SUBJECT: PAUL H. TESKE RESIDENCE, 2292 CLARK STREET
(RIVER HILLS ADDITION)
Mrs. Paul Teske has contacted the City Attorney's office
and Building Inspector's office, asking if inspections and
other advice could be given to them concerning problems that
have occurred with their home during the last three years.
Due to the fact that Teske's have brought civil action against
Windsor Development Company, the home builder, it was the
advice of the City Attorney that the City not become independently
involved with this matter unless subpoenaed by the court at
the time of the hearings and/or trial. This is the adviee that
the City Attorney and Building Inspector have both given Mrs.
Teske during the past couple of weeks. Last week, Mrs. Teske
asked if the City would make a special request to the State
of Minnesota Building Officials' Department, asking a
representative of the State to make a special inspection of
her place of residence. I assured Mrs. Teske on Friday,
November 9; 1979, that I would review this request with the
Building Inspector, Mr. Dale Peterson, on Tuesday, November 13,
1979, and the matter would be handled according to policy at
that time. I spoke with Mr. Peterson this morning and he
informed me that he has already contacted Mr. Duane Grace of
the State Suilding Department requesting that he make such an
inspection and the State was also reluctant to become involved
due to the fact that there is a civil suit in progress.
Z asked that Mr. Peterson again contact the State Building
Department on behalf of the City of Eagan requesting that they
make an inspection and I have notified Mrs. Teske of this
action. Whether the State makes the inspection or not, pending
the lawsuit, is the decision of that agency. Hopefully, this
will resolve the matter as it relates to her contacting members
of the City Council in recent days.

Mr. Peterson's letter is such a collection of errors and omissions,
I hardly know where to begin. We didn't keep exact dates in the beginning because
we had no idea we would ever come to this. The City said the house passed code
when we purchased it and we took their word for it. It was a construction company
from whom we requested repair estimates that opened the question of code violation,
and either they called Mr. Peterson or had us call him ourselves for a re-inspection.
Up until less than two months ago we were unaware of the code even being a law, and
a state law at that. Had we any idea at the time we filed suit against Windsor that
we were dealing with law and code violations, the suit would most definitely have
been handled differently. Since we are just now becoming aware of the laws, we are
now merely asking for its enforcement because it does not seem right to us that a
violation of the law should be subject to civil settlement.
We are undertaking this request entirely on our own, without assistance
from our lawyer, because we can as private citizens go to the government with a law
violation whereas ethics prohibit our lawyer from doing so as a lawyer involved in
the civil suit. In other words, he is representing us against Windsor in a civil
suit arising from:
1. Their never finishing the house in accordance with the purchase
agreements,
2. Their refusal to honor their one year warranty, and
3. Their refusal to honor their five year warranty.
We, as private citizens, are attempting to have the law enforced because, as you
can see from the enclosed general letter of our dealings with Windsor (see
enclosure #1), this case could drag on for years. They didn't honor the code,
their purchase agreement, or either of their warranties, their agreement to settle,
and there is no guarantee they will honor any court settlement in December either.
In the meanEime, we are cold and wet, wasting fuel in an energy crisis,
and paying outrageous utility bills. It could also be the case that so rmich of the
civil action falls under the jurisdiction of the law and thereby is enforceable by
law, that we could drop the civil action and let the law be enforced. We could
then get on with wr lives and these stomach ulcers I'm developing over this could
heal. At this point we are faced with an unsalable house, large doctor bills and
legal fees, and monumental repair bills. We can't understand how this has happened.

