1984 ENERGY CODE REQUIREMENTS
On or about March 1, 1984, the following energy code requirements
should be calculated and included with a building permit application.
1. Roof - ceiling assemblies - R-38 U= 0.025 Average
2. Exterior walls & rim joists - R-20 U= 0.11 Average
3. Floors over unheated spaces - R-20 U= 0.05 Average .
4. Exterior overhangs wi11 be considered as esterior wall.
5. Foundat'rons (all exterior walls}-- Minimum of R-S-insula£ion.
6. All insulated areas must be separated from the heated space
by a well-lapped or sealed vapor barrier with a minimum perm
rating of 0.1. A 4 mil. polyethlene sheet or equivalent meets
this requirement.
A Kraft face R-19 type insulation will be accepted in the rim joist
areas. Air chute baffles are to be placed in every rafter space.

Dear Mr. Roberto:
Earlier this summer, you requested information relative to water
elevations of Pond LP-44 adjacent to Lot 18, Block 3, Wilderness
Run 6th Addition. As a result of your request, City survey crew
personnel have checked the existing water levels of the pond as
well as the existing walk-out elevation of your home. On the date
of the survey (May 6, 1991), the existing water level of the pond
was at elevation 848.55. This elevation is approximately 2.55 feet
above the controlled normal water level of the pond and
approximately 4.95 feet below the calculated high water level of
the pond as identified in the City's Stormwater Management Plan,
1990 Edition.
In researching the information submitted as a part of your building
permit application, the Certificate of Survey submitted, dated
December 5, 1986, proposed a walk-out elevation of 856.0. The
856.0 elevation is approximately 2.34 feet higher than the existing
walk-out elevation on the date of the field measurements (May 6,
1991).
At this time, the City has no plans to alter the water levels,
normal water level or calculated high water level, or the discharge
rate from the pond. If you need additional information or want
further study performed by the City, please do so by responding in
writing.

could remain at flood stage for many months during an extended wet cycle. This
uncontrolled ponding can inundate parks and private land and back up atorm
aewers causing ponding in streets or on private property for long perioda.
Development around such ponds is very difficult to plan as it is impossible to
forecast exactly Che effect of long term wet cycles and large storms on such a
pond level.
For these reasons, it is recommended that all ponds be planned to have some
type af outlet. A few ponds which are extremely large in relatlon to their
drainage area and have a large storage capaci[y may be able to discharge suf-
ficient wa[er [hxough evaporation and seepage to prevent damage due to flooding.
However, it is important that capability of providing an outlet for every pond
be retained in the event that it is needed.
Mos[ of the ponding areas in the system collect wa[ez from large drainage
areas. Because locations near ponds are usually very choice building sites,
it can be very serious if the calculation of water quantities arising from im-
properly selected design criteria resulted in frequent flooding above the
designated high water levels and caused extensive pxoperty damage. To provide
additional protection against such a possibility, the design atorm interval for
ponding areas has been set at lu0 years as compated [0 5 years for storm sewer
design. In addition, home construction should noE be allowed at an elevation less
than 2 or 3 ft, above the expected 100 year storm ponding elevation. Where
possible, overflow routes should be provided and maintained from ponds whenever
possible to mtnimiz.e economic damage and inconvenience if scorage cepacities
are exceeded under unusual circumstances.

I CARE AND MAINTENANCE OF REBTORED LAWN
Dear Mr. Roberto:
on June 22, I spoke with you regarding refusal of the payment by
the City of Eagan for the estimated cost of replacing portions of
your lawn associated with the reconstruction work performed by the
City in 1988.
You indicated that rather than accept payment, you would request
that the City proceed with the restoration work upon the return of
the issued check from the City of Eagan which we received on June
29.
As you are now aware, the City proceeded with contracting a private
landscaping firm to provide additional black dirt and regrade the
drainage swale to ensure that there no longer remains standinq
water. At that time, I'd informed you that once the restoration
had been complete, the related care and maintenance of this
restored area would be your responsibility. You were encouraged
to provide adequate watering to ensure the viability of the new
restored area.
On July 10th or ilth, the resodding work had been completed. At
noon on Wednesday, I stopped by the property and noticed that the
new sod was in dire need of moisture. Subsequently, I stopped at
the residence and spoke with an individual who identified himself
as your house guest for the week who indicated he'd pass the
information on to you and would initiate the much needed watering
of the new sod.

on June 2nd, you forwarded to my attention a letter requesting
reimbursement from the City of Eaqan for the estimated cost to
repair and replace that portion of your lawn within the limits of
the City's project that did not survive the drought in 1988.
On many previous occasions and most recently on June 9th, City
personnel, including our Parks Maintenance Supervisor, have
reviewed the area in question and concur that certain portions of
the new sodded area should be replaced.
our field calculations indicate that approximately 88 square yards
of sod should be replaced. Rather than have the City perform this
restoration, you have indicated a desire to perform the work
yourself. Therefore, in accordance with the bids received from the
City of Eagan for performing various other similar landsaaping
restoration projects, enclosed please find a check in the amount
of $118.80 based on 88 square yards at $1.35/square yard.
While I realize your original letter of June 2nd requested $350,
our investigation of this indicates that it could be performed for
the amount being forward to your attention with this letter.
I hope this helps resolve your concerns and provides you with the
means necessary to accomplish the final restoration to an
acceptable manner.

Dear Sir:
In the Spring of 1988 I received a letter from the City of
Eagan. The letter stated that work needed to be done to the
west side of my yard to facilitate better drainage of Easter
Lane. This was necessary to decrease neighborhood flooding
in the event of heavy rainfall. In good faith I agreed to
cooperate.
Due to the expense of installing an underground drainage
system, the City choose to reshape my yard and in doing so
dug up the my whole front yard. This marked the start of 12
months of problems as I attempt to return my lawn to it's
original condition.
After the reshaping had been completed new sod was laid.
Unfortunately not enough hlack dirt was replaced and the sod
used was of poor quality, this coupled by the severe weather
of last summer caused the majority of the new lawn to die by
September.
Engineer Hruce Allen contacted me and stated that along with
other sod in the area that had died with the severe weather,
mine would be replaced before winter. This did not happen.
After contacted the City I was assured that the probiem would
be rectified in the spring. Although this spring sod has
been replaced on other streets near my home to date mine has
not.

I am seeking reimbursement of $350.00 to cover the cost of
the professional lawn care service that I have employed. I
request payment as soon as possible.

Grading/Drainage Improvements
Dear Mr. Ruberto:
As a result of the super storm that occurred on July 23, 1987,
the City investigated various drainage problems that were
identified throughout the community. One of these problems
related to the flooding of Malmo Place between Easter Lane and
County Road 30 (Diffley Road). Due to the significant amount of
rainfall that occurred, and the limitation in capacity of the
storm sewer system, the intersection of Malmo Place and Easter
Lane flooded, resulting in flooding of the two brick duplex units
immediately to your north.
As a result of our investigation of this drainage system, similar
future situations could be eliminated by providing an emergency
overland drainage outlet for the intersection of Easter Lane ancl
Malmo Place allowing water to drain overland into the ponding
area to your south prior to flooding any residential structures.
It appears the most economic and feasible alternative to this
problem would involve the regrading of your front boulevard area
and your west property line to provide a lower elevation than the
existing duplex units across Easter Lane.
