• RPZ's must be tested every year and rebuilt every five years. Test results should be mailed to Linda Dralle at the City
of Eagan Utilities Department (3419 Coachman Point, Eagan, MN 55122)
• A minimum permit fee is required per address for the following RPZ's: new, rebuild, repair, & remove.
• Water meters include copper horn / strainer, remote wire, and touch-pad meter.

Pursuant to your request, I am providing a letter to serve as a certificate of compliance for
the manufacture of the precast concrete which has been installed at the Terminal
warehouse project site.
Section 1701.7 of the 1994 edition of the Uniform Building Code states that special
inspections are not required when work is performed on the premises of a fabricator
registered and approved by the building official. To provide documentation of this fact, I
have enclosed a copy of a letter of confirmation from the Precast Concrete Institute that
Fabcon, Inc. is a member in good standing of the PCI Plant Certification Program. You
will note that the PCI Plant Certification program is recognized by the ICBO.
The P1ant Certification Program requires the maintaining of inspection records for all
concrete pours. These inspections are performed by Fabcon's Quality control staff and
the records are kept indefinitely. The precast concrete provided for this project by Fabcon
was manufactured in accordance with the approved plans and specifications.

Certification Pmgram as a producer of precasdprestressed concrete in product group and
category C4.
Certified plants undergo at least two unannounced audits annually while new pardcipanu undergo
three audits during the fust year. Mandatory compliance to nationally recognized standards is
necessary to attain and hold certification. A team of specially trained engineers from an
independent consulting engineering firm, conducts these audits on behalf of PCI.
The PCI Plant Certification Program was begun in 1967. It is a requirement of many Federal
and State Agencies. PCI is recognized as an approved quality assurance inspection agency by
the Council of American BuIlding Officials (CABO) which is comprised of the three model
codes: BOCA, ICBO and SBCCI.

Please review Section 106.3.5. and Chapter 17 of the 1994 Uniform Building Code for pertinent
information regarding the required Inspection and Observation Program (as well as information

I wish to emphasize the paragraph on hiring of the special inspector(s) and I quote: "The
special inspector shall be employed by the owner, the engineer or architect of record, or
an agent of the owner, but not the contractor or any other person responsible for the
work." I will need verification that this requirement was adhered to before a Certificate of
Occupancy wiil be issued.

In accordance with our cost esumate dated October 4, 1995, we have provided construction
testing services and special inspections for the Temrinal Wazehouse building. This report
provides a summary of our services.
Background Information
Braun Intertec Corporation (Braun Intertec) performed a geotechnical evaluation for the
facility. The results were submitted in our report dated May 25, 1995, Braun Intertec project
number BODX-95-033.
We were provided with a"Utility, Grading, Drainage and Erosion Control Plan" dated June
23, 1995, last revised September 17, 1995, prepazed by Development Engineering, P.A., and
a"FOOflng and Foundatiou Plan" dated August 2, 1995, prepazed by Lampert Architects.
Proposed Construction
The proposed office/wazehouse building will measure approximately 101,600 squaze feet in
plan dimension. The building is a one-level, slab-on-grade structure constructed with precast
concrete wall panels and a structural steel frame. The building will be supported by typical
spread footings with an assumed soil bearing pressure of up to 3,000 pounds per squaze foot.
Associated with the building will be bituminous drive and pazking azeas and underground
utilities.

Eacavation Observations
The site grading to prepaze the building pad and pavement azeas consisted of removing the
surficial vegetation and topsoil. The majority of the building and pavement areas were
cut-to-grade. Limited amounts of engineered &ll were required to establish pavement grade.
Prior to concrete placement, random, shallow (about 3 feet deep) hand au$er probes were
performed in the interior column and perimeter footing azeas. The hand auger probes
generally encountered poorly graded sand with silt soils which were judged to be in a medium
dense condition.
Reinforcing 06servations
Prior to concrete placement, observations of the footing reinforcement were performed.
Based on our observations, the reinforcing was placed in general accordance with ihe
available plans and specifications.
Compaction Testing
Compaction tests were performed in the engineered fill piaced to establish pavement grade,
utility trench backfill and wall bacld'ill. A totai of 31 compaction tests were performed and
all tests met or ezceeded the minimum density requirements of 95 or 100 percent of standard
Proctor density (AS1'M D 698). The com action tests and Proctor curve were previously

Concrete Testing
Concrete testing was performed on the footing and floor slab concrete. The compression test
cylinders were cast by the conuactor. The compression test results (set numbers 1, 2, 4 to 6)
of the interior column and perimeter footing concrete exceeded the 28-day strength
requirement. The 7-day compression test results (set number 7 to 14) of the slab-on-grade
concrete indicate that the 28-day strength requirement will likel be met. The compression
test resulu were previously submitted and a i to this report.