Had it not been for your Mr. Hendrickson and Mr. Sanders, who have
patiently and honestly answered our questions and further explained the laws to
us, we do not know w hat we would have done. They aze a credit to your office and
the first assurance we have had that there are good and honest people at least in
the State government.
We do not wish to involve the city or state in a civil action, nor do
we ourselves want it.
Some of our problems are in the c wer letter; other things that worry
us as being unsafe and/or mi.ght be under your jurisdiction we have listed below.
You might be able to reassure us that we are physically safe in some of these
problems. They are:
1. Some of the areas of the house are extremely cold and these do not
always correspond to those areas of ice or water damage. In winter,
one closet seldom rose above freezing and if the door was left open,
the room became quite cold. Windsor finally admitted the insulation
was missing and added it there. They a lso admitted that it was
missing in the western rim joists and they "stuffed" it up into the
areas they could reach with a yard stick. In the areas they
couldn't reach, they drilled large holes for it to be blown in, but
never returned to do it. The lack of insulation is clearly visible in
these holes. The work was done in the Fall of 1977 under threats of
legal action by our lawyer.
2. When we started our caulking this Fa11 (1979), we discovered a gap
of almost an inch between the sill of the sliding glass door and two
of the sheets of siding. The sheets had been cut too short and were
the original ones. No insulation was visible. We insulated and
nailed a piece of molding over the area. Did this lack of insulation
and gap meet code?
3. How safe is the wiring with the amount of water we have in the walls?
Could this be part of our electrical problems?
4. The furnace flue has a bad joint seam between the first and second
floors. It is a double-wall galvanized pipe and water flows out of
the pipe at this point, runs through the wa11s, and into the basement
through the joists. The bottom of the furnace is rusted from this.
If water can enter the house at this point, what about the fumes from
the furnace? Does this meet code?
5. When we used the second floor shower stall, water ran down outside of
the sewer pipe into the basement. Windsor did some caulking and the
proUlem stopped. Do we have a leak in a sewer?
6. Eight of the thermo pane windows have condensation between the sheets
of glass, indicating a lack of seal. Is this a violation.of the
energy code?

7. The house has a sump we11 and drain tiles, both of which are inoperative.
The water runs through the concrete block walls, up between the wall
and floor joints, and up between the many cracks in the floor. No
water runs into the sump well. Are there any Laws or codes governing
this? Windsor told us basements in this area are supposed to be wet.
8. The.kitchen exhaust fan flue was blocked for the first six months or
so when we moved in. The dirt and grease blew out along all the
visible seams with the dirt and sawdust frequently landing in our
food on the stove. Should this have passed code? The seams are
still quite loose and considerable air blows out of them into the
cupboards through which they pass before they enter soffits. We
are concerned about this because neighbors in Alabama had their home
burnt down when a grease fire on the stove was sucked up hy the
exhaust fan and exited through loose joints in the flue pipe.
9. We have problems with a bright blue residue building up on the white
sinks and tubs. The Burnsville Water Department came, took scrapings,
and had them analyzed. The cause, as closely as we can understand, is
a residue of inetal caused by an incompatability or an ion exchange
between copper and galvanized water pipe, and they said we would only
find the galvanized pipe when it finally corroded through and broke.
Is this code?
10. The bannister on the wall going to the second floor was not properly
installed and one section fell off. Another railing at the top of
the stairs came loose from the wall. Both were repaired but the
upstairs railing is somewhat loose as is the lower railing. Since
I am partially handicapped and dependent on these railings, we are
concerned for my safety. Is this covered by the code?
11. When siding was replaced, a two by four on the second floor fell out,
12. A corner of a double hung_window sash is missing. It was stained,
painted, and placed into position in this oondition. About four
inches of the frame is missing and this allows the weather to enter.
Does this violate code?
13. Over thirty sheets of the exterior rough cedar siding has delaminated;
through our lawyer's efforts, these were replaced. Now some of these
sheets are also delaminating. They also have a tendency to pull away
from the house. This delamination had started before we took
possession of the house.

As to Mr. Petersons' memo: (enclosure #2)
July 13, 1976 - Final inspection made
We were to take possession of the house at the end of July, 1976. Windsor
said the house was finished, so we arranged for sitters for our children
and flew from D.C. to here to sign the final papers. When we arrived we
found the house unfinished to the point of being uninhabitable. We refused
to sign the papers and returned to D.C. On August 31, 1976 the house sti11
had some forty-four items to be completed, but was habitable so we signed
the papers. We are somewhat startled that the last inspection was on July 13,
when it was still uninhabitable at the end of that month.
March 3, 1978 - Teske's requested a re-inspection
March 3, 1978 - Inspection was made, etc.
We do not recall the date of request and reinspection, but they were not the
same day. Mr. Peterson made the inspection. There are no wet areas at the
ceiling lines at the southwest corner of the building. Condensation was ruled
out because we do not have a furnace humidifier, only a small portable one,
and the attic has all the necessary ventilation. Also we have little ice
buildup on the functioning thermo-pane windows in the wintertime.
Mr. Peterson was also shown the following defects and to the best of my
knowledge he also saw pictures of the missing insulation, and ice on the
interior walls. He was shown the water damage on the inside of the exterior
north wa11e and ceilings in the living room and hall; the water damage on
the inside of the exterior west walls and ceiling in the living and dining
rooms. He also saw the water damage on the inside of the exterior north wall
of the upstairs north bedroom. Some was caused by water Leakage in warm
weather and others by ice and frost in cold. He saw the ceiling damage in
the back bedroom and 6ath, and the damage to the floor in that bathroom from
the roof leaks. He also saw the loose bannisters, and the holes drilled
for insulation that was never installed and the lack of insulation. He said
the missing insulation was against code and he would call Windsor. He also
said that they were a"nice company".
March 3, 1978 - Called Fred Reislus of Windsor, etc.
His statement of talking to Windsor is apparently true although I don't lkDow
the date. Why didn't he inform them they were in violation of the code?
March 3 1978 - Telephone Teske's and informed them of Windsor's position, etc.
Mr. Peterson called us back, but not the same day he inspected the house,
and informed us of his conversation wi.th Windsor. He said Windsor was not
going to fix anything because of the lawsuit. Nothing waS said about the
code violation. I do not recall his mentioning too much time had elapsed

