Dear Mayor Bloomquist and Council Members:
Enclosed is a synopsis of 17ennis Braun and myself's ef£orts to preserve
the original holdina capacity, percolat.ion capabilities and natural
erosion control 'o£ the pond and adjacent hillside. This has been an
onEoinV e£fort since the announcement of the Ches Iviar Development in
1977 with very lil,tle cooperation from the developer and builder and
three years of "we'll see what we can do - call back in two weeks"
frcm the city engineer and buildinL inspector. ,
Before the Ches hiar Development the high water mark was defined by the
treeline arourc the gond. In 1975 (a recnrd year for rainfall) the pond
flooded almost to the treeline, but in the Fall of 1976 the pond bed was
completely dry. I had a garden beyond the treeline in 10,77 an3 in 1978
until it flooded out in July. Since the 1977 start of Ches Nar the pond
continued to rise without receding between rains as it used to. The
pond had flooded 73 feet onto nur lots by Tiay 1980. i,iany trees died and
and others uprooted and tipped over due to the flooded ground.
In Niay 1980 the City furnished a punn and i furnished the power to pump
the pond 3cv,n to de±erTn_ne tottorn damage due to siltation and to facili-

The above mentioned prablems should never have occured with proper
city engineering and supervision of the developer and builder. It is
unbelievable a contractor is allowed by the City to denude and leave
denuded for four years a steep hillside and allow it to erode and fill
a pond so as to flood neighboring iots nakine them unusable. The
initial storm sev;er engineerin7 was lax in r.ot investigating the effect
on adjacent pond levels through seepage between ponds especially after
this problem was brought to their atte^tion. The ?ity does not have
an easement to use our lots for storm sewer ponding water. We feel we
have legal ri'hts to the use of our backyards under normal percipita-
tion years. ',Ne have been very natient vrith the developer, builder ard
City, but unless somet};inc positive occurs by Au--ust 1, 1981 we feel we
have no recourse but to recover past and future damages through the
court system. This has also been conveved to the developer and builder
in a recent letter askin:r for their schzdt:le and plans to comrly with
Mr. Colberts October 1980 letter - as usual there was no response.

June 28p 1977 Dennis Braun and myself attended Planning Commission meeting
concerning plat of Ches Mar 3rd, 4th and 5th Additions. Pond
levels brought to Mr. Rosene's attention and we were aseured
there would be no adverse affect on east pond because storm
water would be piped to west pond. He was very vague about
size of ponds and steepness of surrounding area.
July 1977 Talked to NIr. Hedges and explained I wanted to make sure the
storm sewer wasn't piped to the small pond behind our lots
because I wasn't sure Mr. Rosene understood which pond I was
conr?erned about. He would have Mr. Rosene stop and check area.
Late July 1§77 Mr. Rosene visited pond area with Der.nis Braun and myself. He
assured us storm water would be piped to western pond and
there would be no affect on our pond. His remarks led me to
believe he hadn't seer the area before.
Fall 1977 Began bulldozing road tYru Ches Nar by pushinp trees and stumps
over hillside (future lot 10) and then coverine with clay fill.
Spring 1978 Heavy rains erroded hillside - washed large gullies in hill-
side.
Summer 1978 More clay fill pushed over hill to fill gu7.lies and recover
exrosed trees and construction debris dumped over hillside.
Pond continues to rise and is a mucky brorvn color. My garden
flooded out in July.

April 30, 1980 Tom Colbert called to review pond problem per Mayor Bloomquist's
sueaestion. We met at the pond and reviewed the lack of
erosion control on the lot 10 hillside and the damage the
- water was doing to the trees around the pond. Approximately.
113 of my lot is under water and approzimately 1/4 of Braun's
lot. Mr. Colbert agreed to pump the pond dry to determine
the severity of the clay seal on the pond bottom and would
contact Mfi. Tollefson to clean up the hillsire, restore pond
area to its natural state and provide erosion control to the
hill. I would furnish electricity for the pumping.
May 13 & 14,1980 City laid pipe and installed pump.
M,ay 19, 1980` After repairing pump oroblems City started pumping pond.