Structural Steel Observations
The strucnual steel observations were performed on November 3 and 16, 1995. The
observations consisted of visual weld examinations and bolting observations. The welds and
bolts observed were acceptable except for Report Number 1, Item Number 4, which was not
completed at the time of our 1 ation. The resulu of the structural steel observations

Based on the results of our soil boriags, ezcavation observations d hand auger probes, it is

Based on the results of our reinforcing observations, the reinforcutg was placed in general

Based on the resulis of our concrete tests, it appeazs the footing concrete has met the 28-day
strength requirement and the 7-day tests indicate that the floor slab concrete will likely meet
the 28-day strength requirement.
Based on the results of our structural steel observations, the welds and boiis observed were
found acceptable with the exception of Report Number 1, Item Number 4, which was not
completed at the time of our last observation.

Services performed by the geotechnical and material engineers for this project have been
conducted with that level of caze and sldll ordinarily exercised by members of the profession

An irrigation permit j$ required - please contact Protective Inspections at 681-4675.
Fees
Commerciai project: $25.50 irrigation permit to cover installation of backflow preventer.
$50.50 water permit fee only if new service is installed.
$300.00 per tap if instailed by City.
Residential project: $20.50 irrigation permit to cover installation of backflow preventer.
$50.50 water permit fee if new service is installed.
$760.00 per connection - WAC.
$396.00 12er connection - water treatment facility.
Existing residence: $20.50 irrigation permit to cover installation of backflow preventer -(not
required if backflow preventer previously installed).
Meter charge: If gallons per minute are less than 25, a 1" meter will be required at a cost of
$182.00. If gallons per minute are more thEin 25, a 2" turbo with strainer will
be required at a cost of $822.00. This information is to be supplied by the
designer of the system. No meter will be sold before all sewer and water inspections are complete on a new service. If new

and seal of the meter. Inspection hours are 8:30 a.m. to 3:30 p.m. Monday through Friday. Requests for
A.M. inspections should be made on the preceding work day. Requests for PM inspections will be accepted
until 12:00 noon.

The proposed lot split (two parcels 3.327 acrea and 6.667 acres) by Northwest-
ern Mutual Life Insurance Co. is located south of Eagan Industrial Road midway
between West Service Road and Eagandale Boulevard.
In March 1987, revisions to the Comprehensive Storm Sewer Plan were recom-
mended by the Engineer's for Opus Corporation for this area. These revisions
provided for additional ponding due to the limited capacity of the existing
storm sewers. It vas recommended a pond be provided on this eite and a drain-
age and utility easement vas dedicated in the northeast corner. However, the
pond was never built. Design considerations for the future pond are as fol-
lovs:

Therefore, although the lot split is all that is proposed at this
recommended that future development on either parcel direct all

POND CONSTRUCTION AGREEMENT
This First Amendment is made as of the lik day of 'V30j , 1991, by
and between The DTqrthwestern Mutual Life Insurance Company ("Owner and
Developer") and City of Eagan, a municipality of the State of Minnesota
("City") .
WHEREAS, Owner and Developer and City entered into that certain City
of Eagan Eagandale Center Industrial Park No. 8 Pond Construction
Agreement (the "Contract") and
WHEREAS, Owner and Developer and City desire to amend the Contract to
delay the requirement foz pond construction.
NOW, THEREFORE, in consideration o£ $10 good and valuable considera-
tion, the receipt of which is hereby acknowledged, the parties agree as
follows:
A. Section 2 of the Contract is deleted in its entirety, and the
following is substituted therefore:
2, Notice. The recording of this document shall constitute
notice to all owners and future owners of property in Eagandale
Center Industrial Park No. 8, that the City of Eaqan requires that a
.73 acre foot ponding area be constructed on Lot 2, Slock 1, on a
drainage and utility easement provided by this platting, prior to the
issuance of a second occupancy permit or one (1) year after a second
building permit is issued by the City, as per the plan on file with
the City referred to as Pond Construction/Watermain Construction
* Sheet C-1 dated February 23, 1987. This requirement shall not apply
to the construction of a building by Kraft, Inc.
B. Except as expressly amended hereby, the Contract remains in full
force and effect and the parties continue to be bound by all the provi-
sions ttiereof and by this First Amendment.

responsibility of the owner of said Lot 2, Block 1. The Owner and
Developer shall execute Exhibit "D" attached hereto, and said
document shall be recorded with the County Recorder to serve as
notice to all potential buyers.
B. Except as expressly amended hereby, the Contract remains in full
force and effect and the parties continue to be bouad by all the provi-
sions thereof and by this First Amendment.

