the Tree
Protection Fencing.
12. The development shall be subject to a cash dedication in lieu of water quality

Dear Mr. Carlson:
We have completed our review of the site plan and landscape documents
submitted in pursuit of obtaining a building permit for the above referenced
project. It is our goal that this review will help you in complying with the
applicable codes and we are therefore, requesting that the following items be
addressed:
1. A lighting plan must be submitted for approval as addressed in Condition
6 of the Conditional Use Permit conditions.
2. The north elevation plan shall indicate additional building materials and/or
windows as addressed in Condition 8 of the Conditional Use Permit
conditions.
A revised landscape plan shall be submitted indicating additional
landscaping to the south of the building as shown on original plans
submitted with the Conditional Use Permit application and additional
landscaping on the south side of the parking lot is required. Eagan's
landscaping ordinance requires 75% of the parking lot shall be screened
from the public.

3. Service bay doors shall be prohibited from being open more than 12 inches during
automobile repair.
4. Automobile or truck rental is prohibited on the site.
5. Outdoor storage of tires or other automobile parts is prohibited.
6. Wall and pole mounted light fixtures shall be cut-off and shielded to control glare.

8. An additional building material and/or windows shall be incorporated on the north

Critical Root Zone, whichever is greater, of significant trees to be preserved on-site.
11. The applicant shall contact the City Forestry Division and set up a pre-construction
site inspection at least five days prior to the issuance of the grading permit to ensure
compliance with the approved Tree Preservation Plan and placement of the Tree
Protection Fencing.
12. The development shall be subject to a cash dedication in lieu of water quality
ponding.
13. The development shall be subject to cash park and trail dedication.

Introduction
This report summarizes the results of our special inspection and construction materials testing services
performed during construction of the Jim Cooper's - Eagan Tire and Auto Service located at 4180 and
4190 Blackhawk Road in Eagan, Minnesota. Our work was performed in general accordance with our
cost estimate dated May 19, 2003. The services provided included:
• Footing subgrade observations,
• Concrete reinforcement observations,
• Concrete testing,
• Masonry observations and testing, and
Structural steel observations.
We have provided International Conference of Building Officials (ICBO) certified special inspectors,
engineers, senior engineering assistants, engineering assistants and engineering technicians to conduct
the observations and testing in general conformance with the Uniform Building Code (UBC) Section
1701 and the project specifications.
Special Inspections
Our observations and testing were completed in accordance with the guidelines of UBC Section 1701,
Special Inspections and the project's specifications. For each observation, a Special Inspection Daily
and/or Weekly Report was completed describing the work observed and the tests made- If the work
observed did not conform to the project drawings and specifications, the item was documented and the
contractor was informed of the needed rework on an area. If the discrepancy was not immediately
corrected, the site superintendent, project manager and structural engineer were notified. Corrected
discrepancies were noted on the special inspection reports.

Soil Observations and Testing
On June 11, 2003, we observed the subgrade soils for the building's footings. The approximate density
or consistency of the poorly graded sand and clayey sand were estimated by judging the force required to
advance scattered, shallow (about 2 to 3 feet deep) hand auger probes. Soil classifications were
determined in the field using American Society for Testing and Materials (ASTM) procedures by
examining the hand auger probe cuttings.
The soils exposed at bottom of footing elevation were estimated to be in a medium dense condition and
are similar to the soils encountered in Allied Test Drilling Company's geotechnical report, dated
December 16, 2002. The soils, as observed in our shallow hand auger borings were judged to be suitable
for foundation support.
Concrete Reinforcement Observations
Observations were made of the concrete reinforcing. The observations were performed by an ICBO
Certified Special Inspector for Reinforced Concrete and included observing the reinforcing steel for
proper size, spacing, concrete cover, splice length and comparing them to certified structural drawings.
For a detailed description of the work observed see the attached Special Inspector Daily Reports.
Concrete Testing
Braun hitertec performed slump and air tests and cast 3 sets of concrete test cylinders from concrete
placed for the building's footings. We also cast one set of concrete test cylinders from concrete placed
for the building's slabs-on-grade.
Review of the 28-day test results indicate the concrete represented by these cylinders has met or
exceeded the specified minimum 28-day compressive strength. The concrete tested should be considered
acceptable based on the requirements of the plans and specifications. The results of the compressive
strength tests were previously forwarded and are attached to this report.
Masonry Construction Observations and Masonry Grout
Periodic observations of the masonry construction were conducted by an ICBO Special Inspector. For a
detailed description of the specific areas observed, see the attached Special Inspector Daily reports.
Two sets of masonry grout prisms were cast during the masonry construction. Results of the set cast on
July 2, 2003 were below the specified compressive strength of 3,000 pounds per square inch (psi). These
test results were reported to you. We noted that the samples were poorly made and may not represent the
actual in-place strength. Results of the set cast on July 11, 2003 indicate the compressive strength of the
grout prisms exceeded 3,000 pounds per square inch (psi). Results of the compression tests are attached.

Structural Steel Observations
The observations of the structural steel construction were performed by an ICBO Certified Special
Inspector for structural steel or a Level II Technician qualified in accordance with the American Society
for Nondestructive Testing (ASNT), publication SNT-TC-lA.
The structural steel observations consisted of structural member size and location, visual weld
examinations and bolting observations, which were performed on a periodic, on-call basis. Daily
Observation Reports were submitted. For a detailed description of the work observed, see the attached
Structural Steel Special Inspection Daily Reports.
Summary
Based on the results of our excavation observations and hand auger probes, it is our opinion that the soils
encountered in the excavation bottoms are suitable for foundation support.
Based on the results of our concrete reinforcing observations, the reinforcing observed was placed in
general accordance with the available plans and specifications.
Based on the results of our concrete tests, it appears the concrete tested for this project has met the
minimum compressive strength requirements.
Based on the results of our periodic masonry construction observations of the masonry reinforcing,
masonry units and grouting, it is our opinion that the areas observed were found in general conformance
with the available plans and specifications.
Based on the results of our grout tests, the grout tested for this project during our site visit on June I I has
met the minimum compressive strength requirements.
Based on our observations, the structural steel construction observed was done in accordance with the
approved plans, specifications and applicable provisions of the Uniform Building Code (UBC).
It is our opinion that at the time of our last observations there were no outstanding discrepancies.
General Remarks
No established national standards exist for excavation observations. We have used the methods and
procedures described in this report. Other firms may use different procedures to evaluate bottoms of
excavations.
This test report contains only findings and results arrived at after employing the specific test procedures
and standard listed herein. It is not intended to constitute a recommendation, endorsement, or
certification of the project or material tested.
