The Dakota County Highway Department is purchasing two parcels of
land (in Eagan as part of the above-referenced highway right of way and
in Lakeville as part of the above-referenced highway right of way).
In both of the above-referenced land parcels we are concerned about prior
waste disposal and clean-up needs. The Dakota County Environmental
Management Department made site assessments and prepared a report
for each site. That information is attached for your reference.
The Steininger property is located at the NE quadrant of TH 55 & CSAH
26 (Lone Oak). It is approximately a 127,688 square feet (net) parcel with
a small house and double, detached garage at it's NW corner. The P.I.D.
no. is 10-00100-030-55.
The house and garage are unoccupied. It's address is 2980 Dodd Road,
Eagan, MN 55121. We can provide the house key.
The Cedar Avenue Auto Sales property is located on the west side of
CSAH 23 (Cedar Avenue), between CSAH 50 and Dodd Road at 19927
Cedar Avenue, Lakeville, MN 55044.

SUBJECT: 2980 Dodd Road, Eagan (Site #2943): Testing of Garage Drain Pits
On July 14, 1999, i sampled the two garage drain pits of the now vacant residential property
located at 2980 Dodd Road (former Max Steininger property), Eagan, northeast of the
intersection of Trunk Highway 55, Dodd Road, and Lone Oak Road (Site Assessment Inventory
#2943). The three samples were delivered under a chain of custody to Spectrum Labs, Inc.,
New Brighton, on that same date for analysis. The QA/QC (quality assurance and quality
control) approved results are appended [Attachment 1.], and a sample description and
analytical evaluation are provided as follows.
Soils. The Site Hazard Quotient (HQ) for human exposure is based on residential Soil
Reference Values (SRV). A HQ exceeding unity (HQ = 1) is of concern for any single analyte
or multiple analytes with the same target endpoints [specific organ systems (non-cancerous) or
generic malignancies (cancerous)]. A relative hazard quotient (RHO) may be calculated by.
adding all of the individual analyte HQs, but it is only a very gross estimate of relative human
risk. For example, a RHO of 11 is approximately equivalent to eleven times the acceptable
human exposure limit or 11 x 10"5 (11 additional deaths in 100,000 population). Toxic
Characteristic Leachate Procedure (TCLP) tests were not performed on any samples. TCLP
maybe required for site remediation (waste/contaminated soil removal) and off-site disposal.
Water. The Hazard Index (HI) for human exposure is based on public/non-public drinking
water standards [e.g., Health Risk Limits (HRL), Lifetime Health Advisory (LHA), and Maximum
Contaminant Levels (MCL)]. A HI exceeding unity (HI = 1) is of concern for any single analyte
or multiple analytes with the same target endpoints [specific organ systems (non-cancerous) or
generic malignancies (cancerous)]. A relative hazard index (RHI) may be calculated by adding
all of the individual analyte His, but it is only a very gross estimate of relative human risk. For
example, a RHI of 11 is approximately equivalent to eleven times the acceptable human
exposure limit or 11 x 105 (11 additional deaths in 100,000 population). The garage drain pits
may recharge the shallow groundwater (EPA Class V injection wells). Previously, the
residential well was found to have an elevated lead level [Lead - 48 ug/L (MCL -15 ug/L)].
However, the presence of lead in both the drain pits and the well may be unrelated.

Sample 1 (soil). The south drain pit (Drain Pit #1) in the garage contains petroleum-
contaminated [Diesel Range Organics (DRO) = 140 mg/kg] soil beneath the opening and the
encircling concrete slab floor. The brown sandy loam to loamy sand soils were stained dark
brown to brownish black, retained the odor of aged petroleum, and contained organic and
metal wastes scattered in the soil matrix. Lead was the primary inorganic contaminant [Lead
870 mg/kg (SRV 400 mg/kg)] and accounted for 2.18 of the cumulative RHQ of 2.24 (Table 1.).
Sample 2 (water). The north drain pit (Drain Pit #2) in the garage contains an oily waste in a
milky yellow-tinted water covering a viscous, dark gray sludge becoming interspersed with the
soil beneath. The aqueous sample had an aged petroleum odor and was slippery to the touch.
Diesel Range Organics (DRO) were found at a concentration of 0.900 mg/L. Lead [0.11 mg/L
(MCL 0.015 mg/L)], manganese [0.3 mg/L (HRL 0.1 mg/L)], and antimony [2 ug/L (HRL 6
ug/L)] were the primary inorganic contaminants detected. The three metals accounted for a
cumulative RHI of 10.7 of the total RHI of 11.0 calculated [secondary standards for iron and
sulfur were excluded from the calculation] (Table 1.).
Sample 3 (soil). Under the oily, yellow-tinted water (Sample 2 noted above); the north drain pit
(Drain Pit #2) in the garage contains a malodorous, viscous, dark gray sludge, which becomes
interspersed with the soil beneath. The sludge and soil were sampled. A DRO of 17 mg/kg
was detected. Arsenic [120 mg/kg (SRV 12 mg/kg)] and lead [500 mg/kg (SRV 400 mg/kg)]
were the primary inorganic contaminants detected. The two metals accounted for a RHQ of
11.23 of the cumulative RHQ of 11.31 (Table 1.).

Dear Mr. Steininger:
On May 3, 1983, the City Council authorized the issuance of
the above-referenced grading/excavation permit to allow the
placement of approximately 40,000 cubic yards of material on
the above-referenced parcel owned by Steininger Construction
Company, Inc., located in the northeast corner of T.H. 55 and
Lone Oak Road. This work was to be completed in conformance
-with the grading plan that was submitted with the permit application.
On June 7, 1983, because of concerns raised by MnDOT pertaining
to your operations, I had requested you to submit a written
detailed layout delineating your interim erosion control plan
and future permanent restoration. As of this date, I have not
received any response from you in regards to that request.
A recent inspection of the site indicates that you have expanded
your operations beyond the limits authorized by the above-referenced
grading permit. Consequently, you are in violation of City
Code No. 4.30 and are hereby ordered to CEASE AND DESIST all
operations associated with the property in the vicinity of the
above-referenced parcel. In addition, you are hereby enjoined
from any further work originally authorized under this permit.
In reviewing your original permit application, it has been found
that the original performance bond and insurance certificate
expired on April 25, 1984, and May 1, 1984, respectively. No
renewal certificates have been forwarded to the City to ensure
compliance with your approved permit.
Because of these violations, you are hereby given 30 days to
respond in writing indicating your proposed course of action
to bring your operation into compliance with City codes and
