We are opposed to the special assessment for the
property located at Lot 9, Block 5, Wilderness Run 5th
Addition, for the following reasons;
1) In 1986, the feasibility study on the reference project
was estimated to be approximately $700.00. According to the
present notice, the assessment had been changed due to a
change in plans and specifications for this project to
$1425.00.
The assessed taxpayers were not notified of the change
in specifications or a new feasibility study, with in the
past 4 years.
2) Resodding the right of way was to be done, due to the sod
sliding down the hill when it was watered by the landscape
contractor, per the project engineer.
3) Water flow problem was not corrected by the County. We
requested the County correct said problem dating back to May
4, 1989. To the present time this has not been corrected.
4) Weeds on the road right of way have never been cut, and
are presently at approximately 4 to 5 feet tall. The slope of
said hill is at such a degree, making it next to impossible
to mow by hand.
These particular problems and others have been
discussed on May 4, 1989, a letter dated August 15, 1989, and
another call on August 23, 1989 to Roger the project
engineer. Also, a meeting with Don Chapdelaine at my
property, who also showed concern over the problems stated.

Dear Mr. Stauffer:
On September 10, the City received your letter dated August 20
where you identified several concerns associated with the special
assessments levied against your property under the above-referenced
project as well as the completion and restoration of the project
itself. In relation to your special assessments, the public
hearing to consider the adoption of the final assessment roll was
held on July 10, 1990. The City Council took into consideration
your written objection of July 9 as well as your comments submitted
during the public hearing pertaining to the proposed assessments.
As a result of this discussion and response from staff, the City
Council adopted the final assessment roll as originally presented.
Subsequently, with no specific modification to the assessment roll
as it pertains to your property, the final assessment obligation
has been certified to the Dakota County Auditor's office for
collection through your property tax statement. This assessment
will be spread over 10 years with the first installment being due
with your 1991 property tax payment schedule.
Your other concerns pertaining to the quality of the restoration
of the back slope within County Road 30 as well as the drainage
across your property has been reviewed with you by Mr. Bob Egan of
the Dakota County Highway Department who is the jurisdictional
authority for these issues. As a result of that discussion, it
is my understanding that the County has agreed to work with you to
ensure that the drainage and restoration issues are properly
resolved.

Dear Sir / Ma'm;
It's been well past 30 days and the payment date, and I have yet to hear one
word regarding my objection of the special assessment.. After 2 phone calls to
the lady in special assessments, the last one being August 8th, she promised me
that someone from the public works dept. would return my call that day. After
sitting home all dqy waiting and ;waiting, no calll I shouldn't have to call
hastling you people to get an answer.
To refresh your memory;
1) The meeting was July 10. 1990.
2) Sometime between November of !986 and June 1990 the feasibility study for the
above mentioned project changed. causing the assessment to double.After specs
changed, a new feasibility study should have been done.,and those involved
should have been notified.
3) County has not fulfilled their obligation regarding completion of my yard.
4) Dilater flow problem, which must be corrected.
5) Weeds on the road right of way. County should be responsible to cut the hill
on the right of way, since the slope is a death wish to cut. If someone gets
hurt cutting that slope it will cost the city and county millions.
6) The city engineer was to come out and inspect my property before the council
could make a decision. He never did.
This is my first encounter with city officials, and I am very disappoint
in the professionalism and lack of co Aunication or follow through.
Therefore, it is my opinion;
1) The people involved in the feasibility study back in 1986, were in over their
heads and should have requested outside counseltation. Mr. Colbert kept on
stating this was the first major project for Eagan.
2) Someone is trying to hide. Because I have not gotten a responsb.
3) Since nothing has been done, I'm assuming my objection was approved and there
is no special assessment due.,. --

We are opposed to the special assessment for the
property located at Lot 9, Block 5, Wilderness Run 5th
Addition, for the following reasons;
1) In 1986, the feasibility study on the reference project
was estimated to be approximately $700.00. According to the
present notice, the assessment had been changed due to a
change in plans and specifications for this project to
$1425.00.
The assessed taxpayers were not notified of the change
in specifications or a new feasibility study, with in the
past 4 years.
2) Resodding the right of way was to be done, due to the sod
sliding down the hill when it was watered by the landscape
contractor, per the project engineer.
3) Water flow problem was not corrected by the County. We
requested the County correct said problem dating back to May
4, 1989. To the present time this has not been corrected.
4) Weeds on the road right of way have never been cut, and
are presently at approximately 4 to 5 feet tall. The slope of
said hill is at such a degree, making it next to impossible
to mow by hand.
These particular problems and others have been
discussed on May 4, 1989, a letter dated August 15, 1989, and
another call on August 23, 1989 to Roger the project
engineer. Also, a meeting with Don Chapdelaine at my
property, who also showed concern over the problems stated.