June 4, 1980 CaZled Colbert to see when they would get pump fixed. He
said City would continue pufi,ping until dry so we could in-
spect pond bottom and deter-ine next steu. City would work
with us on trying to get Mr. Tollefson to correct the negative
effect to our property caused by his negligent erosion con-
trol. Erosion has built up a minimum 3 foot high clay delta
which displaces more water on the lots on the other side of
the pond. I reiterated my oifer to remove some trees to
allow earth movine equipment access to the.pond area. Also .
my neighbor and I would allow the placeMent of fill on our
land when the delta is re-oved to restore the pond area to
its natural bottom and original contonrs. I also told Mr.
Colbert that Mr Tollefson had made some,effort to clear up
hillside by cstting, off and recoverine some exposed tree
trunks and sturips and scatterinn grass seed on hillside. No
mulch was used.
Jvne 10, 1980 Called Mr. Colbert. Last Thursday's rain washed out grass seed
and created some new gullies and deepered existing gullies.

Enclosed please find a synopsis of our efforts to preeerve
the original holding capacity, percolation capabilities and
natural erosion control of pond ar,d pond area adjacent to our
lots. This has been an ongoing effort since the announcement
of the Ches Mar Development in 1977.
We have had very little cocperation from the developer and
builder. The city has been very cooperative (the last year)
as we pumped the pond down to deterrr:ine bottom dariage and to
facilitate your restoring the area to its natural contours and
percolation capabilities as called for in Nlr. Colbert's letter
to you last October.
Last year the pond had flooded 73 feet onto our lots before
the city beaan pumping. P9any trees died ar.d others tipped
over due to the flooded ground. In 1975 (a record year for
rainfall) the pond flooded only to the existing treelir:e and
in 1976 the oond bed was completely dry. I had a garden be-
yor.d the tree line in 1977 and 1978 until July when it flooded
out nartially due to erosion and a bare hillside.
The heavy humus and wooded hillside prevented erosion and the
perculation of the pond bed was exceller:t until the develop-
ment of Ches N?ar. we thi-;k we are ?ot bei^g unreasonable in
asking for your cooperation in restoring tne pond area to its
natural stat.e. We also believe, leeally, you can not divert
water through negliger.ce or.to another's property and render it
nseless without proper comper.sation.
Please submit your plans and schedule to correct these
problems to the undersigned. If there is no response in
two weeks we will send a detailed synopsis of our four year
efforts and your resnonses to'the Mayor and City Council.
We hope this will be quickly resolved or we have no ehoice
but to obtain compensation through the legal system.

will be seeded with rye. He said he has no problems and I
have no problems, it is his property and he can do what he
wants with the hillside. If I still think I have a problem
I should talk to Rosene.
Sept. 26, 1999 Called Mr, Colbert. He will return call after a meetina. He
returned call at 5115 Friday night a£ter I had left work.
oct 3, 1979 Called &Ir. Colbert. Secretary noted subject of call and would
have him return call. Call was never returned.
April 28, 1980 Called Mayor Bloonqtiist - explained lack of erosion control by
developer and seeTiingly lack of concern by the city and de-
veloper. She inspected the pond area and acknowledged the
problem. She will talk to city officials at a meeting April
29 and give me the resulta.

April 30, 1980 Tom Colbert called to review pond problem ner htayor Bloomquist's
sueaestion. We met at the pond and reviewed the lack of
erosion control on the lot 10 hillside and the damage the
water was doing to the trees around the pond. Approximatelyi
1/3 of my lot is under water and approximately 1/4 of Braun's
lot. Mr. Colbert aQreed to pump the pond dry to deter^ine
the severity of the clay seal on th= pond bottom and would
contact Mr. Tollefson to clean up the hi2lside, restore pond
area to its natural state and provide erosion control to the
hill. I wauld furnish electricity for the pumping.
May 13 & 14,1980 City laid pipe and installed pump.
May 19, 1980 After repairing pump rroblems city started pumping pond.