since the final inspection; something was said about it being unusual for
him to be recalled to reinspect an occupied house for code violations when
it had already passed the inspection. I do not understand his statement nor
recall any mention 'that his position had to be the same as Windsor's
because too much time had elapsed since his final inspection.' Mr. Peterson
said only that we were suing Windsor, therefore they would do nothing. We
are now curious about the statute of limitations.
Our lawyer, James Roban, had a meeting with Mr. Peterson and was told there
were no code violations, even though Mr. Peterson told me the missing
insulation was in violation. Mr. Rohan could supply this date.
Sometime during that summer or the following spring
When the wall leakage had become very severe and the caulking would not last
more than three to six months, and the basement leakage was also quite severe,
I called Mr. Peterson back to see if he had come across these problems before
and/or knew of a solution. I also wanted to check on the code for these and
for the siding. He seemed startled that the situation still existed and thought
it had been taken care of. He returned and looked at the house and the interior
damage. On one of his visits he had another man with him. I either showed or
wanted to show him the leaks using the hose, because it wasn't raining. The
hose was unacceptable to him because he said it was water under pressure and
any or most houses would leak with a hose turned on it. He said he had never
heard or seen anything like it, but if we didn't stop the leakage we would
ruin the insulation. I asked if he could check into it to see if he had heard
of any solution, particularly if nailing a heavily painted and caulked board
over the Z strip (where we had located one area of leakage) and recaulking it
would help, pur insurance company had suggested this as a temporary means of
repair until the siding was replaced. Mr. Peterson said he would check into
it and get back to me. He never did. I attempted to reach him several tives
thereafter but he was either out or busy and he never returned my calls.
Gradually I became aware that when I asked if Mr. Peterson were in, the
secretary would say yes, but when she found out who was calling, he was out.
Late September - early October 1979
I insisted on speaking to Mr. Yeterson and said that I refused to be put off
any longer and wanted to hear from him. (All I wanted was to find out
whether the board over the Z strip would work or if he had come across an
easy solution). Later in the day I either called back or was called back by
his secretary. I was told that Mr. Peterson had spoken to me before and wouid
not speak to me again.
October 10, 1979 - Teske's called Mayor Murphy, etc.
I do not recall phoning Mayor Murphy until the following week; if I did it
was merely a general conversation about the problem. I know I spoke to him
the week after October 16, probably October 17 or 18.

I called the City Attorney, a Mr. Hauge, as a private citizen to see
how one went about getting building code enforced. He asked why. I.
explained our problem, emphasizing we didn't wish to involve our City in
a civil suit, we just needed our insulation and who was responsible for
enforcing the code. He answered that as long as there was a civil suit
pending, the city didn't like to get involved, Mr. Hauge proceeded to
launch into a vitrialic verbal attack on our attorney. He said he would
only speak or do business with our attorney, refused to discuss anything
with me, and ended the conversation.
I immediately called our own attorney to see if he would speak with the
City Attorney and related to him vry conversation with Mr. Hauge. Mr. Roban
said that:
1. As a private citizen I had the right to discuss this with our City
Attorney. He said he did not need to and it would only run up our
legal fees unnecessarily.
2. By his speaking with the Attorney, it could be construed as an attempt
to draw the City into the suit which was not what we wanted nor in[ended.
I then called two different legal experts to check into our lawyer's handling
of the case to see if any of the City Attorney's charges were valid. Neither
knew or had heard of Mr. Roban. Both agreed with his handling of the case.
The only point they could find any fault with was his taking Windsor's
attorney's word that settlement was reached, but that such agreements 6etween
attorneys were not uncocmion. One laughed and said he bet Mr. Roban would
never take that attorney's word again.
October 16, 1979
I had read articles in the paper and seen reports on television about the
State Energy Department and in an energy crisis felt that perhaps they might
know what to do, So I spoke to a gentleman there who explained that the State
wrote the codes but that it was up to the municipality to enforce them. The
gentleman questioned me closely about the problem, when the house was built,
etc. He said the law governing the insulation was written in January, 1976
and since the house was built after that, it fell under that law, and may very
well be in violation. This is the first time we realized that the code was a
law. He referred me to your office.