INSURANCE COMPANY, a Wisconsin corporation (herein called "HIML") and
KRAFT, INC., a Delaware corporation (herein called "Kraft").
WIINESSETH THAT, WHEREAS:
A. Pureuant to a Purchase Agreement dated .7ulq 29, 1988, by and
between NML, as seller, and Kraft, as purchaser (herein called the
"Purchase Agreement"), NML has this day sold and transferred to Kraft fee
title to certain real property located in Dakota County, Minnesota,
legally described as follows, to-Wit:
Thai part of Lot Tt+o (2), Block One (1), EAGANDALE CENTER
INDUSTRIAL PARK N0. 8, according to the secorded plat thereof,
Dakota County, Minnesota, lying southwesterly of a line 726.00

IN CONNECTION WITH PROJECT NO. 95-BP-GG
This easement, made and entered into this 15tnday of necember , 1995, by
and between TERMINAL EAGr1iN I, LLC, a Minnesota Limited Liabiliry Company, herein
referred to as "Grautor" and the CITY OF EAGAN, a municipal corporation, referred to as
"Grantee".
WITNESSETH:
WHEREAS, said Grantor, is the owner of the tracts of land in the City of Eagan,
County of Dakota, Minnesota, legally described as follows:
A permanent easement for ponding, drainage and utility purposes over,
under and across the southeasterly 171.00 feet of the northwesterly 210.00_
feet of the northeasterly 80.00 feet of Lot 2, Block 1, EAGANDALE
CENTER INDUSTRIAL PARK NO. 8, according to the recorded plat
thereof, Dakota County, Minnesota.
See also Exhibit "A" attached hereto and incorporated herein.
NOW, THEREFORE, the said Crrantor, in consideration of One Dollar ($1.00) and
other good and valuable consideration, to it paid by Grantee, receipt of wlrich is hereby
aclmowledged, hereby gants an easement to the above premises to said Grantee, its heirs and
assigns, for ponding and conservation pucposes, including the normal practice of filling with
water the above-described premises from storm sewer runoff and for utility line puiposes.
The Grantee shall have the right to do whatever is necessary for the enjoyment of the
rights herein granted, including the right of clearing the easement area to allow for the use of
the land as stated herein, and also including the right to excavate within the easement area and
to install, lay, maintain, operate and repair stonn sewer pipes and utility lines and the right of
ingress and egress to and from said tract of land and over and across the easement area for
these purposes.
And the said Cmantor, for itself its he'us, executors, administrators and assigns does
hereby release Grantee, its successors and assigns, from all claims for any and all damages
resulting to said land by reason of the location of lake, ponding area or utility line.
By acceptance of these easements, the Grantee agrees that it shall restore the properry
located outside the anticipated perimeter of standing water to as near the existing grade as is
reasonably possible and fiirther agrees to replace existing culrivated shrubs or sod and to seed
all other azeas not covered with standing water.

It is eacpressly understood that the Grantee, its successors or assigns shall waive and
release said lands or that poriion thereof used for permanent lake or ponding purposes from
any special assessment Ievied on an area basis on account of any improvement in the City of
Eagan for such time as said lands are used for permanent lake or ponding purposes, but at
such time as such uses or purposes aze abandoned then said lands may again be subject to
such special assessments, as have been levied or may hereafter be levied.
The Grantor, its successors and assigns, does covenant with Grantee, its successors
and assigns, that it is the owner of the premises aforesaid and has good right to grant and
convey the easement herein to Grantee.

Administrator Hedges noted that the proposed tax bill that would have potentially resulted in a
tax freeze did not pass. It is expected that the Legislature will be adjouming within the next few days.

Assistant Engineer foertsch noted that residents on Bent Tree Lane have approached the City to
install a sidewalk in their neighborhood. Foertsch continued that the City currently does not have a
policy for sidewaik instailation, i.e. when would a feasibility report be done, how would it be funded,
etc. Councilmember Hunter responded that it should be handled like streetlights. Engineer Foertsch
asked how it would be detertnined which side of the street the sidewalk would be placed. There a2
several policy issues the City will need to research hut direction from the Councii is being requested.
Councilmember Masin opined that sidewalks and traiis should be everywhere in the City.
Councilmember Awada suggesied that sidewalks be incorporated with all new subdivisions.
Councilmember Hunter said he would like a pubiic hearing process before proceeding with any
specific policy.