June 4, 1980 Called Colbert to see when they would get pump fixed. He
said city would continue pumping until dry so we could in-
spect pond bottom and deter7ine next step. City would work
with us on trying to get Mr. Tollefson to correct the negative
effect to our property caused by his negligent erosion con-
trol. Erosion has built up a minimum 3 foot high c2ay delta
which displaces more water on the lots on the other side of
the pond. I reiterated my oifer to re^±ove some trees to
allow earth Movine equipment access to the pond area. Also .
my neighbor and I would allow the placer+ent of fill on our
land when the delta is removed to restore the pond area to
its natural bottom and original contaars. I also told Mr.
Colbert that Mr Tollefson had made some effort to clean up
hillside by cutting off and recovering some exposed tree
trunks and stumps and scatterinq grass seed on hillside. No
mulch was used.
Jvne 10, 1980 Called Mr. Colbert. Last Thursday's rain washed out grass seed
and created some new gullies and deepened existing gullies.
Told Tom or the need for complete erosion control, not just
a feeble effort of spreadinF some grass seed.

pond to the west.
Nov 17, 1980 Bulldozed (aprrox 3 hours) some of the fill at south edge of
pond onto a pile at S.W. edge o= pond. Cut fill 3 feet to
reach original earth contours. Piled dirt in area pre-
viously flooded so water will still be displaced onto our
lots. Did not remove all fill to base of hill. Arother
feeble effort at complying to city's requests.
Nov 18, 1980 Tollefson started rebuildinp wall. Bulldozed hillside and
removed previous retaining wall.
Nov 20, 1980 Bulldozer backfilled partially built retair_ing wall and
left site.
Nov 24, 1980 Called b]r. Colbert. He would rFturn call.
Nov 26, 1980 Called Mr. Colbert. He was unaware of Tollefson's bull-

Dec 1980 West end of pond doesn't freeze coMpletely until it re-
mains below freezing all day.

no action on the hillside. Tollefson completed a retaining
wall about t way down the hill. The hill remains unseeded
and partially bulldozed. Niore gullies have developed during
light rains this spring. Pand level has covered bulldozed
area at hill base and partially surrounds bulldo2ed fill
pile at S.W. edge of pond. According to Kr. Colbert. Mr.
Tollefson had led him to believe the hill had been taken
care of last fall. He would talk to Mr. Tolle£son again.

revealed that while an atterpt had been made to ramve the excess material, it had not
been finished graded to leave a snnrooth surface. In additicm, we have not witnessed suffi-
cient nreventive emsion control measures to insure that additional washing will not

oorbined with the vegetative restoraticn an the steep sidrslopes of the abwe-referencecl