I called your department and spoke to a Mr. Hendrickson. I explained my
problem; he further explained the laws and said you could only inspect tte
house at the invitation of the City to determine if it was actually in
violation. I explained to Mr. Hendrickson that Mr. Peterson and Mr. Rauge,
the City Attorney, refused to speak to me, so how could I get permi.ssion.
He suggested I write a letter to Mr. Peterson requesting State Inspection
and he also gave me your address. Also, he suggested I speak to the Mayor
to see if he would sign or direct Mr. Peterson to sign the permission. He
expressed general curiosity about the delamination, leaks, and interior
frosting, and thought it would be interesting to see it because it puzzled
him. At no point in the conversation did say an inspection
"would be pointless as too much time had elapsed and too many changes cw ld
have been made," as Mr. Peterson claims.
October 17 or 18, approximately
Z called Mayor Murphy and requested permission for the State to inspect the
house. I explained our prohlem and that neither Mr. Peterson or Mr. Hauge
would speak to me. I assured him that we had, as citizens of Eagan, no
desire to involve our City in a civil suit but merely to determine what had
gone wrong with the house and whether it met code. Also, if it did meet code,
perhaps the City should take a second look at the code to protect its citizens.
He said there was to be a"private Council meeting" that night, and he would
bring it up. He didn't think the request unreasona6le but felt he needed to
check into it first before making the request to the State. He asked me whom
he should contact; we joked about trying to find one's way through the maze
of government offices. I didn't have the information handy so I called him
back with the address, and he asked me to drop it to him in the mail. I did.
October 19, 1979
I wrote the enclosed letter to Mr. Peterson requesting a State Inspection
(see enclosure #3).
October 22, 1979
I wrote the enclosed letter (enclosure A) to Mayor Murphy with the address he
requested.
I alerted your office that I had spoken to the Mayor and to watch for that
letter or any indication that permission would he forthcoming. I apoke either
to Mr. Hendrickson or Mr. Sanders and that gentleman said he would watch, so
that when you received the Letter you would know to what it was referring.

We were unable to determine whether it was a denial for State Inspection or
a response to our desire to speak to him, or a response to my phone ca11s to
the City Attorney or the Mayor. Note that the letter to us has no mention
of code violation; nor does it make any reference to that part of Mr..Peterson's
memo to yw dated March.3, 1979, which states:
phone call to Teske "that too much time had elapsed since my final inspection"
therefore he couldn't do anything - a statement he never made to us.
And it is in'complete contradiction of his claim in the memo to you that
"his position (was) not to interfere until legal claim was settled". In
his letter he flatly refuses to do anything.

it after he wrote his letter of October 19, or wrote his Letter of October 19,
1979 later than that date,
As I mentioned above, this statement of his position is a complete contradiction
of his actual letter to us and his earlier, March 3, 1978, portion of the memo.
Nwember 8, 1979
I had not heard from Mayor Murphy so I called him back. He said he had been
busy in the fields, and with his re-election, hadn't gotten arwnd to it, and
had forgotten it. He said he lost the election on November 6 and was no
longer Mayor. Mrs. Bea Blumquist was now Mayor and she would have to sign
the permission. I expressed surprise that she could do anything before her
taking office in January, but he said she was taking over and it was her job.
Mayor Murphy gave me her phone number.
I called Mrs. Blumquist who was horrified that Mayor Murphy should even
suggest that she was to sign anything or do anything official before she was
sworn in in January. She said it was illegal; to call him back and tell him
so. She also referred me to the City Administrator, Tom Hedges and told me
to call the Councilmen. She said she would sign the request as soon as she
took office if all else failed. She also said she would bring it up at a
meeting November 13, 1979.
I recalled Mayor Murphy and informed him of Mrs. Blumquist's stand. He said
he would have to check into our problem and that we could appear before the
Council on November 20, 1979 if I wished. I said yes.

November 9, 1979
I called City Administrator Tom Hedges as Mrs. Blumquist suggested,
explained the problem and the situation. He was quite surprised at Mr.
Peterson's and Mr. Hauge!s attitude and said he would look into it. x
told him I was going to write to each Councilman for permission for the
State to inspect the house; and also in an open letter to the Editor of
the Local newspapers ask the City Councilmen for this permission. He told
me Mr. Peterson was off for the week and would I please not contact the
papers until after he spoke with Mr. Peterson on the following Tuesday.
I agreed.
November 10, 11, and 13. 1979 - Calls to Citv elected officials City Attorney,
City Administrator, and Mavor-elect.
Who made these calls? Mr. Peterson? I spoke to Mr. Hedges November 9
who told me Mr. Peterson was off and Mr. Hedges couldn't speak to him
until November 13 about this. I spoke to the Councilman and the Mayor-
elect November 10, 11, and 12. I did not speak to the Mayor since
November 8, and the City Attorney had refused to speak with me further,
weeks earlier.
November 10, 11, 12, 1979
I called each Cquncilman. All but one saw nothing wrong with the request.
Councilman Smith asked for a copy of the letters to Mr. Peterson and Mayor
Murphy and said he would bring it up at the meeting on November 13, 1979.
November 12, 1979
I spoke to Mr, Hedges. He said he had spoken to Mr. Peterson and that Mr.
Peterson had called your office and given his permission for the State
Inspection. I told him I was given to understand a letter was needed and
who had Mr. Peterson spoken to in your office. He left the phone and I
heard him ask Mr. Peterson whom he had spoken to; I didn't hear the reply.
When Mr, Hedges returned to the phone, he said Mr. Peterson had spoken to
Dwayne Grace. He also said that if your office had told me the request
needed to be in writing, it would be done and requested the address. I
told him it was in the formal request I had written to Mr. Peterson earlier
and gave it to him again: Mr. Hedges then wanted me to meet with Mr.
Peterson in his office at ll a,m. the next morning. I expressed my
apprehension but agreed. Then Mr, Hedges made a casual remark that Mr.
Peterson would call Mr. Grace "today or tomorrow". Yet he had clearly
stated at the opening of the conversation that Mr. Peterson had called
your office and given permission: This made me quite suspicious.
I called your office as soon as I finished my conversation with Mr. Hedges.
Mr. Sanders was then in the oPfice. I related my conversation with Mr. Hedges
to him and asked if such a call had been made. He found Mr. Grace and asked
him. He reported that Mr. Grace had not spoken with Mr. Peterson for weeks.

I spoke to Mrs. Blumquist just hefore she left for the Council meeting
where Councilman Smith and she intended to bring up the subject. I related
to her what Mr. Hedges had said, that your office had not received the
call. I told her of the upcoming meeting the next day and expressed my
apprehension about it. She said it was unnecessary for me to be put through
such a confrontation. I asked if a request for a meeting in public before
the Council would be out of order. She did not think so.
Before the meeting Mr. Hedges told Mrs. Blumquist and Councilman Smith that
it was useless to pursue the letter of permission because your office would
not or could not inspect the house before the civil suit date of December 10,
1979. They assumed he knew a point of law they did not, and did not pursue
the matter that evening. Where did Mr. Hedges get this information? This
is not what your office had told me, and as I later discovered no one called
your office from the City until the afternoon of November 14, 1979, the next
day:
November 14 1979 - Discussed situation with Citv Attornev and State Buildine Code
Division. Correct. That afternoon.
The first thing that morning I called Mr. Hedges and again expressed my fear
of a private meeting with Mr. Peterson. I asked that it be in public before
the City Council. He said it could be arranged for November 20, 1979. I also
told him Mr. Grace had not spoken to Mr. Peterson in weeks. Mr. Hedges became
huffy and said that he had told me Mr. Peterson would place the call yesterday
or today and that Mr. Peterson had spoken to Mr. Grace about the situation
weeks ago. Did he?
That afternoon your office called to tell me Mr. Peterson had just called and
given permission for the State to inspect the house, but only after December 10.
This meant that I would now need the signature of more than one Councilman or
the Mayor and complicated the issue even further.
I called Mrs. Blumquist to tell her of Mr. Peterson's permission to let the
State in but only after December 10, and she then told me of Mr. Hedge's
statement of the previous evening that you couldn't enter the house before
court date. However, to my knowledge, since no one at the City had contacted
the State at that point on November 13, and no one at the State level.had
ever made any such indication to me in any way, I couldn.'t understand the
source of Mr. Hedge's information. Neither could she.
I called Councilman Smith to tell him of Mr. Peterson's phone call to the
State, Mr. Hedge's conversations with me, and my conversations with your
office. He was disturbed because the stories obviously didn't match. He
said he would talk to your office himself, and if I were telling the truth,
he would walk over from his office and sign the permission for you to enter
th e house.