As a follow-up to past correspondence and phone calls regardir.g the reauired clean-
up vrork of the pondi:ig area loca'„ed on the northside of the ahove-referenced lot, this
letter is hereby requesti*ig that you begin this clean-up work in a time frame to insure
that it is conpleted by the end of 1980. As you recall, the City and the adjacent pro-
perty owners have experienced severe erosion during the development of the Ches Ltar 4th
and 5th Additions and also during the development of the house located on 1277 Durberry
Lane (Lot 10, Block 2). This erosion has caused severe siltation to encroach in the
drainaQe easement and effectively seal off the percolation capabilities of this pcnd.
Approximately tvio inches to two feet of excess siltation vcill have to be renoved _`rom
this drainage base. In order to accomplish this, the City has been working cooneratively
erith 17r. Richard L. idey (!.497 Oak Chase Lane) to pump this pond dovm so that construction
equipr.,eat conld gain access to remove this excess mate^ial. The City has provided the
purip and pipizg wh_le Mr. Ney has provided the necessary electricity to accomplish this
referenced de-waterirg, ihis has been an ongoing operation since r.ad-July of this summer.
Hovrever, the pump i?rill no longer be available after October 15, 1980. Subsequently, we
urge you to contract vrith the necessary construction forces to provide for the siltation
removal of this pond. Mr. Ney has indicated his willingness to provide a location for
the placemer.t of the excess material to be removed from the pond. Pdr. Ney has also ex-
pressed his willingness to work cooperatively with you in providing an access to the
pondi:ig area i£ it becomes necessary.
I feel that both Mr. Ney and the City have been most cooperative in helping to alle-
viate the problen created by the erosion from the development of the subdivision and, in
particular, Lot 10, Block 2.
:lthough this pond has been kept in a de-watered state for approximately 10 weeks,
I feel it will still take a special piece of equipment to accomplish the end result of
removing this =xcess siltation. It is hoped that this material will be able to support
a traxcavator ::ith iv-ide-track "swamp" pads. If this piece of equipmen+ is not suitatle
the only other alternative will be a drag line. However, it vrill be your responsibility
to make the necessary arrargements with whatever contractor you so choose to perform
this work.

This letter is to inform you that the City of Eagan has experienced severe
erosion problems within the drainage easement along the north property line
of the the above referenced lot in the Ches Mar 5th Addition. A drainage
easemer.t was dedicated incorporating the pond at the bottom of the hill
behind this referenced lot. It is my understanding that during both the
development of this addition by the developer and the construction of this
single family residence, excess construction debris,, tree stumps, granular
fill, etc. was dumped over the side of this hill. Subsequently, with the
man}r rain falls that occurred since the initiation of the development and
during the construction of this single family residence, excessive erosion
washed down this bank and filled in the pond at the bottom of the hill.
This excessive siltation and erosion has killed several trees, decreased
the water storage volume area of this pond, and effectively sealed off the
seepage and percolat:on capabilities of thia pond.
To determine the extent of the siltation and erosion that occurred, the
City Public Works Department has pumped down this pond so that we could
evaluate the characteristica of this pond basin. Subsequently, an inspec-
tion revealed that there is up to two (2) feet of foreign material that has
washed into this basin. This is in violation of the rights protected by the
drainage easement and has definitely had detrimental effects on the water
quality and hydrological capabilities of this pond. It appears that the only
effective correction to this problem would be to remove all the material that
has settled into this ponding basin and establish e£fective erosion control
measures at the bottom of the disturbed slope, to prevent future similar
occurrances.

The City is requiring corrective action to be performed during 1980, so that
the pond can be restored to its prior conditions. The City feels that both
Gabbert Development Company and Tollefson Builders Incorporated are responsible
for the demage that has occurred. I would suggest that you two contact each
other, review the situation and submit a,joint proposal to the City of Eagan
for your proposed corrective action. I would like to receive this joint re-
sponse no later than July 25, 1980.

At the May 6, 1980 Council meeting, City Council had concerns over
final grading performed on the above referenced lot. A field inspec-
tion reveals that during this clearing, grubbing and grading oper-
ation of this particular lot for its development, that the trees
that were required to be removed,and their stumps,were buried on the
back lot line ad,jacent to the ponding area. In addition, a substantial
quantity of excess dirt was also piled there. Subsequently, because
it was not graded to its proper side slope or re-established with
seeding and vegetative growth, it continued ta erode and has created
an erosion problem in the pond at the bottom of the hill.
The Council is quite concerned that this problem be corrected as
quickly as possible.If the problem cannot be corrected by May 20,
it would be advisable if you would have an explanation and a proposed
plan with a time table as to the corrective measures that would be
taken. The Council will be expecting a status report at the May
20th Council meeting when you are presenting your final plat application.