I called Mr. Sanders and informed him of Councilman Smith's intentions.

November 16, 1979
Mr. Pates spoke to me about his conversation with Councilman Smith. He
said he would need to check into it further and would call me back the
following 1uesday before we were to appear before the City Council.
Councilman Smith told me he directed the City to write the letter giving
the State Inspection before December 10.
November 18, 1974
Councilman Wachter called us to make sure we knew we were on the agenda
for NovemUer twentieth and that it was going to be complicated.
November 17, 18 and 19, 1979
A copy of the memo attached to Mr. Peterson's letter to you was sent to
the Council. We were apparently not to be shown this iremo or know of it.
However, its contents got back to us quite quickly by phone. I saw a
glimpse of the first page of this memo at the Council Meeting and told
the Council it was highly erroneous.
November 20, 1979
We appeared before the City Council. Mr, Hedges said they wanted us first
on the agenda. The place, however, was packed for an issue later on the agenda.
We were immediately informed that the letter giving the State Inspectors the
right to enter the house at any time had been sent. We asked to see a copy,
and were shown the letter. We were handed two sheets of paper for a qui.ck
look as we spoke and they were taken back from us. We told the Council of
our problems with the house and we asked them to enforce the code. The City
Attorney advised the Cwncil against it and said we may have removed the
insulation ourselves, thereby opening the City to a Lawsuit from Windsor.
Windsor themselves removed all the siding that was t wched; it is not a job
of which we are capable. The neighbors can testify to this and one was
present, who later said he had difficulty restraining himself from saying
somethistg at this remark. The City Attorney finally said they would only
enforce the code if we won the lawsuit. We were told we had been sent a
copy of the letter in the mail. Althwgh mail within this City only takes
a day or so we have not received a copy as of November 23.
November 21, 1979
We called the City for a copy of the letter so we could study it. The
secretary said everyone was out to a luncheon meeting and she did not have
permission to give it to us. We told her that the bottom of the letter had

a"c.c. Mr, and Mrs, P. H. Teske" on it. She checked and said we could
have a copy. My husband, who works near City Ha11, went over to get it,
but when he arrived they couldn't find it. He was told all copies were
probably in their briefcases from the night before. At 3 p.m. I called
back to see if the letter had been faund. It had and a copy was at the
reception desk. When I arrived to pick it up, there was only one page,
even though the one we had been shown the night before had two pages.
I asked for the rest of the letter and was told there was no more. I
pointed out the letter contained "Enclosed you will find, etc." so where
was the enclosure. The secretary didn't know; Mr. Peterson and his
secretary were gone for the day and that was a11 she was authorized to
give me, i asked to speak to Mr. Hedges, but he was busy. I said to get
him because I could see him chatting in the doorway of a nearby office.
She did, I requested ehe enclosures, he produced not one more, as we had
been shown, but two more, told her to copy it, and give it to me. It was
the memo we weren't supposed to see or know abwt that had been sent to
the Councilman over the weekend. I thanked him. I also asked for clarifica-
tion of Mr. Peterson's final statement in the letter of my caanting the name
of the person at the Building Code Division to call and then calling the
wrong person. This statement in Mr. Peterson's letter is entirely untrue.
We also find it amusing that this list was compiled by the City Administrator
who claimed he knew nothing of the situation before my phone call to him on
November 9, 1979.
I realize the above must be confusing to you, but I have tried to be as complete
and accurate as possible. We feel that the City for reasons unknown to us does
not want you to see this house and has gone to unusual lengths to prevent it.
They appear to be particularly anxious that you not see it before December 10, 1979,
which makes us all the more suspicious. Even stranger, Windsor's attorney called
our attorney November 21, 1979, the morning after the Council Meeting, ready to sign
the original agreement icmnediately. We learned of this after I spoke to you and
had started this letter. We do not know if this is.another trick, as they pulled
last February or whether they don't want you in here either.
This agreement doesn't cover items we now strongly suspect, as do some construction
experts, are in violation of code. So, if we sign it, we're worried that we'll
sign away our rights and safety.
Please help us and check this house before December tenth. We know it will foul
up your schedule, but it would greatly relieve our minds of much worry; and we are
extremely worried when the City has made it difficult for you to come into this
house and now suddenly the builder wants to sign.

Sievert Hendrickson of the SBC Division and I perPormed the above inspection
Tuesday December 4th, 1979• The inspection took three hours and was quite
thorough. There were six code violations, three of which occurred during
original construction and three during the time of repair and retrofitting.
There is no formal report as yet because Mr. Don Pates, SBC Director, wishes
to review the report and has not done so as of this date.
Violation #1 Uninsulated Bathroom exhaust vent pipe.
Violation N2 Intermediate railing on open side of basement stairs missing.
Violation H3 Plywood Porm supporting 1 foot of concrete for Fireplace floor.
These code violations are easily overlooked in the 20-30 minute time limit
allowed by the workload of this department and do not pose any hazard to the
home owner, except in this case the builder forgot to remove the blockage at
the ash dump.
The SBC Division did an energy calculation and found that even if the insulation
was left out where alleged the home still exceeded the code.
Slides and pictures taken by Nlr. and Mrs. Teske show that they have a problem
with cold spots on parts of their house, but proper construction techniques
had been used. Quality control might have been somewhat lacking.
Zt would be impossible for my office to place a man on site 100% of the time
when there are 300 plus buildings a year being built in Eagan. Especially with
only 1.75 men.

At your request, following the request of Mr. 6 Mrs. P.H. Teske of
2292 Clark St., Eagan, Minn., I accompanied you on an inspection of their
dwelling on Tuesday, Dec. 4, 1979 at 2:30 p.m.
We viewed 18 slides and several color photos of problems associated with the
home. Among those problems were frost accumulation on base-boards and in
corners of intersecting partitions with exterior walls, absence of insulation
when siding was being replaced, water leaks through siding in garage? mqisture
thru basement walls and fioors, and water stains at intersection of ceiling and
exterior walls.
An inspection of the dwelling showed evidence of water leakage in basement
walls, floor, and at ceiling at perimeter of wall. Sump basket had approx.
3/4" of water in bottom, with 2" diameter plastic pipes set 3 inches below top
of concrete floor. Gravel filled trench noted on drawings would have to be
full of water before any would drain in sump - drawings show approx. 3"
diameter pipe at a lower level of the gravel hed. The building code does not
requi_re a drair tile system or sump.
The rim joist on the west wall was partially insulated.
There were water stains in several locations at intersection of interior
partitions with exterior walls, and at wall/ceiling juncture on both the first
and second floors. Some drywall tape was showing evidence of loosening. The
ceiling of one bedroom on second floor had several stained areas which
appeared to be the result of water.
One upper sash in second floor bedroom had a tapered splinter of wood approx.
1/4" wide x 4" long that was missing, adjacent to the weather stripping which
allowed some infiltration.
Brick moulding and sill extensions on some window frames were loose.

There was evidence of water leakage through flashing at horizontal joints in
siding, in the garage area. The flashing evidently is not adequate to provide
weather protection. The owner advised that the vertical portion of the
flashing (behind upper plywood sheet) was approximately equal Co the exposed
portion which is 5/8". We did not remove any siding to verify this. Tfiere
was also evidence of water leakage through plywood panels.
Several siding panels (rough cedar, reverse board 6 botten design) had been
replaced. Some nail spacing on replaced sheets exceeded the minimum spacing
required -(6" at edge 6 12" in field of panel) by the code.
A large gap under the patio door had been caulked S a moulding installed to
prevent infiltration of air. The energy conservation provisions in effect as
of Jan. 31, 1976 :equired caulking of all 2xterior joints.
An energy calculation is attached to the report indicating the building does
comply with the energy conservation provisions of the code in respect to
Thermal Transmittance values of walls, ceiling & floors. The calculation are
based on absence of insulation in rim joist fi overhang area of the second
flocr and rim joist areas of first floor that were not open for inspection.
I have also attached a listing of building code non-compliance items.

We spoke on the telephone today about several concerns you have which
relate directly and indirectly to your neighborhood. I appreciated your
telephone call and was able to review with City staff and other persons
some of your concerns and would like to share some of those findings with
you.
Regarding City Council action of Tuesday, October 5, at which time I was
directed to correspond or meet with Zachman Homes and Mid America Pipeline
Company relative to the excavation of the roadway and concerns about the
buried gas transmission line, I chose to delegate this issue to the Director
of Public Works as it relates to an engineering issue. The Director of
Public Works held a meeting on Tuesday, October 19, at which time City
officials, officials representing Zachman Homes, a representive of Mid
America Pipeline Company and representatives of Minnegasco were in atten-
dance. For your information, I have included a copy of a memorandum
that provides comment to the City Council about the issue that was addressed
by you before the City Council at the October 5, 1982 meeting.
Regarding the berm that was guaranteed by MnDOT and assured by the
City of Eagan, after checking with both the Director of Public Works and
a MnDOT official, the dirt hauling has resumed and the berm is being re-
shaped to meet the original elevation agreed to by the City and MnDOT.
I have also spoken with the City's health officer and they will initiate
action through the state health office if more medical information is provided
to their office for review. As we stated on the telephone, it would be
beneficial to the City if Karen Kennedy, Dick Decker, Reverend Stockard
and you could provide letters of inedical discovery from each of your
respective doctors to this office and the same will be given to the City's
health officer. If there is reason for further concern, that information
will be provided to the Minnesota State Heatth Officer. We are certainly
hopeful that the medical findings will be found to be coincidental For the
sake of your neighborhood and other neighborhoods in both the Cities of
Burnsville and Eagan in that general vicinity.

The trees are to be trimmed by the Park Department and it will be scheduled
within the next two weeks, or sooner if work program ming permits. This
relates to the final trim ming of trees that were removed by the power com-
pany during site construction work.
Regarding the sign that was approved for Naegele Company, the City In-
spection Department will work to assure the neighborhood that the sign
will conform to, all City ordinance requirements. lf a representative of
River Hills 9th would like to review . the ordinance requirements and height
of the sign with the Chief Building lnspector, those arrangements will cer-
tainly be coordinated.
I will continue to monitor various actions that apparently have not been
complied with to date. If you are aware of any further concerns regarding
health problems caused by dust in the area, please notify me immediately.
Zachman Homes has been specifically noticed by the Director of Public Works
to provide sufficient w atering to control dust to the best extent feasible,
considering the nature of the operations, in conformance with City ordinance
practices.

can be resolved to your satisfaction'.

wexe all pxesent at that time to witness the actual location of the pipe-
line. Subsequeritly, several additional abovrground location marl:ers
have been placed showinq the exact location of this aas line.
The Northern Dlatural gas line which transcrresses thtinuqh the Cinnar+on
Ridge Addition has been tal;en over by the Minneqaso Co. P4innegasoo per-
sonnel have physically deterniined the locati.on and ciepth of this pipe-
line at several locations as it progresses throur,h this subdivision.

have placed additional above-qmtu-id r.rerker sicros referencing the exact lo-
cation and have oontinually replaced these through the wnstructi.on opera-
tions.
At this meti.ng, both the pipeline rr,,,par; es were asked if they felt at
anY time there was a hazardous sitvation with the oonstsuction activities
as it relates to their respective pipelines. 7'heir response indicated
that they felt there was yeiy qood =Mamication and ooordination of cvn-
stsuCtion activities and that at rro time did they feel that the existing
operation created a hazardous situation to theis pipelinp or the surmund-
ing ocnmimity.
It was deternuned that the Mirmegasw pipeline will be the cnly one that
wi.ll be affected by the constructicm operations of the Cinnamn Ridge de-
velogment. The MAPCti gas Line has been detPSmi.ned to be outside the am-
struction boundaries of any phase or aspect of the Cinnamvn Ridqe project.
All nar*ies were ranizided.to continue with their open lines of om:imica-
tion to i.nsure that eveiyone associated with the develogrent is )aiavledgr
able about any aperation that may affect their particular situation.
As a result of this meeting, it is my opinion that the construction cper-
ations are being perfoaned in a safe, efficient and propPS m3.,ier an3
there should be no reason for alazm or croncesn by the existing residents
of the River Hills 9th Subdivision or the future residents of the Cinna-
mon Ridge Subdivision.
I would like to extend my appreciation to all pa*+;es inwlved for their
oooperation in helping to define potentiai hazanlous opesations and their
ability to handie thaiiin a pmfessional and safe mazmes.
If the City Coimcil would Like any further mnfirmation of the operation-
